2025 Comprehensive Plan Amendments Preliminary Docket
City of Moses Lake
1. Add reference to new Water and Sewer Plans within Ch. 5 Utilities
2. Transportation Element – Planned (Future) Streets Map update
3. Water Policies
Policy 5.1.7 Require connection to the city water system for all new development within city
limits and all short plats and subdivisions within the UGA unless otherwise allowed by
State or County regulations. Encourage properties on existing private well systems to
connect to city water.
Policy 5.1.10 Analyze opportunities to leverage water supply by exploring water reuse, use
of irrigation rights and enhanced conservation efforts. Add water conservation text to limit
potable water for irrigation purposes.
4. Sewer Policies
Policy 5.1.14 Require connection to the city wastewater system for all new development
within city limits and all short plats and subdivisions within the UGA unless the density is
less than one unit per acre or other exception is allowed by state or county regulations.
Encourage sewer extensions to the remaining unsewered areas and require existing
development to connect when on-site systems have failed, and sewer facilities are
available.

CALL TO ORDER
The special meeting of the Moses Lake City Council was called to order at 6:01 p.m. by Mayor Swartz in the Council Chambers of the Civic Center. ROLL CALL
Present: Mayor Swartz; Deputy Mayor Madewell; Council Members Lombardi, Skaug, Fancher, and Myers. Council Member Martinez attended from remote access.
Urban Growth Area (UGA) Extraterritorial Agreement (ETA) Policy Discussion A draft ETA Policy was included in the meeting packet. Public Works Director Brian Baltzell provided a slide deck outlining discussion of principles, UGA anticipated growth, and three
options for approvals: Tiered Evaluation, and Resource Allocation by Legislative Action or
Lottery Drawing. Discussion ensued about modeling in the water system plan, hydraulic modeling for fire flow, and blended classifications. Comments were made from developers on vested projects that will have separate Development Agreements drafted for Council to approve aside from the new policy.
Community Development Building Division Work Plan
Building Official Todd Cunningham provided a slide deck in the meeting packet. He reviewed the division’s work plan and primary goals regarding permit and business license process timelines. The Code compliance staff will continue to respond quickly for abatement of graffiti and work on regulations update, as well as work with public safety staff trespass violations.
Council and staff discussed cost recovery fees at a percentage for permits vs. full recovery on
code enforcement.

CALL TO ORDER
The special meeting of the Moses Lake City Council was called to order at 11:30 a.m. by Mayor Swartz in the Council Chambers of the Civic Center.
ROLL CALL
Present: Mayor Swartz; Deputy Mayor Madewell; Council Members Martinez, Lombardi, Skaug, and Myers. Council Member Fancher was absent.
Homelessness Services Discussion The Moses Lake Ad Hoc Homeless Committee met on April 17 to discuss the 2024 Annual Review
of the Homeless Housing Program report, the Evaluation of the City’s Role in Human Services & Strategic Planning for the Open Doors Sleep Center Memorandum (Memo). The purpose of the Memo was to outline an evaluation for Council to provide direction to staff related to maintaining public safety, fiscal discipline, community standards, and responsible governance. Council was asked to consider one of three levels for the city’s involvement in social
and health services: (1) Core and Basic, (2) Coordination, or (3) Direct Service Role.
The following factors were discussed: camping regulation update, shelter site restoration, public awareness campaign, existing public safety and supportive resources, community mobilization, resource guides, regional shelter contacts, and internal readiness of Police, Fire, Parks, and Code
Enforcement.
Action taken: Council Member Lombardi moved to have staff close the Sleep Center on June 30 in alignment with the funding grant expiration date using service Option, Core and Basic Role, second by Mayor Swartz. The motion carried 5 – 1, Council Member Martinez was opposed.
Action taken: Mayor Swartz moved to conduct a special meeting to discuss service Option 2, a Coordination Role, prior to June 30, second by Deputy Mayor Madewell. The motion carried 6 – 0.

RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW 42.24.180
requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis.
The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by
the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering
services, or performing labor must be certified by the appropriate official to ensure that the materials have been
furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid
obligations against the City.
RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The
statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to
approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has
adopted policies that implement effective internal control; (3) the legislative body has provided for review of the
documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be
recognized as receivables and diligently pursued.
The City meets all these conditions.
To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council
approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during
the period prior to the date of the Council meeting.
All payments made during this period were found to be valid claims against the City. Details are attached and any
questions should be directed to the City Manager or Finance Director.
The City’s internal controls include certification of the validity of all payments by the appropriate department prior to
submission for payment. The Finance Director has delegated authority for the examination of vouchers and
authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and
validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place.

In 2024 staff conducted a review of Moses Lake Municipal Code 13.08 and discovered several items referencing
reimbursements for sewer improvements that were determined to be expired and subsequently repealed per
Ordinance 3059. As part of the review, all active reimbursements were cataloged and date noted for expiration.
MLMC 13.08.082 expired 12/28/2024, which was after the original request in October 2024 to clean up Chapter
13.08. RCW 35.91.060 limits the enforcement period of a reimbursement contract between the City and the
developer for a period not to exceed twenty (20) years from the date that City Council accepts the
improvements.
Staff requests MLMC 13.08.082 titled Water Main Charges, Wanapum Drive, Broadway Avenue, and Lakeshore
Drive be repealed in its entirety.
Fees associated with the reimbursement will not be collected for future use.

AN ORDINANCE AMENDING MOSES LAKE MUNICIPAL CODE CHAPTER 13.08 TITLED
“WATER AND SEWER CONNECTIONS”
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS
FOLLOWS:
Section 1. The following section of Chapter 13.08 is hereby repealed in its entirety:
13.08.082 titled ‘Water Main Charges – Wanapum Drive, Broadway Avenue, and
Lakeshore Drive’
Section 2. Effective Date. This ordinance shall take effect and be in force five (5) days after
its passage and publication of its summary as provided by law.
Adopted by the City Council of the City of Moses Lake, WA and signed by its Mayor on
September 9, 2025.

Fine Seal Coating and Striping has the completed contracted work for the 2025 Crack Seal project. The project
consisted of installing rubberized asphalt in 700,061 lineal feet of cracks on designated streets within the City of
Moses Lake. The work completed is in the amount of $179,215.82. The original contract price was $179,200 for
700,000 lineal feet of cracks and the Engineer's Estimate was $259,000. Additional funds spent were within
project budget.
The work by the contractor is physically complete and ready for acceptance.
Upon acceptance, the City will enter into the 60-day lien period as required by Washington State law.
Options and Results
The 60-day lien period will begin.

Recitals:
1.The City of Moses Lake adopted the Title 15 – Unified Development Code October
4, 2024; and
2.The City of Moses Lake Zoning District Map is adopted pursuant to Moses LakeUnified Development Code (MLUDC) 15.405.020 Adopted Zoning Map and
Interpretation; and
3.Pursuant to MLMC 15.245.010, the zone classifications on the City of Moses Lake
zoning map may be amended by application for rezone; and
4.On March 31, 2025, Western Pacific Engineering & Survey, Inc. on behalf of
Homesley Properties LLC and Hals Properties LLC. has submitted a request for
Site-Specific Rezone for Parcel Numbers 101543000, 101544000, 101545000,
101547000, 101548000, and 10154200 from Light-Industrial to C-2 GeneralCommercial (Exhibit A: Current Zong for Parcels of Interest Map and Exhibit B:
Proposed Zone Changes for Parcels of Interest Map); and Parcel Number
110189000 (Exhibit C Boundary detail of southerly 4.6-acres of the 7.86 acre
parcel) from C-2 General Commercial to R-3 Multi-family Residential; and
5.On July 8, 2025, the City of Moses Lake issued a SEPA Determination of Non-
Significance; and
6.On July 22, 2025, the Hearing Examiner conducted a duly noticed Public Hearing
on the Western Ave / Homesley Site Specific Rezones; and
7.On July 31, 2025, the Hearing Examiner issued a recommendation of approval
regarding the Western Ave / Homesley Site Specific Rezones (Exhibit D); and
8.Pursuant to 15.245.030 (C), the City Council shall review and consider the HearingExaminer recommendation; and shall be approved by ordinance by the City
Council; and

9.The City Council has reviewed the Hearing Examiner recommendation, concurs
with the recommendation, and herby adopts the Findings within the
recommendation.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS
FOLLOWS:
Section 1. Recitals Incorporated. The Recitals set forth above are hereby adopted and incorporated as Findings of Fact of the City Council.
Section 2. Additional Findings. The Council may adopt further additional findings after
the public hearing is held and evidence presented to the City Council.
Section 3. The following rezones are hereby adopted: Parcel Numbers 101543000,
101544000, 101545000, 101547000, 101548000, and 10154200 from Light-Industrial to
C-2 General Commercial (Exhibit A Current Zong for Parcels of Interest Map & Exhibit B
Proposed Zone Changes for Parcels of Interest Map); and Parcel Number 110189000
(Exhibit C Area Boundary - southerly 4.6-acres of the 7.86 acre parcel and LegalDescriptions) from C-2 General Commercial to R-3 Multi-family Residential.
Section 4. Severability. If any section, sentence, clause or phrase of this ordinance should
be held to be invalid or unconstitutional by a court, board or tribunal of competent
jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance.
Section 5. Enforcement. Violations of this ordinance are enforceable to the same extent
as other violations of Title 15 MLUDC and are equally subject to injunctive and other
forms of civil relief that the City may seek.
Section 6. Conflict. In the event that there is a conflict between the provisions of this
ordinance and any other City ordinance, the provisions of this ordinance shall control.
Section 7. Effective Date. This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary as provided by law. .

LATECOMER CONTRACT
This LATECOMER CONTRACT (“Contract”) is entered into this ____ day of ______, 202___ ,
by and between the City of Moses Lake, a municipal corporation (“City”) and Lakemont ML 1
LLC (“Developer”).
RECITALS
WHEREAS, Developer is the owner of certain real property legally described on Exhibit A,
attached and incorporated herein, and commonly known as Lakemont Major Plat
(“Development”); and
WHEREAS, pursuant to Title 35 RCW and Chapter 3.65 of the Moses Lake Municipal Code
(“MLMC”), the City has by Resolution No. ______ adopted by the City Council of the City on the
___ day of _______, 202__, approved the execution of this Contract with the Developer for the
_______________ improvements (“Improvements”) described in this Contract; and
WHEREAS, the City has previously accepted the bill of sale attached as Exhibit B, attached and
incorporated herein, with respect to the Improvements as part of the utility systems of the City.
NOW THEREFORE, IN CONSIDERATION OF THE CONDITIONS AND COVENANTS
HEREIN, THE PARTIES AGREE AS FOLLOWS:
1.DEVELOPER. As of the date hereof and under the terms of this Contract, the Developer
has the sole right to recover latecomers fees associated with the Improvements.
2.IMPROVEMENTS. The Improvements which have been constructed by the Developer are
as described in the attached Exhibit B. The Improvements have been constructed in
accordance with the ordinances and requirements of the City governing the construction
specifications for Improvements of such type, are consistent with the City’s comprehensive
plans and development regulations, and have been approved by the City Engineer.
3.REIMBURSEMENT AREA. The properties benefited by the Improvements constructed
by the Developer are shown in Exhibits C, attached and incorporated herein, and described
in Exhibit D, attached and incorporated herein (“Reimbursement Area”). Any owner of
real property legally described within the Reimbursement Area as shown in Exhibits C and
D shall pay an amount as identified in Section 4. All property within the Reimbursement
Area shall be subject to the Latecomer Fee as provided in this Contract as a condition of
plat approval, a condition of issuance of a building or other development permit on property

not platted or on platted lots that are deemed insufficient, or a condition of connection to
the utility Improvements.
4.LATECOMER FEE. For a period of fifteen (15) years from the date that the City accepted
the Improvements, any owner (latecomer) of real estate located within the Reimbursement
Area, and which owner has not otherwise fully contributed their pro rata share to the
original cost of the Improvements, shall pay to the City the amounts shown in Exhibit E,
attached and incorporated herein (“Latecomer Fee”). The Latecomer Fee represents the fair
and equitable pro rata share of the cost of construction of the Improvements payable by
properties benefited by the Improvements. Payment of the Latecomer Fee is a condition of
issuance of any development permit by the City or connection to utility Improvements as
set forth in Section 3. The City shall reimburse the Developer within sixty (60) days of the
date the City receives payment from an owner.
5.EFFECT OF CONTRACT. The provisions of this Contract shall not be effective as to any
owner of real property not a party hereto unless this Contract has been recorded in the Grant
County Auditor’s Office prior to the time such owner receives a development permit or
connects to City utilities. If for any reason the City fails to obtain a Latecomer Fee before
a property owner connects to the Improvements then the City is not liable for payment to
the Developer. The Developer agrees to pay all fees for recording this Contract with the
Grant County Auditor’s Office.
6.DUTIES OF THE CITY. The City will use its best efforts to collect and distribute the funds
pursuant to the process set forth in this Contract. However, the City, its officials,
employees, or agents shall not be held liable or responsible for failure to implement any of
the collection provisions of this Contract, unless such failure is willful or intentional. The
City is acting in the capacity of a collection agent and is not obligated by this Contract to
make any payment except those amounts actually collected pursuant to this Contract. This
Contract does not constitute a guarantee on the part of the City that any reimbursement will
be collected or paid during the term of this Contract. The City takes no responsibility to
defend legal challenge to this Contract with Developer. Any challenge to the City’s
authority or process for a latecomer contract will not be defended by City. The City may
tender defense of the Contract to Developer.
7.OWNERSHIP OF IMPROVEMENTS. By prior acceptance of the Bill of Sale, the City
acknowledges and agrees that the Improvements have been accepted by the City as
satisfactory and the City agrees that the Improvements have or will become a part of the
municipal system of the City. All maintenance and operation costs of the Improvements
shall be paid by the City.

8.NOTIFICATION BY DEVELOPER. Every two years from the date the Contract is
executed, the Developer shall provide the City with information regarding the current
contact name, physical and mailing address, and telephone number of the Developer. At
any time during the term of this Contract, if two (2) years and sixty (60) days lapse without
written notification from the Developer, then the latecomer fees collected by the City under
this Contract will be deposited in the City’s capital fund.
9.COVENANT RUNNING WITH THE LAND. This Contract shall be a covenant running
with the land and be binding on the Developer, its successors, heirs, and assigns and shall
be binding on the legal owners of all properties within the Reimbursement Area and their
successors, heirs, and assigns.
10.INDEMNIFICATION. The Developer will defend, indemnify, and save the City and the
City’s officials, employees, and agents harmless from all claims and costs of defense
arising out of this Contract as a result of Developer’s actions, misconduct, or breach of
contract, including but not limited to attorney's fees, expert witness fees, and the cost of
the services of engineering and other personnel whose time is reasonably devoted to the
preparation and attendance of depositions, hearings, arbitration proceedings, settlement
conferences and trials growing out of the demands and/or actions of property owners
incurred in the performance or completion of this Contract.
11.ENFORCEMENT. This Contract shall be enforceable only by the parties. The Contract is
for the benefit of the parties, or their assigns, and not for the benefit of any third party.
Should any legal action be brought by either party for breach of this Contract or to enforce
any provision herein, the prevailing party of such action shall be entitled to reasonable
attorney’s fees, court costs, and such other costs as may be fixed by court. This Contract is
entered into under the laws of the State of Washington, and the parties intend that
Washington law shall apply to the interpretation hereof. Venue and jurisdiction to enforce
all obligations under this Contract shall lie in the Grant County Superior Court. The
obligations of the parties hereunder may not have an adequate remedy by way of an action
for damages and may be enforced by an action for specific performance. In the event a
court of competent jurisdiction declares any material provision of this Contract invalid,
unconstitutional, or otherwise unenforceable, any party may elect to terminate the
remainder of this Contract. In the event a non-material provision of this Contract is declared
invalid, unconstitutional, or otherwise unenforceable, such provisions hereof as are not
affected by such declaration shall remain in full force and effect.
12.MISCELLANEOUS PROVISIONS

12.1 Developer shall not assign this contract without written consent of the City.
12.2 It is understood that the contractual relationship between the City and Developer is
such that Developer is an independent contractor and not an agent of the City.
12.3 All notices required or provided under this Contract shall be in writing and
delivered in person or sent by certified mail, postage prepaid. Notices required to

LATECOMER CONTRACT
This LATECOMER CONTRACT (“Contract”) is entered into this ____ day of ______, 202___ ,
by and between the City of Moses Lake, a municipal corporation (“City”) and Lakemont ML 1
LLC (“Developer”).
RECITALS
WHEREAS, Developer is the owner of certain real property legally described on Exhibit A,
attached and incorporated herein, and commonly known as Lakemont Major Plat
(“Development”); and
WHEREAS, pursuant to Title 35 RCW and Chapter 3.65 of the Moses Lake Municipal Code
(“MLMC”), the City has by Resolution No. ______ adopted by the City Council of the City on the
___ day of _______, 202__, approved the execution of this Contract with the Developer for the
_______________ improvements (“Improvements”) described in this Contract; and
WHEREAS, the City has previously accepted the bill of sale attached as Exhibit B, attached and
incorporated herein, with respect to the Improvements as part of the utility systems of the City.
NOW THEREFORE, IN CONSIDERATION OF THE CONDITIONS AND COVENANTS
HEREIN, THE PARTIES AGREE AS FOLLOWS:
1.DEVELOPER. As of the date hereof and under the terms of this Contract, the Developer
has the sole right to recover latecomers fees associated with the Improvements.
2.IMPROVEMENTS. The Improvements which have been constructed by the Developer are
as described in the attached Exhibit B. The Improvements have been constructed in
accordance with the ordinances and requirements of the City governing the construction
specifications for Improvements of such type, are consistent with the City’s comprehensive
plans and development regulations, and have been approved by the City Engineer.
3.REIMBURSEMENT AREA. The properties benefited by the Improvements constructed
by the Developer are shown in Exhibits C, attached and incorporated herein, and described
in Exhibit D, attached and incorporated herein (“Reimbursement Area”). Any owner of
real property legally described within the Reimbursement Area as shown in Exhibits C and
D shall pay an amount as identified in Section 4. All property within the Reimbursement
Area shall be subject to the Latecomer Fee as provided in this Contract as a condition of
plat approval, a condition of issuance of a building or other development permit on property

not platted or on platted lots that are deemed insufficient, or a condition of connection to
the utility Improvements.
4.LATECOMER FEE. For a period of twenty (20) years from the date that the City accepted
the Improvements, any owner (latecomer) of real estate located within the Reimbursement
Area, and which owner has not otherwise fully contributed their pro rata share to the
original cost of the Improvements, shall pay to the City the amounts shown in Exhibit E,
attached and incorporated herein (“Latecomer Fee”). The Latecomer Fee represents the fair
and equitable pro rata share of the cost of construction of the Improvements payable by
properties benefited by the Improvements. Payment of the Latecomer Fee is a condition of
issuance of any development permit by the City or connection to utility Improvements as
set forth in Section 3. The City shall reimburse the Developer within sixty (60) days of the
date the City receives payment from an owner.
5.EFFECT OF CONTRACT. The provisions of this Contract shall not be effective as to any
owner of real property not a party hereto unless this Contract has been recorded in the Grant
County Auditor’s Office prior to the time such owner receives a development permit or
connects to City utilities. If for any reason the City fails to obtain a Latecomer Fee before
a property owner connects to the Improvements then the City is not liable for payment to
the Developer. The Developer agrees to pay all fees for recording this Contract with the
Grant County Auditor’s Office.
6.DUTIES OF THE CITY. The City will use its best efforts to collect and distribute the funds
pursuant to the process set forth in this Contract. However, the City, its officials,
employees, or agents shall not be held liable or responsible for failure to implement any of
the collection provisions of this Contract, unless such failure is willful or intentional. The
City is acting in the capacity of a collection agent and is not obligated by this Contract to
make any payment except those amounts actually collected pursuant to this Contract. This
Contract does not constitute a guarantee on the part of the City that any reimbursement will
be collected or paid during the term of this Contract. The City takes no responsibility to
defend legal challenge to this Contract with Developer. Any challenge to the City’s
authority or process for a latecomer contract will not be defended by City. The City may
tender defense of the Contract to Developer.
7.OWNERSHIP OF IMPROVEMENTS. By prior acceptance of the Bill of Sale, the City
acknowledges and agrees that the Improvements have been accepted by the City as
satisfactory and the City agrees that the Improvements have or will become a part of the
municipal system of the City. All maintenance and operation costs of the Improvements
shall be paid by the City.

8.NOTIFICATION BY DEVELOPER. Every two years from the date the Contract is
executed, the Developer shall provide the City with information regarding the current
contact name, physical and mailing address, and telephone number of the Developer. At
any time during the term of this Contract, if two (2) years and sixty (60) days lapse without
written notification from the Developer, then the latecomer fees collected by the City under
this Contract will be deposited in the City’s capital fund.
9.COVENANT RUNNING WITH THE LAND. This Contract shall be a covenant running
with the land and be binding on the Developer, its successors, heirs, and assigns and shall
be binding on the legal owners of all properties within the Reimbursement Area and their
successors, heirs, and assigns.
10.INDEMNIFICATION. The Developer will defend, indemnify, and save the City and the
City’s officials, employees, and agents harmless from all claims and costs of defense
arising out of this Contract as a result of Developer’s actions, misconduct, or breach of
contract, including but not limited to attorney's fees, expert witness fees, and the cost of
the services of engineering and other personnel whose time is reasonably devoted to the
preparation and attendance of depositions, hearings, arbitration proceedings, settlement
conferences and trials growing out of the demands and/or actions of property owners
incurred in the performance or completion of this Contract.
11.ENFORCEMENT. This Contract shall be enforceable only by the parties. The Contract is
for the benefit of the parties, or their assigns, and not for the benefit of any third party.
Should any legal action be brought by either party for breach of this Contract or to enforce
any provision herein, the prevailing party of such action shall be entitled to reasonable
attorney’s fees, court costs, and such other costs as may be fixed by court. This Contract is
entered into under the laws of the State of Washington, and the parties intend that
Washington law shall apply to the interpretation hereof. Venue and jurisdiction to enforce
all obligations under this Contract shall lie in the Grant County Superior Court. The
obligations of the parties hereunder may not have an adequate remedy by way of an action
for damages and may be enforced by an action for specific performance. In the event a
court of competent jurisdiction declares any material provision of this Contract invalid,
unconstitutional, or otherwise unenforceable, any party may elect to terminate the
remainder of this Contract. In the event a non-material provision of this Contract is declared
invalid, unconstitutional, or otherwise unenforceable, such provisions hereof as are not
affected by such declaration shall remain in full force and effect.
12.MISCELLANEOUS PROVISIONS

12.1 Developer shall not assign this contract without written consent of the City.
12.2 It is understood that the contractual relationship between the City and Developer is
such that Developer is an independent contractor and not an agent of the City.
12.3 All notices required or provided under this Contract shall be in writing and
delivered in person or sent by certified mail, postage prepaid. Notices required to

1 LLC does by these presents hereby convey, set over, assign, transfer, and sell to the City of
Moses Lake, Grant County, Washington, a municipal corporation the municipal improvements
described as WATER & SEWER. The location of the municipal improvements are depicted on
Exhibit A and are more particularly described on Exhibit B attached and incorporated herein. The
said grantor(s) hereby warrants that they are the sole owner(s) of all of the municipal improvements
described above, all charges incurred for materials and labor have been paid and there are no liens
against the municipal improvements, that they have full power to convey all rights herein
conveyed, and agree to hold the City of Moses Lake harmless from any and all claims which might
result from the execution of this document.

RESOLUTION NO. 4022
A RESOLUTION APPROVING A LATECOMERS AGREEMENT BETWEEN LAKEMONT ML LLC AND THE CITY OF MOSES LAKE FOR PARTIAL REIMBURSEMENT FOR THE COST OF CONSTRUCTING A REQUIRED PUBLIC IMPROVEMENT.
RECITALS:
1.The Moses Lake municipal code and the State Environmental Policy Act may require privatedevelopment to make infrastructure improvements.
2.Chapter 35.91 RCW provides that, at the owner’s request, a municipality may contract with the
owner of real estate for the construction or improvement of water or sewer facilities that the ownerelects to install solely at the owner’s expense. The owner must submit a request for a contract to
the municipality prior to the approval of the water or sewer improvements by the municipality.
3.MLMC 3.65 describes the process for a property owner or developer to request the execution of alatecomer agreement with the City Council for water and/or sewer improvements to provide forthe partial reimbursement of the cost of constructing the water and/or sewer improvements.
4.Lakemont ML LLC completed construction improvement of water and sewer facilities as part of theLakemont Major Plat located on Eastlake and Burke Drive, at the applicant’s expense.
5.As a result of installing this required improvement Lakemont ML LLC has submitted a proposedlatecomer’s agreement, including a description of the methodology and the pro rata share foreach property to the City seeking to be partially reimbursed for the cost of constructing the improvement.
6.The City accepted the improvements as complete on February 25, 2025.
7.The City Engineer reviewed and approved the method of assessment and cost of construction onAugust 8, 2025.
8.The City Engineer sent appropriate notices to all affected property owners via certified mail on
August 11, 2025.
RESOLVED:
1.The City Council of the City of Moses Lake, Washington, approves the Lakemont ML LLCLatecomers Agreement with Exhibits attached hereto and incorporated by this reference as if setforth in full.
