A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR
MUNICIPAL USE AS A PART OF LKQ FOSTER AUTO PARTS
Recitals:
1.Street and Utility improvements lying in dedicated right-of-way or easements are in place and
connected to the City of Moses Lake’s street and utility systems as part of LKQ Foster Auto Parts. The
project includes street restoration, water, and stormwater improvements to Tyndall Rd. 2,243’ of 10” C-
900 water main, four hydrant assemblies, 2,689 Cubic Yards of excavation and shaping for stormwater
retention area, and 10,715 Square Feet of HMA patching of Tyndall Rd.
2.Said street and utility improvements have been installed in accordance with the City of Moses Lake’s
Community Standards and were completed in January of 2026.
3.RCW 35.91.030, indicates that developer installed public street and utility facilities, should be accepted
by the City of Moses Lake upon completion if the facilities are built to city standards.
4.A Subdivision Maintenance Bond shall be provided by the developer for a two-year maintenance period
which commences on the January 27,2026.
Resolved:
1.The City Council of the City of Moses Lake accepts the LKQ Foster Auto Parts street and utility
improvements as facilities of the City of Moses Lake and as such will charge for use of facilities as
authorized by ordinance.
2.After January 27, 2026, all operational costs of the said street and utility improvements shall be borne
by the City of Moses Lake as provided by city ordinance and subject to the required maintenance bond.
3.Subject to final inspection, after January 28, 2028, all further maintenance and operational costs of said
street and utility improvements shall be borne by the City of Moses Lake, as provided by city
ordinance.
ACCEPTED by the City Council on January 27, 2026.
