City Council approval to proceed with funding request for a surface water treatment plant through
Congressionally Directed spending requests with our federal representatives.
Each year, our federal representatives put out calls for projects to fund through congressionally directed
spending requests. This year staff is recommending one request to help the city transition to shallow and
surface water sources, which is the need for a surface water treatment plant. Based on the testing results of
Well 34, treatment will be needed for this source, so given the larger need for shallow and surface water
treatment, staff is recommending funding to complete this project near the well site.
Grant funds will help support the cost of this needed facility instead of having the cost fall fully on water utility
rate payers.

Staff will proceed with submitting funding requests.

With the departure of Rob Harris, this provided for a fresh look at the optimal organization of development
review and construction management/inspection functions within Municipal Services/Engineering. In addition,
with the work ahead with water education and new conservation incentive programs, two part time positions are
being recommended to be consolidated into a full-time position for water conservation work. Kirk Holmes and
Kirsten Sackett have recommended the following moves that have been reviewed with the City Council Finance
Committee:
1) Move the development review position to Community Development, along with the budget for that position.
2) Move both public and private construction inspection under one division, Construction Management office, in
Municipal Services/Engineering. By moving all inspections into one division, this frees up the engineering
design side of the house to focus on project conceptualization and design. Engineering techs used to split time
between design and construction inspection. This also insures that both public and private projects are
inspected consistently.
3) Combine a part time position in water with a part time position in code enforcement to create a full-time water
conservation position. The position in code enforcement was a full-time position that was created by adding a
half time position for water conservation enforcement. This leaves a part time position in code enforcement for
summer weed enforcement.
A project list, project timelines and 2022 year end report are included to understand the work load of the
construction management office.
The full-time water conservation position had two part time salaries, so the additional cost would be the benefits
associated with the full-time position. The construction management office is seeking one additional
construction inspector to help handle all construction projects that will be managed out of one division.
$100,000 represents partial year of benefits for the water conservation position and the new construction
inspector position.
Options and Results
The new construction inspection position would be authorized as well as the full time water conservation
position.
Staff will bring back options for recommended changes.
The organization would remain as is.

It was a very busy year for Development Engineering staff. We experienced both department
growth with the addition of an Engineering Tech and reduction with the departure of the
Development Engineering Manager, change in our processes and accepted the challenge of
evolving the department in a central Construction Management Program.
Development Engineering oversees the public component (streets, water, sewer, etc) of private
projects. Staff is responsible for reviewing and permitting all proposed new infrastructure and all
proposed impacts to existing public infrastructure.
Staff reviews all plans submitted by private
developers for commercial, industrial, and new
residential subdivisions. This is done to protect the
public health and safety and to ensure all new
construction conforms to the City’s Standard
Specifications and Details, Materials List and
comprehensive plans and will function as intended
within the city’s existing infrastructure.
Following is a brief description of services Development Engineering provides and some of the administrative responsibilities:
• Research water and sewer utility requests for availability, location, and size of available service.
• Calculate reimbursements and development fees that are due prior to connection to City utilities.
• Review and approve all Developer improved street and utility construction plans.
• Issue Street and Utility Construction Permits and provide on-site construction inspection for Developer projects.
• Assign street addresses to all properties within the City of Moses Lake corporate limits.

• Process, maintain and monitor all Street & Utility

developers, insurance agents, engineering firms, architects, internal staff,
and the public on private and capital improvement projects
• Maintain and update Community Street & Utility Standards
• Continue evaluating process for efficiency
Several new subdivisions were under construction in 2022 with some continuing into
2023. There were 145 new addresses issued in 2022: 134 to new subdivision and 11 to
individual parcels.

After the last provider of security services for the Sleep Center provided notice that they would no longer be able
to obtain insurance, city staff went through a process to select a new firm. One of the considerations discussed
with City Council was for the city to stand up our own security division due to security needs for other city
facilities as well. Due to the cost and long term obligation, City Council asked that staff take one more
opportunity to see if there was a firm that could provide the service. Staff appreciates that during a conversation
at the last MLED meeting, it was noted that the agencies participating in that group were using contract security
which may provide for a more stable presence of employees in this area, which was an issue in the past. As a
result, three firms were interviewed and staff is requesting authorization to contract with Pacific Security. At this
time, this contract would be for the sleep center, which already has budget identified for this contract. Staff will
be bringing forward a plan for additional security services for consideration of a budget amendment, which
would result to an amendment of this contract at that time, if approved.
Security services are already budgeted for the Sleep Center. This contract simply replaces the prior contractor
at a reduced rate due to the contractor not providing armed security, which comes at a premium and is not
preferred by the Police Chief.

CONTRACT FOR SECURITY GUARD SERVICES
THIS CONTRACT FOR SECURITY GUARD SERVICES is made and entered into
on this ____ day of February 2023, by and between the City of Moses Lake, a Washington
municipal corporation and non-charter code city (“City”), and Pacific Security, a division of Parker
Corporate Services, INC.
NOW THEREFORE, in consideration of the foregoing recitals and the terms, conditions,
covenants, and agreements set forth herein, the Parties agree as follows:
1. GUARD SERVICES. Pacific Security shall provide Security Services to the City
to include one 12-hour shift from 4:30 p.m. to 4:30 a.m. Sunday through Saturday to patrol several
designated City facilities and a second 10-hour shift from 9:00 p.m. to 7:00 a.m. Sunday through
Saturday at the City’s sleep center.
1.1 “Security Services” shall mean surveying city facilities and properties,
informing any individual present on closed property that the property is closed, and reporting any
illegal activity occurring thereon to law enforcement or other appropriate authorities.
1.2 Pacific Security shall not detain any individual for any purpose.
1.3 Pacific Security shall not enter onto any other property not owned by the
City while providing Security Services under this contract.
1.4 Pacific Security shall provide information as a “fact witness” to law
enforcement to assist in the arrest, charging, and prosecution of such offenders by law
enforcement. However, Pacific Security shall not sign a complaint or similar document on behalf
of the City and any request for a signed complaint by a law enforcement agency shall be referred
to the City.
1.5 Any action of an official nature shall be referred to the City.
1.6 Pacific Security shall provide regular reports, on a daily or weekly
occurrence as directed by the City, of security services to the City.
1.7 Security Services in addition to those set forth above may be provided to
the City upon written request; however, all additional services or fee modifications will be
incorporated in an addendum to this contract.
1.8 The City may increase or decrease the number of hours at its discretion,
with advance notice. Increases with less than 72 hours’ notice will be billed at one and half times
the current bill rate through the following week.

2. COMPENSATION. The City shall pay to Pacific Security Thirty-Five Dollars
($35.00) per hour for a guard with a vehicle and Twenty-Eight Dollars and Thirty-Three Cents
($28.33) for a guard without a vehicle for security services provided.
2.1 All payments for Security services by the City are due and payable upon
receipt of invoice and past due thirty (30) days thereafter.
2.2 Any payment past due more than thirty (30) days shall incur a one and a
half percent (1.5%) service charge per month.
3. TERM AND TERMINATION. This Contract shall commence on February ___,
2023 and shall automatically renew every month unless terminated. This Contract may be
terminated by either Party at any time by giving the other Party at least thirty (30) days prior written
notice of the termination date of this Contract.
4. EMERGENCY CONTACT INFORMATION. The City agrees to provide
Pacific Security with the names and phone numbers of persons to be contacted in case of an
emergency. It is the responsibility of the City to update the emergency information and to keep it
current. Further, it is the City’s responsibility to inform Pacific Security of any changes known to
the City affecting the protected premises and Pacific Security’s provision of security services
thereto. The City agrees that Pacific Security shall not be responsible for any loss or damage which
is caused by the City’s failure or inability to notify Pacific Security of changes concerning the
City’s premises or to update emergency information.
5. PERSONAL PROTECTION DEVICES. Pacific Security and its employees or
agents may carry personal protection devices solely for personal protection. Personal protection
devices, including but not limited to tasers, stun guns and OC spray, shall not be used to fulfill the
purposes of this Contract. Personal protection devices do not include firearms or any object used
as a dangerous weapon. Possession or use of a firearm or any object used as a dangerous weapon
is prohibited on City property. Pacific Security shall indemnify and hold the City harmless for any
liability or claim arising from the use of personal protection devices by the agents and employees
of Pacific Security.
6. RECORDS. Pacific Security shall maintain records regarding the contracted
Security Patrol services, indicating the dates and times of services provided. Remarks will be
made for those things which appear to require the City’s attention or incidents of interest which
may have occurred but did not warrant notifying the City or law enforcement. All data, reports,
and information regarding work performed by Pacific Security hereunder in written, electronic or
other form, shall become the property of the City. Pacific Security shall retain all records of service
related to the City for a period of six years and such records are available to the City upon request.
Pacific Security understands and agrees that, in performing services for a public entity, certain

records and documents created by and/or in the possession of Pacific Security may be public
records and may be subject to applicable state and federal public disclosure laws. Pacific Security
agrees to comply with any such regulations at its cost. Pacific Security shall not divulge to any
third parties any information obtained from or through the City or developed hereunder without
first obtaining approval from the City or its designated representative.
7. QUALIFICATIONS OF ASSIGNED PERSONNEL. Assigned personnel shall
be guard certified in the State of Washington or meet guard certification requirements as defined
in RCW Chapter 18.170. Assigned personnel shall read and understand “post orders” written in
English, write an organized, clear, and readable report in English, and understand and verbally
communicate in clear, understandable English. Assigned personnel shall have at least two years
of prior experience and satisfactory performance in a guard service position. Assigned personnel
shall not have been separated from previous protective service employment or military service for
disciplinary reasons, abuse of drugs or alcohol or a physical or mental infirmity rendering them
incapable of performing their duties. Assigned personnel shall possess a current and valid
Washington state driver’s license. Assigned personnel are tested “drug free” personnel, have a
valid First Aid and CPR certification, Modification of Aggressive Behavior (MOAB) and shall have
basic knowledge of fire prevention and suppression methods and equipment. Assigned personnel
shall be familiar with and follow all City policies regarding the workplace including but not limited
to workplace harassment, no smoking policy, violence in the workplace, drug free workplace, and
workplace discrimination.
8. RELATIONSHIP BETWEEN PARTIES. The Parties intend that an independent
contractor relationship will be created by this Contract. Nothing in this Contract shall be
interpreted to create an employee/employer relationship, association, joint venture, agency
relationship, or partnership. The City shall not be obligated to pay to Pacific Security, and Pacific
Security shall not be entitled to any benefits accorded to City employees by virtue of the services
provided under this Contract. The City shall not be responsible for withholding or otherwise
deducting federal income tax or social security or any other tax, for contributing to the state
industrial insurance program or otherwise assuming the duties of an employer with respect to
Pacific Security. Pacific Security shall be responsible for the payment and all contributions or taxes
which are measured by wages, salaries, or other remuneration paid to persons employed by Pacific
Security for the work to be performed hereunder, or which arise by virtue of Pacific Security’s
employment and which now or hereafter may be imposed by any governmental authority. Such
contributions or taxes, shall include, but not be limited to, Unemployment Insurance, Worker's
Compensation, Old Age Retirement Benefits, Medicaid, Disability, Pensions or Annuities, and
Income Taxes. Pacific Security shall comply with all laws and administrative regulations relating
to such contributions or taxes. Pacific Security accepts full and exclusive liability for and shall
pay all sales, use, gross receipts, and any other taxes arising from the fees paid to Pacific Security
by the City for Pacific Security’s performance of this Agreement. The City is interested primarily
in the results to be achieved; subject to paragraphs herein, the implementation of services and the

safety measures required by the services will lie solely with the discretion of Patrol. No agent,
employee, servant or representative of Pacific Security shall be deemed to be an employee, agent,
servant or representative of the City for any purpose. Pacific Security will be solely and entirely
responsible for its acts and for the acts of its agents, employees, servants, subcontractors, or
representatives during the performance of this Contract. It is understood that Pacific Security is
free to contract for similar services to be performed for other parties while Patrol is under contract
with the City. Nor shall either Party have any right, power or authority to enter into any agreement
or undertaking for, or act on behalf of, or to act as or be an agent or representative of, or to
otherwise bind, the other Party. In the performance of the services herein contemplated Pacific
Security is an independent contractor with the authority to control and direct the performance of
the details of the work, however, the results of the work contemplated herein must meet the
approval of the City and shall be subject to the City's general rights of inspection and review to
secure the satisfactory completion thereof.
9. WARRANTY OF SERVICES. It is agreed and understood by the City that the
services provided hereunder can only provide a degree of security resulting from reasonable efforts
of Pacific Security to carry out mutually agreed security procedures. However, Pacific Security
understands and acknowledges that the City will be relying upon its accuracy, competence and
credibility and the completeness of the services to be provided hereunder. The City further
understands and agrees that Pacific Security is not providing absolute or maximum security and
that Pacific Security is not an insurer. All amounts payable to Pacific Security under this Contract
are based solely upon the value of the services rendered and are unrelated to the value of the City’s
property. Pacific Security is not responsible for any loss by reason of theft, vandalism, or any other
act, which is not directly caused by an agent or an employee of Pacific Security. The City
understands that the services furnished under this Contract shall be in conformity with practices
which are generally current in the security industry. The Parties agree that Pacific Security does
not represent and cannot warrant that the services furnished will prevent or minimize the likelihood
of loss; Pacific Security’s responsibility is solely limited to providing physical security services
and Pacific Security has not been engaged as a consultant or otherwise to provide an assessment
of security needs at the site(s) covered. The nature and level of security services provided were
determined solely by the City and the City acknowledges that additional security services were
available to the City at an additional cost.
10. PROHIBITION ON HIRING ASSIGNED PERSONNEL. The City agrees that
it shall not directly hire or employ a Pacific Security employee currently employed by Pacific
Security and within one (1) year following the termination of this Contract.
11. INSURANCE. Pacific Security shall, at its own expense, maintain in force and
effect at its own cost and expense the following insurance coverage which shall be placed with an
insurance carrier authorized to do business in the State of Washington and rated A-VII or better
by Best’s Financial Strength Rating Guide:

Commercial general liability insurance not less than two million dollars ($2,000,000.00)
per occurrence and five million dollars ($5,000,000.00) aggregate;
Worker’s Compensation insurance as required by the Industrial Insurance laws of the State
of Washington;
Automobile liability insurance not less than one million dollars ($1,000,000.00) per
occurrence combined single limit of liability; and
Crime insurance with endorsement for third party coverage not less than one million dollars
($1,000,000.00) per occurrence (in lieu of a crime insurance policy, Pacific Security may
elect to provide an Employee Dishonesty Bond covering all employees performing the
services under this Contract in an amount of $50,000).
The City and its officials, officers, employees, and agents shall be added as an additional insured
under the general liability, automobile liability insurance, and employer’s liability insurance
required under this Contract. It is the sole responsibility and obligation of Pacific Security to
provide updated insurance information to the City, including but not limited to any notices of
cancellation or reduction in limits of Pacific Security’s insurance. Pacific Security’s insurance
shall be endorsed to require prior written notice by certified mail, return receipt requested, be given
to the City thirty (30) days before any cancellation or reduction in limits is effective. Pacific
Security shall provide the City with evidence of such insurance in the form of a certificate of
insurance and a copy of the amendatory endorsements, including but not necessarily limited to the
additional insured endorsements, evidencing the Automobile Liability and Commercial General
Liability insurance prior to the commencement of services and throughout the term of this
Agreement.
12. INDEMNIFICATION. Pacific Security shall indemnify and hold the City and its
agents, employees, and/or officers, harmless from and shall process and defend at its own expense
any and all claims, demands, suits, at law or equity, actions, penalties, losses, damages, or costs,
of whatsoever kind or nature, brought against the City arising out of, in connection with, or incident
to the execution of this Agreement and/or Pacific Security’s performance or failure to perform any
aspect of this Contract; provided, however, that if such claims are caused by or result from the
concurrent negligence of the City, its agents, employees, and/or officers, this indemnity provision
shall be valid and enforceable only to the extent of the negligence of Pacific Security and its agents,
employees, and/or officers; and provided further, that nothing herein shall require Pacific Security
to hold harmless or defend the City, its agents, employees and/or officers from any claims arising
from the sole negligence of the City, its agents, employees, and/or officers. Pacific Security
expressly agrees that the indemnification provided herein constitutes the contractor's waiver of
immunity under Title 51 RCW, for the purposes of this Agreement. This waiver has been mutually
negotiated by the Parties. The provisions of this section shall survive the expiration or termination
of this Contract. No liability shall attach to the City by reason of entering into this Contract except
as expressly provided herein.

13. ENTIRE AGREEMENT. The Parties represent that this is the entire agreement
and understanding among the Parties, and that there are no representations, warranties, terms,
covenants or conditions made by any other party except as herein expressly contained. This
Agreement shall not be altered, waived, modified or canceled in any respect except in writing,
duly executed by all of the Parties hereto, and no oral agreement or course of conduct to the
contrary, shall be deemed an alteration, amendment, modification of cancellation.
14. SEVERABILITY. If any provision or portion of this Contract shall for any reason
be held or adjudged to be invalid or illegal or unenforceable by any court of competent jurisdiction
or other governmental authority, (1) such portion or provision shall be deemed separate and
independent, (2) the Parties shall negotiate in good faith to restore insofar as practicable the
benefits to each Party that were affected by such ruling, and (3) the remainder of this Contract
shall remain in full force and effect.
15. GOVERNING LAW. The validity, interpretation, and enforcement of this
Contract and each of its provisions shall be governed by the laws of the state of Washington,
without regard to its conflicts of law principles. This Contract is subject to all applicable laws and
regulations. Each Party expressly reserves the right to seek changes in, appeal, or otherwise contest
any laws, orders, or regulations of a governmental authority.
16. VENUE. Any lawsuit arising directly or indirectly out of this Contract will be
litigated in the Superior Court for Grant County, Washington.
17. WAIVER. Any waiver by either Party of a breach of any provision of this Contract
shall not operate as or be construed to be a waiver of any other breach of such provision or of any
breach of any other provision of this Contract. The failure of a Party to insist upon strict adherence
to any term of this Contract on one or more occasions shall neither be considered a waiver nor
deprive that Party of any right thereafter to insist upon strict adherence to that term or any other
term of this Contract. Any waiver must be in writing and signed by the Party to be charged
therewith.
18. SECTION HEADINGS. Section headings appearing in this Contract are inserted
for the convenience of reference only and shall not be construed to be interpretations of the text of
this Contract.
19. THIRD-PARTY BENEFICIARIES. This Contract is not intended to and does
not create rights, remedies, or benefits of any kind whatsoever in favor of any persons,
corporations, associations, or entities other than the Parties herein, and the obligations herein
assumed are solely for the use and benefit of the Parties, their successors in interest and, where
permitted, their assigns.
20. NOTICES. Unless otherwise provided in this Contract, any written notice,
demand, or request required or authorized in connection with this Contract shall be deemed

properly given if delivered in person, delivered by recognized national courier service, or sent by
first class mail, postage prepaid, to the persons specified below:

WORKSHOP
Urban Services Discussion – Water Focus
City Manager Allison Williams and her team of Directors provided a PowerPoint presentation to
update Council on the land use planning process and the requirements under the Growth
Management Act, including the newly adopted Capital Facilities Plan. Population growth from
2000 to 2020 was reviewed as well as 2023 approved and unapproved Capital Improvement Plan
projects, projected revenues, fire response areas for stations built in 1993 and 1996, and fire
ratings.
The focus of this discussion was to review the long-term water supply issue facing the City. The
water supply goal is to provide clean, health water which requires maintaining and stabilizing
water system capacity that meets legal water pressure and fire flow; and ensuring adequate
availability for future and currently known planned system expansion.
Discussion ensued amongst Council, staff, and residents regarding the legal access to move from
deep to shallow aquifer, industrial chemical cleanup, partnerships with Conservation Districts,
cost of converting to purple pipe for irrigation, cost of converting to drought resistant
landscaping, rate implementation to encourage conservation, and Columbia River resource for
agriculture.
Staff will present interim regulations for MLMC 13.07 related to urban growth area water
connections and MLMC 18.57 related to landscaping strips for Council consideration on March
28.
City Manager Allison Williams commended the Utility Division staff present at the meeting for
implementation of new rates.
EXECUTIVE SESSION
Mayor Myers called an Executive Session at 7:17 p.m. for 30 minutes to discuss the evaluation
of a public employee pursuant to RCW 42.30.110(1)(g) with no business to follow.

Planning Commission Appointment
Community Development Director Kirsten Sacket and Planning Commission Chair Nathan Nofziger conducted interviews on both applications received and recommend appointment of Aaron Weber. Mayor Myers recommended appointment of Aaron Weber to the Planning Commission for a 6-year term expiring December 31, 2028.
Action taken: Council Member Swartz moved to approve the appointment as presented, second
by Council Member Fancher. The motion carried 7 – 0. Grant County Homeless Housing Task Force Representative and Alternate Appointment Staff received an email from Commissioner Rob Jones with the by-laws for the new Grant County Homeless Housing Task Force. The City Council needs to send a recommendation
designating one Member and one Alternate to represent the City on the task force. Other representation will be from Grant County Health District, a Medical Healthcare Service Provider, a Behavioral Health or chemical dependency treatment service provider, Grant County Veterans Services Officer, Chief Deputy of the Grant County Jail, and an “at-large” small city member appointed by the Association of Grant County Cities and Towns.
Action taken: Council Member Swartz moved to appoint Deanna Martinez as the Grant County Homeless Housing Task Force Representative, second by Council Member Fancher. The motion carried 7 – 0.

Random Acts of Kindness Day Proclamation A proclamation was read declaring February 17, 2023, as Random Acts of Kindness Day. Gene Sharratt represents a group of individuals devoted to the central Washington Act of

proclamation and to suggest making 2023 a year of kindness.

Fire Employee Promotion Fire Employee Joe Schwendeman was given his oath of office for his recent promotion to
Battalion Chief.
New Parks, Recreation, and Cultural Services Director Doug Coutts was introduced as the new Parks, Recreation, and Cultural Service Director. Dollie Boyd was thanked for her service as Interim Parks, Recreation, and Cultural Services Director.
4th of July Fireworks Display
Museum Superintendent Dollie Boyd described cost, duration, positive, and negative aspects for 4th of July Celebration option of a traditional firework show vs an aerial light show using drones.
Action taken: Council Member Martinez moved to proceed with the traditional fireworks show
and send a request for funding to the Lodging Tax Advisory Committee, second by Council Member Eck. The motion carried 7 – 0. Legislative Priorities Update Local priorities included Water Infrastructure, Police Reform, Police Station Construction,
and Larson Playfield Irrigation Conversion. Updated AWC priorities dated February 6 were also included in the packet. City Annual Report
Assistant City Manager Rich Huebner reviewed the content of the 2022 City Annual Report
and thanked directors for their contribution.

#2 DOH Associates Police Station Owner’s Representative Contract Council pulled from Consent to discuss the particulars needed of an Owner’s
Representative. City Manager Allison Williams explained the value that has been
provided on the Larson Rec Center, and the desire to have this same oversight of the Police Station Build. Change Orders were minimized as a result of their work. Action taken: Council Member Martinez moved to proceed with the Owner’s Representative,
second by Mayor Myers. The motion was withdrawn. Action taken: Council Member Martinez moved to discuss further with DOH Associate’s Larry Gangle at the next meeting (will be the 3/14 meeting, due to availability), second by Council Member Swartz. The motion carried 6 – 0. Council Member Eck was not present for this vote.
ADMINISTRATIVE REPORTS
Downtown Clean up Event The Moses Lake Downtown Association is hosting a clean-up event on February 25, 2023, from 11 a.m. to 2 p.m. All are encouraged to participate.
Water Purveyor Profile Sheet A summary of issues, needs, sources, public safety, contacts, and fast facts was included in the packet.
Ambulance Cost of Service Study Request for Qualifications
The 2023 Budget includes expense to solicit vendors for a Cost of Service Study for availability of an ambulance program. The study will determine future staffing and fees for the program. The last study was completed in 2016.
Parks Watering Conversion Update
McCosh Park and Cascade Valley Park have been converted for full irrigation using lake water.
COUNCIL COMMUNICATIONS AND REPORTS
Council Member Swartz expressed his excitement for going to AWC Action Days on the 15th and 16th of February. Council Member Fancher announced that he is going to be on the Moses Lake Economic
Development Council for his work position. He will recommend City Manager Allison Williams
if an ex officio position opens. Council Member Skaug attended the Finance Committee meeting. There were a few budget amendments brought forward. He also commented on the State Audit Exit Interview and gave
kudos to Finance Director Madeline Prentice for her and her team’s work with the auditors.
Council Member Martinez also attended the Finance Committee meeting. The money that is

being spent speaks to the priorities that the Council has brought forward, including bringing more staff on and moving staff around to fill gaps. Some of the money that is being spent is also on water and sewer infrastructure. There is a security group who will be contracted for the sleep
center. Grant County Health District met and they are switching gears to pre-covid programs
such as the Harm Reduction Program, needle exchange, and the Youth Cannabis and Commercial Tobacco program. The Moses Lake Community Coalition will be meet in March. Mayor Myers will miss Grant Transit Authority (GTA) meeting this month due to conflict with
AWC Action Days. Public meetings for the GTA Service Analysis will be held on February 15,
2023, from 3:30 p.m. – 5 p.m. at the Transit Center and on February 21, 2023, from 10:30 a.m. – Noon via Zoom. EXECUTIVE SESSION
Mayor Myers called an Executive Session at 7:46 p.m. for 30 minutes to discuss Real Estate
Acquisition, Elected Official or Employee Complaint, and Potential Litigation, pursuant to RCW 42.30.110(1) subsections (b), (f) and (i). The session was extended 15 minutes. There was no business to follow.

RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW
42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a
monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above
format for approval by the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering
services or performing labor must be certified by the appropriate official to ensure that the materials have been
furnished, the services rendered, or the labor performed as described, and that the claims are just, due and
unpaid obligations against the City.
RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met.
The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted
to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body
had adopted policies that implement effective internal control; (3) the legislative body has provided for review of
the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they
shall be recognized as receivables and diligently pursued.
The City meets all these conditions.
To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council
approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments
during the period prior to the date of the Council meeting.
All payments made during this period were found to be valid claims against the City. Details are attached and
any questions should be directed to the City Manager or Finance Director.
The City's internal controls include certification of the validity of all payments by the appropriate department prior
to submission for payment. The Finance Director has delegated authority for the examination of vouchers and
authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and
validated. The Finance Division regularly reviews it processes to ensure appropriate internal controls are in
place.

In 1951, Grant County acquired road easements extending south for 2016 feet from Wheeler Road, located just
West of the former U&I Sugar plant site (documents recorded in Auditor's File Numbers 173690, 174073, 173074
and 176948, records of Grant County). A road has never been constructed within the existing easements. The
properties over which the road easements lie were annexed in 1999. The road easements are currently under
the ownership and jurisdiction of the city of Moses Lake.
Group 14 Technologies is currently seeking to develop a site within the Central Terminals Industrial Binding Site
Plan. The existing road easements cross over the site they have selected.
The current property owner, Central Terminals LLC, has requested that the existing road easements be
abandoned to clear the way for Group 14 to develop a battery materials manufacturing plant. Staff sees no
benefit in retaining the existing road easements in their current location and brings this request before city
council for approval.

RESOLUTION NO. 3933
A RESOLUTION TO ABANDON ROAD EASEMENTS
RECITALS:
1. In 1951, the county acquired road easements south of Wheeler Road between Road L NE andRoad N NE, recorded in AFN’s 173690, 174073, 173074 and 176948.
2.A county road was never developed within these easements.
3.The land within the and adjacent to the road easements is currently occupied by an irrigation pivot
and is with the Central Terminals Industrial Binding Site Plan.
4. Central Terminals LLC has requested that the city abandon the road easements to clear land toallow for a development proposal and land sale to Group 14 Technologies.
RESOLVED:
1. The City of Moses Lake, Washington, declares that road easements found in AFN’s 173690,174073, 173074 and 176948 are unused and not necessary and are hereby abandoned.

Biosolids are a byproduct of the wastewater treatment process. Removal of the product from the wastewater
treatment lagoons is essential to the treatment process. Land surrounding the Dunes WWTP has been leased
out to farm sod and other crops to reduce shipping costs of bio-solids to other land application sites. This
general services contract is for the land application of biosolids to the adjacent farmed fields.

In September 2022, the City signed an Inter-Agency Agreement with the Department of Enterprise Services.
This agreement allowed us to work with McKinstry and the State to develop an Investment Grade Audit (IGA) of
possible energy savings and water conservation opportunities within the City of Moses Lake. This funding is the
first step that will allow us to proceed with our low water landscaping, solar options, LED lighting upgrades, and
to conduct a facility conditions assessment to provide us with our greatest areas of need throughout our
facilities.

III. PROJECT CONDITIONS:
The Project Conditions contained in the Main Energy Services Agreement will be used unless specifically changed herein. The cost effectiveness criteria for this project are per the McKinstry Essention, LLC proposal dated January 24, 2023.
IV. SCOPE OF WORK:
Per the ESCO proposal dated January 24, 2023 conduct a Detailed Investment Grade Energy Audit of City of Moses Lake, City Wide Lighting Conversion to LED, Solar at Civic Center and/or WWTP and Water Conservation, to identify cost effective energy
conservation measures and present a written Energy Services Proposal, including all energy audit documentation. The ESCO shall prepare the final Energy Services Proposal, detailing the actual energy services and ESCO equipment to be provided, energy savings and cost guarantees, measurement and verification plans, and commissioning plans for the proposed measures. Measures will include items that save energy, water and other
resources. The Cost Effectiveness Criteria for this project shall be as established in the Main Energy Services Agreement or as modified in Section III above. V. SCHEDULE FOR COMPLETION
Final completion of the Energy Audit within 120 calendar days after Authorization to Proceed.

This wastewater discharge permit is hereby granted by the City of Moses Lake, Washington, referred to as the City, to Grant County
Fair Grounds referred to as the Permittee. This permit authorizes Permittee to discharge wastewater from the permittee's Facility into
the City's POTW in accordance with the conditions contained within this permit. The permit becomes effective as of the date signed
by the City.
GENERAL CONDITIONS
1. All discharges and activities authorized herein shall be consistent with the terms and conditions of this permit. The discharge
of any pollutant not authorized by this permit shall constitute a violation of the terms and conditions of this permit.
Whenever the Permittee refuses to take corrective action or continues a violation, the imposition of civil penalties or
termination of this permit may result, or both. Termination ofthis permit may require disposal of the wastewater in some
manner other than into the private sewer or to the City's POTW, at the expense of the Permittee.
2. Nothing in this permit shall be construed as excusing the Permittee from complying with any current federal, state, or local
statutes, ordinances, or regulations.
3. All facility changes that may result in a significant deviation in character of pollutants discharged to the POTW, from that
herein specified, shall be reported to the City. Significant adverse deviations in character ofpollutants shall be authorized by
the City before discharge to the sewer system. No significant change shall be made until plans have been approved by the
City, and a new or modified permit has been issued. No new connections, increased flows, or significant changes in
wastewater characteristics are permitted that will cause violation of the effluent limitations specified herein.
The diversion or bypass of any discharge from any pre-treatment facility utilized by the Permittee to maintain compliance
with the terms of this permit is prohibited except where unavoidable to prevent loss of life or severe property damage. The
procedure outlined in paragraph four (4) of these General conditions shall be followed in the event of such a diversion or
bypass to the City's POTW.
4. In the event the Permittee is unable to comply with any of the conditions of this permit because of a breakdown of equipment
or facilities, due to actions on the part of the Permittee, the Permittee shall perform the following actions:
a. Immediately stop, contain, and clean up the unauthorized discharge and correct the problem.
b. Immediately notify the City so steps can be taken to prevent damage to the POTW.
c. Submit a written report within fifteen (15) business days of occurrence, describing the breakdown, the actual
quantity and quality of the resulting waste discharge, corrective action taken, and the steps taken to prevent a
recurrence.
d. Pay reasonable costs incurred by the City that are associated with a breakdown, accident, or other cause that can be
demonstrated as attributable to such event.
Any permit noncompliance constitutes a violation of chapter 13.05 of the Moses Lake Municipal Code and is grounds for
enforcement action in accordance with that code.

5. Compliance with the above requirements does not relieve the Permittee from responsibility to maintain continuous
compliance with the conditions of this permit, or the resulting liability for failure to comply.
6. The Permittee shall adequately maintain and efficiently operate all treatment or control facilities or systems installed or used
by the Permittee to achieve compliance with the terms and conditions ofthis permit.
7. After written notice of one of the following, the Permittee has ten (10) business days from the date of the notice to request a
hearing before the City Council. If the City Council determines a violation has occurred, the permit may be amended,
suspended, or revoked in whole or -in part.
a. Violation of any terms or conditions of this permit.
b. Obtaining this permit by misrepresentation or failure to fully disclose all relevant facts.
c. A change in any condition that requires a permanent reduction or elimination of permanent discharge to the POTW.
8. The Permittee shall allow authorized representatives of the City to perform the following actions, at all reasonable times:
a. Enter that portion of the premises by escort where an effluent source or disposal system is located or where records
are required to be kept under the terms and conditions of this permit.
b. Inspect monitoring equipment or monitoring methods required by this permit.
c. Sample discharge ofpollutants.
d. Review test results and test methods.
9. This permit does not constitute authority for discharge into public waters of Washington State. Any such discharge by the
Permittee shall be subject to applicable regulations administered by the Department of Ecology.
10. The costs incurred by the City in handling, treating, monitoring, and disposing of the Permittee's wastewater shall be borne
by the Permittee in the rate structure. The City may set forth the various fees in a separate ordinance.
11. The Permittee shall make application for permit renewal at least 180 days prior to the expiration date of the permit. In the
event that the City does not respond within the allotted 180 day period, the existing permit shall remain in force until the
revised permit is issued.
12. The Permittee shall submit payment of fees associated with this permit as set forth in the fee schedule adopted by the City of
Moses Lake. The City may revoke this permit if the permit fees are not paid.
Effluent Limits
During the period of this permit, the Permittee is authorized to discharge wastewater to the POTW subject to the specified flow,
concentration, and monitoring requirements. Wastewater shall be monitored and discharged to the POTW and shall not exceed the
maximum daily flow of 80,000 gallons per day. The effluent limitations for the discharge to the POTW are shown in Table 1: Effluent
Limits Outfall 001 (Facility's Sampling Manhole).
Effluent characteristic limits not listed in this permit are set forth in Chapter 13.05, Wastewater Regulations, City of Moses Lake
Municipal Code.
In order to meet the effluent limitations, the Permittee shall provide facilities as specified herein. When required, pretreatment and
storage facilities shall be designed and operated by the Permittee in a manner such that the wastewater discharge to the POTW
complies with the effluent limits. During emergency conditions, or when the effluent does not meet the conditions of this permit, the

Permittee shall divert the flow, collect the wastewater, and re -treat the effluent. If the permit effluent limitations cannot be achieved
by the onsite treatment system, the effluent shall be collected and sent off site for disposal in accordance with applicable regulations.
Beginning on the issuance date and lasting thru the expiration date ofthis permit, the Permittee is authorized to discharge wastewater
to the City of Moses Lake POTW subject to the following limitations:

a. Maximum Daily effluent limit means the highest allowable daily discharge. The daily discharge means the discharge of a
pollutant measured during a calendar day. For pollutants with limits expressed in units of mass, calculate the daily discharge as
the total mass of the pollutant discharged over the day [lbs/day = (concentration mg/1) x (flow gpd / 1,000,000 ) x 8.34] . For color and pH,
the daily discharge is the average measurement of the pollutant over the day. For temperature, no single measurement shall
exceed 104°F.
Monitoring Requirements
The Permittee shall monitor the wastewater and production according to the following schedule in Table 2: Monitoring Requirements Final

SURCHARGE SCHEDULE
If Maximum Daily Effluent Limits for TSS, BODS, or FOG from Table 1 are exceeded during the month, a surcharge will be added to that monthly
billing statement, and the Permittee will provide a proposal for review by the City of Moses Lake Wastewater Manager to demonstrate how the
effluent will be reduced to permitted levels. Failure to reduce the effluent to permitted levels will constitute a violation of this permit. Surcharge rates
are shown in Table 3: Surcharge Schedule.

Reporting and Record Requirements
The Permittee shall monitor and report in accordance with the conditions set forth in this.permit. Falsification of the information submitted to the
City of Moses Lake is a violation of the terms and conditions of this permit.
Monitoring Results required by this permit shall be submitted by email on or before the 15ffi day of the month following the sampling period.

Waste Preventative Practices
Waste preventive practices shall be used to reduce or eliminate contaminant loading to the POTW. These practices may include, but are not
limited to the following:
a. The Permittee shall provide access to the monitoring and flow control station for authorized representatives of the City during normal
business hours and in the event of an emergency.
b. The pretreatment and storage systems shall be maintained continuously in satisfactory and effective condition by the Permittee, and
shall be subject to periodic inspection by the City.
c. The Permittee shall designate a representative whose responsibilities include the operation and maintenance of the pretreatment and
storage facilities, monitoring and permit compliance, and all other aspects of the wastewater discharge. The representative shall be
available to meet with the City on any matter related to the wastewater discharge to the POTW.
d. The Permittee shall be held liable for all damages directly attributable to its wastewater discharge, exclusive of normal wear and tear.
Permittee shall not be jointly and severally liable for the damage caused by any other party, but shall be liable for its pro -ratio share of
all liability directly attributable to Permittee's waste discharge. Liability for damages may include damages to the sewage collection
system, pump stations, sewage treatment plant, and degradation of receiving water.
e. The following requirements shall apply:
In the event that hazardous petroleum or radioactive material reaches the POTW, contact 911 upon discovery. Then immediately
notify the Public Works Division by phone or email.
Reportin! Permit Violations
The Permittee shall take the following actions when either the City permit or the State permit conditions are violated:
a. Immediately stop, contain, and cleanup unauthorized discharges; stop the noncompliance; and
correct the cause of the problem.
b. Contact the City of Moses Lake within 24 -hours by phone or E-mail.

C The City of Moses Lake, a municipal corporation of the State of Washington, or its duly authorized agents or representatives.
Composite Sample: A mixture of grab samples collected at the same sampling point at different times, formed either by continuous sampling or by
mixing discrete samples. The sample may be time -composite (collected at constant time intervals) or flow -proportional (collected either as a constant
volume at time intervals proportional to stream flow); or collected by increasing the volume of each aliquot as the flow increased while maintaining a

Overview
Over the last several years incident response volume has increased substantially within the city limits of Moses
Lake. Incident response volume has increased in all areas and includes fires, rescue responses, emergency
medical response, and hazardous materials / conditions. New development continues to take place, and daily
staffing in the fire department is stretched to the point where concurrent incident responses have negatively
impacted our ability to meet the council adopted performance standards for response time and staffing levels.
The increase in incident responses and the continued development of the city prompted fire department staff to
analyze response priorities and attempt to find alternative means for the city to fund additional staffing to meet
the needs of the city and our growing industrial, commercial, and residential base. One of the alternative means
was to identify grant funding and apply for grant funding. To this end an application was prepared through
Homeland Security and the Assistance to Firefighters grant program to bring our total operations division staffing
from 33 to 42. Staffing at 42 members allows 14 members to be placed on each of our 3 operational shifts and
allows full staffing of an additional medic unit with cross staffing of an engine to better meet the needs of our
residents and property owners. Staffing the additional unit full time satisfies the needs identified through
Washington Survey and Rating Bureau of individual units (fire companies) that respond to more than 2,500
incidents annually. Station 1 currently responds to more than 4,400 incidents annually. The performance
standards adopted by Council resolution are unable to be maintained due to overlapping incidents in the Station
1 area, this has resulted in an increase in delayed responses waiting for a unit to become available to handle
the response. Delayed responses also increase the number of times units assigned to the Station 2 first
response area are pulled out of the Station 2 response area to handle incidents in the Station 1 area. Increased
response time is directly correlated to staffing levels and overlapping incidents. Increased response time for our
units can quite literally be the difference between life and death as a delayed response for cardiac arrests,
respiratory arrests, trauma codes, and trapped victims at structural fires or in vehicle accidents.
On February 9, 2023, the Assistance to Firefighters Grant program management team announced an award in
the amount of $3,317,058.00 for staffing in the Moses Lake Fire Department through the Staffing for Adequate
Fire and Emergency Response, (SAFER), program. Moses Lake has participated in two previous SAFER grant
awards. Unlike the previous awards that required matching funds from the City there is no city match required
for these funds.
The grant is to fund nine positions beyond the 33 operational division positions that we had at the time of the
grant application. We have hired four personnel that have been being funded through the ARPA grant, these
four personnel would be transferred to the SAFER Grant and an additional five personnel would be hired to
bring the operations division staffing to a total of 42 positions. The three-year period of the grant will allow time
to complete the cost of service study for Ambulance and to identify other revenue streams, including tax
revenue from development currently in the plan review stage. Our current level of growth in industrial facilities,
commercial structures, residential structures, increasing population, and significant increases in incident
response clearly identifies a need to implement additional staffing for fire and emergency response. Using the
grant funds as awarded will allow the city to adequately staff in the near term, while allowing an opportunity for
long range planning of fire and emergency services without using general fund or ambulance fund revenue
sources through the term of the grant.
There is a negotiation opener in June of this year to discuss call volume and staffing needs with Local 1258
IAFF. The personnel awarded under this grant will satisfy the criteria of the negotiation opener and we would not
need to re-visit staffing until completion of the current CBA.

Based on the award amount there will be no wages / benefits cost to the city for the three year period of the
grant. The grant authorizes $84,335.00 in wages and $33,734.00 in benefits for each position in year one of the
grant, $87,708.00 in wages and $35,083.00 in benefits for each position in year two of the grant, and
$91,216.00 in wages and $36,486.00 in benefits for each position in year three of the grant.
Initial outlay for equipment, psychological evaluations, pre-employment physicals, uniforms and initial training is
estimated at a total of $42,000.00 if we conduct an in house academy or a total of $87,000.00 if we were to send
the new hires to the State Fire Academy.
We have identified areas in our budget where we can reprioritize some equipment items to accommodate most
of the equipment cost for initial outfitting in our 2023 budget. We have also identified that overall overtime costs
will go down once these positions are filled, and that savings will offset most if not all of the costs for the pre-
employment medical components as well as some of the training costs.
Options and Results
Approving the grant will allow acceptance of the grant in the 30-day window to accept or reject the grant as
required in the grant award letter.
The city must either accept or reject the grant based on the grant requirements listed in the award letter.
The city would need to reject the grant in the amount of $3,317,058.00 in federal funding.
