The budget workshop to discuss the proposed budget with Council is scheduled for Saturday, September 23rd, from 8:00 a.m. to 12:00 p.m. Council's priorities from the May 2023 special meeting are included in the budget guidelines. The annual budget must be formally adopted by City Council after public hearings have been held. The property tax levy must be approved and submitted to the County Assessor no later than November 30th. Final public hearing on the proposed budget must be held no later than the first Monday in December, with final budget adoption occurring no later than December 31st. Staff is recommending that the final budget hearing and adoption of the 2024 budget be held on November 28, 2023. Options and Results N/A Staff will bring back options for recommended changes. COML Council Packet 7-11-23, Page 4 of 41 MEMORANDUM To: Interim City Manager Department Directors Division Managers Administrative Support Staff From: Madeline Prentice, Finance Director Date: June 27, 2023 Re: Fiscal Year 2024 Budget Guidelines The purpose of these instructions is to communicate the process we will be using to develop the FY 2024 budget. We will be considering key strategies, priorities, and objectives with the overall goal of allocating resources to meet the following strategic priorities of the City Council. Vision Moses Lake is a diverse, connected and supportive community of innovation and opportunity that values its namesake lake, small town vibe, growing arts and cultural scene, aerospace, manufacturing and agricultural heritage and an abundance of sunshine and outdoor activities. Mission Provide a service-oriented government that works with all interests in the community to implement our Vision. In May 2023, the Council met to establish priorities for the City which are: • Manage and Encourage City Growth o Streamline City permitting processes o Market opportunities to address housing needs and ability to increase supply o Utilize manufacturing presence to leverage investment o Add and revitalize infrastructure (water, sewer, transportation) o Beautify corridors, add amenities (shopping, activities) • Crime Reduction o Emphasize programs that can steer youth positively o Address drug and transient issues o Collaborate on gang/drug initiatives o Augment graffiti abatement efforts • Collaboration o Align interests with County, Port, Economic Development Committee (EDC), Big Bend Community College (BBCC), Watershed Council, etc.  Be responsive to the public, customers and agencies - hire with customer service in mind COML Council Packet 7-11-23, Page 5 of 41 • Preserve Lake Health and Access o Add infrastructure that can help the lake (sewer, stormwater) o Support the efforts of the Watershed Council o Address EPA Superfund Site • City Sustainability o Financial Stability • Address Aquifer Issue o Water communication plan and staff work plan • Communication o Increase visibility in the community The following key principles will be observed as we prepare the City’s 2024 budget: • The City must adopt a balanced budget that is fiscally prudent and sustainable. This may require departments to change the method of service delivery, change current service levels, or discontinue certain services to live within available resources. • Department goals should align with City Council’s priorities. • Departments should identify budgetary outcomes that advance the City’s priorities. • Identify key performance measures that can be used to evaluate the effectiveness and efficiencies of meeting the priorities. • Identify capital investments for projects, facilities and equipment that will optimize city infrastructure, services, and operational efficiencies. Include maintenance and operating costs in your capital requests. • For costs related to staffing, the preliminary budget will incorporate increases related to contractual obligations negotiated for our represented employees and non-represented will be based on the step program developed in 2019. Finance will perform these calculations. • New or reclassified positions will be considered if the need can be justified to impact one of the City’s goals. • Unrestricted reserve funds shall only be used for one-time capital costs. Ongoing maintenance and operating expenses will be reviewed on a line-item basis to ensure need. • Training costs should be based on specific training needs identified in each department’s plan. Training is encouraged to enhance employee expertise and performance but needs to be justified as part of the business case. • The “base” overtime budget should be estimated as though the operation is fully staffed. Overtime caused by vacancies should be covered by related salary savings. • If there are significant programs and operational changes needed, a policy proposal should be written to meet City priorities. Significant operation program changes include: o Major service reductions or expansions; o Any increase or decrease in staffing levels; o Significant one-time costs, including all capital improvements; o Significant ongoing cost increase to maintain existing services or changes in the method of service delivery; o Changes in operations that will significantly affect customer service – either external or internal to the organization; and COML Council Packet 7-11-23, Page 6 of 41 o Proposed fee increases or new revenue sources. Any proposal for additional budget authority for staff or programs should come with proposed revenues to cover the additional costs or proposed expenditure reductions in other areas. Sales tax is strong in the first half of 2023, fueled by major construction projects. Since much of the increase is tied to “one-time” projects, we will strive to use these balances for capital projects in 2024. In past years, as budgets allowed, we have increased contributions to capital reserves for replacement in the Fleet Maintenance and Building Maintenance Funds and made additional contributions to Central Services for Information Technology hardware and software replacement. We will continue to evaluate capital replacement needs as we work through the 2024 budget. Finance will be submitting more detailed instructions for budget development under separate cover. COML Council Packet 7-11-23, Page 9 of 41 MOSES LAKE CITY COUNCIL June 27, 2023 EXECUTIVE SESSION Mayor Myers called an Executive Session at 6:10 p.m. for 20 minutes to evaluate qualifications of applicants, and to discuss litigation pursuant to RCW 42.30.110(1) subsection (g) and (i). Mayor Myers extended the session for 3 minutes. CALL TO ORDER The regular meeting of the Moses Lake City Council was called to order at 6:34 p.m. by Mayor Myers in the Council Chambers of the Civic Center with audio remote access. Special notice for remote attendance and citizen comment were posted on the meeting agenda. ROLL CALL Present: Mayor Myers; Deputy Mayor Martinez; Council Members Eck, Fancher, Madewell, Swartz, and Skaug. PLEDGE OF ALLEGIANCE Mayor Myers led the Flag Salute. AGENDA APPROVAL Action taken: Deputy Mayor Martinez moved to approve the Agenda as presented, second by Council Member Swartz. The motion carried 7 – 0. PRESENTATION Airport Commission Quarterly Report Municipal Airport Commission Chair Rod Richeson advised they are receiving building permits for airport lots, they have scheduled a pre-application meeting with staff for the fuel pump system, and that they are working on road and weed issues. CITIZEN’S COMMUNICATION Water Conservation Andrew Koeppen, Moses Lake, distributed a handout about the average water usage for the top 30 users in the City and discussed the comparison to national averages. Various Topics Elisia Dalluge, Moses Lake, asked whether Council was receiving her emails, asked Council to look into the firing of a HopeSource employee, and commended Council on the water rate tiers. SUMMARY REPORTS MAYOR’S REPORT National Society Daughters of the American Revolution (NSDAR) Certificate A letter and Certificate of Award was received from NSDAR for the proper use and correct displays of our US Flags. These items were sent by Chair Cindy Johnson-Sakuma following their attendance on May 23rd during the Mayor’s award to honor local resident Miyo Koba. Citizen Comment Rules Mayor Myers requested to amend Council Rules for Citizen Comments as follows: require speaker requests be submitted by 3 pm on the day of a meeting, limiting the number of speakers to ten per meeting (excluding Public Hearings), and limiting speaking time to three minutes per speaker. Action taken: Council Member Swartz moved to modify the Citizen Comment Rules to require submission of requests prior to Citizen Comment period, and to have a limit of 5 minutes per person that will be reduced to allow a maximum period of 30 minutes for citizen comments, second by Council Member Fancher. The motion carried 7 – 0. Mayor’s Absence Mayor Myers will be absent for the July 11 meeting and confirmed that Deputy Mayor Martinez will be in person to facilitate the agenda. CITY MANAGER’S REPORT Budget Workshop Staff will docket a Budget Workshop for Council on September 23 from 8 am to 12 pm. Public Works Projects A list showing status on several water, wastewater, stormwater, landscaping, and transportation projects was distributed to Council prior to the meeting. Shopping Cart Theft Update Community Development staff will reach out to the company that picks up carts and request they increase the frequency and locations of their services. Northshore Lift Station Project Noise Exception The contractor for the Northshore Lift Station Project has requested temporary approval to operate a sound attenuated generator between the hours of 10 pm and 7 am in a residential area for four to five days during the last week in June, or the first or second week in July. Action taken: Council Member Swartz moved to approve the noise exception as presented, second by Council Member Skaug. The motion carried 7 – 0. CONSENT AGENDA #1 a. OLD BUSINESS #2 Water Conservation Code/Fee Update Ordinance 3029, Resolution 3941 Staff updated the proposed regulations to reflect changes Council requested on June 13. Council asked staff to make additional attempts of contact when sending letters regarding leak detection. Action taken: Council Member Swartz moved to adopt Ordinance 3029, second by Deputy Mayor Martinez. The motion carried 4 – 3. Council Members Eck, Skaug and Madewell were opposed. Action taken: Deputy Mayor Martinez moved to adopt Resolution 3941 as presented, second by Council Member Swartz. The motion carried 7 – 0. #3 Shoreline Management Program Ordinance 3030 The first presentation of the periodic update occurred with Council on June 13. Staff included a description of state regulated and local option changes in the meeting packet. Action taken: Council Member Fancher moved to adopt Ordinance 3030 as presented, second by Council Member Swartz. The motion carried 7 – 0. NEW BUSINESS #4 Municipal Airport Lease Insurance Requirements #5 Municipal Airport Commission Membership Action taken: Council Member Eck moved to postpone agenda items 4 and 5 until the airport appraisal is complete, second by Council Member Swartz. The motion carried 7 – 0. #6 Development Code Update Staff provided a history of work being performed since 2021 to update the Development Code. The next step will be to have the Planning Commission approve a Public Participation Plan on July 13, followed by approval of the Plan by the Council on July 25. Council requested a public study session be scheduled with Planning Commission. Interim City Manager Kevin Fuhr will docket for Council within the next few months. Red, White and Boom! Event The City is hosting the Red, White, and Boom! Event on Saturday, July 1, with events taking place at both McCosh Park and Sinkiuse Square. Summer Concert Series premier will begin at 8:30 p.m. featuring Journey tribute band, Stone in Love. The following were reported after Council Communication and Reports: Association of Grant County Cities and Towns (AGCCT) The next meeting for AGCCT will be this Thursday in George. Council needs to contact Deputy Clerk Jen Schober for RSVP of meal and posted notice of quorum. Twelve Groundbreaking All Council are invited to attend the groundbreaking for the new jet fuel company on July 11 from 10:30 am to 12:00 pm. AWC Conference Assistant City Manager Rich Huebner attended the AWC Conference in Spokane. Mayor Carl Florea from Leavenworth is the new District 3 representative, which includes Grant County. COUNCIL COMMUNICATIONS AND REPORTS Council Member Fancher attended the Grant County Economic Development Committee meeting. They are working on future budget requests. Council Member Eck shared there was an increased attendance and traffic issues at the Port of Moses Lake’s Father’s Day weekend airshow, and status quo for Boeing employees and plane storage. Deputy Mayor Martinez discussed the Grant County Board of Health’s procedures on denying food vendor permits. She thanked Police and Code Enforcement staff for the RV clean up. Mayor Myers attended a leadership roundtable with Community Development Director Kirsten Peterson that was hosted by the Chamber of Commerce. He also attended the Washington State Department of Transportation (WSDOT) Presentation Design Training: Explore current transportation opportunities to plan, design, and build walkable, accessible communities featuring Ian Lockwood as the speaker that was hosted by the City. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council. RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body had adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City's internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews it processes to ensure appropriate internal controls are in place. GC2022-067 Westshore Biofilter Final Pay Estimate Signed.pdf 1.34MB City staff identified a severe manhole corrosion issue as well as an odor issue at MH 30-014 on Westshore Drive. The goals of this project were twofold: The first was to clean, grout, and rehabilitate the manhole with a corrosive resistant liner, and the second goal was to reduce the wastewater odor in the area. This is a deep manhole, so correcting the existing corrosion and installing the liner to prevent future corrosion was important to prevent the high cost of manhole replacement. City staff also place a high priority on reducing wastewater odor in the area for the general benefit of the neighborhood. There are ongoing efforts by city staff to optimize the odor removal efficiency of the system. City council awarded the project to the contractor on January 10, 2023, for the amount of $263,466.20. The final amount paid to the contractor was $261,527.14. The contractor's work is now complete and ready to be accepted. All punch list items are complete and relevant city departments have inspected the contractor's work in their areas of responsibility. Upon acceptance, the City will enter into the 60-day lien period as required by Washington State Law. Washington state provides several methods in which land can be annexed into the City’s corporate limits. The most common method is the 60% Annexation Petition Method, and this is the method that is being used. The first step in this method is for the applicant to submit a request which is formally called a “Notice of Intent to Commence Annexation Proceedings” (Notice of Intent.) This Notice of Intent must contain the signatures of at least ten (10%) percent of the property owners within the proposed annexation area by assessed valuation. The applicant has met this requirement. The next step is to present the Notice of Intent to City Council for review during a public meeting. Council will NOT decide on whether or not to approve the actual annexation during this initial review. Instead, the Council will determine if the City will consider evaluating the proposed land area for annexation. Should the Council agree to review the proposal for annexation, Council must make a decision on the following three items at this time: 1. Whether the city will accept, reject, or geographically modify the proposed annexation. At this point, Council can decide if it is satisfied with the proposed boundary, or if it should be expanded to include additional land or decreased to eliminate some parcels. If Council wishes to increase the land area, it should inform the applicant of the desired logical boundary and that they may need to collect additional signatures to meet the required assessed valuation percentage. 2. Whether it will require the simultaneous adoption of a proposed zoning regulation, if such aCOML Council Packet 7-11-23, Page 27 of 41 proposal has been prepared and filed (as provided for in RCW 35A.14.330 and 35A.14.340). The proponent has not proposed a change to the zoning classification. In this case, the zone will default to the zone that implements land use classification in the City’s Comprehensive Plan which is Medium Density Residential. 3. Whether the City will require the assumption of all or any portion of existing city indebtedness by the area to be annexed. Typically, the City requires the proposed area to be taxed at the same rate as the rest of the City upon annexation. Some of the issues a city should examine in reaching a decision on this question are: • Was the outstanding indebtedness incurred to finance an improvement or facility that will benefit the newly annexed area? • Will assumption of a proportionate share of the city’s outstanding indebtedness place an excessive financial burden on annexed property in light of other indebtedness previously placed on the property through the county or special districts, which will remain on the property after annexation? • Will the property to be annexed be forming an expensive LID for special improvements, such that requiring assumption of the outstanding indebtedness would not be equitable? • To what extent does the annexing city desire to encourage (or subsidize) the annexation? Should Council choose to move forward with this analysis, Staff will conduct the necessary research to determine if there is any indebtedness. Intent to Annex A Notice of Intent to Commence Annexation Proceedings petition was submitted on May 17, 2023 (Exhibit B), with the signature from Drew Scott, who at the time was in the process of purchasing Parcel Number 170485000. The petition was also signed by Tom Cordell (owner). The petition includes additional signatures representing sixty percent (60%) of the assessed value in the proposed annexation area. Since the property is within the City’s Urban Growth Boundary, it is eligible for annexation. As proposed, there are 19 properties within the annexation area which combined, contain 83.5 acres. The total valuation of the 19 properties is $4,743,280. The valuation of the properties of the signatories of the Notice of Intent is $2,870,235 (over ½ of the total value). The signatories own three parcels (170185000, 170403000, 170478062). The proposed annexaon includes one parcel 170485000 which is located east of Straord Rd., west of Wenatchee Rd., north of Sage Dale Rd and South of Maple Dr. The proposed annexaon includes an addional 18 parcels between Straord Rd. and Longview Elementary School, south of Maple Dr. and north of the railroad tracks. Straord Rd is included in the proposed annexaon. The annexaon does not include Wenatchee Rd., Sage Dale Rd., or Maple Dr. Proposed Zoning The City of Moses Lake Comprehensive Plan (Comp Plan) Land Use designation for the property east of Stratford Rd. is Medium Density-Residential. According to the Comp Plan, the “principal land uses in areas designated as Medium Density-Residential should consist of a mixture of single-family residential uses and a variety of “missing middle” housing types, such as duplexes, triplexes, and townhomes. Residential densities should range from 6-10 units per acre, and development regulations should include optional density bonuses and lot size flexibility to encourage housing variety.” This designation is implemented by the R2- Single Family and Two- Family Residential Zone. To be consistent with the Comp Plan, the zoning of the property east of Stratford Rd should be designated as R2, Single-family and Two Family. (Exhibit C) The proposed annexation area west of Stratford Rd is designated in the Comp Plan as General Commercial. The Comp Plan lists the principal uses in this designation as: The general commercial category includes retail, wholesale, business, and office land uses. Within this category are professional offices, hotels, motels, restaurants, recreational and entertainment uses; grocery stores, hardware supply, garden supply, repair, and maintenance services. Other uses include residential uses not to conflict with commercial floor space, accessory uses, automobile-related uses, manufactured home sales, and uses that normally require outdoor storage and display of goods. Mixed-use commercial development may be appropriate in locations near established residential neighborhoods; mixed commercial/office development may be appropriate on larger, campus-sized properties suitable for business parks and larger employment centers. The implementing zoning for this area of the proposed annexation is C-2 General Commercial. Annexation Boundary Pursuant to RCW 35A 14 120 and within this proceeding the City Council may COML Council Packet 7-11-23, Page 28 of 41 Fiscal and Policy Implications Approve, Authorize, or Adopt: Provide Amended Direction: No Action Taken: Annexation Boundary Pursuant to RCW 35A.14.120 and within this proceeding, the City Council may geographically modify the proposed annexation. Upon review of the applicant’s proposed annexation, the Community Development Department analyzed the region for consistency with a “logical annexation boundary,” and makes no recommendation to modify the proposed annexation boundary. Pursuant to the petition process of annexation, the valuation to apply must fall within specific criteria. As shown within the valuation table below, a total valuation of $4,743.280 is estimated based on Grant County Assessor’s records for the total proposed area. Of the proposed area, the three parcels belonging to the applicants have an estimated valuation of $2,870,235, which is 61% of the valuation of the proposed area for annexation. The estimated assessed value of the property of the non-participants is $1,873,045. Following this ten percent annexation meeting, a petition will be circulated. If the applicant returns a sufficient petition and it is certified by the Grant County Assessor, a date will be scheduled for the sixty percent City Council Public Hearing. In addition, the potential annexation boundary will be evaluated by service providers and comments gained to provide guidance for proceeding with annexation. This will require appropriate time in which, a census will be taken within the annex boundary and public notice of annexation. Following the gathering of both service providers and citizen comments, and pursuant to MLMC 20.03.060, the Planning Commission shall hold a public hearing and make recommendations to the City Council on the annexation. If the legislative body requires the adoption of a proposed zoning regulation and/or the assumption of all or any portion of indebtedness as conditions to annexation, it is to record this action in its minutes. Council acceptance is a condition precedent to circulation of the petition. There is no appeal from the council decision. In summary, if the Council agrees to consider the annexation, this does not commit the City to initiating the public review process, nor does it guaranteed that the City Council will approve a future annexation petition based on initiating the review. If the City Council agrees to move forward with considering the annexation, staff will review and explore feasibility, level of service, and fiscal implications of accepting the annexation, zoning, and ultimate development impacts. All appropriate agencies and city department shall be consulted as part of the review, pending City Council deliberation. Staff will need to complete analysis on costs of providing city services to the area.
