We will be considering key strategies, priorities, and objectives with the overall goal of allocating resources to meet the following strategic priorities of the City Council. In 2021, the City adopted a new vision and mission to guide the work of the City: Vision Moses Lake is a diverse, connected and supportive community of innovation and opportunity that values its namesake lake, small town vibe, growing arts and cultural scene, aerospace, manufacturing and agricultural heritage and an abundance of sunshine and outdoor activities. Mission Provide a service-oriented government that works with all interests in the community to implement our Vision. In addition, in February 2022, the newly seated Council met to establish priorities for the City which are: • Manage and Encourage City Growth o Streamline City permitting processes o Identify housing needs and ability to increase supply (marketing opportunities) o Benefit from manufacturing identity o Add and revitalize infrastructure (water, sewer, transportation) o Beautify corridors, add amenities (shopping, retail, activities) • Crime Reduction o Emphasis on programs that can steer youth positively (STEM/STEAM programs) o Collaborate on gang/drug initiatives o Augment graffiti abatement efforts • Collaboration o Align interests with County, Port, EDC, BBCC, Watershed Council and receive regular reports o Be responsive to the public, customers, agencies  Hire with customer service in mind, augment bilingual staff Moses Lake Council Packet 7-26-22, Page 4 of 84 • Lake Health o Shoreline master program update underway o Augment City infrastructure that can influence lake health (sewer infrastructure, stormwater diversion) o Participate in Watershed Council • City Sustainability o Staffing – evaluate staffing to support the needs of the City o Ensure a strong financial backbone The following key principles will be observed as we prepare the City’s 2023 budget: • The City must adopt a balanced budget that is fiscally prudent and sustainable. This may require departments to change the method of service delivery, change current service levels, or discontinue certain services to live within available resources. • Department goals should align with City Council’s five priorities established by Council. • Departments should identify budgetary outcomes that advance the City’s priorities. • Identify key performance measures that can be used to evaluate the effectiveness and efficiencies of meeting the priorities. • Identify capital investments for projects, facilities and equipment that will optimize city infrastructure, services, and operational efficiencies. Include maintenance and operating costs in your capital requests. • For costs related to staffing, the preliminary budget will incorporate increases related to contractual obligations negotiated for our represented employees and non-represented will be based on the step program developed in 2019. Finance will perform these calculations. • New or reclassified positions will be considered if the need can be justified in order to impact one of the City’s goals. • Unrestricted reserve funds shall only be used for one-time capital costs. Ongoing maintenance and operating expenses will be reviewed on a line item basis to ensure need. Inflation is running at an annual rate of about 10%, fueled by continued supply line shortages/disruptions and increased fuel prices and then there will be a necessity for conduct of business. • Training costs should be based on specific training needs identified in each department’s plan. Training is encouraged to enhance employee expertise and performance, but needs to be justified as part of the business case. • The “base” overtime budget should be estimated as though the operation is fully staffed. Overtime caused by vacancies should be covered by related salary savings. • If there are significant programs and operational changes needed, a policy proposal should be written to meet City priorities. Significant operation program changes include: o Major service reductions or expansions; o Any increase or decrease in staffing levels; o Significant one-time costs, including all capital improvements; o Significant ongoing cost increase to maintain existing services or changes in the method of service delivery; Moses Lake Council Packet 7-26-22, Page 5 of 84 o Changes in operations that will significantly affect customer service – either external or internal to the organization; and o Proposed fee increases or new revenue sources. Any proposal for additional budget authority for staff or programs should come with proposed revenues to cover the additional costs or proposed expenditure reductions in other areas. Sales tax is coming in strong in the first half of 2022, fueled by major construction projects and increasing online purchases. Since much of the increase is tied to “one-time” projects, we will strive to use these balances for capital projects in 2023. In the past several years, as budgets allowed, we have increased contributions to capital reserves for replacement in the Fleet Maintenance and Building Maintenance Funds and made additional contributions to Central Services for Information Technology hardware and software replacement. This practice has allowed us to do some “catch up” on those purchases and has built the replacement reserves although these levels remain below true replacement cycle requirements. We will continue to evaluate capital replacement needs as we work through the 2023 budget. Finance will be submitting more detailed instructions for budget development under separate cover. The RCW Budget calendar and estimated target dates to meet state law requirements is attached to this document. Moses Lake Council Packet 7-26-22, Page 8 of 84 CHALLENGES WITH GCAO Staffing: • Hourly wages out of pace with other employers • Constant rotation of staff • Compassion fatigue Our shelter needs 225 hours per week of staff time to complete cleaning, feeding, meeting with potential adopters, scheduling spay/neuter appointments, transporting animals to vet, caring for sick animals, completing paperwork, advertising adoptable pets, etc. The facility is open to the public Monday through Wednesday from 12:00-5:00 p.m. and Thursday through Saturday from 12:00-6:00 p.m. Though closed to the public on Sunday, we need 8 hours of staff time to clean kennels and feed our animals. As you can see in the chart below, we cannot hit the 450 hours per bi-weekly payroll in order to complete all of the tasks necessary to operate the shelter due to turnover. In lieu of paid staff, members of the Board of Directors are taking on responsibilities in addition to director duties. This expectation is not sustainable and is reflected in the fact that only two Board members have served more than one year. We also have volunteers occasionally, but often lose them because the conditions at the facility are so dreadful. Payroll This chart is our bi-weekly payroll and number of hours of paid work. It does not include volunteer hours. Building Issues: Functional Limitations We are one of two brick and mortars in our county and the only open door shelter in Grant County. The Board has made a number of investments to the building. However, the following issues exceed our current resources: • No AC in dog runs due to significant electrical issues • Electrical deemed unsafe by two electricians both of whom refused the work • Shingles coming off of the roof • Stench due to lack of ventilation • Damage due to rat infestation • Not enough kennels for dogs Moses Lake Council Packet 7-26-22, Page 9 of 84 Number of Dogs brought to the Shelter by the City and County. *These numbers do not include owner surrenders or animals we find abandoned on our property. A common occurrence is finding an abandoned litter of puppies and/or kittens at the gate when staff arrive in the morning. Lack of Resources: • City, county, & public bring us more animals than we have capacity to serve • The City and the County need to provide the monetary resources for GCAO to pay competitive wages, retain an adequate staff, and find/build an adequate facility to humanely house the number of animals being entrusted to our care The Way Forward: The City and the County need to provide for the true costs of services. Do a presentation for Rotary to ask for funding for the design of a new building. GCAO needs a new building that can: • Provide shelter for 80 dogs, keep our current capacity for cats, and provide space for adequate exercise • This will require additional staff to support • Is built to serve as an animal shelter o Drainage o Indoor/outdoor kennels o Isolation area for dogs who are sick/contagious/injured o Isolation area for cats who are sick/contagious/injured o Space for animals to exercise & play & be trained o Has a true cat room that provides stimulus Other Options • Dissolve GCAO and promote a city/county run shelter. YR 2022 Jan Feb March April May June Total County 15 7 25 23 10 14 80 City 21 28 37 38 17 26 167 36 35 62 61 27 40 247 Moses Lake Council Packet 7-26-22, Page 10 of 84 June 26, 2022 To: Grant County Commissioners, Danny Stone, Cindy Carter, and Rob Jones; Moses Lake City Manager, Allison Williams; and Moses Lake Chief of Police, Kevin Fuhr My name is Sara Thompson Tweedy and I am writing to you in my role as the president of the Grant County Animal Outreach, which is the only animal shelter in Grant County. The shelter takes in stray, neglected, seized, and abused animals from every city and town in our county. I have served on the Board for one year. During that time, I have assessed the situation at GCAO and have concluded that GCAO cannot continue on its current trajectory without significant investment from our partners. We are facing a dire situation at the shelter. Our facility is dilapidated and is consistently over capacity with dogs and cats which leads to substandard conditions. We have staffing challenges due to the low wages we offer our kennel attendants because our budget won’t allow for higher wages. We need more support from the two primary public entities to whom we provide services. Attached you will find a detailed description of those challenges. On behalf of the Board of GCAO Directors, I am requesting: 1. An increase in the amount of our annual contract to $100,000. This would require an annual increase on the part of the City by $40,000 and the county by $58,000. 2. Support for a new building. The contractual increase will allow us to hire additional kennel attendants as well as increase wages so our staff can afford to stay with us longer term. Many of our staff are devoted to animal welfare but are lured away to work in jobs that pay higher hourly wages. We also need to increase the salary of our Executive Director so we can attract and retain a qualified person. We need to be able to pay in the $60,000-$70,000 range for this position. The building in which GCAO is housed is dilapidated beyond repair. The functional limitations that we face on a daily basis make our work even more challenging than it already is. GCAO is willing to launch a fundraising campaign for a new building, but we want the support of the City and the County Commissioners. This support can be in the form of donated land or a significant monetary investment to help us in this effort. We will be launching a fundraising effort for a new building and would like to make a public announcement that includes concrete support from the Commissioners and the City. The unfortunate reality is that without these investments, GCAO is near the point of dissolution. The City and the County are depending upon a small dedicated group of individuals to provide services that far exceed our current capacity. In our assessment, we must work together to address these challenges because one entity alone cannot overcome the challenges associated with the years of neglect of the facility. The staff and the animals in their care deserve humane conditions and the public would support an investment of their taxpayer dollars towards this effort. Two members of the public testified during the public hearing in opposition to the annexation. In addition, and due to the results of the public outreach and input which resulted in a less than 60% valuation in the affirmative, the Planning Commission recommends a reduction in the area for the annexation boundary. After receipt of public testimony, the Planning Commission unanimously voted in favor of the requested annexation with a modification of the “Alternative Proposed Maple Landing Annexation” to specifically exclude the properties with ETA’s and to recommend simultaneous adoption of R-2 Single-Family and Two (2) Family Residential zoning. Please refer to the first exhibit of this report, which is a map depicting the reduced annexation area recommended to City Council by the Planning Commission and supported by Staff. Grape Drive SUMMARY: A notice of intent to commence annexation has been received by the Community Development Department to consider annexation of parcel 170478005 (Exhibit 1). The property consists of 4.87 acres and is located at 4762 Grape Dr NE, to the south of Rd. 4.8 NE and west of Grape Dr. City Council held an initial meeting on May 24, 2022, to determine the following: 1. Whether the City will accept, reject, or geographically modify the proposed annexation. 2. Whether the City shall require the simultaneous adoption of the zoning designations for the parcels proposed to be annexed. 3. Whether the City shall require the assumption of all, or part of, existing City indebtedness by the area, if annexed. At the conclusion of the meeting Council unanimously decided to: 2) require the simultaneous adoption of R3-Multi-Family Residential, and 3) require the assumption of existing City indebtedness by the area. Regarding the first item, Council held further discussion on increasing the geographic boundaries of the annexation based on a recommendation from staff. At the conclusion of the meeting, Council modified the proposed annexation area to include additional properties in the vicinity. It should be noted that after the boundary is set by City Council during the initial meeting, the boundary cannot be increased in subsequent meetings, but it can be reduced in size. Council also directed staff to contact each of the affected property owners to determine if the city could obtain enough signatures to constitute the 60% valuation required for annexation. Pursuant to the Moses Lake Municipal Code 20.03.060 Legislative Decisions, subsection B. Planning Commission, “the Planning Commission shall hold a public hearing and make Moses Lake Council Packet 7-26-22, Page 16 of 84 Planning Commission 7/14/2022 – Public Hearing: Petition to Annex – Maple Landing North Page 2 of 2 recommendations to the City Council on the decisions listed in (A) above”, which refers to #5. Annexations. Following the Planning Commission’s recommendation, Council will hold a public hearing to formally consider and act upon the proposed annexation. A decision to approve the annexation is implemented by ordinance, which may be given first reading at the conclusion of the Council’s public hearing. Additionally, a petition for annexation will be filed with the Grant County Assessor to determine sufficiency in regard to legal description and corresponding owner(s) of record. ANALYSIS: The original parcel for which the annexation petition was received is depicted on a map that is attached to this report as Exhibit 2. The parcel is bounded by City limits to the south and west and thus it is deemed contiguous to the City limits. The geographic boundary approved for consideration by City Council is attached to this report as Exhibit 3. The rationale for considering the increased boundaries is due to the fact that four properties in the vicinity have Extra Territorial Agreements,1 three have covenants, and a City sewer main is currently located in Space Street and is already serving various properties. City Staff sent out a notification to all of the properties located within the vicinity regarding the potential for annexation. Staff also went door to door to discuss the annexation process and to obtain additional signatures on the petition. Not enough signatures were obtained to include the entire geographic boundary approved for consideration by City Council. As such, Staff would recommend consideration of a different boundary attached as Exhibit 4. Recitals: 1. On May 19, 2022, the City of Moses Lake, Washington received a notice of intention to commence annexation proceedings pursuant to the “direct petition” method of RCW 35A.14.120 for parcel 10876; as more fully described in Section 1 of this Ordinance and depicted in Exhibit A, attached hereto. 2. The City of Moses Lake agreed to participate in the improvements, filling in the gaps for uncovenanted property on Westshore Drive and the completion of the West side of Hansen Road. Two ordinances were prepared to for reimbursements to the City. #3 Police Department Imprest Account Resolution 3905 The Police Department receives periodic donations that are directed for a specific purpose and intended to address an immediate need. In order to properly account for and report these activities, the Finance Department would like to establish a separate checking account (revolving/imprest fund) with an authorized balance of $2,000 for the Police Department to collect and disburse the donated funds. Action taken: Council Member Swartz moved to adopt Resolution 3905 as presented, second by Council Member Eck. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council. RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. Through this program, the city acquired several sculptures that are at facilities and parks. These sculptures are in need of major repair and others need to be maintained. This ordinance will allow for us to maintain the current sculptures, expand the public art program and promote public art. The proposed Public Arts Ordinance will establish the Moses Lake Arts Commi ee and establish a Public Art Program. It will provide for the procedures and requirements of administering the Public Art Program and create and establish a Public Art Fund using 1% of the money budgeted for City capital projects. Money from federal or state grants will not be considered in the calcula on of the 1% for the Public Art Fund. The Moses Lake Arts Commi ee will report to the Parks, Recrea on, & Cultural Services Advisory Board, which in turn makes recommenda ons to the City Council. Money from the Public Art Fund may be used to upkeep and maintain public art owned by the City, purchase public art to be displayed on City property, and promote pubic art within the City of Moses Lake. Through your support of this ordinance, the aesthetic nature and charm of the City is enhanced by the arts, the citizens of the City shall hold and enjoy works of art, promote, and encourage public art programs and further the development of and public awareness of the visual and performing arts. Moses Lake Council Packet 7-26-22, Page 80 of 84 ORDINANCE 3009 AN ORDINANCE ESTABLISHING THE MOSES LAKE ARTS COMMITTEE; PROVIDING FOR ITS ORGANIZATION, DUTIES, AND FUNCTIONS; ESTABLISHING A PUBLIC ART PROGRAM; PROVIDING FOR THE PROCEDURES AND REQUIREMENTS FOR ADMINISTERING THE PUBLIC ART PROGRAM; AND CREATING AND ESTABLISHING A PUBLIC ART FUND. WHEREAS, the artists and artistic institutions of Moses Lake contribute to and provide cultural, educational, entertainment, and recreational benefits available to and used by the citizens of the Moses Lake and thereby enhance the public environment and welfare; and, WHEREAS, the aesthetic nature and charm of the City of Moses Lake is enhanced by the arts, the citizens of the City of Moses Lake shall hold and enjoy works of art, promote, and encourage public art programs and further the development of and public awareness of the visual and performing arts; and, WHEREAS, the establishment of a means whereby the Moses Lake Arts Committee shall maintain an orderly acquisition of art by the City of Moses Lake as well as be able to support public art programs in the visual and performing arts. THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION 1. Purpose. Pursuant to Moses Lake Municipal Code (MLMC) Chapter 2.08, there is established a Moses Lake Arts Committee to promote and encourage public programs to further the development and public awareness of and interest in the visual and performing arts and to act in an advisory capacity to the Parks, Recreation, & Cultural Services Advisory Board in connection with the artistic and cultural development of the city. The Moses Lake Arts Committee is charged to: A. Promote and encourage public programs to further the development and public awareness of, and interest in, the visual and performing arts and the cultural heritage of the area; and B. Advise the City of Moses Lake in connection with the artistic and cultural development of the Moses Lake area; and C. Provide local artistic and cultural services to citizens of the Moses Lake area by making available to the city and its citizens expertise on the subject of visual and performing arts and cultural heritage; and D. Encourage donations, apply for, and pursue grants or other support to further expand artistic, cultural programs, and services for the citizens of the Moses Lake area; and E. Work with the governments, institutions, and citizens of the City of Moses Lake and neighboring communities in connection with the above stated purposes. Moses Lake Council Packet 7-26-22, Page 81 of 84 SECTION 2. Establishment, Membership, and Duties of the Arts Committee A. The Moses Lake Arts Committee shall consist of five members, recommended by Parks, Recreation, & Cultural Services staff and approved by Parks, Recreation, & Cultural Services Advisory Board. Each member shall serve for a term of three years with a limit of two consecutive terms. Vacancies shall be filled for the unexpired term in the same manner as original appointments. B. The Moses Lake Arts Committee shall organize, adopt administrative rules and procedures necessary to accomplish its purposes, and elect from its members a chairperson and secretary. C. The Moses Lake Arts Committee shall have the following duties and powers: 1. To hold quarterly public meetings and keep written record of its proceedings which shall be of public record; 2. To initiate, sponsor, or conduct, alone or in connection with other public or private agencies, public programs to further the development and public awareness of and interest in the visual and performing arts; 3. To advise and assist the city in connection with such artistic activities as may be referred to it by the city. D. Professional staff assistance shall be assigned and provided by the City of Moses Lake Museum & Art Center with additional assistance and information to be provided by department staff as may be necessary to aid the Moses Lake Arts Committee in carrying out its duties and responsibilities under this ordinance. SECTION 3. The committee shall operate pursuant to and comply with the requirements set forth in MLMC Chapter 2.08, as now enacted or hereafter amended. SECTION 4. Other The committee may advise with owners of private property in relation to the beautification of such property. Anyone contemplating the erection of any building, or the making of any improvement thereon may submit the plans and designs or sketches thereof to the Moses Lake Arts Committee for advice and suggestions for which no charge shall be made by the committee. The Moses Lake Arts Committee may also become involved in an advisory capacity, with the City Council’s permission, with any beautification projects the City of Moses Lake undertakes or with the construction of public structures to be able to plan for art placement or incorporation in the building design phase. SECTION 5. Public Art Program There is hereby established a Public Art Program requiring that one-percent (1%) of monies appropriated for any capital project, as defined herein, by any and all city departments, shall be placed into the Public Art Fund and used for the acquisition of public art, the upkeep of public art owned by the city, the replacement of public art at the end of its useful life, or the promotion of art programming. Scope of Art Programs The City of Moses Lake Art Committee shall establish by policy definitions that will define what types of art shall be purchased, what types of artists shall be eligible for contracts, and defining the roles of others involved in either the purchase of art or the promotion of art programming. The City of Moses Lake Arts Committee will also develop policy guidelines for the expenditure of the 1% for the Arts funds, which will be presented to the Parks, Recreation, & Cultural Services Advisory Board for recommendation to City of Moses Lake City Council for approval. SECTION 7. Public Art Fund There is hereby established a fund called “Public Art Fund” into which all monies required by this Ordinance shall be deposited and from which the Moses Lake Arts Committee shall create an annual budget to present to the Parks, Recreation, & Cultural Services Advisory Board to review and recommend for incorporation into the City’s annual budget approval process. All City Departments shall deposit into the Public Art Fund, out of any monies appropriated for any capital project an amount equal to one percent (1%) of the appropriation for the administration of the Public Art Program, excluding any funds from State or Federal sources which are ineligible to be used in conjunction with public art fund programs. One percent (1%) of the funds from multiple city capital projects may be accumulated in the Public Art Fund for the purposes as defined in Section I. Purpose. Only those capital projects exceeding the sum of SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00) will be subject to the provisions of this Ordinance. At such time as the total capital project expenditure of any individual projects exceeds SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00), the one-percent (1%) provided herein of all such monies expended for that capital project shall be paid into the Public Art Fund. One percent of the construction contract award, excluding any funds from State or Federal sources which are ineligible to be used in conjunction with public art fund programs, including additive change orders or other alterations to the contract, will be placed into the Fund. Washington State sales tax, design fees, furnishings, and administrative expenditures will not be included as part of the capital project expenditure. A capital project is defined as any project paid for wholly or in part by the City of Moses Lake to construct or remodel any building, structure, park, street, sidewalk, parking facility, or utility, or any portion thereof, including permanent fixtures to any building within the jurisdiction of the City of Moses Lake. However, the purchase of land, local improvement district projects including the city’s participation in any such District, maintenance and operation, and the purchase of equipment are not considered capital projects. Public Art Fund monies shall not be expended without the prior approval of the City Council. Severability The provisions of this Ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, section or portion of this Ordinance, or the invalidity of the application thereof to any person or circumstances shall not affect the validity of the remainder of this Ordinance, or the validity of its application to other persons or circumstances.
