EDC Trends Website: Grant County Trends
The EWU Institute for Public Policy & Economic Analysis was created in 2002 to provide data about a variety of factors in the region that will be useful for businesses, communities and others as they plan for the future. There are over 60 categories being compared at National, State, and County levels. City staff recently selected 37 categories specific to the City. Dr. Patrick Jones
provided an online walkthrough of the population, sales tax, graduation, and crime measurement
graphs and will return annually to give us an update.
CALL TO ORDER
The regular meeting of the Moses Lake City Council was called to order at 7:07 p.m. by Mayor Curnel with audio remote access. Special notice for attendance and citizen comment were posted
on the meeting agenda.

Present: Mayor Curnel; Deputy Mayor Jackson; Council Members Eck, Riggs, Liebrecht, and Hankins. Council Member Myers attended remotely.

Action taken: Deputy Mayor Jackson moved to approve the Agenda as presented, second by Council Member Eck. The motion carried 7 – 0.
SUMMARY REPORTS
MAYOR’S REPORT
Governor Inslee Visit Governor Inslee toured the Open Doors Sleep Center on July 15 and commended City staff for building a program that can be modeled around the State.
Food Bank Dedication The official ribbon cutting ceremony for the new facility was held on July 19.
Moses Lake School District Candidate’s Forum Mayor Curnel and Council Member Liebrecht attended a forum last night for the school
board candidates on the August 3 primary election sponsored by the Chamber of
Commerce.
COVID-19 Indoor Masking There have been 40 new cases reported in Grant County in the last five days. The local
health authority may reinstate a mandate for indoor masking for all residents, even those who are vaccinated.

CITY MANAGER’S REPORT
Budget Reallocation for Museum Parks, Recreation & Cultural Services would like to reallocate $150,775.00 to the
museum budget to redesign three of the permanent exhibits with more interactive features
and create open/visible storage of the Adam East archaeological collection. Museum Manager Dollie Boyd advised that the project is anticipated to be done in six months.
Action Taken: Council Member Liebrecht moved to authorize the reallocation of funds as
presented, second by Council Member Riggs. The motion carried 7 – 0.
Creative District A Creative District is an urban walkable area around businesses with artistic and creative activities. Museum Manager Dollie Boyd hosted public meetings with ArtsWA Program Manager Annette Roth last Friday and Saturday. Mrs. Boyd announced that the
temporary position for administrative support on this project has been filled, encouraged everyone to complete the online needs survey for the new Creative District, and shared that Soap Lake is working to establish a Creative District too.
Reject Stratford Road Completion Project Bid
One bid was received that nearly doubled the Engineer’s Estimate. Staff contacted other interested contractors and learned that modifying the schedule for subcontracted work would make a difference in the amount of bidders..
Action Taken: Council Member Liebrecht moved to reject any and all bids second by Council
Member Riggs. The motion carried 7 – 0.
New Municipal Services Director City Manager Allison Williams emailed photos and a brief bio of our new Municipal
Services Director Dave Bren whose first day will be August 16.
CITIZEN’S COMMUNICATION
Airshow Visit Washington Executive Director Terry Quick summarized the hurdles for the event this year
due to the COVID-19 Pandemic. He shared itemized expenses, online attendance statistics,
room nights provided from hoteliers, and that they plan to expand attractions for their show. Mr. Quick and representatives from the Port of Moses Lake presented a framed event poster signed by the pilots to the City Council which was received by Deputy Mayor Daryl Jackson.
PUBLIC HEARING
#1 Extend Wireless Facility Interim Controls Ordinance 2978 The ordinance extends the interim controls for siting of small cell wireless facilities for six months that went into effect in 2020. Mayor Curnel opened the hearing at 7:58 p.m.
No written comments or requests to speak were received, and the hearing was closed.
Action Taken: Council Member Hankins moved to adopt Ordinance 2978 as presented, second by Council Member Liebrecht. The motion carried 7 – 0.

Action taken: Council Member Liebrecht moved to approve the Consent Agenda as presented, second by Council Member Myers. The motion carried 7 – 0.
OLD BUSINESS
#3 Award Zoning Code Update Contract The development code needs to be replaced and include the state mandated housing
requirements, correct outdated code, and implement new streamlined processes. After a
request for proposal went out, staff evaluated the submitted proposals and all ranked SCJ Alliance the highest.
Action taken: Deputy Mayor Jackson moved to authorize the City Manager to execute a contract
with SCJ Alliance for a Zoning Code Update as presented, second by Council Member Riggs.
The motion carried 7 – 0.
#4 Water Conservation Extension MLMC 13.07 Ordinance 2980 The City is experiencing a rise in temperatures earlier in the summer which created
pressures on the capacity to maintain water reserves and supply the demand. Council
requested for staff to draft changes to extend the period that the water conservation program operates to include June and September.
Action taken: Council Member Hankins moved to adopt Ordinance 2980, second by Council
Member Liebrecht. The motion carried 7 – 0.
NEW BUSINESS
#5 Update Parking Regulations MLMC 10.12 Ordinance 2979 The amendment to MLMC 10.12 adds no parking on a segment of Juniper Drive at the
GTA Bus Stop No. 1147.
Action taken: Council Member Hankins moved to adopt Ordinance 2979 as presented, second by Deputy Mayor Jackson. The motion carried 7 – 0.
#6 Grove Estates MP #2 Group B Water System
The Code allows new Group B public water systems to be created in the City's RSA (aka
UGA) if they meet specific criteria and enter a covenant to connect to City services once located within 550 feet of the property. The current request from Rick Penhallurick is located near Grove and Elgin Roads in Cascade Valley.
Action taken: Council Member Hankins moved to authorize the creation of a group “B” water
system to serve a proposed 7 lot subdivision as presented, second by Council Member Eck. The
motion carried 5 – 2, Deputy Mayor Jackson and Council Member Liebrecht opposed.
#7 Lakeshore Dr. Payment Arrangement When the covenants were called in on the Lakeshore Dr. improvements, homeowners

were offered the option of making payment arrangements with the City. The interest rate will be prime plus 2% and will be fixed on the date that the agreement is signed.
Action taken: Council Member Hankins moved to authorize staff to execute Lakeshore Drive payment arrangements as requested by property owners using the template as to form, second by
Council Member Riggs. The motion carried 7 – 0.
#8 Accept 2019 State Auditor’s Report The State Auditor recently published the City’s 2019 Financial Statements Audit Report. There were no findings for the first time in several years and the finding from the previous year was considered fully corrected.
Action taken: Deputy Mayor Jackson moved to accept the Financial Statements Audit Report for the City of Moses Lake for the year-ended December 31, 2019, as presented, second by Council Member Eck. The motion carried 7 – 0.
ADMINISTRATIVE REPORTS
National Night Out The annual event will begin at 6 p.m. on Tuesday, August 3 at McCosh Park. Police Chief Fuhr and County Sheriff Jones will be sitting on the dunk tank and many more activities will be offered.
Regional Haz Mat Team
City Fire has been working with Chelan County Fire Districts, Grant and Chelan County Emergency Management to form a regional haz mat response team, which may include PUD from both counties in the future. They will hear in the next few weeks if the $344k grant application is awarded for equipment and training.
COUNCIL COMMUNICATIONS AND REPORTS
Council Member Liebrecht commended the Fire Department for the regional haz mat agency coordination and inquired about the status of Stratford Rd project clean-up for Randy Bruce property. City Manager Allison Williams advised that she has been in touch with Mr. Bruce on the clean-up status.
Council Member Riggs commented on the new signs at boat launches that inform residents of the water conditions.

Summary
RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City.
RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued.
The City meets all these conditions.
To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting.
All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director.
The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place.

Overview
Industrial Construction of Washington has completed work for the above project.
The project consisted of replacing approximately 1,000 feet of existing A.C. pipe in Westshore Drive
prior to the reconstruction of the roadway.
The work completed is in the amount of $210,017.23. The original price for the contract was
$206,693.69. The extra cost was due to small overruns on fittings and patching needed to complete
the project.
The work completed by the contractor is physically complete and ready for acceptance.

INTERLOCAL AGREEMENT BETWEEN THE CITY OF MOSES LAKE, WA AND THE CITY OF MATTAWA, WA
RELATING TO PROVISION OF INTERIM CHIEF OF POLICE SERVICES
This Agreement is made and entered into this 27th day of April, 2021, by and between the City of Moses Lake, Washington, a non-charter code city, hereinafter referred to as MOSES LAKE,
and the City of Mattawa, a non-charter code city, hereinafter referred to as MATTAWA, for the
provision of interim chief of police services.
Recitals:
1. Mattawa is currently and temporarily without a chief of police and needs the assistance and
service of an interim police chief;
2. Moses Lake has police staff available to provide Mattawa with the services of a temporary,interim chief of police;
3. This Agreement will provide for the immediate needs of Mattawa with adequate compensationto Moses Lake.
NOW THEREFORE, Moses Lake and Mattawa hereby agree as follows:
1. Authority. This Interlocal Cooperation Agreement is executed pursuant to the authorityconferred upon the parties on Chapters 10.93 and 39.34, RCW. In all respects, the parties shallbe deemed to be acting in their governmental capacities.
2.Interim Police Chief Services. Moses Lake agrees to make its Captain, Mike Williams,
available to Mattawa as a temporary, interim police chief.
3.Scope of Services. The Interim Chief services will be provided by Moses Lake through itsdesignee, Captain Mike Williams.
3. Consideration. As consideration for such services, Mattawa agrees to pay Moses Lake atCaptain Williams’ current hourly rate ($77.79) for all time spent acting as Interim Chief forMattawa, not to exceed forty (40) hours per week. Mattawa authorizes the use of its commandvehicle for purposes of commuting and performing the services pursuant to this Agreement and
will be responsible for the operating costs of this vehicle during the term of this Agreement.
Captain Williams will continue to wear his Moses Lake uniform and utilize his Moses Lakeissued equipment and gear.
4.Term of Agreement. This Agreement shall be effective April 27, 2021, after execution by both
governing bodies, and shall continue in full force and effect until Mattawa hires a new police
chief or until January 31, 2022, unless otherwise terminated by either party as provided inParagraph 16.

5. Property. It is not expected that property shall be acquired or disposed of on behalf of thisAgreement. The property owned by Mattawa and used in providing the services under the terms
of this Agreement shall remain property of Mattawa and the property owned by Moses Lake and
used in providing services under the terms of this Agreement shall remain property of MosesLake.
6.Details of Services. The Interim Police Chief is an administrative, supervisory, professional
position responsible to plan, organize, and manage Mattawa Police Department (MPD)
operations including:
•provide guidance and oversight of operational activities• assist with development and update of operations and training manuals,
administrative policy manuals, and similar MPD policies.
• create, supervise, and monitor work schedules and duty calendar for the efficientoperations of the MPD and its personnel.•assist and mentor the sergeant and patrol officers as necessary•assist with recruitment and selection of new members
•facilitate personnel evaluations
• supervise, evaluate, and monitor training programs for members• evaluate and supervise the SRO program and officers
These duties will be performed in accordance with Mattawa’s chain of command and adopted
policies and procedures.
5.Liability. Each City shall be responsible for the wrongful or negligent actions of its employeeswhile performing pursuant to this Agreement as their respective liability shall appear under thelaws of the State of Washington and/or Federal Law and this agreement is not intended to
diminish or expand such liability.
6.Contract Administration. The parties do not by this Agreement create any separate legal oradministrative entity. The Mattawa Mayor and the Moses Lake City Manager shall beresponsible for administering the terms of this Agreement. The parties do not intend to jointly
own any real or personal property as part of this undertaking.
7. No Third Party Beneficiary. The provisions of this Agreement are not intended to create anythird0party beneficiary contract rights, and therefore none should be deemed created by theAgreement. The Agreement between the parties is only intended to create rights and/or
obligations between the signatory parties.
8. Governing Law. This Agreement is entered into and shall be governed by the laws of theState of Washington. In the event of a dispute, the venue shall lie in Grant County, Washington.
9. Amendment and Waiver. This Agreement may be amended by mutual written agreement of
the parties. No waiver by any party of any term or condition of this Agreement shall be deemedor construed waiver of any other term or condition, nor shall a waiver of any breach be deemed

to constitute a waiver of any subsequent breach whether of the same or a different provision of this Agreement.
10. Insurance Requirements. Each party to this Agreement shall maintain and procure for theduration of this Agreement insurance against claims for injuries to persons or damages toproperty or persons. Mattawa shall provide insurance coverage for Captain Williams in theperformance of his duties for Mattawa.
11.Waiver of Breach. The failure of either party to this Agreement to insist upon strictperformance of any of the covenants and agreements contained in this Agreement, or to exerciseany option or right conferred by this Agreement, in any one or more instances shall not beconstrued to be a waiver or relinquishment of any such option or right of any other covenants or
agreements which shall all be and remain in full force and effect.
12. Workers Compensation Industrial Insurance. Both parties agree to provide WorkersCompensation Industrial Insurance through Washington Department of Labor and Industriesduring the times that Captain Williams works for each of them.
13.Notices. Any notice required or desired to be served, given, or delivered hereunder shall bein writing and shall be deemed to have been validly served, given, or delivered upon deposit inthe United States mail by registered or certified mail with proper postage prepaid and addressedto the party to be notified. Each party shall include the applicable address below the signature
block hereof.
14.Severability. If any term, provision, covenant, or condition of this Agreement is held by acourt of competent jurisdiction to be invalid, void, or unenforceable, the remainder of theprovision hereof shall remain in full force and effect and shall in no way be affected, impaired,
or invalidated as a result of such decision.
15. Captions. The captions used herein are for convenience only and are not a part of thisAgreement and do not in any way limit or amplify the terms and provisions hereof.
16. Termination of Agreement. Upon thirty (30) days prior written notice, either party may
terminate this Agreement. If for any reason during the term of this Agreement, Captain Williamsdoes not continue to work in the position of Captain for the City of Moses Lake, this Agreementshall be immediately terminated.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement, effective on the date shown above. The signatories below represent and warrant that they possess the authority to execute this Agreement and bind their respective entities.

Overview
Moses Lake Rotary approached the City in September 2019 about updating the Skate Park for their
community service project. The Skate Park is well over 25 years old; it is constructed of metal,
which most modern skateparks are constructed out of concrete. Moses Lake Rotary President,
Steve Ausere, and Spencer Grigg met about the project to discuss various options that would
benefit the Skate Park and the community. They decided that lighting and adding skateable
features to the park were the best options. Moses Lake Rotary along with Moses Lake Parks,
Recreation and Cultural Services staff looked at all funding options from grants to local funding
sources. In the end, Moses Lake Rotary was able to fundraise $141,000 from the following
businesses: Samaritan Healthcare, Wenatchee Valley Medical Group, Rotary and Kiwanis Golf
Tourney, Rotary Auction, Fund-A-Cause, The Rotary Foundation, Anonymous Donations,
Northwest Farm Credit, Dave & Becky Thomas, Go Fund Me, Moses Lake Industries, Inland Tarp &
Supply, Moses Lake Community Health, and a grant from the Paul Lauzier Foundation.
Moses Lake Parks, Recreation & Cultural Services is excited to work with Moses Lake Rotary on the
updates to the Skate Park. It will be a wonderful addition to the Skate Park and for the community.

RESOLUTION NO. 3861
A RESOLUTION OF THE CITY OF MOSES LAKE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF MOSES LAKE AND THE MOSES LAKE ROTARY CLUB FOR IMPROVEMENTS TO THE SKATE PARK
Recitals:
1. The City of Moses Lake (hereafter called "City") is a municipal corporation dulyformed and existing under the laws of the State of Washington with City Hall located
at 401 S. Balsam Street, Moses Lake, Washington 98837.
2. The Rotary Club of Moses Lake ("Rotary Club") is duly formed and existing as anonprofit organization under the laws of the State of Washington.
3. The City owns, operates and maintains a public park known as the Moses Lake Skate
Park located within the City with common street address known as 414 W 4th Ave,Moses Lake, Washington. The Park is operated and managed by the Parks andRecreation Division of the City.
4. The Rotary Club desires to enhance the Park for the benefit of the community by
expending up to $141,000 for development and construction of additions to the skatebowl and lights.
5. The City is authorized to enter into agreements with community service organizations
for the construction of improvements to public parks pursuant to RCW 35.21.278 and
other statutes, and desires to enter into this agreement with Rotary Club for thedesign, construction and completion of improvements at the Skate Park.
6.It is in the best interest of the City of Moses Lake to execute the attached agreement.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Moses Lake:
Section 1. The “Recitals” provisions set forth above are hereby incorporated in this Resolution as findings in support of the actions authorized in this Resolution.
Section 2. The City Manager of the City of Moses Lake is hereby authorized and directed to execute and administer the attached and incorporated "Agreement between the City of Moses Lake and the Rotary Club for development, maintenance and use of the Moses Lake Skate Park."
Section 3. The provisions of this Resolution shall become effective upon adoption and shall
continue until further formal action of the City Council.
