PLEDGE OF ALLEGIANCE Police Chief Kevin Fuhr led the Flag Salute. 9/11 20th ANNIVERSARY VIDEO TRIBUTE A video was shared containing footage of the Moses Lake 9/11 Memorial filmed with firefighters in several communities and their 9/11 Memorials throughout the state. Firefighter Jason Koziol was the only Honor Guard member of the State of Washington to be in this video. AGENDA APPROVAL The Code Enforcement action listed on the posted agenda has been resolved and all items that were needing to be discussed in Executive Session were completed during yesterday’s meeting. SUMMARY REPORTS MAYOR’S REPORT Constitution Week Proclamation A proclamation declaring September 17 through 23, 2021, as Constitution Week was read by Mayor Curnel. AGCCT Meeting An AGCCT Meeting is scheduled on September 30, 2021, at 6:00 p.m. in Electric City. Yonezawa Sister City Letter A letter was sent to the Mayor from Mayor Nakagawa of Yonezawa City, Japan regarding the tree planting and cultural exchange activities in the fall of 2021, marking the 40th year of the Sister City relationship. Due to COVID, these plans have been canceled and the visit will be rescheduled once the Pandemic has ended. Paul Hirai Moment of Silence Highlights from Paul Hirai’s obituary in the Columbia Basin Herald was read. Mr. Hirai was instrumental in establishing Yonezawa as our Sister City and was commended for his work in agriculture and at Big Bend Community College. A moment of silence was held in his honor. Project Contract Reinstatement Resolution 3862 Six conditions were presented for Council to consider in authorizing a resolution which would reinstate the Stratford Rd Construction Contract with C&R Tractor. President, Counsel, Surety Counsel, and Surety Project Manager spoke to the conditions for reinstatement. Pamp Maiers provided his concerns with the proposed agreement. Action taken: Council Member Hankins moved to adopt Resolution 3862 as presented, second by Council Member Eck. The motion carried 7 – 0. Budget Retreat on Saturday, October 2, 2021 The annual Council Budget Retreat is going to be on October 2, 2021, in the Council Chambers at the Civic Center. Administrative Staff Change City Manager Allison Williams requested that City Clerk Debbie Burke’s title be changed to City Clerk – Administrative Services Manager. This change encompasses the addition of Information Technology staff oversight with continued duties to oversee Deputy Clerk, Municipal Court services, and risk management. This change would come with the appropriate compensation. Action taken: Council Member Hankins moved to approve the title change of the City Clerk as presented, second by Council Member Eck. PUBLIC HEARING #1 Fox Property Vacate Ordinance 2982 This Ordinance is for the consideration of vacating a 30’ by 290’ portion of the Right-of-Way on Third Ave adjacent to the Lewis Elliot Addition No. 2 Plat, correcting a scrivener’s error on the prior legal description. The Public Hearing was opened on August 24. There being no public testimony then or now, the Hearing was closed at 7:55 p.m. Action taken: Council Member Riggs moved to adopt Ordinance 2982 as presented, second by Council Member Eck. Action taken: Council Member Hankins moved to approve the extension of the Photo Enforcement Amnesty Program as presented, second by Council Member Liebrecht. The motion carried 7 – 0. #4 Snow Removal Policy Update Municipal Services Director Dave Bren provided an update on the Snow and Ice Control Policy. Council requested that he look into requiring the equipment necessary to ensure that snow does not block driveways. NEW BUSINESS #6 Prorated Utilities Policy Ordinances 2983 and 2984 Ordinance 2983 amends MLMC 2.30.140 allowing for the proration of utilities by day. Ordinance 2984 amends MLMC 13.12 also allowing for the proration of utilities based on the number of days service is provided. Action taken: Council Member Myers moved to adopt Ordinance 2983 as presented, second by Council Member Riggs. The motion carried 7 - 0. The motion carried 7 – 0. #7 School Zone Speed Limit Change Ordinance 2985 This ordinance establishes 20 mph speed zones beyond the minimum requirements of the Manual on Uniform Traffic Control Device for pedestrian safety. The ordinance includes signage for existing streets and the addition of Nelson Rd. by the new elementary school. Action taken: Council Member Hankins moved to adopt Ordinance 2985 as presented, second by Council Member Riggs. The motion carried 7 - 0. #8 Black Dot (AT&T) Antenna Lease Renewal The lease renewal is for the facilities on the 900 Juniper Dr Reservoir. This is the final renewal from cell antenna leases that were re-negotiated in 2020. Council requested information for expenditure of this revenue at a future meeting. Moses Lake Council Packet 9-28-21, Page 7 of 73 CITY COUNCIL MINUTES – September 14, 2021 pg. 4 ADMINISTRATIVE REPORTS Comprehensive Plan Update The Comprehensive Plan’s initial Public Hearing will be presented this Thursday before the Planning Commission. All documents are available on the City’s website. The Planning Commission has been doing a deep dive in this year’s update that will be provided to Council with a recommendation for consideration in October. Council has scheduled a study session on October 12 followed by a Public Hearing and adoption on October 26. COUNCIL COMMUNICATIONS AND REPORTS Council Member Eck expressed his concerns for the Stratford Rd. completion project. Council Member Liebrecht thanked personnel for sharing the 9/11 video and thanked the City Manager for scheduling a meeting with the Municipal Airport Advisory Board. Council Member Riggs expressed concerns on recent graffiti and local shootings. He also wanted to give his appreciation to Law Enforcement for keeping residents safe. Council Member Myers requested information regarding the Yonezawa and Highway 17 intersection. City Manager Allison Williams responded that WSDOT requested a traffic study. A joint meeting with Perteet Engineering will be held this Friday to consider a phased improvement plan due to anticipated growth due to the full build out of the area causing the intersection to fail. Mayor Curnel encouraged Council to attend the AGCCT meeting on September 30. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council. RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place. The focus of the changes are as follows: •Chapter 5.04 covers the basic business license process. We have a few licensees stall in providing the required documentation, and it takes an inordinate amount of staff time to follow-up. We are requesting to add a 60-day time frame for the licensee to provide the required information, and if they are not responsive, we can close the application, without a refund. •Chapter 5.06 deals with temporary licenses, and we are clarifying that it is for selling “non- food related” items and eliminating a cash-deposit requirement. •Chapter 5.07 addresses Mobile Food and Street Food Vendors. We are asking for them to identify if they are residential based, and provide a site plan, food handlers permit and written authorization from the property owner to conduct business on their property, if applicable. Since we are in partnership with Department of Revenue’s Business Licensing Services (BLS) we presented our requested modifications for their review. They indicated we could make these types of modifications to our ordinance without changing our basic relationship established through the model ordinance adopted in 2019. Fiscal and Policy Implications This should not have a significant financial impact. It could result in a few more $85 business license fees in a year, but only if businesses don’t respond in a timely manner. The business license fee is basically to cover the cost of processing the business license, and if we need to try several times to Moses Lake Council Packet 9-28-21, Page 13 of 73 Page 2 of 2 reach out to a business to get their documentation, that cost has been incurred, which is why we are proposing no refund. Moses Lake Council Packet 9-28-21, Page 14 of 73 ORDINANCE 2986 AN ORDINANCE AMENDING MOSES LAKE MUNICIPAL CODE SECTION 5.04.040 TITLED "APPLICATION FOR NEW BUSINESS” THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Section 5.04.040 of the MLMC titled "Application for New Business" is amended as follows: 5.04.040 Application for New Business: Application for a business license as required by this chapter is made through the Business Licensing Service (BLS). The application must include all information required for all licenses requested and total fees due for all licenses, as well as the handling fee required by RCW 19.02.075. BLS will provide the application information to the Finance Director. If the licensee is a new business, prior to the issuance of the business license, the Finance Director shall submit the application therefor to the Fire Chief and the Building Inspector of the City for approval of the location where the licensee is to carry on the business, trade or profession, and the business license shall be approved for issuance only if the location is in compliance with building and fire codes of the City as those codes relate to existing and/or new structures. Applications for a business license as required by this chapter will remain in a “pending status” for a period of 60 days from the date of receipt by the City. Within the 60-day period, the applicant has the responsibility to provide all required information and documentation requested or required by the City for the purpose of activating said license. Upon expiration of the 60 days, the application shall be deemed abandoned and shall be withdrawn from processing; provided, however, that the Business License Technician shall have the discretion whether to permit an extension of the 60 days, not to exceed 30 days, in order to permit a late processing. Any application not processed within the original 60 days or extension thereof shall be required to be processed as a new application. Section 2. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of the ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted independently and without regard to the section affected. Section 3 . This ordinance shall take effect and be in force five (5) days after its passage and publication of its summary a as provided by law. The license required by this chapter is in lieu of the general business license required under Chapter 5.04. 5.06.030 Definitions: For the purpose of this chapter, a “transient merchant,” “itinerant merchant,” or “itinerant vendor” is defined as any person, firm, corporation or association, whether as owner, agent, consignee or employee, whether a resident of the City or not, which engages in a temporary business of selling and delivering non-food related goods, wares, and merchandise within said City, and who, in furtherance of such purpose, hires, leases, uses or occupies any building, structure, parking lot or area, motor vehicle, tent, railroad boxcar or both, public room in hotels, motels, lodging houses, apartments, shops, or any street, alley, or other public places within the City, for the exhibition and sale of such goods, wares and merchandise, either privately or at public auction; provided, that such definition shall not be construed to include any person, firm, corporation or association who, while occupying such temporary location, does not sell from stock but exhibits samples only for the purpose of securing orders for future delivery only. The person, firm, corporation or association so engaged shall not be released from complying with the provisions of this chapter merely by reason of associating temporarily with any local dealer, trader, merchant or auctioneer, or by conducting such transient business in connection with, as a part of, or in the name of any local dealer, trader, merchant or auctioneer. 5.06.040 License – Contents: All licenses provided for in this chapter shall be issued by the Finance Director upon paying to the Finance Director the proper license fee as provided in this chapter. All licenses shall bear the name of the licensee, and shall designate the nature of the business, trade, or profession operated by the licensee; and shall also designate the location where the business, trade, or profession is carried on, the date of their expiration of the license, the date of the issuance of the license, and the amount paid for the license. Each licensee shall conspicuously post such license in his place of business or office, and shall produce such license for inspection if required to do so by any authorized City official. 5.06.045 Application Requirements: The application shall be submitted at least fourteen (14) days before the proposed start of business, and shall include the following: Moses Lake Council Packet 9-28-21, Page 18 of 73 A.Application form; B.Application fee per Section 5.06.080; C.Cash deposit per Section 5.06.100; D.Written permission of the owner of the property where the business is proposed to be located and/or authorization to utilize garbage service provided by the service location. D E. Site plan showing the proposed location of the business, including existing buildings, parking, and any proposed structures, vehicles, tents, etc.; E F. Proof of insurance coverage, per Section 5.06.047. 5.06.047 Insurance: The licensee shall obtain and maintain public liability and property damage insurance in the amount of one million dollars ($1,000,000) which shall remain in full force and effect during the duration of the license. The insurance policy shall name the City as an additional named insured and the policy shall not be canceled or reduced without prior written notice to the City at least thirty (30) days in advance of the cancellation. Proof of insurance shall be provided as a condition of issuance of the license. 5.06.050 Review by Fire Chief and Building Official: Prior to the issuance of all licenses authorized by this chapter, the Finance Director shall submit the application to the Fire Chief and Building Official of the City for approval of the location where the licensee is to carry on the business, trade or profession, and the business license shall be issued only if the location is in compliance with building and fire codes of the City as those codes relate to exiting and/or new structures. 5.06.060 Location Change: If an existing licensee desires to change the location of the business, trade, or profession from the location designated on the business license, application must be made to the Finance Director at least fourteen (14) days prior to the change in location and the Finance Director shall, prior to the issuance of a new business license, submit the application therefor to the Fire Chief and the Building Official of the City for approval of the new location where the licensee is to carry on the business, trade, or profession, and the business license shall be issued only if the location is in compliance with building and fire codes of the City as those codes relate to existing and/or new structures. There shall be no additional business license fee assessed an existing licensee for a change of his location, and the new business license issued shall carry the same expiration date. 5.06.070 Term of License: All licenses shall be for a period of one year, unless otherwise provided in this chapter; such license is to begin January 1st of each year and terminate the following December 31st. 5.06.080 Fee Schedule: Moses Lake Council Packet 9-28-21, Page 19 of 73 The business license fee shall be assessed in accordance with the adopted fee schedule for the year or part thereof, payable in advance, for each business, trade or profession, conducted or carried on within the corporate limits of the City; provided, that tax-exempt nonprofit companies, associations, corporations, or co-partnerships of whatever kind as defined by the federal or state government shall not be required to pay the business license fee but, nevertheless, shall obtain a business license, without fee, if conducting a business in order to raise funds from members outside the organization. The business license for tax-exempt nonprofit companies, associations, corporations, or co-partnerships of whatever kind as referred to herein shall be obtained once and shall be effective for the lifetime of the organization. This exemption is an addition to that provided in Section 5.06.090. No business, trade or profession conducted or carried on in a single location under one (1) management or ownership shall pay more than one (1) license fee regardless of the multiple nature of the business carried on; provided further, that no tax-exempt nonprofit company, association, corporation, or co-partnership of whatever kind as defined by the federal or state government which operates or conducts a community festival or event or event of no more than four (4) days in duration shall be required to obtain a business license as herein previously provided and the exemption which has been provided shall extend to the festival’s or event’s participants operating under sanction of said festival or event. Any business, profession or trade in more than one (1) location within the City shall pay a license fee for each location where the business, profession, or trade is conducted. 5.06.090 Certain Businesses Exempt: A.Recognizing that there are locally owned and operated small or part-time businesses which would be unduly penalized by requiring licensing under this chapter and the payment of the business license fee as provided in Section 5.06.080, there is exempted from this business licensing chapter those locally owned and operated businesses, professions, or trades wherein the annual gross income is less than one thousand dollars ($1,000) per year. B.The provisions of this chapter shall not be construed to apply to the following: 1. Persons selling only fruits, vegetables, berries, eggs, or any farm produce. 2. Persons selling only trees used for the celebration of the Christmas season. 3. Persons required to obtain a business license under Chapter 5.04. 5.06.100 Cash Deposit: Before a license is issued under authority of this chapter, the applicant, in addition to paying the applicable license fees, shall deposit with the Finance Director a refundable cash deposit or a cashier’s check in the amount of one hundred fifty dollars ($150). The deposit or cashier’s check shall be refunded or returned to the licensee at such time as it has been determined that any check used to pay the license fee has cleared and after the licensee delivers to the City a signed declaration indicating the amount of gross sales and which calculates the amount of sales tax to be forwarded to the Washington Department of Revenue. In addition the statement shall contain a current address and telephone number of the licensee. 5.06.105 Garbage Receptacle Required: Moses Lake Council Packet 9-28-21, Page 20 of 73 All transient merchants vendors shall have at least one (1) adequately sized garbage receptacle upon the site of business for customer use. 5.06.110 Nontransferability of License: All licenses provided for in this chapter shall be nontransferable. 5.06.120 Revocation or Denial of License: Any license pursuant to this chapter may be revoked or denied, in writing, by the Community Development Director for any of the following causes: A.Any fraud, misrepresentation, or false statement contained in the application for license. B.Any fraud, misrepresentation, or false statement made in connection with the selling of products. C.Any violation of this chapter. D.Conviction of the licensee of any felony or of a misdemeanor involving moral turpitude. E.Conducting the business licensed under this chapter in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health, safety, or general welfare of the public. 5.06.130 Duty of Building Official to Enforce: It shall be the duty of the Building Official of the City of Moses Lake and his designee to examine all places of business and persons subject to the provisions of this chapter, to determine if this chapter has been complied with and to enforce the provisions of this ordinance against any person found to be violating the same. 5.06.140 General Fund: All funds received by the City under the terms of this chapter shall be paid into the General Fund of the City and budgeted annually for any municipal purpose, as required by law. 5.06.150 Fees Collected by Court: The City shall have the power to institute suit or action in any court of competent jurisdiction for the purpose of collecting any license fees that are due and payable. 5.06.160 Penalty for Violations: Failure to comply with any provision of this chapter shall subject the violator to the following penalties as they are defined in Chapter 1.08: Violation Penalty Failure to Obtain License C-7 5.06.170 Appeal: Moses Lake Council Packet 9-28-21, Page 21 of 73 Any person aggrieved by the denial of an application for a license or by the revocation of a license as provided for in this chapter shall have the right to appeal to the City Council. A person, firm, or corporation so engaged shall not be relieved from complying with the provisions of this chapter merely by reason of associating temporarily with any local dealer, trader, merchant, or auctioneer, or by conducting such temporary business in connection with, as part of, or in the name of any local dealer, trader, merchant, or auctioneer. B.“Food” shall have its usual and ordinary meaning, and shall include all items designed for human consumption, including, but not limited to, candy, gum, popcorn, hot dogs, sandwiches, peanuts, soft drinks, frozen concessions, nonalcoholic beverages, and dairy products. Products regulated by the Washington State Liquor and Cannabis Board may not be sold by mobile or street vendors. C.“Authorized concession stand” shall mean a concession stand operated or maintained for the sale of food or merchandise, in the public parks of the City, or on other public property, by the City or in accordance with a City-approved agreement or franchise. D.“Public celebration” shall mean the Spring Festival activities customarily celebrated in and around McCosh Park and other areas of the City, as well as any other time of public celebration. E.“Special event” shall mean an event for which the City has authorized use of City facilities for use by vendors, such as the Farmers Market. F.“Street vendor” shall mean a vendor, including any owner and employee, selling food within a public or private parking lot, pedestrian plaza, public street, alley, sidewalk, public right-of-way, or public property, using a nonmotorized cart or temporary structure. 5.07.030 Exemptions: The provisions of this chapter shall not be construed to apply to the following: A.Persons selling only fruits, vegetables, berries, eggs, or any farm produce. B.Persons selling only trees used for the celebration of the Christmas season. C.Persons required to obtain a business license under Chapter 5.04. 5.07.040 Application: Any person, firm, or corporation desiring to secure a license as a mobile or street vendor shall make application to the City, on forms to be provided by the City, at least fourteen (14) days before the requested start date of the business. Such application shall provide: A.The name or names and address of the applicant, vehicle license numbers of all vehicles or a description of the conveyance from which the applicant proposes to conduct business; description of the general type of food proposed to be sold by the applicant. B.Each application shall be accompanied with the license fee as provided for in this chapter. C.Each license application for a mobile or street vendor shall be accompanied with the following information to establish compliance with this chapter and other applicable codes: 1.A statement explaining the method of trash and litter disposal being proposed by the vendor and/or signed agreement from the property owner to utilize their garbage. Site Plan of where unit will be located (if applicable) as it pertains to existing buildings, parking and exits. 5. Food Handlers permit (if applicable). 6. Written authorization from the Property Owner to conduct business on their property (if applicable). 5.07.045 Insurance: The licensee shall obtain and maintain public liability and property damage insurance in the amount of one million dollars ($1,000,000) which shall remain in full force and effect during the duration of the license. The insurance policy shall name the City as an additional named insured and the policy shall not be canceled or reduced without prior written notice to the City at least thirty (30) days in advance of the cancellation. Proof of insurance shall be provided as a condition of issuance of the license. 5.07.050 Investigation and Determination: Upon receipt of such application, the Community Development Director shall cause such investigation of such person’s or persons’ business responsibility to be made as is deemed necessary for the protection of the public good and shall refer the application to the Community Development Department for its determination as to compliance with standards and requirements of this chapter. An application shall be denied by the Community Development Director upon written findings that the applicant’s business responsibility is unsatisfactory or that the proposed business activity will violate any applicable law, rule, or regulation. Any license issued under this chapter shall contain the number on the license, the date same was issued, the nature of the business authorized to be carried on, the amount of license fee paid, the expiration date of said license, and the name or names of the person or persons authorized to carry on the same. The Community Development Department shall keep a record of all licenses issued under this chapter and shall promptly provide the Washington State Department of Revenue a copy of any license issued under this chapter. 5.07.060 Fees: A. An initial application fee shall be assessed in accordance with the adopted fee schedule and will be submitted with all applications for each vehicle, conveyance, or stand. The renewal fee for a mobile or street vendor license shall be the same as a standard business license, provided there has been no interruption in maintaining the mobile or street vendor licenses of the vehicles, conveyances, or stands. B. Any license issued under the provisions of this chapter shall expire December 31st of the year it is issued. C. In addition to the application fee, the applicant shall pay an annual fee which shall be assessed in accordance with the adopted fee schedule to help defray the cost of screening the applicant for the license. Any license issued under this chapter shall not be transferred to any other person, firm, or corporation. 5.07.080 Compliance with Regulations: All food vendors shall comply with all laws, rules, and regulations regarding food handling, and all vehicles, conveyances, and stands used for the sale of food shall comply with all applicable laws, rules, and regulations respecting such vehicles, conveyances, or stands as established by the Grant County Health District, the Washington State Motor Vehicle Code, and as set forth in the Moses Lake Municipal Code. 5.07.090 Mobile and Street Vendor Standards: All mobile and street vendors licensed under this chapter shall conform to the following standards: A. No mobile or street vendor shall operate from one (1) location in a residential zone as defined in Title 18 for longer than fifteen (15) minutes at a time. B. No mobile or street vendor shall locate his or her vehicle or conveyance in that portion of public right- of-way abutting private property without the written permission of the owner of the abutting private property. No food shall be offered, displayed, or sold, and no customers served, in any vehicle travel lane. A temporary stand shall not be located within twenty feet (20') of any public right-of-way or within twenty feet (20') of the intersection of any public right-of-way and private driveway. C. No signs or signage shall be permitted other than that which can be contained on the vehicle or conveyance utilized or as otherwise allowed. D. No vehicle, other conveyance or temporary stand shall be located closer than twenty feet (20') from any building or structure. E. No vehicle, other conveyance or temporary stand shall locate closer than fifty feet (50') from flammable combustible liquid or gas storage and dispensing structures. F. All mobile and street vendors shall have at least one (1) adequately sized garbage receptacle upon the site of business or on the vehicle or conveyance for customer use. G. Sites used by mobile or street vendors shall be cleaned of all debris, trash, and litter at the conclusion of daily business activities. H. All vehicles, other conveyances, or temporary stands shall be equipped with at least one (1) 2A-40 BC fire extinguisher. I. No mobile or street vendor shall sell or vend from his or her vehicle or conveyance: 1. Within four hundred feet (400') of any public or private school grounds during the hours of regular school session, classes, or school related events in said public or private school, except when authorized by said school. Within three hundred feet (300') of any public park of the City where any City-authorized concession stand is located during times other than during the course of a public celebration except as approved by the Parks and Recreation Department of the City. 4. Within three hundred feet (300') of any public park of the City where any City authorized concession stand is located during the course of a public celebration when nonprofit organizations are permitted to engage in the sale of merchandise and food in such park. 5. Within three hundred feet (300') of any public park or other public space during a special event for which organizations are permitted to sell merchandise and/or food in the park or public space for a fee, unless the mobile or street vendor obtains written permission from the coordinator of the event. J. No mobile or street vendor shall conduct business so as to violate the traffic and sidewalk ordinances of the City as now in effect or hereafter amended. K. No mobile or street vendor shall obstruct or cause to be obstructed the passage of any sidewalk, street, avenue, alley or any other public place, by causing people to congregate at or near the place where goods, wares, food, or merchandise of any kind is being sold or offered for sale. L. The intent of this project is to demolish those structures. The Police Storage Building and Firing Line Structure are located on Randolph Road, and the abandoned Well 22 building is located near Big Bend College. Benefits of completing the project include opening the land for other uses and mitigating possible health hazards from materials like lead paint and asbestos. Staff opened bids for the Building Demolition Project on August 26th, 2021. The City received six (6) bids for the work. The apparent low bid is $52,790.80 and the Engineer’s Estimate is $53,603.80. The quote is $50,900.00, from Central Washington Asphalt, Inc. (CWA). The quote is based on the cost of a single snow event. The Engineer estimated this cost at $35,000.00, based on historical contracts with the City. Per CWA, the cost increase for 2021 ($15,900 over Engineer) is due to higher cost of fuel, labor (often on short notice and on holidays), and insurance claims. Fiscal and Policy Implications The 2021 budget included about $90,000 for three snow events. We had one event in February 2021. This leaves sufficient funds for one (1) snow event in the remainder of 2021, due to the price increase. The Contractor represents and warrants that it will diligently and completely perform all services and obligations consistent with customarily accepted good practices and standards of performance applicable to service providers rendering the same or similar type of service and that it will comply with all applicable federal, state and local laws, ordinances, rules and regulations including, but not limited to, the Occupational Safety and Health Administration (OSHA) and the Washington Industrial Safety and Health Act (WISHA). If the Contractor intends to rely on information or data supplied by the City, other City contractor’s or other generally reputable sources without independent verification, such intent shall be brought to the attention of the City 4.5 It is further provided that no liability shall attach to the City by reason of entering into this contract except as expressly provided herein. 4.6 Before any work at the site is started, Contractor shall deliver to City with copies to the Engineer and each additional insured identified, certificates of insurance which Contractor is required to purchase and maintain in accordance with the Contract Documents. The Contractor, at its expense, shall obtain and keep in force any and all necessary licenses and permits. The Contractor shall obtain a business license as required by Moses Lake Municipal Code Chapter 5.04. If the City is assessed, made liable, or responsible in any manner for taxes contrary to the provisions of this Contract, the Contractor agrees to hold the City harmless from such costs, including attorney's fees. In the event the Contractor fails to pay any taxes, assessments, penalties, or fees imposed by any governmental body, including a court of law, other than those taxes the City is required to pay, then the Contractor authorizes the City to deduct and withhold or pay over to the appropriate governmental body those unpaid amounts upon demand by the governmental body. It is agreed that this provision shall apply to taxes and fees imposed by City ordinance. Any such payments shall be deducted from the Contractor’s total compensation. 4.8 If this Contract involves services for which state and/or local laws may require the Contractor to pay prevailing wages, and Contractor hereby agrees to pay such applicable prevailing wages. If applicable to this Contract, a Schedule of Prevailing Wage Rates for the locality or localities where this Contract will be performed is attached and made of part of this Contract by this reference. If prevailing wages do apply to this Contract, the Contractor and its subcontractors shall (a) be bound by the provisions of Chapter 39.12 RCW, as amended, relating to prevailing wages and usual fringe benefits, (b) ensure that no worker, laborer or mechanic employed in the performance of any part of this Contract shall be paid less than the prevailing rate of wage specified on that Schedule, and (c) immediately upon award of the Contract, contact the Department of Labor and Industries, Prevailing Wages section, Olympia, Washington, to obtain full information, forms and procedures relating to these matters. Per such procedures, a Statement of Intent to Pay Prevailing Wages must be submitted by the Contractor and its subcontractors to the City, in the manner requested by the City, prior to any payment by the City hereunder, and an Affidavit of Wages Paid must be received or verified by the City prior to final Contract payment. 4.9 The Contractor shall, at such times and in such form as the City may reasonably require, furnish the City with periodic status reports pertaining to the services undertaken pursuant to this Contract. Upon City’s request, the Contractor shall make available to City all accounts, records and documents related to the scope of work for City’s inspection, auditing, or evaluation during normal business hours as reasonably needed by City to assess performance, compliance and/or quality assurance under this Contract. No payroll or employment taxes or contributions of any kind shall be withheld or paid by the City with respect to payments to Contractor. The Contractor shall be solely responsible for all said payroll or employment taxes and/or contributions including, but not limited to, FICA, FUTA, federal income tax, state personal income tax, state disability insurance tax and state unemployment insurance tax. If the City is assessed, made liable or responsible in any manner for such taxes or contributions, the Contractor agrees to indemnify and hold the City harmless from all costs incurred, including attorney fees. Unless otherwise specified in writing, Contractor shall provide at its sole expense all materials, working space, and other necessities and instruments to perform its duties under this Contract. 4.11 In the event of a dispute pertaining to this Contract, the parties agree to attempt to negotiate in good faith an acceptable resolution. If a resolution cannot be negotiated, then the parties agree to submit the dispute to voluntary non-binding mediation before pursuing other remedies. This provision does not limit the City’s right to terminate authorized by this Contract. 4.12 The Contract is made with reference to and shall be construed in accordance with the laws of the State of Washington. If a dispute arises under this Contract, resort shall be to litigation and jurisdiction and venue shall be in the Superior Court of Grant County, State of Washington. 5. Moses Lake Council Packet 9-28-21, Page 63 of 73 2021 Snow Plowing– Contract No. 116.2021.03 Page 19/24 INSURANCE REQUIREMENTS _______________________________________________________________________________________ EXHIBIT A Indemnification / Hold Harmless The Contractor shall defend, indemnify and hold the Owner and its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with the performance of this Agreement, except for injuries and damages caused by the sole negligence of the Owner. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the Owner, its officers, officials, employees, and volunteers, the Contractor’s liability hereunder shall be only to the extent of the Contractor’s negligence. It is further specifically and expressly understood that the indemnification provided herein constitutes the Contractor’s waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement. A. Insurance Term The Contractor shall procure and maintain insurance, as required in this Section, without interruption from commencement of the Contractor’s work through the term of the contract and for thirty (30) days after the Physical Completion date, unless otherwise indicated herein. B. No Limitation Contractor’s maintenance of insurance, its scope of coverage and limits as required herein shall not be construed to limit the liability of the Contractor to the coverage provided by such insurance, or otherwise limit the Owner’s recourse to any remedy available at law or in equity. C. Minimum Scope of Insurance Contractors required insurance shall be of the types and coverage as stated below: 1. Automobile Liability insurance covering all owned, non-owned, hired and leased vehicles. Coverage shall be at least as broad as Insurance Services Office (ISO) form CA 00 01. 2. Commercial General Liability insurance shall be at least as broad as ISO occurrence form CG 00 01 and shall cover liability arising from premises, operations, stop gap liability, independent contractors, products-completed operations, personal injury and advertising injury, and liability assumed under an insured contract. The Commercial General Liability insurance shall be endorsed to provide a per project general aggregate limit, using ISO form CG 25 03 05 09 or an equivalent endorsement. There shall be no exclusion for liability arising from explosion, collapse or underground property damage. The Owner shall be named as additional insureds under the Contractor’s Commercial General Liability insurance policy with respect to the work performed for the Owner using ISO Additional Insured endorsement CG 20 10 10 01 and Moses Lake Council Packet 9-28-21, Page 64 of 73 2021 Snow Plowing– Contract No. 116.2021.03 Page 20/24 Additional Insured-Completed Operations endorsement CG 20 37 10 01 or substitute endorsements providing at least as broad coverage. 3. Excess or Umbrella Liability insurance shall be excess over and at least as broad in coverage as the Contractor’s Commercial General Liability and Automobile Liability insurance. The Owner shall be named as additional insureds on the Contractor’s Excess or Umbrella Liability insurance policy. The Excess or Umbrella insurance coverage will drop down when underlying policy aggregate limits are exhausted. D. Minimum Amounts of Insurance Contractor shall maintain the following insurance limits: 1. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. 2. Commercial General Liability insurance shall be written with limits no less than $1,000,000 each occurrence, $2,000,000 general aggregate and a $2,000,000 products- completed operations aggregate limit. 3. Excess or Umbrella Liability insurance shall be written with limits of not less than $2,000,000 or other per occurrence and annual aggregate. The Excess or Umbrella Liability requirement and limits may be satisfied instead through the Contractor’s Commercial General Liability and Automobile Liability insurance, or any combination thereof that achieves the overall required limits. E. Owner Full Availability of Contractor Limits If the Contractor maintains higher insurance limits than the minimums shown above, the Owner shall be insured for the full available limits of Commercial General and Excess or Umbrella liability maintained by the Contractor, irrespective of whether such limits maintained by the Contractor are greater than those required by this contract or whether any certificate of insurance furnished to the Owner evidences limits of liability lower than those maintained by the Contractor. F. Owner Other Insurance Provision The Contractor’s Automobile Liability, Commercial General Liability and Builders Risk insurance policies are to contain, or be endorsed to contain that they shall be primary insurance as respect the Owner. Any Insurance, self-insurance, or self-insured pool coverage maintained by the Owner shall be excess of the Contractor’s insurance and shall not contribute with it. G. Contractor’s Insurance for Other Losses The Contractor shall assume full responsibility for all loss or damage from any cause whatsoever to any tools, Contractor’s employee owned tools, machinery, equipment, or motor vehicles owned or rented by the Contractor, or the Contractor’s agents, suppliers, contractors or subcontractors as well as to any temporary structures, scaffolding and protective fences. Waiver of Subrogation The Contractor and the Owner waive all rights against each other, any of their Subcontractors, Sub- subcontractors, agents and employees, each of the other, for damages caused by fire or other perils to the extent covered by Builders Risk insurance or other property insurance obtained pursuant to the Insurance Requirements Section of this Contract or other property insurance applicable to the work. The policies shall provide such waivers by endorsement or otherwise. I. Acceptability of Insurers Insurance is to be placed with insurers with a current A.M. Best rating of not less than A: VII and licensed to do business in the state of Washington. J. Verification of Coverage Contractor shall furnish the Owner with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsements, evidencing the Automobile Liability and Commercial General Liability insurance of the Contractor before commencement of the work. Before any exposure to loss may occur, the Contractor shall file with the Owner a copy of the Builders Risk insurance policy that includes all applicable conditions, exclusions, definitions, terms and endorsements related to this project. Upon request by the Owner, the Contractor shall furnish certified copies of all required insurance policies, including endorsements, required in this contract and evidence of all subcontractors’ coverage. K. Subcontractors The Contractor shall cause each and every Subcontractor to provide insurance coverage that complies with all applicable requirements of the Contractor-provided insurance as set forth herein, except the Contractor shall have sole responsibility for determining the limits of coverage required to be obtained by Subcontractors. The Contractor shall ensure that the Owner is an additional insured on each and every Subcontractor’s Commercial General liability insurance policy using an endorsement at least as broad as ISO Additional Insured endorsement CG 20 38 04 13. L. Failure Notice of Cancellation The Contractor shall provide the Owner and all Additional Insureds for this work with written notice of any policy cancellation within two business days of their receipt of such notice. M. Failure to Maintain Insurance Failure on the part of the Contractor to maintain the insurance as required shall constitute a material breach of contract, upon which the Owner may, after giving five business days’ notice to the Contractor to correct the breach, immediately terminate the contract or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the Owner on demand, or at the sole discretion of the Owner, offset against funds due the Contractor from the Owner. This shall include paid claims, reserve claims, and potential claims. N. Deductible Any insurance deductible shall be paid by the Contractor and shall not be greater than 10% of the total "Amount of Quote." O. Property Insurance Owner shall not be responsible for purchasing and maintaining any property insurance to protect the interests of Contractor, subcontractors or others in the Work. Moses Lake Council Packet 9-28-21, Page 67 of 73 2021 Snow Plowing– Contract No. 116.2021.03 Page 23/24 SPECIAL PROVISIONS ______________________________________________________________________________________ 1.0 DESCRIPTION The Contractor shall plow snow as directed by the City Manager, Municipal Services Director, Public Works Division Director, City Engineer, or Street Maintenance Manager until December 31, 2022. Snow plow events are considered emergencies; therefore, when directed to plow snow by the City, provisions of section 10, hours of work, in General Special Provisions are waived. The Contractor shall provide all labor, equipment, and materials required to satisfy the snow plowing requirements in accordance with the Contract and as directed by the City. 2.0 EQUIPMENT A.All equipment shall be in good condition and readily available for use when a snow event occurs. B.The Contractor shall identify the equipment to be used for snow plowing operations on Attachment“A” of this quote proposal. C.The Contractor shall have at least 3 motor graders ready and available for performing the work. Motor graders shall be at least 140 size or larger, shall include chains, an operator, and fuel. D.The Contractor shall have on hand a mechanic’s service truck, wheel loader, and dump truckavailable for service as directed by the City. Motor graders shall be available and operatingsimultaneously to comply with the requirements of these specifications. 3.0 SNOW PLOWING REQUIREMENTS A.The Contractor shall plow snow off the streets and berm the snow in the gutter or edge of pavement. B.The Contractor shall not place snow on sidewalk. C.The Contractor shall not place berms in intersections. D.The Contractor should attempt to keep mail box access open for mail delivery. E.If the street has housing or commercial buildings on only one side, the Contractor shall berm all snowto the opposite side. F.The Contractor shall be capable of moving snow out of the cul-de-sacs and dead-end streets. G.The City will provide snow plow route maps to the Contractor. The Contractor is not authorized to plow snow beyond the City’s right-of-way without written consent of the property owner. No work on private property will be paid by this Contract. 4.0 MEASUREMENT “Motor Graders”, “Wheel Loaders”, and “Dump Trucks” will be measured per hour. For this Contract each motor grader, wheel loader, and dump truck will be measured as a motor grader. Mechanic service trucks will be measured as one half of a motor grader, per hour. Where multiple motor graders, wheel loaders, mechanic service trucks, or dump trucks are placed in service as directed by the City, measurement will be for each motor grader, wheel loader, mechanic service truck, or dump truck in service. Measurement per hour will be rounded up to the nearest half hour. No specific measurement will apply to the lump sum item “Mobilization”. 5.0 PAYMENT The following items will be paid in accordance with the terms of the Contract: “Motor Grader” per hour. The unit Contract price per hour for “Motor Grader”, shall be full payment for all labor, equipment, and materials for each hour that a motor grader, wheel loader, or dump truck is in service as directed by the City of Moses Lake, and for each two hours for a mechanic service truck. Payment for these items shall include costs for all taxes, bonding, fees, and permits. No payment will be made for a piece of equipment that is idle during repairs after one hour of down time. “Mobilization (insurance)” per lump sum. The unit Contract price for “Mobilization” shall be full payment for all insurance required for the Contract. This requires the installation of an irrigation systm, fall seeding, and long term maintenance of a green belt adjacent to the runway. Please see the attached Airport Irrigation area map. A green belt next to the runway, is not a runway, however it is a key safety facility that most airports have. The proposed green belt is also an essential element in the revitalization of the Airport. The proposed green belt would be used for airshow facilities, emergency facilities, and flight operation facilities. A green belt adjacent to the runway is a traditional and needed facility for an airport. The power extention, control valves, and control system adds to the cost, but a pump is not needed so total costs are similar. In addition, the volunteer staff at the airport will help with the project as much as they can. The project estimated at $60,000. Fiscal and Policy Implications This project was under consideration to be conducted in-house by Parks Irrigation Staff and Public Work Water Staff. However, staff is very busy with maintenance throughout the City, so there was never time to work on the project this last year. The Fall seed planting season is just about here now. Therefore, it is best to have the project conducted by a private contractor. The budget for the work would come from Parks and Water funds. Since the project is small, the City can go straight to requesting quotes from the MRSC. The quotes would be solicited from the entire MRSC list, so it would be open to all irrigation system contractors. Council Packet Attachment A.
