Summary Narrative: On 9.28.2021 City Council voted to have the current Airport Lease rewritten to the
satisfaction of both the Airport Advisory Board and the City Council. City staff will need legal support to

of the Airport.

Ordinance Update and Grant Support
Summary Narrative: There are several Complete Streets State Grant opportunities that the City is
missing out on. The loss of not getting Grants on a yearly basis adds up to many improvements not being
conducted each decade. Many small Cities in the area are getting these grants on a continual basis. To
compete for these grants the City will need a major update of its Complete Streets Code (Attachment A).
In addition, the City will need experienced grant writing support to get started.
Potential Complete Streets Grant Sources: State funding sources include the following:
• Department of Transportation (WSDOT)
• Department of Health (DOH)
• Department of Archaeology and Historic Preservation (DAHP)
• Washington Feet First
• Cascade Bicycle Club
• Future Wise
A letter was prepared and sent out to each of the above granting agencies (Attachment B). Letting them
know that we are in the process of updating and wish to be considered for grant funding.
Consultant Support & Selection: The deadlines for Complete Streets Grants are in October and
November. Therefore, City Staff quickly recognized the need for specialized ordinance revisions and
grant support to compete for trails, sidewalks, and streets grant funding. Brooklyn Holton, of Firm
Foundations, was identified as having excellent credentials, complete street experience, and great
contacts with the Complete Street grant agencies (Attachment C).

PHASE1 - POLICY UPDATE AND ADOPTION. This includes a public hearing at the 10.26.2021 City

NOTICE IS HEREBY GIVEN THAT the Moses Lake City Council will consider adoption
of the updated Complete Streets Policy to guide the planning, design, construction and maintenance of the Moses Lake multimodal transportation system.
The City Council of the City of Moses Lake invites all interested parties to attend a Public Hearing on October 26, 2021, at 7:00 p.m. to offer testimony on the decision to
update the Complete Streets Policy. Citizens are also encouraged to participate in the survey prior to October 25th that is provided online in English and Spanish: https://www.firmfoundationscc.com/moseslake.

Overview
The City of Moses Lake and Northland Communications have completed the process established
in the Federal Communications Act for the update and renewal of a cable franchise. Northland
Cable provided official notice to the City for renewal and negotiation under the informal process.
After official correspondence between the entities, the City was contacted by Northland under its
newest DBA Vyve Broadband, who requested by letter, the renewal of the franchise by triggering
the option to have an automatic term extension as provided for in the City’s franchise. Their letter
of request is included in your packet. Staff has reviewed their performance and concurs with the
extension. This public hearing, following the Federal Communications Act, provides the
opportunity for the public to review their performance.
Fiscal and Policy Implications
This is an extension of the existing franchise and the financial terms and conditions would continue
through March 31, 2027.

ORDINANCE 2990
AN ORDINANCE GRANTING NORTHLAND CABLE TELEVISION, INC. A CABLE TELEVISION FRANCHISE RENEWAL
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Renewal.
1.1 Background. On December 11, 2011, effective April 1, 2012, the City, by Ordinance No. 2636, granted to Northland Cable Television, Inc., DBA Northland Cable Television (“Northland”), a franchise to construct, operate, maintain, repair, replace, upgrade and rebuild a cable system for the provision of cable television,
video programming and other programming and related services in the City (the
“Franchise”). By letter, dated July 16, 2021, the City was timely notified of Northland's intent to exercise the five (5) year automatic renewal through March 31, 2027. Northland completed the required upgrades pursuant to Section 10 of the Franchise and the City waives the requirement that the upgrade be completed
on or before the seventh (7) year of the current ten (10) year term. Northland is
currently doing business under two registered trade names, Vyve and Vyve Broadband. 1.2 Automatic Extension of the Franchise Term. The term of the Franchise is
hereby automatically extended for a period of five (5) years, commencing April 1,
2022, and expiring March 31, 2027. 1.3 Amendments. Section 18.2, “Notices”, of the Franchise is updated and amended to reflect changes to Grantee’s designated legal address as follows:

1.4 Estoppel. No event of default under the Franchise, and no event which could become an event of default with the passage of time or the giving of notice, or both, has occurred and is continuing as of the date hereof.

and each of the documents referenced in Section 1.1 of this ordinance, the Franchise shall remain in full force and effect in accordance with its terms.

Larson Recreation Center Operating Feasibility Green Play, LLC Tom Diehl, Project Manager and Principal provided a PowerPoint presentation
to illustrate the options for programs, admission fees, rentals, staffing, operating hours, and type
of equipment installed in the Center. Worksheets with six different financial scenarios were distributed to Council to review, some including debt service and some not. CALL TO ORDER
The regular meeting of the Moses Lake City Council was called to order at 7:05 p.m. by Mayor
Curnel with audio remote access. Special notice for attendance and citizen comment were posted on the meeting agenda. ROLL CALL
Present: Mayor Curnel; Deputy Mayor Jackson; Council Members Eck, Riggs, Liebrecht, and
Hankins. Council Member Myers attended the meeting remotely. PLEDGE OF ALLEGIANCE

Down’s Syndrome Buddy Walk Mayor Curnel attended the buddy walk on Saturday, September 25. He said it was well-attended and he recommended it to anyone who might want to participate next year.
AGCCT Mayor Curnel issued a reminder that the AGCCT Meeting is on September 30 at 6:00 p.m. in Electric City.
CITY MANAGER’S REPORT
Employee New Hire and Promotions An introduction was given of new hire Felicia Ziemer, Recreation Specialist and of the two employees recently promoted: Recreation Superintendent Carrie Hoiness and Athletics Recreation Supervisor Steven Kinzer. Additionally, introduction was given of
Interim Finance Director Gail Gray and Human Resources Director Shannon Springer.

Washington State Main Street Conference City Manager Allison Williams attended the conference as a panelist.
Stratford-Valley Road Paving Memo The completion of the Stratford-Valley Intersection is underway. The paving of the intersection has already been completed and the cleanup work is expected to continue into early October. Municipal Services Director Dave Bren thanked all involved for getting this completed in two days.
CITIZEN’S COMMUNICATION
Municipal Airport Lease Airport Advisory Board Member Richard Pearce addressed Council regarding his concerns with the airport lease and requested that the lease be completely re-done.
Action taken: Council Member Liebrecht moved to do away with the current lease and start from scratch on a new one, second by Council Member Eck. The motion carried 6 – 0. Deputy Mayor Jackson abstained from voting.

#3 Mattawa Police Contract Termination
On September 16, 2021, the City of Mattawa, at the request of the City of Moses Lake, agreed to terminate the contract that had been in place since April 27, 2021. The City of Moses Lake is no longer providing services to the City of Mattawa.
Action taken: Council Member Riggs moved to accept the termination of the Mattawa Police
Contract as presented, second by Deputy Mayor Jackson. The motion carried 7 – 0.

NEW BUSINESS
#4 Snow Removal Contract
The City received one quote for the work in the amount of $50,900 from Central Washington Asphalt, Inc. (CWA), which was $15,900 over the engineer’s estimate. Per CWA, the cost increase for 2021 is due to higher cost of fuel, labor and insurance claims. With the cost nearly doubling for the side arms, the City is doing a Public Outreach for volunteers to snow plow sidewalks for disabled persons and seniors.
Action taken: Council Member Riggs moved to award the snow removal contract as presented, second by Council Member Eck. The motion carried 6 - 1. Deputy Mayor Jackson was opposed. #5 Airport Irrigation Project Discussion The Airport Advisory Board has formally requested the installation of a green belt on the
west side of the main runway. This requires the installation of an irrigation system, either
using City water or using the Bureau of Reclamation’s irrigation water, fall seeding, and long-term maintenance. A green belt is a key safety facility that most airports have. Airport Advisory Board Member Tim Prickett spoke about the benefits of adding the drought resistant green belt and using Bureau of Reclamation water.
Action taken: Council Member Hankins moved to approve the project as presented, second by
Council Member Liebrecht. The motion carried 7 - 0. ADMINISTRATIVE REPORTS
Recycle Program
The Waste Management recycling program has received a rebate for the past three months. The last month was at $20.10/ton which is a reversal of the City paying $109/ton in 2021. It was also noted that staff will bring forward Lakeside Disposal’s request to extend their contract at a future meeting.
Homeless Encampment by Walmart
Police Chief Kevin Fuhr met with Washington State DOT and the General Manager of Walmart regarding the homeless camp on the West side of Highway 17 near Stratford Rd. They will start the clean up on Friday that should be complete by Monday. COUNCIL COMMUNICATIONS AND REPORTS
Council Member Liebrecht requested Council draft a letter to the Governor to relax the vaccine mandate so that our employees are not in danger of losing their jobs. Only three Council were in favor which lacked the necessary consensus to move forward.
Council Member Riggs thanked Mr. Prickett and staff for the idea of the irrigation concepts and
the greenspace idea. He also requested a citywide consumption report for the new extension on water conservation months. Council Member Myers reported that the Grant Transit Authority received a Safety Star Award
for their stable safety records. The award is for $3,500 to go towards employee recognition.

Mayor Curnel thanked all of those involved to get the Highway 17 homeless camp removed. Several Council Members thanked Municipal Services staff and contractors for their efforts on completion Stratford/Valley Rd. project.

Summary
RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place.

Overview
The platting regulations require all the street and utility improvements installed in right of way
and municipal easements to be accepted by City Council or bonded for prior to recording the plat
and issuing building permits. The construction plans are required to be reviewed and approved
by the City prior to construction. All the construction work is inspected to assure compliance
with the construction plans and city standards. The street and utility improvements in place will
serve a nine (9) lot residential subdivision.

Fiscal and Policy Implications
Upon acceptance, the City will be responsible for the maintenance and repairs of the
improvements. A SUBDIVISION MAINTENANCE BOND or other approved security in the amount
of $100,493.25 (50% of total costs of $200,986.50) to the City is required to be provided by the
owners for the two year maintenance period which commences on the date of acceptance of the
improvements by the City Council.

RESOLUTION NO.
A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR MUNICIPAL USE AS PART OF AS PART OF POTH PHASE 1 MAJOR PLAT Recitals:
1. Street and Utility improvements, lying in dedicated right-of-way or easements, are in place and connected to the City of Moses Lake’s street and utility systems as part of Poth Phase 1 Major Plat.
2. Said street and utility improvements have been installed in accordance with the City of
Moses Lake’s Community Standards, such facilities being completed in August of
2021.
3. RCW 35.90.030 indicates that public street and utility facilities, which are developer installed should be accepted by the City of Moses Lake upon completion if the facilities are built to city standards.
4. A Subdivision Maintenance Bond shall be provided by the developer for a two-year
maintenance period, which commences on the October 12, 2021 resolution date.
Resolved: 1. The City Council of the City of Moses Lake accepts the street and utility
improvements as facilities of the City of Moses Lake and as such will charge for use
of facilities as authorized by ordinance.
2. After October 12, 2021 all operational costs of said street and utility improvements, shall be borne by the City of Moses Lake, as provided by city ordinance.
3. Subject to final inspection, after October 12, 2023 all maintenance costs of said street
and utility improvements, shall be borne by the City of Moses Lake, as provided by
city ordinance.

Overview
The Well 31 Decommissioning Project (GC2021-048) has been progressing as requested. Work
completed so far has included the demolition of the wellhouse structure and the removal of the
well pump.
After the removal of the pump, it became possible to complete a video inspection of Well 31. An
air line and other debris were discovered at two different depths within the well casing (see the
well inspection report attached).
The work to remove the debris from the well is required by the Washington State Department of
Ecology. The debris must be removed in order to perforate the casing and properly decommission
the well.
The original contract price was $49,972.40. The new maximum contract price will be $83,901.60,
however the City will only pay for actual work required to fish the debris out of the well.
Fiscal and Policy Implications
This change order would require additional funds to be spent.

Overview
Staff discovered that three servers that host virtual machines have met their end of useful life
during the recent inventory process and requesting authorization to replace them with two new
PoswerEdge R6525 units costing $33,180.51 each, plus tax.
The servers will continue to work for an indefinite amount of time but could fail and are currently
slowing processes significantly. There are no other remedies to improve their performance
except to replace.
The former servers were general use and not designed to host virtual machines. The proposed
servers are designed for virtual machines and are therefore more robust for this type of
application so only two servers are needed to replace the current three.
Fiscal and Policy Implications
Funds were not budget for the expenditure in 2021. The attached memo for IT staff explains the
current situation and three options for replacement.
With the new inventory tracking, servers will be monitored for replacement on an annual basis in
the future.

Options for VM Server upgrades.
We currently have 3 physical, hardware servers hosting 23 virtual servers for different roles. It provides
better flexibility and saves employees from interruptions since the virtual machines can be moved from
one physical machine to another if any hardware fails, or if updates are needed, allowing the system to
fail gracefully, and we can back up each full virtual machine and bring it back online from Operations in
hours even if something happened to all equipment at the Civic Center. Trying to replace even basic
servers for each of those would run somewhere around $161,000 ($7,000 each by the 23 servers we are
running). So, we are proposing the following possibilities:
Option 1 ($47,000):
• 3 Basic Dell servers with additional RAM to support the current virtual machines with proper
failover capabilities and proper Windows licenses.
• These servers would work but would have some performance penalties around simultaneous
usages. We’d expect them to need to be replaced in roughly 5-6 years in service. They would
certainly be faster than the current machines which are 10 years old.
Option 2 ($66,500)
• 2 purpose-built machines customized to handle much more parallel usage and load, they would
each have the ability to handle the entire load so that any hardware problems could be handled
without interrupting employee’s usage.
• These would bring marked improvements to any city employee that currently accesses any
server on the city’s network, saving a substantial amount of time. We’d expect these to last
easily from 8-10 years of usage.
Option 3 ($85,000)
• 2 purpose-built machines, as in option 2. Added this, replacing our current virtual machine drive
space with hardware (2 - 12-bay high speed network storage units) that could also fail gracefully,
allowing more fully uninterrupted operation, rather than time spent restoring from backups,
and provide further assurance that city employees can complete their tasks quickly and without
interruption.
• These would similarly provide 8-10 years of usage for the hardware, provide flexibility in
updating storage space, and allow cleaner updates to mitigate security concerns quickly in
allowing updates for all the components while the system stays active.

Staff Report Summary
The attached resolution authorizes the continuation of the suspension of utility shut offs and
waiving of delinquent fees and assessments through October 31, 2021. Monthly shut offs and
delinquent fee assessment will resume in November per the attached schedule.
Overview
On March 18, 2020, Governor Inslee issued Proclamation 20-23 which called on all water
providers in Washington State to ensure the health and safety of their employees and the
public by stopping disconnection of water service due to non-payment and waiving of late
payments for all customers during the COVID-19 pandemic. After a series of proclamations
were issued extending the disconnection and late fee waiver, Governor Inslee issued
Proclamation 20-23.16 providing a final termination date for the moratorium on September
30, 2021.
In response to the Governor’s order, the City of Moses Lake developed the COVID-19 Utility
Relief Program to provide an opportunity for our customers to seek long-term payment plans
and CARES Act grant funds to help alleviate any financial hardship created by the pandemic
on September 9, 2020. As of October 6, 2021, we have received 77 applications for payment
arrangements and/or CARES Act grant funds. We have paid less than $10,000 in delinquent
charges with CARES funds, with approximately 30 applications still pending final review.
There are nearly 600 delinquent residential water/sewer accounts totaling over $300,000 in
delinquent balances.
Despite our continued efforts over the past twelve months, encouraging customers to contact
the utility department for payment arrangements and/or financial assistance, we did not

receive the response we’d hoped for. We have seen a sharp increase in customer calls
regarding how to apply for assistance since the moratorium expiration date and we expect a
similar increase in applications received. We have seen a recent surge in financial assistance
provided by OIC paying customer bills, however appointment availability is currently
backlogged by 2-3 weeks with check issuance taking an additional 3 weeks on average.
Our plan moving forward will include scheduling shut off dates for those 600+ customers
throughout the month of November with final notice of termination delivered on the October
utility bills, followed by phone and/or door notifications stating scheduled turn off dates and
times. To handle the volume of delinquent accounts subject to suspension, we are increasing
shut off dates to twice per week in November and will continue until we reach a manageable
amount and can resume once per week. We are adjusting our phone notification schedule to
deliver calls the Friday prior to scheduled shut off dates, allowing additional time for
customers to remit payment or apply for assistance. Delinquent fees will be assessed in
accordance with MLMC 13.12.085 if the account remains unpaid without an approved
payment arrangement in place. Fiscal and Policy Implications
The utilities will continue to see reduced cash flow, and we could lose approximately $15,000 in
late fees deposited into the Water/Wastewater fund from this action.

RESOLUTION 3869
A RESOLUTION AUTHORIZING TEMPORARY SUSPENSION OF UTILITY SHUT OFFS AND LATE FEES THROUGH OCTOBER 2021 TO CONTINUE PROVIDING RELIEF FOR CUSTOMERS IMPACTED BY
THE COVID-19 OUTBREAK. Recitals: 1. Businesses and individuals throughout the State of Washington have been negatively
impacted by the COVID-19 outbreak, and are experiencing unprecedented economic
hardship. 2. A Covid-19 Utility Relief Program was authorized on September 1, 2020 by the City Manager in accordance to Resolution No. 3811 and Executive Order 20-23.4 from the
Governor’s Office which expired on September 30, 2021.
3. The City Council desires to extend the relief provided by Executive Order 20-23.4 and the City’s Covid-19 Utility Relief Program through October 31, 2021, by temporarily suspending utility shut offs and waiving late fees for delinquent customers to allow
additional time for those impacted to seek financial assistance for delinquent balances or
secure a payment arrangement with the Utility Billing Department.
Resolved: 1. The City Council of the City of Moses Lake hereby authorizes the continuation of the

Ratepayer Assistance and Preservation of Essential Services
WHEREAS, on February 29, 2020, I issued Proclamation 20-05, proclaiming a State of Emergency
for all counties throughout Washington State of as a result of the coronavirus disease 2019 (COVID-
19) outbreak in the United States and confirmed person-to-person spread of COVID-19 in Washington
State; and
WHEREAS, as a result of the continued worldwide spread of COVID-19, its continued persistence in
Washington State, and the high risk it continues to pose to our most vulnerable populations, I have
subsequently issued several amendatory proclamations, exercising my emergency powers under RCW
43.06.220 by prohibiting certain activities and waiving and suspending specified laws and regulations;
and
WHEREAS, the COVID-19 disease, caused by a virus that spreads easily from person to person
which may result in serious illness or death and has been classified by the World Health Organization
as a worldwide pandemic, continues to persist as an ongoing threat in Washington State; and
WHEREAS, the COVID-19 pandemic caused a global economic slowdown and an economic
downturn in Washington State, which resulted in layoffs and reduced work hours for a significant
percentage of our workforce and significant reductions in business activity impacting the commercial
sectors that support our state’s economic vitality, including severe impacts to the large number of small
businesses that make Washington State’s economy thrive; and
WHEREAS, the COVID-19 pandemic has limited the available financial resources of many of our
people and businesses with many of them suffering considerable economic hardship as a result of the
economic impacts of the COVID-19 pandemic on our economy, resulting in a significant threat of
utility services being disconnected and late payment fees being imposed; and
WHEREAS, maintaining provision of utility services during this crisis is an essential tool in
sustaining and protecting the health and welfare of our people and businesses as a critical part of the
overall response to the COVID-19 pandemic; and
WHEREAS, the Washington State Utilities and Transportation Commission regulates the rates and
services of investor-owned utilities in Washington State and is coordinating with utilities throughout
the State to protect the availability and affordability of essential utility services for those economically
impacted by the COVID-19 pandemic through a variety of measures, including: suspending
disconnection of utilities for nonpayment, waiving late fees, working with affected utility customers to

establish payment arrangements, and improving access to energy assistance for affected customers;
and
WHEREAS, on March 18, 2020, I issued Proclamation 20-23, waiving and suspending statutes and
prohibiting certain activities relating to utility services; and
WHEREAS, on March 24, 2020, I issued Proclamation 20-23.1, amending and continuing the waivers
and suspension of statutes and the prohibitions of certain activities relating to utility services; and
WHEREAS, under the provisions of RCW 43.06.220(4), the statutory waivers and suspensions in
Proclamations 20-23, et seq., have been periodically extended by the leadership of the Washington
State Senate and House of Representatives, and which I acknowledged and similarly extended the
prohibitions therein; and
WHEREAS, on January 15, 2021, under the provisions of RCW 43.06.220(4), the statutory waivers
and suspensions of Proclamation 20-23, et seq., were extended by Senate Concurrent Resolution 8402
until the termination of the state of emergency pursuant to RCW 43.06.210, or until rescinded,
whichever occurs first, and which I acknowledged and similarly extended the prohibitions therein; and
WHEREAS, on March 18, 2021, I amended 20-23, et seq., to extend the prohibitions on
disconnecting, refusing to reconnect, and charging late fees until termination of the COVID-19 State of
Emergency or 11:59 p.m. on July 31, 2021, whichever comes first; and
WHEREAS, the Washington State Utilities and Transportation Commission extended its moratorium
for disconnections for nonpayment through July 31, 2021, at which time the Commission will lift its
moratorium; and
WHEREAS, the worldwide COVID-19 pandemic and its persistence in Washington State continue to
threaten the life and health of our people as well as the economy of Washington State, and remain a
public disaster affecting life, health, property or the public peace; and
WHEREAS, the Washington State Department of Health continues to maintain a Public Health
Incident Management Team in coordination with the State Emergency Operations Center and other
supporting state agencies to manage the public health aspects of the incident; and
WHEREAS, the Washington State Military Department Emergency Management Division, through
the State Emergency Operations Center, continues coordinating resources across state government to
support the Washington State Department of Health and local health officials in alleviating the impacts
to people, property, and infrastructure, and continues coordinating with the Department of Health in
assessing the impacts and long-term effects of the incident on Washington State and its people.
NOW, THEREFORE, I, Jay Inslee, Governor of the state of Washington, as a result of the above-
noted situation, and under Chapters 38.08, 38.52 and 43.06 RCW, do hereby proclaim that a State of
Emergency continues to exist in all counties of Washington State, that Proclamation 20-05 and
amendments thereto remain in effect, and that Proclamations 20-05 and 20-23, et seq., are amended to
(1) recognize the extension of statutory waivers and suspensions therein by the Washington State
Legislature until termination of the State of Emergency pursuant to RCW 43.06.210, or until rescinded,

whichever occurs first, and (2) similarly extend the prohibitions therein until through the termination
of the state of emergency, or until rescinded, whichever occurs first, unless provided otherwise below.
I again direct that the plans and procedures of the Washington State Comprehensive Emergency
Management Plan be implemented throughout state government. State agencies and departments are
directed to continue utilizing state resources and doing everything reasonably possible to support
implementation of the Washington State Comprehensive Emergency Management Plan and to assist
affected political subdivisions in an effort to respond to and recover from the COVID-19 pandemic.
I continue to order into active state service the organized militia of Washington State to include the
National Guard and the State Guard, or such part thereof as may be necessary in the opinion of The
Adjutant General to address the circumstances described above, to perform such duties as directed by
competent authority of the Washington State Military Department in addressing the outbreak.
Additionally, I continue to direct the Washington State Department of Health, the Washington State
Military Department Emergency Management Division, and other agencies to identify and provide
appropriate personnel for conducting necessary and ongoing incident related assessments.
ACCORDINGLY, in recognition of the above findings, and to help preserve and maintain life, health,
property or the public peace under RCW 43.06.220(1)(h), I continue to prohibit all energy,
telecommunications, and water providers in Washington State from conducting the following
activities:
(1) Disconnecting any residential customers from energy, telecommunications, or water service
due to nonpayment on an active account, except at the request of the customer.
(2) Refusing to reconnect any residential customer who has been disconnected due to
nonpayment;
(3) Charging fees for late payment or reconnection of energy, telecommunications, or water
service; and
(4) Disconnecting service to any residential customer who has contacted the utility to request
assistance from the utility’s COVID-19 Customer Support Program.
These prohibitions on disconnecting, refusing to reconnect, and charging late fees in this proclamation,
as amended, are extended until termination of the COVID-19 State of Emergency or 11:59 p.m. on
September 30, 2021, whichever comes first.
Citizens encountering financial difficulties should contact their local utility providers. Most utilities
have adopted policies that can help with delinquent bills and ensure continued service after the
moratorium expires. Also, the Washington State Department of Commerce has assembled resources
for utility customers, which may be accessed here or by calling 2-1-1.
FURTHERMORE, it continues to be the intent of this order to ensure that vulnerable populations and
households retain access to essential services while they are experiencing financial hardship caused by
layoffs, reduced hours, or other circumstances caused by the COVID-19 pandemic. Access to these
services is critical to ensure the safety and health of our communities during this crisis. This order
therefore acknowledges the role that the public and private utilities subject to this order play in
protecting the health and well-being of our communities and families; and expresses gratitude for their
voluntary efforts to support customers during this crisis.

ADDITIONALLY, I want to thank the vast majority of utility customers who have continued to pay
what they can, as soon as they can, to help support the people and the systems that are supporting them
through this crisis. The intent of Proclamation 20-23, et seq., is to provide relief to those individuals
who have been impacted by the COVID-19 crisis. This Proclamation does not relieve customer from
the obligation to pay for utility services. Customers and utilities are expected to continue to
communicate in good faith with one another, and to work together, on the timing and terms of payment
and repayment solutions. Utilities should prioritize use of customer support tools, particularly those
that have accrued extensive utility bill arrearages, prior to the end of the moratorium, in order to help
avoid credit and collections issues.
Violators of this order may be subject to criminal penalties pursuant to RCW 43.06.220(5).

Overview
The Municipal Services and Public Works departments have
been investigating installing a city owned and operated self-
service 100LL fuel system at the Moses Lake Municipal
Airport. In order to support the funding of the potential
fueling system the City secured a WSDOT Community
Aviation Revitalization Board (CARB) Loan in September of
2020 in the amount of $175,000.
Engineering staff conducted research, design, and bidding preparations that provided two
feasible system configurations as follows:
Option A: provides a 12,000 gallon used and refurbished tank
Option B: provides a 6,000 gallon new tank.
The Engineer’s Estimate for either option was $274,837.36.
Bid Results: Bids were solicited and Staff opened bids for the Municipal Airport Fuel Storage
Project on September 22, 2021. The City received five (5) bids for the work (see attached bid
summary). The apparent low bid is Ultra Tank Services Inc. from of Bellingham, WA at
$342,766.22 for a 6000 gallon system. Ultra Tank Services Inc., has all of their licenses in place
with the State and is judged to be a responsible bidder per State requirements.

Airport Advisory Board Recommends Bid Rejection: The Airport Advisory Board held a public
meeting on Thursday, October 7, 2021. The Board reviewed the Bids and voted to recommend
rejection of the September 22, 2021 bids. In addition, the board recommends preparation of a
new package for the solitiation of bids.
Private Fuel Service Letter: Crosswinds Aviation also
responded to the open Bid Solicitation with a letter
offering to provide the service privately on a 24/7
basis, with service improvements to provide self
service, and at competitive prices. The Crosswinds
Fuel System is already installed and in service at the
Airport.
Fiscal and Policy Implications
The Municipal Airport Fuel Storage Project would require planned and budgeted funds to be
spent including funds from a CARB loan. The CARB loan currently provides $175,000 of borrowed
funding. An additional $167,766.22 of funding would be necessary for this project.

Overview
Hayden Homes is complete with the City requested Offsite Sewer and Water improvements per
the February 23, 2021 Council Action (Attachment A). The work was conducted under a
Developer Extension Agreement and Hayden Homes has requested reimbursement in the
amount of $928,093.77 (Attachment B).
Watermain Relocation: City Staff had estimated a cost of $440,000 to complete the water line
from well 31 to Hansen Road (Attachment C). The February 23, 2021 Council Action authorized
working with Hayden Homes by Developer Agreement to complete the water line. The
contractor, Rotchy Incorporated, estimated $195,111.11 for the work and then completed it for
$193,230 including the irrigation costs, sales tax, traffic control, patch, and prorated
mobilization. (Attachment E).
WESTSHORE DRIVE AREA HANSEN & WESTSHORE INTERSECTION UNDER CONSTRUCTION

Deep Sewermain Construction: City Engineering had budgeted in the 2020 budget $750,000 to
complete the construction of a very deep sewer main (32’) through the Westshore Drive hill to
avoid a future pumpstation and its long term maintenance (Attachment D. The February 23,
2021 Council Action authorized working with Hayden Homes by Developer Agreement to
complete the sewer line. The contractor, Rotchy Incorporated, estimated $691,847.19 for the
work and then completed it for $734,863.77 including sales tax and prorated mobilization.
Fiscal and Policy Implications
The reimbursement for City requested water and sewer improvements would require previously
planned and budgeted funds to be spent.

Erika Ritchie, Social Worker and Youth Homelessness advocate from HopeSource, spoke in support of the enhanced shelter. School Board Member Vickey Melcher spoke in opposition of the City funding to HopeSource for the shelter funds. Deputy Mayor Jackson was opposed. #5 Airport Lease Modification Council adopted a new lease agreement in January 2020. City Manager Allison Williams reviewed leases from other airports and provided the amended language to Section 31. Staff is requesting Council consideration to allow staff to exercise the portion of the Developer Agreement related to completing the water and sewer improvements in Westshore Drive and appropriate bonding to ensure the completed project. Action taken: Council Member Liebrecht moved to authorize the City to move forward with the reimbursement to the Developer per the Development Agreement, with a finding that the timeline is required by the Developer to have them proceed with the project and have the City reimburse them, second by Council Member Eck. The motion carried 7 -0. NEW BUSINESS #7 Zoning for Sleeping Shelters MLMC 18 Ordinance 2969 The original siting decision and type of shelter used for the Open Doors Sleep Center project in 2020 was made under the emergency provisions related to the COVID-19 pandemic and associated grant funding. The Code needs to be amended to authorize sleeping shelters at the Broadway location. An email was received from Vaughn Ann Blethen in support of the zone change. Action taken: Council Member Riggs moved to adopt Ordinance 2969 as presented, second by Deputy Mayor Jackson. The motion carried 7 -0. #8 Community Street and Utility Standards Update Resolution 3845 Staff has updated the 2018 Community Street and Utility Standards to correspond with the 2020 Washington State Department of Transportation's Standard Specifications for Road, Bridge, and Municipal Construction. ADMINISTRATIVE REPORTS City Manager Allison Williams requested Council send her comments regarding the snow removal as she will be addressing the current contract protocols with staff. She also stated that staff will have the facilities and policies ready to have a limited attendance in-person option for the next Council meeting. Finance Director Cindy Jensen advised that they are in negotiations with Eastside Wood Recycling to collect yard waste on a portion of the property al the City's former fire range. This would avoid costs or the other potential vendor to haul to Ritzville. COUNCIL COMMUNICATIONS AND REPORTS Council Member Don Myers thanked the Police Chief Kevin Fuhr for coordination his ride along, shared a few incidents, and that there is a good morale within the Police Department. 1.CONSTRUCTION STAKING SHALL BE DONE BY A PROFESSIONAL LAND SURVEYOR AND A COPY OF THE STAKING NOTES
SHALL BE PROVIDED TO THE DEVELOPMENT ENGINEER.
2.THE CONTRACTOR SHALL PROVIDE A TRAFFIC CONTROL PLAN FOR WORK WITHIN THE RIGHT-OF-WAY THAT MEETS ALL

SANITARY SEWER CONSTRUCTION
1.SEWER MAINS SHALL BE AIR TESTED AT 5 PSI FOR 5 MINUTES AFTER ALL BACKFILL OPERATIONS ARE COMPLETE. THE
CITY SHALL OBSERVE AND VERIFY ALL SEWER MAIN TESTS PRIOR TO ACCEPTANCE. THE CONTRACTOR SHALL
PROVIDE 24-HOUR NOTICE TO THE CITY PRIOR TO ALL TESTS.
2.ALL MAINS, SERVICE LATERALS, AND MANHOLES SHALL BE CLEAN AND FREE OF DIRT AND DEBRIS.
