RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council. RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place. Background City Council approved the Poth 1 Major Plat. In the interim between the approval of the preliminary plat and final plat, a boundary line adjustment was made, removing land area out of the proposed plat. The land removed from the plat was adjacent to the cul-de-sac serving the plat. The plat dedicated a four-foot utility easement and 10-foot right-of-way around the cul-de-sac. The attached easement provides for continuation of the easement and right away on the cul-de- sac. Fiscal and Policy Implications Municipal Code directs Council to accept easements that are conveyed to the City. Background The platting regulations require all the street and utility improvements installed in right of way and municipal easements to be accepted by City Council or bonded for prior to recording the plat and issuing building permits. The construction plans are required to be reviewed and approved by the City prior to construction. All the construction work is inspected to assure compliance with the construction plans and city standards. The street and utility improvements in place will serve a thirty-two (32) lot residential subdivision. As part of the platting process, the Developer is responsible for the half width improvements to Westshore Drive and Hansen Road for the frontage of the plat. The Developer has a Development Agreement is in place for these improvements to take place with Sagecrest Phase 3 Major Plat. The City participated in the costs to extend 18” sewer from Montana Street to north of Cove West Drive. The 18” sewer is to serve the future needs of the Mae Valley development area. Moses Lake Council Packet 9-8-20, Page 32 of 60 Page 2 of 2 Fiscal and Policy Implications Upon acceptance, the City will be responsible for the maintenance and repairs of the improvements. A Subdivision Maintenance Bond or other approved security in the amount of $445,556.00 (50% of total costs of $891,112.00) to the City is required to be provided by the owners for the two year maintenance period which commences on the date of acceptance of the improvements by the City Council. Street and Utility improvements, lying in dedicated right-of-way or easements, are in place and connected to the City of Moses Lake’s street and utility systems as part of Sagecrest Phase 1 Major Plat. 2. Said street and utility improvements have been installed in accordance with the City of Moses Lake’s Community Standards, such facilities being completed in August 2020. 3. RCW 35.90.030 indicates that public street and utility facilities, which are developer installed should be accepted by the City of Moses Lake upon completion if the facilities are built to city standards. Resolved: 1. The City Council of the City of Moses Lake accepts the street and utility improvements as facilities of the City of Moses Lake and as such will charge for use of facilities as authorized by ordinance. 2. After September 8, 2022, all further maintenance and operation cost of said street and utility improvements, shall be borne by the City of Moses Lake, as provided by city ordinance. In December 2019, the Council held a work session with the providers of services in an effort to understand the work being done to assist the homeless and chronically homeless populations in Moses Lake. In May 2019, the City Council passed Resolution 3764 electing to have the City operate its own homeless program and in August 13, 2019 the City Council passed Resolution 3774 declaring the City’s intent to authorize a sales and use tax for affordable and supportive housing. In May of this year, due to the onset of the COVID pandemic, funding came available to provide for those most at risk to be housed, tested and quarantined which would help the City with the chronic homelessness issue as identified in the Grant County Plan to End Homelessness. In that plan, the January point in time count identified 63% of the unsheltered population was within Moses Lake. In May action was taken to award an outreach contract to HopeSource, however the homeless site location was not approved and City staff have been working with HopeSource on a permanent site as well as evaluating sites for a temporary location. At this meeting, an overview will be provided of the work and a preferred temporary location will be discussed. BACKGROUND: With the onset of the COVID pandemic, Grant County received COVID-19 Emergency Housing Funds that provided the ability to create a plan for the identification of, housing of and quarantining of populations that are at risk. The plan needed to be signed off on by the Public Moses Lake Council Packet 9-8-20, Page 36 of 60 Page 2 of 2 Health Officer. The funding was intended to create additional emergency shelter space, increase access to sanitation and hygiene and address the costs of the displacement. The plan needed to be done in partnership with the largest city. As a result of the effort, the City developed the first phase of a plan for the chronically homeless, carried out a request for proposals for a qualified non profit as a partner in an initial and long term plan to provide a progressive response to the housing need for those most at risk in Moses Lake. HopeSource was the successful respondent and a contract for services has been executed whereby HopeSource began with outreach to the homeless population. Recognizing that the City needs infrastructure for the homelessness issue in the City, City staff have been working with HopeSource on a permanent solution, while taking input on potential site location for a temporary facility. In addition, the City hired a coordinator for the program who will also provide grant administration within the Community Development Department. At this meeting, a presentation / overview will be provided and a preferred site will be discussed for the temporary homeless housing project, with the potential of a lease of the site on the September 22nd City Council agenda. The cost of the plan is being covered by the COVID-19 Emergency Housing funds received through the County and City of Moses Lake CARES Act funding. Action requested: Review and discussion of the presentation and consensus to move forward with developing a lease for the preferred site, which would be brought for action on September 22. Penn Street for the purposes of carrying out recreation programs. The lease is set to end November 30, 2020. Staff has negotiated for the extension of the lease for an additional 30-month term. BACKGROUND: The properties on Penn Street used to be the City’s Public Works site. Upon the sale of these properties to Joe and Lori Garro, the City leased back The Learning Center location and embarked on the process of designing the Larson Recreation Center. The Larson Recreation Center is set to go to bid at the end of September and if the bid is successful and the project is awarded, then the programs at The Learning Center would transition to the Larson Recreation Center upon its completion. The lease amount is $3,100 a month, which is an increase from $2,000 a month, however less than the market rate of $6,000 a month for like space. The City Council will be presented with the option to exchange that value for properties that were to be included in the original sale. This transaction will be coming forward on the September 22nd Council Agenda. Date and Parties. This Lease, for reference purposes only, is dated the __ day of September, 2020, and is entered into by and between Joe and Lori Garro, husband and wife, ("Lessor") and the City of Moses Lake, a municipal corporation organized under the laws of the State of Washington, ("Lessee"). 2. Subject Property and Leased Premises. Lessor hereby leases to Lessee and Lessee hereby leases from Lessor the following property: a. Approximately 6,000 square foot building located at 701 E. Penn St., Moses Lake, Washington, and located on the land legally described in Exhibit A attached hereto. This building houses the City’s Learning Center (“TLC”). The above property is referred to as the "Leased Premises". 3. Lease Term. The term of the Lease shall commence on December 1, 2020, and shall expire on June 1, 2023. Notwithstanding the foregoing, at the time the new Larson Recreational Center facilities are ready for TLC occupancy, Lessee may terminate this Lease upon 90 days advance written notice. 4. Rent. Lessee shall pay the Lessor as rent the sum of $3,100.00 per month. 5. Utilities. Lessee agrees to pay for all utility charges associated with Lessee's use of the Leased Premises. Provided, however, Lessor shall be responsible for any utility assessment charged to the Subject Property for system wide utility improvements, such as, but not limited to LID and ULID assessments. 6. Parking. Lessee shall be entitled to continued use of the parking area provided on the Subject Property. Lessor agrees that he will not allow further uses on the Subject Property that would require the use of any of the current parking established for the Subject Property. 7. Indemnification and Insurance. Lessee shall defend, indemnify, and hold harmless the Lessor from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or damage to property, Moses Lake Council Packet 9-8-20, Page 40 of 60 2 which arises out of Lessee's negligent use of Leased Premises, or from the negligent conduct of Lessee's business, or from any activity, work or thing done, permitted, or suffered by Lessee in or about the Leased Premises, except only such injury or damage as shall have been occasioned by the sole negligence of the Lessor. In the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Lessee and Lessor, the Lessee's liability hereunder shall be only to the extent of the Lessee's negligence. The Lessee shall procure and maintain for the duration of the Lease, insurance against claims for injuries to persons or damage to property which may arise from or in connection with the Lessee's operation and use of the Leased Premises, with insurance limits to be approved by Lessor. Lessee shall not assign this Lease nor sublet the leased premises without Lessor's written consent. 9. Waivers. One or more waivers of any covenants or conditions by either party shall not be construed as a waiver of a subsequent breach of the same covenant or condition or agreement. 10. Use of Premises. Lessee will not make any changes or alterations to the Property without Lessor's prior written consent, which consent will not be unreasonably withheld. Lessee agrees not to violate any law, ordinance, rule, or regulations of any governmental authority having jurisdiction of the leased premises. 11. Default. The failure by Lessee to observe or perform any of the express or implied covenants, promises, agreements, or provisions of this Lease to be observed or performed by Lessee where such failure has continued for a period of fifteen (15) days after written notice thereof from Lessor to Lessee specifying the particulars of such failure; provided, however, that such notice shall be in lieu of, and not in addition to, any notice required by Washington law, and further that, no default shall be deemed to have occurred where the cure of such failure or default cannot be completed within fifteen (15) days but the Lessee has in good faith initiated corrective action within the notice period and shall diligently pursue such corrective action until its cure has been completed. The City received seven (7) bids for the work. The low bid was $513,818.17 and the Engineer’s Estimate was $841,075.60. Background The 2020 budget includes money for completing these improvements. The installing new communications radios, telemetry panels, and associated electrical upgrades at 30 well, reservoir, booster pump, and control valve locations throughout the City’s water system. This will allow the City to have additional and faster control of the water system as well as getting more data feedback to the operators to diagnose problems. There will also be a better understanding of where investment dollars should go to improve the system. The low bidder, Farmers Electric II of Othello, WA has successfully completed multiple projects for the City of Moses Lake. The Standards provide a set of guidelines for development inside of the City of Moses Lake. The Standards spell out the procedure for applying for a deviation to the Community Street and Utility Standards. The procedure is as follows: A request may be made to the Municipal Services Director for a deviation of any requirement of the Community Street and Utility Standards. All requests shall be in writing and sent to the Municipal Services Director at P.O. Box 1579, Moses Lake, Washington, 98837. Upon receipt of a request or recommendation for a deviation to the Community Street and Utility Standards the City Council or the Municipal Services Director shall consider the deviation request at or prior to its next regular meeting, provided that the request is submitted for review two weeks prior to the City Council meeting. The City Council shall approve, conditionally approve, or disapprove the deviation request in compliance with the following requirements. 1. Deviations shall not be approved that would be detrimental to the public health, safety, or welfare; or that would be injurious to real property. 2. A deviation approval may require such conditions as may serve the objectives of the requirement that is being deviated, insofar as is practicable. Background Rob Parish is proposing developing a Commercial Binding Site Plan creating two parcels located in the 400 Block of South Wanapum Drive. Mr. Parish is proposing to develop one parcel with a sit-down type breakfast diner on one parcel and possibly building a mini storage on the second parcel. As part of the platting process the Developer is responsible for the halfwidth improvements fronting the property. There is an existing water main fronting the property with the ability to serve the parcel with water. Gravity sewer is not available to serve the property. There is an existing sewer force main fronting the property, however due to the volume of flow in this main it was determined this line should remain a transmission line and not to allow services on it. To serve the property the Developer is required to extend a low-pressure force main from an existing manhole in the intersection of Wanapum Drive and Wapato Drive. The existing storm drainage on Wanapum Drive is curb-cut swale type drainage. The developer has two deviation requests: 1) Requesting to install the new low-pressure force main outside of the roadway prism. The main would be installed behind the curb in the planter strip. 2) Install curb cut swale style storm drainage on Wanapum Drive. Fiscal and Policy Implications There are no fiscal implications to the City for granting the deviation request. Policy allows for granting deviations. Options Option Results • Grant the deviation The Developer would be allowed to install the low-pressure force main outside the roadway prism. • Modify the deviation Provide staff with specific changes to the requested deviation . • Take no action The Developer would be required to construct the development to current City standards. Moving the force main to the right of way, off of the street (see attachment). We hope this will minimize traffic impact to an area that sees over 4000 vehicles per day. This impact would be minimized both during install and subsequent maintenance. Moving the prism also allows mitigation of construction proximity risks to the transfer line, which has a near constant flow. Street aesthetics would also be protected due to required patch work. We aim to reduce street cuts, material removal, patching, striping and extensive flagging and traffic impact. No foreseeable impact to future development down S. Wanapum Drive, looking at both the city R/W and feasible lots for future use. Is there any reason why moving the force main would result in negative impacts? The original contract price for the project was $310,658.54. The increase in cost was for additional asphalt to make the flow between gates better for vehicles. Background The Engineering Division of the Municipal Services Department is preparing plans and specifications for constructing full width improvements on Kinder and Longview Streets. During the ROW research process, it was discovered that the west half of Longview Street was never acquired by Grant County prior to the City’s annexation of the housing development. The City of Moses Lake currently has a water main and a BST roadway within this acquisition proposal area. Staff has communicated with the landowner, Jerry Hendrickson. The owner has offered to sell approximately 550 feet x 30 feet wide for road right-of-way, for $10,000. Fiscal and Policy Implications Right-of-Way purchase will be necessary to construct the roadway full width to city standards and to acquire the area that city is currently occupying.
