Grigg. He has informed us that he will be retiring on
February 1, 2021, with his last day being January 17th.
We want to thank you, Spencer, for the thirty years
of service you have given the city in the Parks and
Recreation Department. You have been instrumental
in bringing so many musical events and other
entertaining events to our community over the years.
With you at the helm of the Parks Department, our
citizens have had access to a myriad of recreational
and educational programs; a beautiful Museum and
Art Center; the well-loved Surf ‘n Slide Water Park;
the very popular Cascade Campground; and a city full
of stunning parks and recreation areas (just to name a few). We know that you also have an
amazing staff in your department, who couldn’t have done it without you!

The regular meeting of the Moses Lake City Council was called to order at 7:00 p.m. by Mayor Curnel via audio only remote access. Special notices for attendance and citizen comment were

CITY MANAGER’S REPORT
Interim Parks Director Appointment – Susan Schwiesow The current Parks Director, Spencer Grigg will retire in February after 30 years of service. Recreation Superintendent Susan Schwiesow has been with the City in the Parks Department since 1993 and will be the Interim Director.
Grant County Solid Waste Advisory Committee Vacancy The Grant County Solid Waste Advisory Committee has a vacancy. City Manager Allison Williams would like to have a member of Council, staff, or a local resident apply to represent the City. The Mayor and City Manager discuss the volunteer request to
represent by Council Member Eck and Deputy Mayor Jackson.
COVID Update Due to the increase of COVID exposures and the impact it is having on providing essential services, staff has gone back to the protocols implemented in March after the
first shut down.
Aspect Consulting Contract Amendment Aspect is the Consultant for the water rights claims that are being denied by Department of Ecology. The previous contract was under the City Manager’s signing authority of
$50,000, and they are now estimating an additional $15,000 to complete preparation for a
hearing with the Department of Ecology, complete the Kaufmann purchase and sale agreement, and explore additional water rights.
Action taken: Council Member Liebrecht moved to authorize the City Manager to execute the
contract amendment, second by Council Member Riggs. The motion carried 7 – 0.

#2 2021 Budget Ordinance 2960 – Second Presentation
The first public hearing of the draft ordinance occurred on November 10. There were two revisions: an increase of the solid waste tipping fee and using the City’s portion of LTAC funds for fireworks. Mayor Curnel continued the public hearing at 7:09 p.m. There was no public testimony, and the hearing was closed at 7:09 p.m.
Action taken: Council Member Hankins moved to adopt Ordinance 2960, second by Council
Member Eck. The motion carried 7 – 0. NEW BUSINESS
#3 2020 Budget Adjustment Ordinance – First Presentation
The draft ordinance reflects changes in nine funds totaling $1,306,000 in additional expenses and $931k in additional revenue that are mainly tied to the response to the COVID-19 pandemic. General Fund line items that were not spent were able to accommodate interim expense movement. First presentation of the ordinance. No action taken.
#4 WSDOT Airport Fuel Station Loan Agreement Resolution 3835
The Municipal Airport Advisory Board feel the availability of fuel sales will attract more air traffic/business to the community. They received approval on the loan application submitted to the Community Aviation Revitalization Board (CARB) in late October for $175k. The resolution is required as a pre-contract requirement because this program has a long-term commitment to WSDOT in exchange for the funding. There will be a surcharge on fuel sales to
cover the loan payment as well as other expenses that will be incurred for the new unit.
Action taken: Council Member Eck moved to adopt Resolution 3835, second by Council Member Riggs. The motion carried 7 – 0.
ADMINISTRATIVE REPORTS
Municipal Court Clerk Status The Municipal Court Clerk was previously filled by the former Executive Assistant. When she resigned earlier this year, the role was assigned to Police staff. The City was

recently informed that they can no longer fill the position with administrative or police staff. This decision will affect many of the cities in Grant County. City Attorney Katherine Kenison is working with MRSC to see if this will have an affect statewide and
see if it would be worth trying to get a legislative change. Grant County Conservation District Annexation Status Effective November 6, 2020, the City has been re-annexed into the Grant County Conservation District. City Attorney Katherine Kenison provided the County with an AG
opinion on a prior case example to complete the process.
COUNCIL COMMUNICATIONS AND REPORTS
Council Ad Hoc Homelessness Committee Update Council Member Liebrecht advised that there has been a delay in opening the temporary
sleeping center shelter due to a delay in delivery of shower and office facilities as well as
some electrical work. Housing and Grants Coordinator Taylor Burton will contact the City Council for a tour of the facility prior to its opening. At the Homeless Task Force meeting, it was reported that the Housing Authority will no
longer be disbursing Hotel vouchers and that they are operating under limited hours. The
Ad Hoc Homeless Council Committee is requesting a letter be sent to County Commissioners and the State with a request for an audit and to ensure that services are being provided in accordance with the state grant and the Grant County Plan to End Homelessness.
Action taken: Council Member Eck moved to support a letter to the Grant County Commissioners, second by Deputy Mayor Jackson. The motion carried 7 – 0. Council Member Liebrecht also wanted to express gratitude to Recreation Superintendent Susan
Schwiesow, expressing that she has done a good job over the years when covering absences of Parks Director Spencer Grigg. Council Member Myers had a citizen approach him about only having one drive through COVID testing area in the area. He requested Mayor Curnel to follow up on solutions with the Grant
County Health District. Council Member Hankins requested to have Council think about enforcement of the Governor’s Emergency Pandemic Mandates and how the City should respond to those who are not in
compliance. City Attorney Katherine Kenison said that there are mixed opinions among
Prosecutors on whether or not they will enforce the proclamations and mandates. Chief Fuhr reported that they are not actively searching for non-compliance, however, they have a plan to respond to complaints and try to educate residents on this law. They can also report incidents to the State for Business or Liquor Cannabis Board for possible license suspension. Chief Fuhr also
said that the best thing for Council to do is to be the example to residents for following these
laws. Council Member Riggs also had a conversation with a citizen over the lack of drive-through

testing and advised Samaritan Healthcare’s phone number at 764-3335 is listed in the paper to arrange an appointment to acquire a test. Mayor Curnel stated that our health care system is not overwhelmed at this time for those requesting tests.
EXECUTIVE SESSION
Mayor Curnel called an Executive Session at 7:59 p.m. to be held for 20 minutes pursuant to RCW 42.30.110(1) subsection (i) to discuss litigation; and there will be no further business after the Executive Session. Mayor Curnel extended the Executive Session for 15 minutes.

Summary
RCW 42.24 governs the process for audit and review of claims and payroll payments for the City. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council.
RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City.
RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued.
The City meets all these conditions.
To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting.
All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director.
The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place.

Overview
Staff is seeking approval of a revised work plan in adopting regulatory standards for wireless
facilities.
In September 2018, the FCC adopted a declaratory Ruling and Order that substantially preempts
the City's authority on the siting of small wireless facilities (also known as "small cell facilities") and
set specific rules for small cell permitting. This ruling affects small cell facilities in the public rights-
of-way and private properties and went into effect in 2019.
Some impacts of the FCC Order related to small wireless facilities include a shortened period of
time in which the City has to process franchise agreements and right-of-way use permits, limits on
City permit applications fees, and limits on the City's ability to regulate design requirements.
On August 11, 2020, the City Council approved Ordinance No. 2953 based on a model set of design
standards and permitting procedures being utilized by several Washington cities. The Ordinance
adopted interim regulations regarding small wireless facilities and wireless communication eligible
facilities requests in order to comply with federal law and Federal Communication Commission
(FCC) declaratory rulings, entered findings in support of adopting interim regulations and
established a work program for permanent regulations and declared an emergency.
Once the Ordinance is routed through Planning and state agencies, it will be turned over to
Engineering Services for Council adoption, implementation, and fee schedule.

Overview
Staff is seeking approval of a Landscape Maintenance Agreement with Sun Terrace Developers
and the Homeowner’s Association (HOA). In early November it was brought to the City’s
attention that the Sun Terrace HOA had turned off a meter which provided water to required
landscape along Towhee Street which resulted in the street trees dying. The HOA was
responsible for the water usage. Subsequent phases require additional streetscape and
maintenance along this corridor. The improvements border a future City park and in order to get
the streetscape the City has negotiated the agreement under consideration. There is an existing
water meter to serve the improvements which the City will supply the water. The Developer will
replace the dead trees and install new streetscape within the 5 ft. landscape buffer. The HOA will
maintain the streetscape until such time the City takes over the park.
Fiscal and Policy Implications
The proposed agreement will result in the City of Moses Lake providing water towards the
maintenance of streetscape along future dedicated park land.

AGREEMENT TO PROVIDE LANDSCAPE MAINTENANCE
THIS AGREEMENT between Sun Terrace Homeowners Association (hereinafter “HOA”), a Washington non-profit corporation, and the City of Moses Lake, a Washington municipal corporation (hereinafter “City”), is for the maintenance of landscaping on City property (described herein as Exhibit A; hereinafter “landscaped area”) by the HOA as a condition
of plat approval for one or more plat phases of the Sun Terrace Addition subdivision.
The terms of the Agreement are as follows: 1. The City will provide water service and all other infrastructure necessary to
maintain the landscaped area;
2. The HOA shall provide all labor and materials necessary to maintain the landscaped area; 3. This agreement shall terminate upon one of the following events:
a. By mutual agreement of the parties;
b. By unilateral decision of the City; c. By dissolution of the HOA; d. By sale or transfer of the landscaped area to another entity or person.
This agreement shall become effective upon signature by the parties below.

Overview
RCW 35.33.091 sets forth the requirements to amend the budget absent a true “emergency”.
Most fund amendments are primarily the result of things already approved by Council but just not
completely incorporated in the current budget. A summary of the changes follows:
•COVID Cares Act initiatives. The City received a grant to mitigate the additional costs incurred
because of the pandemic. Additional programs include small business grants; utility payment
assistance; a COVID compliant homeless shelter; information technology to support
telecommuting and remote meetings; improving the Council Chambers audio-visual
capabilities to assist public engagement even though we weren’t meeting in person; and
additional cleaning, personal protective equipment (PPE), and physical barriers between
people to stop the spread of the virus in city facilities. It should be noted that General Fund
also had some additional costs related to COVID, but because it will be underspent in total
(primarily because of the reduction in Parks and Recreation programs), we did not feel it was
prudent to increase its total budget.
•Police received more in forfeited/seized property and is proposing to use it to purchase
supplies for the investigation unit and the Tactical Response Team (TRT).
•We budget a “generic” $26,000 each year for potential paths and trails improvements. We
had an actual project tied to the improvements done along Pioneer, and we anticipate needing
an additional $5,000 to complete the project.
•The Water/Wastewater fund contracted to do a cost of service study for a total of $80,000
split between the two operations.
•The City is reviewing a purchase of water rights, so we are adding $150,000 to the Water Rights
capital fund should we need to put down earnest money.

• Unemployment claims are higher than anticipated this year, adding $25,000 which will be
charged back to applicable operating budgets, keeping that entry neutral as well.
• Risk management deductible estimates exceeding original estimates -- $80,000 is being added.
• In implementing our new financial and asset management systems, we have found that there
can be some efficiencies and reduction in the potential for keying errors if we can “build a
bridge” for data to flow between them. We are estimating that will have a one-time cost of
$60,000.
During development of the 2021 preliminary budget, which requires analysis of 2020 budget
trends and estimates, we noted several instances where additional appropriation is warranted so
funds remain within budget at the end of 2020. In some cases, there is additional revenue to
support the additional expenditures, either in program revenues or grants. In those cases that are
not supported by additional revenue, the fund balance is adequate to absorb the increase.
The attached ordinance increases the 2020 budget for 9 funds resulting in citywide total
expenditures of $1,306,000 and adds $931,000 to estimated revenue, resulting in a net use of fund
balance of $375,000 in 5 separate funds (4 funds have equal expenditures and revenues).
Fiscal and Policy Implications
It is a compliance issue to have actual results be within the authorized appropriation. If we
overspend an appropriation, the State Auditor’s Office would likely note it as an area of non-
compliance with laws.

AN ORDINANCE AMENDING THE 2020 BUDGET FOR THE CITY OF
MOSES LAKE; AND MAKING APPROPRIATIONS FROM
UNAPPROPRIATED FUND BALANCES WITHIN VARIOUS FUNDS
FOR EXPENDITURE DURING 2020 FOR VARIOUS PURPOSES AS
DESCRIBED IN THE ATTACHED SCHEDULE
Whereas, the various funds indicated on the attached Schedule 1 contain Unappropriated Fund
Balances available for appropriation and expenditures during 2020 in various amounts and for
the purposes mentioned in the attached Schedule; and
Whereas, at the time of the adoption of the 2020 budget it could not reasonably have been
foreseen that the appropriation provided for by this ordinance would be required; and the City
Council declares that an emergency exists of the type contemplated by RCW 35.33.091 and that
it is in the best interests of the City to make the appropriation herein provided, now, therefore,
BE IT ORDAINED BY THE CITY OF MOSES LAKE:
Section 1. Appropriations are hereby made, for expenditure during 2020, from Unappropriated
Fund Balances in the various Funds to the various accounts and in the various amounts, and for
the specific purposes, all as specified in the Schedule attached hereto and incorporated herein.
Section 2. This ordinance is one making an appropriation and shall take effect immediately upon
its passage and approval as provided by law.
Section 3. The City Council declares that an emergency exists and this ordinance is deemed a
public emergency ordinance necessary for the protection of public health, public safety, public
property, or public peace and shall take effect immediately as provided by law upon one reading
if a majority plus one of the whole membership of the City Council vote in favor of passage.
Section 4 - Severability. If any section of this ordinance is found to be unconstitutional or
invalid as written or as applied to any particular person or circumstances, no other section of the
ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted
independently and without regard to the section affected.

Overview
The Lodging Tax is an excise tax authorized by State law in RCW 67.28, Public Stadium, Convention,
Arts and Tourism Facilities. The City of Moses Lake has imposed an excise tax on charges for lodging
by hotels, motels, and similar business enterprises, pursuant to Chapter 82.08 RCW. In Moses Lake
the total tax on lodging is 4% (this includes the original 2% sales tax credit and the additional 2%
special excise tax).
The Moses Lake Lodging Tax Advisory Committee (LTAC) met on October 19 to consider the 2021
applications for funding support to eligible groups and organizations that have positive impacts on
tourism in the greater Moses Lake area. The funding source is the hotel/motel tax that the City of
Moses Lake received from the State of Washington.
The LTAC members considered all applications in accordance with the LTAC General Guidelines
documents with specific attention to the Project Evaluation Criteria portion of the Guidelines. The
LTAC originally recommended that the City Council fund 8 of the 13 applications received as
outlined in the attached summary. Council reviewed the recommendation at their October 27
meeting, and asked to add a distribution of $13,000 for Columbia Basin Allied Arts. This triggered
the state rule that the LTAC reconvene to consider the Council change. After meeting again on
November 23, the LTAC members reviewed Council’s recommendation and agreed to fund this
additional applicant at $10,000, still below Council’s requested amount. Since this is the second
recommendation from the LTAC committee, Council can finalize the list.
Fiscal and Policy Implications
The City of Moses Lake has established a special revenue fund titles “Tourism Activities Fund” to
account for the lodging tax receipts and related tourism promotion expenditures.

The City intends to maintain a reserve in the fund and will assess how much of the fund to
appropriate in a given year on an annual basis.
As set forth in RCW 67.28.1816, the revenues received from the City’s hotel/motel tax may be used
for the following purposes only:
1. Tourism marketing;
2. Marketing and operations of special events and festivals designed to attract tourists;
3. Operations and capital expenditures of tourism-related facilities owned or operated by a
municipality or a public facilities district; or
4. Operations of tourism-related facilities owned or operated by non-profit organizations.

Overview
This resolution would approve the new 2021 Fee Schedule for all charges. Many of the fees are
unchanged from 2020. Fire did a comprehensive review of their permit fees, which resulted in
updates to these charges. In accordance with Council direction given in November of 2016, basic
utility fees are being adjusted to keep up with inflationary increases, by applying the year-over-
year increase in September’s All Urban Consumers (CPI-U) West—B/C (i.e. small cities) index of
0.62%. The Water and Wastewater utilities are in the middle of a cost of service study. Preliminary
results of that study show that both these utilities need an overall 3% increase in rates to maintain
operations, so those rates are increased by 3%. The next step in the cost study is to balance rates
among customer classes. We do not anticipate those changes to come until mid-2021.
The Solid Waste utility fees are typically processed in September when the hauling contracts are
updated. This year they were unchanged then because the haulers increase was also under 1%,
and the interfund loans were entirely paid off and not required in the 2021 budget. However, the
County Commissioners passed a 71% increase in the landfill charges to start March 1, 2021. The
resulting rate adjustment to cover this additional cost is 9.0%, which is incorporated in Attachment
A to the fee schedule. Please note that the solid waste rates were reduced by 9.6% in December
2019 as a result of favorable hauling contract negotiations, so solid waste rates will still be below
where they were just over a year ago.
Fiscal and Policy Implications
Since we have previously established by ordinance that the appropriate way to modify the City’s
fee schedule is by resolution, that is how we are setting the fees to be effective January 1, 2021.
These fees were used to develop the revenue estimates that are the basis of resources available
to accomplish the 2021 Budget that was adopted by Council at the November 24, 2020 meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOSES LAKE, WASHINGTON SETTING THE CITY OF MOSES
LAKE FEE SCHEDULE AS OF JANUARY 1, 2021
Recitals:
1. In connection with the municipal functions and operations of the City of Moses Lake,
the City requires certain fees; and
2. It is appropriate to review such fees and make adjustments to appropriately address
costs; and
3. In keeping with the philosophy of setting City fees in amounts reflective of actual costs,
it is appropriate at this time to revise certain fees to compensate the City for costs
associated with various City functions and facilities.
Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSES
LAKE:
Section 1. That the 2021 Fee Schedule of the City of Moses Lake pertaining to all fees is
amended as set forth in Exhibit A.
Section 2. Severability. If any sections, sentence, clause or phrase of this Resolution shall be
held to be invalid or unconstitutional by a court of competent jurisdiction, or its application held
inapplicable to any person, property or circumstance, such invalidity or unconstitutionality or
inapplicability shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this Resolution or its application to any other person, property or
circumstance.
Section 3. This Resolution shall be in full force and effect January 1, 2021.

Overview
The water main and sewer force main on Westshore Drive NE were installed by the developers of
the Moses Pointe development beginning in 2000. The property is under County jurisdiction, but
the property owner wishes to connect to the City services.
Juan Andres Perez requests approval to connect to the City’s water and sewer systems to serve a
single-family residence on their lot, Parcel #170750000 located at 2948 Westshore Drive NE. The
property is located outside of the current City limits and is inside the UGA as defined in the most
current Grant County Comprehensive Plan. The proponent is requesting to connect to City water
and sewer. The City’s water and sewer systems have the capacity to serve the lot. If approved, the
property owners will be required to sign an Extra Territorial Agreement (ETA). The ETA must be in
place before a permit is issued for connecting to city services
Fiscal and Policy Implications
Per Resolution No. 3717, non-contiguous lands may be permitted to connect if it is impractical for
the property owner to annex with Council approval.

Overview
Hayden Homes LLC is the developer of the Sagecrest Major Plat sub-division. The sub-division
includes approximately 95 single family lots with improvements being made to Westshore Drive
and Hanson Road. As part of the platting process Hayden Homes is required to install
improvements with each phase of development to the current City of Moses Lake Standards. Due
to the dynamic and size of some of the improvements it has been determined a developer
agreement would better serve the interests of both the City of Moses Lake and Hayden Homes.
The developer agreement stated as part of Sagecrest Phase 3 Major Plat, Hayden Homes would
develop Westshore drive and Hansen Road to current standards.
Hayden Homes began construction of Sagecrest Phase 1 in approximately February of 2020, this
phase was completed in September of 2020. Construction of phase 2 began in September of 2020
this phase is also nearing completion.
The City of Moses Lake Wastewater Master Plan 2015 shows an eighteen-inch sewer main being
installed in Westshore drive from approximately Blue Heron park north to approximately Road 3.3
NE. In 2015 the City of Moses Lake installed the Blue Heron Lift Station and began installing the
eighteen-inch gravity sewer line in Westshore Drive, the new sewer main was installed to the
intersection of Westshore Drive and Montana Street.
As part of Sagecrest Phase One, the City participated with Hayden Homes to extend the eighteen
-inch sewer main from Montana Street to just north of Cove West Drive.
In conjunction with the developer agreement, staff was planning on participating with Hayden
Homes to install the eighteen-inch sewer main for north of Cove West Drive to the intersection of
Fairway Drive and Westshore Drive with Sagecrest Phase 2. With this timing all the eighteen-inch

ewer main would be in place prior to Hayden Homes building Westshore Drive with Sagecrest
Phase 3.
Due to the additional depth required in this portion of Westshore Drive, up to 32’ deep, the initial
costs of this section of installation are higher than what would be expected for a project of the
same length at a more standard depth.
In consideration of Hayden Homes agreeing to incur the costs associated with the engineering,
design, surveying and asphalt restoration for the cost of over-sizing the municipal utility
improvements Hayden Homes will receive credit for the existing gravity sewer main adjacent to
the Sagecrest Plat, the City of Moses Lake would agree to participate in the costs associated with
upsizing and additional depth required to install the 18” gravity sewer main to meet the current
Wastewater System Plan.
Fiscal and Policy Implications
Moses Lake Municipal Code 17.24.020 City Participation, section A, states the City may
participate in the cost of street and over-sizing municipal utility improvements that are not
required of the applicant. The City will reimburse the owner of the subdivision for the agreed cost
for the additional street and municipal utility improvements after the construction is complete
and accepted by the City Council. No approval is authorized by the City unless a written approval
for the reimbursement by the City is sent to the owner of the Subdivision prior to construction.
Moses Lake Municipal Code 17.24.010 Procedure for installing improvements: states
“comprehensive layout plans should be used by the applicant as a guide in preparing preliminary
plats and construction plans”. The Wastewater System Plan 2015 shows an 18” sewer main
installed in Westshore Drive. It is the City’s intent to have this 18” sewer main serve as far to the
North without the need to install an additional lift station. This future plan will require the 18”
sewer main to be installed a minimum grade defined by Department of Ecology Criteria for
Sewage Design.
Rotschy Incorporated, Hayden Homes contractor, has provided a cost of $600,026.45 to install
this section of sewer main and associated manholes. City Engineering budgeted in the 2020
budget $750,000.00 to complete this project.

1.SEWER MAINS SHALL BE AIR TESTED AT 5 PSI FOR 5 MINUTES AFTER ALL BACKFILL OPERATIONS ARE COMPLETE. THECITY SHALL OBSERVE AND VERIFY ALL SEWER MAIN TESTS PRIOR TO ACCEPTANCE. THE CONTRACTOR SHALLPROVIDE 24-HOUR NOTICE TO THE CITY PRIOR TO ALL TESTS.
2.ALL MAINS, SERVICE LATERALS, AND MANHOLES SHALL BE CLEAN AND FREE OF DIRT AND DEBRIS.
3.ALL 18" GRAVITY SEWER PIPE SHALL BE ASTM F679 PS46 PVC PIPE. 8" GRAVITY SEWER PIPE SHALL BE ASTM D3034 SDR

Overview
In June of 1984, Richard C. Aldrich and Billie Aldrich platted property they owned in the Westlake
area. Part of the platting process required improvements to be made to Idaho Road and Pritchard
Road. The City Council authorized the Aldrich’s to move forward with their plat and deferring the
improvements until a later date in January of 1984.
The terms of the covenant state the property owner is responsible for full width street
improvements on the State frontage of Pritchard Road and Idaho Streets and water and sewer for
the full frontage of the plat.
The triggering event is the City of Moses Lake’s determination that sufficient adjacent
development has occurred to require installation of the improvements.
With the Love’s Travel Stop project moving forward, the adjacent area is being developed to a
standard above what currently exists.
The current owners of the property were notified by letter August 25, 2020, of the City’s intent to
call in the covenant.

Overview
Moses Lake Municipal Code 8.26.030 outlines the billing procedures for false alarms. Incorporated
in the revised ordinance are changes to update and clarify actions / procedures taken by the Fire
Department for responses to occupancies with false fire alarms and aligns with the adopted fee
schedule.
Fiscal and Policy Implications
1. Billing responsibility changes from the Finance Department to the Fire Department.
2. Updates the municipal code to be consistent with the fee schedule adopted by the City

ORDINANCE – First Presentation
AN ORDINANCE AMENDING MOSES LAKE MUNICIPAL CODE SECTION 8.26.030 TITLED “FIRE DEPARTMENT RESPONSE” THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. Section 8.26.030 of the Moses Lake Municipal Code titled “Fire Department Response” is amended as follows:
8.26.030 Fire Department Response
For a Fire Department response to any false alarm the Fire Chief shall inform the Finance Director and the Finance Director shall charge and collect from the person having or maintaining such fire and/or automatic sprinkler alarm system on premises owned or occupied by him/her, fees as follows:
A. For a response to premises at which no other false alarm has occurred within the
preceding three (3) month ninety (90) day period, hereinafter referred to as a “first response,” no fee shall be charged, but the person having or maintaining such fire alarm system and/or automatic sprinkler alarm system shall, within three (3) working days after notice to do so, make a written report to the Fire Chief on forms
prescribed by him setting forth the course of such false alarm, the corrective action
taken, whether such alarm has been inspected by an authorized serviceman, and such other information as the Fire Chief may reasonably require to determine the cause of such false alarm and corrective action necessary.
B. For a second response to the premises within three (3) months ninety (90) days
after the first response, no fee shall be charged, but a written report shall be required as for a first response and the Fire Chief shall be authorized to inspect or cause to be inspected, the alarm system and/or automatic sprinkler alarm system at such premises, prescribe necessary corrective action, and shall give notice to the person
having or maintaining such alarm system of the conditions and requirements of this section. the City Fire Marshal will give notice to the person maintaining or having control of such alarm system that the system must be inspected and/or have maintenance performed to correct the issue resulting in the false alarms.
C. For a third response to the premises within three (3) months ninety (90) days after such second response, and for all succeeding responses within three (3) months of the last response, a fee of five hundred dollars ($500) shall be charged, and if such third false alarm or any such succeeding false alarm is as a result of failure to take
necessary corrective action prescribed by the Fire Chief, the Fire Chief may order
the disconnection of such alarm system and it shall be unlawful to reconnect such alarm system until such corrective action is taken; provided, that no disconnection shall be ordered as to any premises required by law to have an alarm system in

operation. of a first response a fee shall be charged that is specified in the currently adopted City of Moses Lake fee schedule.
D. For a first response caused by a failure of maintenance personnel to provide proper notification to the Moses Lake Fire Department that testing, maintenance, or service work is to be performed on a fire alarm and/or automatic sprinkler or suppression system, a fee of one hundred dollars ($100) shall be charged to the
service company performing the work. For fourth or subsequent response to the premises within ninety (90) days of a first response, additional fees shall be charged that are specified in the currently adopted City of Moses Lake fee schedule.
E. Second, and subsequent responses caused by the failure to provide proper
notification shall result in a charge of two hundred dollars ($200) being assessed. For a false alarm that results in a Fire Department response due to construction activities where the contractor has failed to place the alarm system in standby or “test” condition, or fire drills that have not been duly reported to the Multi-Agency
Communications Center, such responses shall have a fee charged as specified in the
currently adopted City of Moses Lake fee schedule.
Section 2. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of
the ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted independently and without regard to the section affected. Section 3. Effective Date. This ordinance shall take effect and be in force five (5) days after its passage and publication or its summary as provided by law.

Overview
Within Moses Lake City limits there are a number of areas served by private water systems
coordinated through the Grant County Coordinated Water System Plan. If there is a service failure,
RCW 70A.100.060 (3)(b) allows the City Council of the City of Moses Lake, serving in its capacity as
the local legislative authority, to amend the water service areas for the affected utilities.
In March of this year the City received a letter from United Builders of Washington, Inc. asking for
the City to provide water service within the Basin Water Sources, Inc service area so they could
develop their property to an urban standard as Basin Water Sources, Inc was unable to provide
adequate flow. MLMC 13.07.020 (E) provides a process for review of disputes of service which
United Builders of Washington, Inc utilized. The City’s Utilities Technical Review Committee
reviewed the appeal and provided a Notice of Decision of intent to serve on September 23, 2020.
As no appeal of the decision was received, this Ordinance would formalize the adjustment of the
water service boundary and allow for United Builders of Washington, Inc. to move forward with
their building plans through the typical city permitting processes.
Fiscal and Policy Implications
The Ordinance simply provides for the alteration of the water service boundary. Ultimately, with
development, more users will avail themselves of the City’s water utility.

ORDINANCE – 1st Presentation
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MOSES LAKE, WASHINGTON, APPROVING AN AMENDMENT TO
THE WATER SERVICE AREA OF BASIN WATER SOURCES, INC.
Recitals:
1. The Public Water System Coordination Act of 1977, Chapter 70A.100 RCW, provides
guidance and requirements for the provision of adequate supply of potable water through
public water supply systems.
2. RCW 70A.100.060 requires that a coordinated water system plan be created and
approved by the Secretary of the Department of Health (DOH), and the boundaries of a
critical water supply service area be established, and that all purveyors covered by the
plan shall comply with the plan.
3. In 1999, the Grant County Coordinated Water System Plan (CWSP) was created and
approved by the Secretary of DOH as directed by the Public Water System Coordination
Act of 1977.
4. The policies and requirements of the CWSP is based on state law, specifically RCW
70A.100, and establishes the boundaries of water service areas for the area’s various
water purveyors, including the City of Moses Lake and Basin Water Sources, Inc.
5. RCW 70A.100.060 (3)(b) allows the City Council of the City of Moses Lake, serving in
its capacity as the local legislative authority, to amend the water service areas for the
affected utilities.
6. RCW 70A.100.060(3)(b) allows a purveyor of water service to establish a new public
water system within the service area of any municipal water purveyor if the Council
determines that the purveyor cannot provide service in a timely and reasonable manner.
7. RCW 70A.100.060(3)(b) requires that the property affected by the determination be
subsequently removed from the municipal water service area, and that any new public
water system be constructed in accordance with the construction standards and
specifications embodied in the CWSP.
NOW, therefore, the City Council of the City of Moses Lake, Washington, do ordain as
follows:
Section 1. The City Council of the City of Moses Lake makes the following findings of fact:

A. United Builders of Washington, Inc., owns property within the City‘s UGA, retail water
service area, and incorporated limits, and identified by parcel numbers 101193000,
101195000, and 101196000 (Property).
B. The Property is also within the service area of Basin Water Sources, Inc., a private municipal
water purveyor.
C. United Builders of Washington, Inc. requested water service for the Property from Basin
Water Sources, Inc. and was denied the requested service.
D. Pursuant to MLMC 13.07.020 and the CWSP, United Builders of Washington, Inc. filed a
timely appeal challenging the denial of service.
E. The City’s Utilities Technical Review Committee reviewed the appeal and record and issued
a Notice of Decision to serve the property September 23, 2020.
F. Notice was provided to Basin Water Sources, Inc., and the City received no response; Basin
Water Sources, Inc. did not participate in the appeal process.
G. The City has the current capacity to provide the requested water service to the Property in a
safe and reliable manner, can provide the service in a timely and reasonable manner, and has
sufficient water rights to provide the service.
H. The City incorporates the above recitals as additional findings of fact.
Section 2. The City Council of the City of Moses Lake makes the following conclusions of law:
A. The Proposed map amendment has been reviewed pursuant to the requirements of the Public
Water System Coordination Act of 1977, Chapter 70A.100 RCW, and Grant County/Moses
Lake CWSP, and the City of Moses Lake’s Comprehensive Plan, and is consistent with those
requirements.
B. The proposed map amendment is necessary to allow the property owner to establish a public
water system to accommodate a new proposed residential development.
C. As proposed, the amendments should not have a significant adverse impact on public welfare
and safety and will instead enhance and protect the public welfare and safety by providing
water service in sufficient quantity as necessary for adequate fire flow and development at
higher densities consistent with the current zoning designation.
D. The Growth Management Act, at RCW 36.70A.110 (4) states that “In general, cities are the
units of local government most appropriate to provide urban governmental services.”
E. The Grant County/Moses Lake CWSP is incorporated by reference into the City’s
Comprehensive Plan (Moses Lake Comprehensive Plan at Section 5.6 (1.24).
F. Countywide Planning Policy 2.2A.IV states that cities should be the primary provider of
urban governmental services, public facilities and public services within the Urban Growth
Area, also citing RCW 36.70A.
G. The service request is consistent with the City’s adopted local plans and development
regulations.
H. Pursuant to RCW 43.20.260, the City has a duty to provide service to new service
connections within its retail service area.

I. The CWSP (Section V) and Moses Lake Municipal Code 13.07.020 provide the process to
follow when an applicant is pursuing water service for a new development within the
purveyor’s service area. The applicant and the City have followed that process.
J. The City Council adopts the findings and conclusions of the City Manager’s Notice of
Decision dated September 23, 2020, and exhibits by reference as though set forth herein.
Section 3. Authorization for amendment of CWSP and service area of Basin Water Sources, Inc.
Pursuant to RCW 70A.100.060 and the Grant County/Moses Lake CWSP, the City
Council approves the request to remove the Property from Basin Water Sources, Inc.’s
water service area, as shown on the attached map. The City of Moses Lake will provide
water service to the Property pursuant to the request of United Builders of Washington,
Inc.
Section 4. Notice.
A copy of this Ordinance will be provided to the Grant County Commissioners, DOH,
United Builders of Washington, Inc., and Basin Water Sources, Inc.
Section 5. Severability.
If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is
declared unconstitutional or invalid for any reason, such decision shall not affect the
validity of the remaining parts of this Ordinance.
Section 6. Effective Date
This Ordinance is effective upon publication as provided by law.
Adopted by the City Council of Moses Lake and signed by its Mayor on December 22, 2020.
