Balsam, Moses Lake, Washington. ROLL CALL: Present: Mayor Liebrecht, Deputy Mayor Curnel; Council Members Jackson, Myers, Leonard, Riggs, and Hankins. PLEDGE OF ALLEGIANCE: Moses Lake High School Senior Abby Reigstad led the Council in the Pledge of Allegiance. SUMMARY REPORTS: MAYOR’S REPORT Grant Transit Authority Reappointment Mayor Liebrecht received a letter from GTA requesting Don Myers be reappointed for a 1-year term. Action taken: Council Member Leonard moved to confirm the reappointment, second by Deputy Mayor Curnel. The motion carried 7 – 0. Lodging Tax Advisory Committee Reappointments and New Appointments Appointments to this committee are for a 1-year term. Mayor Liebrecht recommended reappointment of Leslie Ramsden, Cale Russell, and Tim Molitor and new appointments of Deputy Mayor Curnel and Richard Hanover. Action taken: Council Member Jackson moved to confirm the reappointments and new appointments, second by Council Member Riggs. The motion carried 7 – 0. Municipal Airport Advisory Board Reappointments and New Appointment Appointments to this committee are for a 4-year term. Mayor Liebrecht recommended reappointment of Richard Pearce and Tom Dent and new appointment of Finley Grant. Action taken: Council Member Hankins moved to confirm the reappointments and new appointment, second by Council Member Leonard. The motion carried 7 – 0. CITY MANAGER’S REPORT WCIA 2019 Rate Increase Deputy City Manager Gil Alvarado explained that prior staff had improperly reported property to be insured. The initial increase from WCIA’s 2018 invoice was $167k. Mr. Alvarado was able to negotiate the amount to $83,619, only a 15% increase. CITY COUNCIL MINUTES – January 8, 2019 pg. 2 Improper Revenue Booking City Manager John Williams advised that the State Auditors discovered former staff failed to change the booking of revenue to the month incurred vs. the month received in accordance to a change in state law 15 years ago. New City Employee Police Chief Kevin Fuhr provided a brief history about Joseph Enderton and then administered the Oath of Office for his position as a Moses Lake Police Officer. UGA Amendment The Port of Moses Lake has requested an expansion of the UGA boundary in order to access city water and sewer at their West Gate Development. A map was distributed to Council at the meeting. Action taken: Mayor Liebrecht moved to have staff proceed with a recommendation to the Grant County Commissioners for an approval on the requested expansion of the UGA boundary as presented, second by Council Member Leonard. The motion carried 7 – 0. Real Estate Excise Tax Amendment, Ordinance 2919 Staff distributed an amendment to MLMC 3.27.050 at the meeting that proposed eliminating the sunset date of December 31, 2018. Action taken: Council Member Hankins moved to adopt Ordinance 2919 as presented, second by Council Member Leonard. The motion carried 5 – 2, Deputy Mayor Curnel and Council Member Myers were opposed. Facility Use Policy Council provided parameters for staff to finalize a new policy for 3rd party use of the Council Chambers and other city facilities. The proposed update of the fees will be presented at the next meeting for discussion. CONSENT AGENDA #1 a. City Council meeting minutes dated December 20th b. Claims in the amount of $1,023,275.16; prepaid claim checks in the amounts of $1,545.95, $54,817.30, and $218,691.21; claim checks in the amount of $752,939.50; and payroll checks in the amount of $363,770.78. Action taken: Deputy Mayor Curnel moved to approve the Consent Agenda as is, second by Council Member Riggs. The motion carried 7 – 0. NEW BUSINESS #2 Wrestling Statue Donation Several citizens, businesses, and students at CB Tech raised funds to build a statue to represent the wrestling program. The statue will be placed downtown with the other sport sculptures. Three citizens provided input to the Council on the history of the wrestling program and statue donation. ADMINISTRATIVE REPORTS Finance Director Cindy Jensen advised that residents can drop off non-artificial trees to Lakeside Disposal this week at no charge. Deputy City Manager Gil Alvarado distributed a page from the internet regarding Xyleco Technology’s feature on the tv show 60 Minutes on January 4, 2019. He explained that the information provided on the show was inaccurate regarding the building occupancy. City Manager Williams noted that tomorrow is recognized as Law Enforcement Appreciation Day. COUNCIL COMMUNICATIONS AND REPORTS – no action taken. EXECUTIVE SESSION Mayor Liebrecht called an Executive Session at 8:00 p.m. to be held for 20 minutes pursuant to RCW 42.30.110(1)(c) to consider the minimum price at which real estate will be offered for sale, and pursuant to RCW 42.30.110(1)(i)(B) to discuss potential litigation with no further business to follow. The City received eleven (11) bids for the work. The low bid was $449,001.46 and the Engineer’s Estimate was $563,092.90. Background The 2019 budget includes money for completing these improvements. This project includes installing one mile of 12” water main and 6 fire hydrants in Road ‘L’ NE from Kittelson Road to Nelson Road. This project will improve the network reliability and allow for future expansion of the water system in the Urban Growth Area The low bidder, C and E Trenching has just successfully worked on projects within the City of Moses Lake. Fiscal and Policy Implications The project will require budgeted funds to be spent. Page 2 of 2 Options Option Results • Award the 2019 Road ‘L’ Watermain Project to the lowest bidder Staff will move forward with executing a contract with the low bidder to complete the work. • Take no action Staff will stop working on this project and wait for further direction from City Council. Bid Summary Legal Review N-A Page 1 of 2 CITY OF MOSES LAKE STAFF REPORT To: John Williams, City Manager From: Fred Snoderly, Municipal Services Director Date: January 18, 2019 Proceeding Type: Consent Agenda Subject: Accept Street Light Rehab - Owen, Westover, Loring - 2018 Legislative History: • First Presentation: • Second Presentation: January 22, 2019 • Action Motion Staff Report Summary Neppel Electric LLC has completed work on the Street Light Rehab – Owen, Westover, Loring - 2018 and it is ready to be accepted. Background The project consisted of retrofitting an existing metered street light system on Owen Road, Loring Drive, and Westover Boulevard that is maintained by the City of Moses Lake, into a non-metered street light system that will be owned and maintained by Grant County PUD. Final payment has been made for $51,358.29. The original contract price was $72,048.56. The work completed by the contractor is physically complete and ready for acceptance. Fiscal and Policy Implications Upon acceptance, the City will enter into the 60-day lien period as required by Washington State Law. Page 2 of 2 Options Option Results • Accept the project as presented. The 60-day lien period will begin. • Take no action. The project won’t be accepted at this time. None Legal Review N-A Page 1 of 2 CITY OF MOSES LAKE STAFF REPORT To: City Council From: John Williams, City Manager Date: January 14, 2019 Proceeding Type: New Business Subject: Ordinance to update MLMC 16.52 Legislative History: • First Presentation: January 22, 2019 • Second presentation: February 12, 2019 • Action: Consider Adoption of Ordinance on February 12th Staff Report Summary Moses Lake Municipal Code Chapter 16.52 addresses the installation and maintenance of automatic fire extinguishing systems. Changes in the certification requirements outlined in the State Fire Code for design work, installation, and maintenance are incorporated in the revised ordinance. Background Changes adopted at the state level requiring NICET Level III certification for design work for plan submittal, NICET Level II for installation and maintenance, and ICC or equivalent certification levels for work on special hazard systems are incorporated into the MLMC. The incorporation into MLMC allows the jurisdiction to locally adopt the certification requirements for work on fire suppression and other fire protection systems, and additionally allows design submittal by registered professional engineers in lieu of NICET certification. Fiscal and Policy Implications Page 2 of 2 Options Option Results • Adopt the ordinance amending MLMC 16.52 Requires that only individuals certified by nationally recognized testing and standards practices are allowed to work on required fire suppression and alarm systems. Requires the possession of a City of Moses Lake Business License to perform this type of work in the City. • Take no action. Enforcement would fall under state fire code as a misdemeanor versus a civil infraction regulated under MLMC, and would not allow the flexibility to accept plans drawn by registered professional engineers. Chapter 16.52 of the MLMC titled “Installation and Maintenance of Automatic Fire Extinguishing Systems” is amended as follows: Chapter 16.52 INSTALLATION AND MAINTENANCE OF AUTOMATIC FIRE EXTINGUISHING AND FIRE ALARM SYSTEMS Section 2. Section 16.52.030 of the MLMC titled “General Information” is amended as follows: 16.52.030 General Information A. The regulations contained herein require the installation and maintenance of fire extinguishing and fire alarm systems. B. Complete information regarding the systems shall be submitted to and approved by the Moses Lake Fire Marshal. As-built plans shall be submitted to the building owner and the Fire Marshal. C. All fire sprinkler systems shall be installed by a contractor licensed by the State of Washington to install fire sprinkler systems and components. Contractors performing work on fire suppression and fire alarm systems within the City of Moses Lake shall also be required to have a current City of Moses Lake Business License. D. All fire extinguishing and fire alarm system designs shall be submitted in a format prescribed by the Fire Marshal and shall be designed by a person holding either a current Fire Protection Engineer stamp or a current NICET Level III certification. Design of kitchen fire suppression systems and special hazard systems including FM-200 and UL-300 systems shall be submitted in a format prescribed by the Fire Marshal and shall be designed by a person holding a current certificate of competency from the system manufacturer or a current International Code Council, (I.C.C.) certification. E. Installation, testing, and maintenance of all fire protection and alarm systems shall comply with the provisions of the currently adopted state fire code, its amendments and all incorporated referenced standards. F. D. Maintenance and testing of systems required under this chapter shall be in accordance with the most recent editions of National Fire Protection Association Standards 13 and 25, and with the provisions of the currently adopted State Fire Code. Records of maintenance and testing shall be reported to the reporting service currently in use by the Fire Department within fourteen (14) days of service. Section 3. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of the ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted independently and without regard to the section affected. Section 4. Effective Date. This ordinance shall take effect and be in force five (5) days after its passage and publication or its summary as provided by law.
