CALL TO ORDER:
The regular meeting of the Moses Lake City Council was called to order at 7:00 p.m. by Mayor Liebrecht in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake,
Washington.

Certificate of Achievement – Jim Herrin Mayor Liebrecht announced the achievements listed on Mr. Herrin’s certificate.
ADDITIONAL BUSINESS
Council Member Jackson and Mayor Liebrecht requested a Study Session be scheduled regarding the copay and deductible charges for ambulance charges to citizens living in the city limits.
CITY MANAGER’S REPORT
February 12, 2019 Regular Council Meeting Date Council agreed to cancel the Regular Meeting and hold a Special Meeting on February 11th to accommodate travel time for staff and Council attending the AWC City Action
Days event in Olympia.
Park Board Vacancy Connor Lange recently resigned from the Park & Recreation Advisory Board. Staff posted the vacancy for the unexpired term with an application due date of Friday,
February 1st.
Red Light Camera Correspondence City Manager John Williams shared his response to an email regarding photo enforcement equipment at the corner of S Pioneer Way and E Hill Ave.
Facility Use Rental Fees Staff presented a draft Facility Rental Application which included new fees that were a result of feedback from Council at prior meetings. Council agreed with the proposed fee structure and requested a Resolution be presented to formally adopt the new fees.

Staff Report Summary
On February 6th staff opened bids for the 2019 Sand Dunes Irrigation Well Project. The City
received three (3) bids for the work. The low bid was $163,555.30 and the Engineer’s Estimate
was $203,119.90.
Background
The 2019 budget includes money for completing these improvements. This project includes
drilling a 16” well near the Sand Dunes Wastewater Treatment Plant to provide irrigation water.
The ground has been leased to a farmer that will grow crops that will use City biosolids for
fertilizer. This will save the City the cost of having to haul the biosolids from the plat to farms
across the county.
The low bidder, Bransen Drilling, LLC, has just successfully worked on projects within the City of
Moses Lake.

Staff Report Summary
Wheeler Excavation, LLC has completed work on the Grand Drive Construction - 2018 Project and
it is ready to be accepted.
Background
The project consisted of improving Grand Drive from Hill Avenue to Ball Court including asphalt, curb
and gutter, storm drainage and replacing the 6” asbestos concrete watermain with 8” PVC pipe.
Final payment has been made for $192,866.76. The original contract price was $197,425.96.
The work completed by the contractor is physically complete and ready for acceptance.
Fiscal and Policy Implications
Upon acceptance, the City will enter into the 60-day lien period as required by Washington State
Law.

Staff Report Summary
The street and utility improvements constructed to serve the Barrington Point 4A Major Plat are
complete and are ready to be accepted by the City Council.
Background
The platting regulations require all the street and utility improvements installed in right of way
and municipal easements to be accepted by City Council or bonded for prior to recording the plat
and issuing building permits. The construction plans are required to be reviewed and approved
by the City prior to construction. All construction work is inspected to assure compliance with
the submitted plans and city standards. The street and utility improvements in this project will
serve a twenty-four (24) lot residential subdivision.
Fiscal and Policy Implications
Upon acceptance, the City will be responsible for the maintenance and repairs of the
improvements.
A subdivision maintenance bond or other approved security in the amount of $232,271.20 (50%
of total costs of $464,542.40) to the City is required to be provided by the owners for the 2-year
maintenance period which commences on the date of acceptance of the improvements by the
City Council.

A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR MUNICIPAL USE AS PART OF BARRINGTON POINT 4A MAJOR PLAT Recitals:
1. Street and utility improvements, lying in dedicated right-of-way or easements, are in place and connected to the City of Moses Lake’s street and utility systems as part of Barrington Point 4A Major Plat.
2. Said street and utility improvements have been installed in accordance with the City of Moses Lake’s Community Standards, such facilities being completed in January, 2019.
3. RCW 35.91.030 indicates that public street and utility facilities, which are developer
installed, should be accepted by the City of Moses Lake upon completion if the facilities
are built to city standards.
Resolved: 1. The City Council of the City of Moses Lake accepts the street and utility improvements
as facilities of the City of Moses Lake and as such will charge for use of facilities as authorized by ordinance, contingent upon the owners providing a maintenance bond for the street and utility improvements to be effect for 2-years from the date of acceptance of the improvements by the City Council.
2. After February 11, 2021, all further maintenance and operation cost of said street and utility improvements, shall be borne by the City of Moses Lake, as provided by city ordinance.

Staff Report Summary
Moses Lake Municipal Code Chapter 16.52 addresses the installation and maintenance of
automatic fire extinguishing systems. Changes in the certification requirements outlined in the
State Fire Code for design work, installation, and maintenance are incorporated in the revised
ordinance.
Background
Changes adopted at the state level requiring NICET Level III certification for design work for plan
submittal, NICET Level II for installation and maintenance, and ICC or equivalent certification levels
for work on special hazard systems are incorporated into the MLMC.
The incorporation into MLMC allows the jurisdiction to locally adopt the certification requirements
for work on fire suppression and other fire protection systems, and additionally allows design
submittal by registered professional engineers in lieu of NICET certification.

Extinguishing Systems” is amended as follows:
Chapter 16.52 INSTALLATION AND MAINTENANCE OF AUTOMATIC FIRE EXTINGUISHING AND FIRE ALARM SYSTEMS
Section 2. Section 16.52.030 of the MLMC titled “General Information” is amended as follows: 16.52.030 General Information
A. The regulations contained herein require the installation and maintenance of fire extinguishing and fire alarm systems.
B. Complete information regarding the systems shall be submitted to and approved
by the Moses Lake Fire Marshal. As-built plans shall be submitted to the building owner and the Fire Marshal.
C. All fire sprinkler systems shall be installed by a contractor licensed by the State
of Washington to install fire sprinkler systems and components. Contractors
performing work on fire suppression and fire alarm systems within the City of Moses Lake shall also be required to have a current City of Moses Lake Business License.
D. All fire extinguishing and fire alarm system designs shall be submitted in a
format prescribed by the Fire Marshal and shall be designed by a person holding either a current Fire Protection Engineer stamp or a current NICET Level III certification. Design of kitchen fire suppression systems and special hazard systems including FM-200 and UL-300 systems shall be submitted in a format prescribed by
the Fire Marshal and shall be designed by a person holding a current certificate of
competency from the system manufacturer or a current International Code Council, (I.C.C.) certification. E. Installation, testing, and maintenance of all fire protection and alarm systems shall
comply with the provisions of the currently adopted state fire code, its amendments
and all incorporated referenced standards.
F. D. Maintenance and testing of systems required under this chapter shall be in
accordance with the most recent editions of National Fire Protection Association
Standards 13 and 25, and with the provisions of the currently adopted State Fire Code. Records of maintenance and testing shall be reported to the reporting service currently in use by the Fire Department within fourteen (14) days of service. Section 3. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of the ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted independently and without regard to the section affected.
Section 4. Effective Date. This ordinance shall take effect and be in force five (5) days after its passage and publication or its summary as provided by law.

bulk storage vessels for molasses and extend their existing fire line for an additional fire hydrant.
The request was routed to City staff for comment. No negative comments were received.
Background
A building permit cannot be issued on unplatted property in accordance with MLMC 16.02.040
unless the City Council finds that the public interest will not be adversely affected by the issuance
of such a permit.

Staff Report Summary
Pure Country Harvest, LLC, (formerly known as Vern’s Meats) has requested a building permit to
add to the refrigerated area of the existing building. Pure Country Harvest currently operates
under a Non-Conforming Use permit granted to them by the City of Moses Lake. The Non-
Conforming Use permit allows them to operate and maintain a meat packing and slaughter
business within a Residential Zone
Background
Vern’s Meats was operational prior to the annexation of the area in 1951. Vern’s Meats was
considered a non-conforming use in 1961 and given 20 years to discontinue the use. At the end
of the 20-year sunset period, Ordinance #1017 was adopted by the City Council which amended
MLMC Chapter 18.69 Non-Conforming Uses to allow non-conforming uses to continue subject to
the conditions of the Planning Commission, a biennial review and/or upon change of ownership.
In 2015, ownership changed to Pure Country and has been under review and compliant per
MLMC 18.69.
In December 2018, owner’s and agent for Pure Country Harvest, LLC requested to add on to their
existing facility. They have asked to add 400 SF to their existing loading dock area for a small

cooler unit and for an additional 2,500 SF to expand the southern portion of the building for
cooler storage.
Per MLMC 18.69.050, it is recognized that there are needs for upgrades, improvements,
replacements or additions to non-conforming uses. The City Council may grant the request for
staff to issue a permit for the upgrade, improvement, replacement or addition, after a public
hearing before the Planning Commission. The Planning Commission held a public hearing on
January 10, 2019. The public was not opposed to the use, but they did have noise concerns from
the semi-truck refrigeration units and the noise that occurs during the slaughtering process. The
owners noted that the new expansion would eliminate most of the semi-truck refrigeration unit
noise, but the need for some type of sound barrier would be necessary for the slaughter noise.
As a condition to the issuance of the permit, the City Council shall require plans and specifications
of the proposed replacement, rebuilding, or addition be filed. The Council can require plans or
measures be mitigate the noise concerns as part of the issuance of any building permit.

Motion
Staff Report Summary
On February 6th staff opened bids for the 2019 Mini Storage - Rebid Project. The City received two
(2) bids for the work. The low bid was $678,833.41 and the Engineer’s Estimate was $474,252.87.
Background
The City has sold the property on Penn Street. Several City departments have been using the
existing buildings to store various items. It is necessary to construct storage facilities to house these
items in the long term. This project would build mini storage type facilities to accommodate the
storage buildings, fencing, as well as a police impound and car search area.
The bids received were well above what research shows to be the current going rate for these
types of facilities.
Fiscal and Policy Implications
The project would require budgeted funds to be spent well above the existing budget.
