STUDY SESSION
A study session was held prior to the regular meeting to discuss the Comprehensive Plan
amendments. Staff gave Council two homework assignments: provide two to three sentences for
a new Vision Statement and to return suggested changes to the Public Participation Plan within two weeks or sooner. CALL TO ORDER
The regular meeting of the Moses Lake City Council was called to order at 7 p.m. by Mayor
Liebrecht in the Council Chambers of the Civic Center, 401 S. Balsam St., Moses Lake, Washington. ROLL CALL
Present: Mayor Liebrecht; Deputy Mayor Curnel; Council Members Jackson, Myers, Leonard,
Riggs, and Hankins. PLEDGE OF ALLEGIANCE
Moses Lake High School Senior Natalie Jaeger led the Council in the Pledge of Allegiance.
SUMMARY REPORTS:
MAYOR’S REPORT Lodging Tax Advisory Committee Appointment
Mayor Liebrecht recommends appointment of B.J Garbe for an unexpired term scheduled
to end December 31. The vacancy is due to a recent resignation from Cale Russell.
Action taken: Council Member Jackson moved to confirm the appointment, second by Council Member Myers. The motion carried 7 – 0.
CITY MANAGER’S REPORT
Police New Hire Oath of Office Interim Police Chief David Sands provided a brief history about Chase Pitt and then administered the Oath of Office for his position as a Moses Lake Police Officer.
CITIZEN’S COMMUNICATION Port of Moses Lake Air Force Exercise Port President Darrin Jackson, 7810 Andrews St. NE, Moses Lake, invited everyone to visit the
Grant County Airport during the Mobility Guardian exercise that will occur day and night for the
next 20 days by 150 Air Force personnel representing McChord, Fairchild, and Andrews Air Force Bases. Moses Lake Water Quality
Chuck Perry, 4180 W Lakeshore Dr., Moses Lake, commented on the algae issue and
encouraged Council to have the City join the Grant County Conservation District. On the same

subject Elisia Dalluge, 310 Loring, Moses Lake, shared her research on algae issues worldwide.
PRESENTATION
Grant County Conservation District Associate Supervisor Harold Crose is also the Chair for the recently formed Moses Lake Watershed Council. The MLWC is developing a three year strategic plan for a systematic approach and priority to treating the algae bloom issue. The watershed covers 1.2 million acres and Moses Lake regional area is 6k acres. Following the presentation, Moses Lake Irrigation and
Rehabilitation District (MLIRD) Director Richard Teals as well as former MLIRD Director and former Tourism Commission Member Mary Perry provided comments in support of the GCCD and MLWC. Council asked staff to bring back the estimated cost that would be assessed on City owned property should the Council start the process for the City to join the GCCD.
CONSENT AGENDA

Action taken: Council Member Riggs moved to approve the Consent Agenda, second by Council Member Leonard. The motion carried 7 – 0. OLD BUSINESS #2 Voucher Audit Amendment MLMC 3.40.030 Ordinance 2931 – Second Presentation First presentation of the amendment took place in April. The changes will streamline the bill paying and council packet preparation processes, as well as bring the City up to date to current BARS Manual standards.
Action taken: Council Member Hankins moved to adopt the ordinance as presented, second by Deputy Mayor Curnel. The motion carried 6 – 1, Council Member Jackson was opposed. NEW BUSINESS #3 Fire Impact Fee Rate Study Ordinance – First Presentation Staff explained the formulas used to develop the proposed impact fees, how the fee is not in addition to mitigation fees, and its relevance to the Comprehensive Plan. Local
business owners Richard Penhallurick and Mark Fancher, as well as Samaratin Project
Manager Joe Kunkel provided comments to Council. The ordinance will be presented for Council action on September 24.

#4 Moses Lake School District Property
MLSD is considering the purchase of a property near the Municipal Airport to build a new elementary school. Staff distributed planning documents to Council in advance of the meeting and School District Superintendent Dr. Joshua Meek brought their planning documents to the meeting for Council’s review. The Council had concerns of the location for school safety, lack of pedestrian routes, and noise. Following the motion and
vote, resident Larry Ledeboer provided comments to support the Council’s motion.
Action taken: Council Member Jackson moved to have staff send a letter to the School District in opposition of the proposed location for a new elementary school as discussed on August 13, second by Council Member Hankins. The motion carried 7 – 0.
The Mayor called a five minute recess at 9:06 p.m.
#5 Emergency Sewer Project Declaration Resolution 3780 The sewer main syphon from Northshore Drive and Broadway Avenue recently broke for the third time in recent years due to the age of the steel pipe. State law requires Council
declare an emergency in order to bypass the bidding process for this project. MLIRD Director Richard Teals reported this last break and provided comments to Council.
Action taken: Council Member Leonard moved to adopt Resolution 3780, second by Deputy Mayor Curnel. The motion carried 7 – 0.
ADMINISTRATIVE REPORTS
Council agreed to Community Development Director Kris Robbins’ request to have the Mayor sign a letter of support for an affordable housing grant application. Municipal Services Director Fred Snoderly requested the Council amend the City Manager’s
spending authority for emergency contracts. Action taken: Mayor Liebrecht moved to increase the authorized amount from $100k to $500k for this one project, second by Council Member Leonard. The motion carried 7 – 0.
Interim City Manager Kevin Fuhr advised that he, Council Member Jackson, Airport Advisory Board Chair Pierce, and City Attorney Katherine Kenison had their first meeting last week to discuss changes to the City’s Airport Lease.
COUNCIL COMMUNICATIONS AND REPORTS
Council Member Riggs commended the Moses Lake Business Association (MLBA) for their sold out Sip and Stroll event held last weekend. Council Member Leonard announced the Remembrance event to be held by First Responders
tomorrow morning at 7 a.m. at the 9/11 Memorial next to the library.

Deputy Mayor Curnel requested construction workers not block both egresses on his street, not to use the school yard as their travel route, and to let them know they are doing a great job. He
also asked staff to prepare water conservation statistics since the rationing went into effect two years ago.
Mayor Liebrecht asked staff to draft a letter of appreciation to the MLBA thanking them for maintaining the flower pots in the downtown corridor.

Staff Report Summary
Attached is a resolution repealing Resolution No. 3718 and to adopt the new Administrative
Policies and Procedures effective October 1, 2019.
Background
On February 13, 2018, the City Council rescinded Resolution No. 3718 and authorized the City
Manager to execute any and all administrative policies and procedures deemed necessary and
appropriate.
The City Council now desires to provide administrative policies and procedures and by repealing
Resolution No. 3718 and adopting the current resolution, the City Council will implement the
new Administrative Policies and Procedures effective October 1, 2019.
Staff Recommendation
Recommends that the City Council adopt the resolution.

RESOLUTION NO. 3782
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE,
WASHINGTON ADOPTING ADMINISTRATIVE POLICIES AND PROCEDURES FOR
EMPLOYEES OF THE CITY OF MOSES LAKE AND REPEALING RESOLUTION
NO. 3718.
Recitals:
1. The City Council of the City of Moses Lake wishes to reestablish goals and
policies for the relations between the City and its employees; and
2. The City Council desires to provide for maintaining specific personnel rules and
regulations through Administrative Policies and Procedures; and
3. The City Council desires to repeal Resolution No. 3718 and to provide for an
effective day of October 1, 2019, for implementing the new Administrative Policies and
Procedures.
Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSES
LAKE:
Section 1. The new Administrative Policies and Procedures shall be established for the
City of Moses Lake to reestablish a system of personnel administration, which is based upon
equal opportunity and sound principles of public personnel administration and is consistent with
Federal and State statutes and City ordinances.
Section 2. The new Administrative Policies and Procedures shall consist of rules and
regulations, setting out procedures to govern all pertinent personnel matters within the City.
Procedures included in the new Administrative Policies and Procedures will be binding on all
employees. In cases where these policies conflict with City ordinance, Civil Service rules and
regulations, the provisions of a collective bargaining agreement, personal service contract, or
Federal or State law, the terms of that law or agreement prevail. The official Administrative
Policies and Procedures shall be maintained by the City Manager and shall consist of the policies
and procedures as originally drafted and amended.
Section 3. The City Manager or his/her designate shall have the sole responsibility for
preparing revisions, additions, or deletions to the Administrative Policies and Procedures. If
adopted by Council, a copy of the revision, addition, or deletion shall be distributed to all
employees and may be effective immediately.
Section 4. Resolution No. 3718 is hereby appealed.
Section 5. This resolution shall become effective immediately upon its passage and
adoption.

Staff Report Summary
The Community Development Department has received a request from Tim Uhrik, Tait &
Associates, on behalf of O’Reilly Auto Parts to build on an unplatted property, parcel number
110475093, on Pioneer Way. The proposal is to construct an auto parts store at this location. The
applicants have taken part in a pre-application meeting with staff on this proposal.
Background
A building permit cannot be issued on unplatted property in accordance with MLMC 16.02.040
unless the City Council finds that the public interest will not be adversely affected by the issuance
of such a permit.
Fiscal and Policy Implications - No impact.

Staff Report Summary
Staff has received three proposals for providing engineering services and technical assistance to
the Municipal Airport Advisory Board and the Municipal Services Director to facilitate operations
and improvements at the airport. The selection committee has selected T-O Engineering as the
most qualified firm and requests authorization to enter into a professional services agreement with
them for on call consulting and future projects identified by the City.
Background
The City has worked with T-O Engineering in the past on airport projects and feels confident in their
ability to deliver projects on time and within budget.
Fiscal and Policy Implications
The agreement will require funds to be spent.

Staff Report Summary
Joe Salvetti, Luxury Restroom Trailers, has requested to discharge sanitary wastewater to MH
Nos. L33-004 (No. 1 at ASPI), PL28-001 (No. 2 Boeing), and PL27-001 (No. 3 Boeing) without a
physical connection. The discharge would be for the Boeing Corporation’s Special Project which
will last at least one year. An estimate of 800 gallons/week will be discharged over the special
project period. All of the wastewater is from domestic use.
Background
MLMC 13.05.130 requires Council approval for all discharges without physical connections to the
POTW.
Fiscal and Policy Implications
Staff time has been spent to review the request and prepare the reports. Additional costs will be
required to treat 800 gallons/week of wastewater. Our facilities have the capacity for this
request.
The proponent should pay a fee of $250 for administrative costs. The discharge to Manholes 2
and 3 will be billed monthly as metered through the Boeing Lift Station (10 units). The discharge
to Manhole 1 (3 units) will be billed as 0.3 times the Boeing rate, because that discharge is not
metered.

Maintenance, & Engineering were discussed. Preliminary cost estimates discussed with the City
Council at the April council meeting indicated a rough estimate of $9,000,000. Since that time, a
professional cost estimator has provided details which indicate that the cost will likely be above
that initially discussed amount.
Background
The City of Moses Lake purchased the old batting cage complex in 2001. The facility was
modified to ultimately become the Larson Recreation Center with a ground floor that featured
batting cages, a concession area, a party room and restrooms. The upstairs that became known
as The LOFT (Learning Opportunities For Today) with computer stations, and game tables. In late
2014 the city opted to close the facility due to budget shortfalls. In 2018, the city contracted with
Driftmier Architects, P.S. to evaluate the building and ultimately provide a renovation plan to
redevelop the facility. Following the results of that contracted evaluation, City Council directed
staff to move forward with the assistance again of Driftmier Architects, P.S. to design a new
30,000 square foot facility. The larger sized facility would include office space for the Parks &
Recreation Department to move into so that the overcrowded Police Department could expand
into the current Parks & Recreation side of the building. Additionally, with City Council’s decision
to sell the Penn Street property we were also directed to include classroom space to replace our
classroom (The Learning Center) We have accomplished that request and are now ready, with
City Council support, to move forward with this new state of the art facility. We ask for your
direction now with this project.

Fiscal and Policy Implications
Based upon current cost estimates, construction costs stand at approximately $10,169,774.00
excluding sales tax and architecture & engineering expenses (see attached document).

Staff Report Summary
Attached are resolutions providing for the abatement of nuisances at the following addresses; 1105 E Hill Ave,
1111 E Hill Ave, both owned by Gordon L. Beeman, and 1518 S Lakeway Dr, owned by Homer E & Muriel D Basel.
The Council should hold a hearing to consider the allegations of the Code Enforcement Officer that the properties
contain a public nuisance which has not been corrected. If the Council concurs that a public nuisance exists, the
resolution should be adopted allowing the City to remove the public nuisance.
Background
The code enforcement matter at 1105 E Hill Ave (COD2019-0544) was initiated by code enforcement. The
property is approximately 8700 Square feet, is located in a residential zone (R-1) and the structure has been vacant
for approximately 3 years. Since 2017, the property has been under enforcement 4 times for weeds and tall
grasses.
The code enforcement matter at 1111 E Hill Ave (COD2019-0935) was initiated by code enforcement. The
property is approximately 6500 square feet, is located in a residential zone (R-1) and is a vacant lot. The property
was also put under enforcement and abated with council approval in 2017.
The code enforcement matter at 1518 S Lakeway Dr (COD2019-0876) was initiated by code enforcement. The
property is approximately 15680 square feet, is located in a residential zone (R-1), and is a vacant lot.
In accordance with MLMC 8.14, Nuisances, the site was inspected and determined to be a nuisance pursuant to
MLMC 8.14. See attached May 23, 2019 Notice of Violation and Order to Correct or Cease Activity.

RESOLUTION NO. 3777 A RESOLUTION DETERMINING THAT GORDON L. BEEMAN IS THE OWNER OF CERTAIN REAL PROPERTY WITHIN THE CITY; THAT A NUISANCE REQUIRING ABATEMENT BY CITY FORCES OR FORCES CONTRACTED BY THE CITY EXISTS ON SUCH PROPERTY; AND DIRECTING THE USE OF SUCH FORCES TO ABATE THE NUISANCE FOUND Recitals: 1. Real Property Location and Ownership. It is alleged by a Code Enforcement Officer of the
City, a person authorized to enforce the ordinances and municipal code of the City, that the
real property located at 1105 E Hill Ave (Lot 12 Block 1 South Terrace Add), Parcel #111026000, Moses Lake, Washington, is the site of public nuisance violations of Moses Lake Municipal Code (MLMC) 8.14.030.U. The records of Grant County show the owners of the subject property to be Gordon L Beeman, 2015 24th St #11, Bellingham, WA. 98225-8177. 2. Notice. On May 23, 2019, the Code Enforcement Officer caused to be delivered by regular mail and certified mail to the owner of record of the subject property a Notice of Violation and Order to Correct or Cease Activity. No appeal was filed to challenge that order. The time to
comply under that order has passed. The nuisance described in that order has not been abated by correction of the condition of the property and a nuisance continues to exist on the subject property. On September 5, 2019, the Code Enforcement Officer caused to be
delivered to Gordon L Beeman a notice of the intent of the City Council to consider adoption of a resolution such as this at its meeting of September 24, 2019. Such notice was in writing, in the English language and was delivered by certified mail and regular mail to the record
owner of the subject property. 3. Violations. It has been established by the Notice of Violation and Order to Correct or Cease Activity that the following violations exist on the subject property and have not been corrected: 3.1 A violation of MLMC 8.14.030.U – Nuisance Defined. Each of the following conditions, unless otherwise permitted by law, is declared to constitute a public nuisance, and whenever the Code Enforcement Officer determines that any of these conditions exist upon any premises or in any stream, drainage way or wetlands, the officer may require or provide for the abatement thereof pursuant to this chapter.
3.2 Except for any designated public park land, natural area, or environmentally sensitive area, or any undeveloped parcels of land not adjacent to developed areas or which are used for agricultural purposes, all grasses, weeds or other vegetation growing or which
has grown and died, which is determined to be a fire or safety hazard or a nuisance to persons, shall not exceed twelve inches (12”) in height measured above the ground.
a. The above exception may be waived and additional maintenance required by the Code Enforcement Officer if he determines such action is necessary to protect the safety of persons or adjoining property. b. All maintenance shall be done in a manner so that soil stability will not be disrupted or disturbed. Grass, weed, or vegetation control shall not include plowing, discing, or scraping the soil to eliminate the grasses, weeds, or other vegetation unless a soil stabilization plan, which will minimize blowing dust and maintain soil stability

and which shall be approved by the city prior to any plowing, discing, or scraping is implemented immediately.
3.3 Compliance shall be required as follows: a. Property with no sidewalk/activity trail or residential dwelling on the property shall be exempt. b. Property with sidewalk/activity trail but no residential dwelling on the property shall be required to control the vegetation ten feet (10’) from the back of the sidewalk/activity trail. c. Property with sidewalk/activity trail and a residential dwelling shall be required to
control vegetation on the entire piece of property. 4. Hearing. On September 24, 2019 the Moses Lake City Council conducted a hearing to
consider the allegations of the Code Enforcement Officer that the subject property contains a public nuisance ordered corrected which remains uncorrected and that the record owner is responsible for the costs of correcting and abating such violations if such corrections and
abatement is accomplished by City forces or forces contracted by the City for such purpose. All interested persons were permitted to provide written or oral evidence relevant to the issue. 5. Gordon L Beeman is the record contract owner of the subject property per the records of Grant County. 6.2 The public nuisance located upon the subject property consists of:
6.2.1. Grasses and weeds measuring greater than twelve (12) inches in height.

adoption of this resolution to cause the nuisance violations listed herein to be removed to the satisfaction of the Code Enforcement Officer. Those improvements include the following: 6.4.1 Trim/cut the grasses and weeds down to measure less than twelve (12) inches in height.
6.5 City staff shall provide a status report to City Council on the progress of the record contract owner and occupant to make the cleanup required on the subject property. If the improvements, as listed above, are not to the satisfaction of the Code Enforcement Officer, the City is authorized to use City forces or contract forces to cause the identified public nuisances to be removed from the subject property to the satisfaction of the City Manager. All costs of any removal of the identified public nuisances done at City expense shall be recovered by the City Manager by all reasonable means including immediate assignment of the costs so incurred for collection. 6.6 A copy of this resolution shall be provided to the record contract owner by certified and

Any poison oak or poison ivy, Russian thistle or other noxious weeds, as defined by Chapter 8.22 of the Moses Lake Municipal Code entitled “Noxious Weed Control” whether growing or otherwise; but nothing herein shall prevent the temporary retention of such weeds in approved covered receptacles. 4. Hearing. Staff Report Summary
The United States Department of Homeland Security, through the Assistance to Firefighters Grant
program, has awarded a personnel grant to the City of Moses Lake for three Firefighters.
Background
In 2016, the City Council had a Cost of Service Study for Ambulance Service completed. Part of this
study was an evaluation of the Fire Department’s current and future personnel needs. The study
recommended that six new firefighter positions be created within the fire department. During
budget year 2019 we were able to fund three of the six recommended positions.
The Fire Department has sought out alternative funding sources to fund the remaining three
positions recommended through the study and has been successful in securing grant funding for
75% of the personnel costs associated with three new hires.
The grant will provide approximately 75% of the total cost of wages and benefits for the first two
years of the program, with the third year of the program moving to 25% of wages and benefits.
Fiscal and Policy Implications
There will be new personnel costs associated with hiring the three positions and we will need to
budget approximately $90,000.00 to cover the matching costs in 2020 and 2021. There will be
estimated overtime savings of approximately $27,000.00, bringing the net new costs to the City of
approximately $63,000.00. The grant will provide approximately $480,000.00 in personnel funding
for the first two years of the program, and $75,000.00 in personnel funding for the third year of
the program.

There will be an initial equipment cost associated with hiring the three new personnel of
approximately $14,550.00.
The Fire Department and Finance Department have worked together to identify costs and the
recommendation is to move forward with the grant acceptance.

• Adopt Resolution 3781 Authorizes the Fire Department to accept the
SAFER Grant on behalf of the City.
• Take no action. We would reject the SAFER Grant and would
not receive any of the grant funding
associated.

A RESOLUTION ACCEPTING A PERSONNEL GRANT FOR FIRE AND EMERGENCY RESPONSE Recitals:
1. The Department of Homeland Security has awarded a grant to the City of Moses Lake for personnel costs associated with the hiring of three additional firefighters within the Fire Department.
2. The grant period is for three years and covers approximately 75% of personnel costs for
the three positions the first two years of the grant period, and 25% of personnel costs for the third year of the grant period.
Resolved:
1. The City Council of the City of Moses Lake accepts the Staffing for Adequate Fire and Emergency Response (SAFER) Grant.

Staff Report Summary
The Moses Lake Lodging Tax Advisory Committee (LTAC) met on September 17 to consider the
2020 applications for funding support to eligible groups and organizations that have positive
impacts on tourism in the greater Moses Lake area. The funding source is the hotel/motel tax that
the City of Moses Lake receives from the State of Washington.
The LTAC members considered all applications in accordance with the LTAC General Guidelines
document with specific attention to the Project Evaluation Criteria portion of the Guidelines. The
LTAC recommended that the City Council fund 9 of the 14 applications received as outlined in the
attached summary.
Background
The Lodging Tax is an excise tax authorized by State law in RCW 67.28, Public Stadium, Convention,
Arts and Tourism Facilities. The City of Moses Lake has imposed an excise tax on charges for
lodging by hotels, motels, and similar business enterprises, pursuant to Chapter 82.08 RCW. In
Moses Lake, the total tax on lodging is 4% (this includes the original 2% sales tax credit and the
additional 2% special excise tax).
Fiscal and Policy Implications
The City of Moses Lake has established a special revenue fund titled “Tourism Activities Fund” to
account for the lodging tax receipts and related tourism promotion expenditures.
The City intends to maintain a reserve in the fund, and will assess how much of the fund to
appropriate in a given year on an annual basis.

As set forth in RCW 67.28.1816, the revenues received from the City’s hotel/motel tax may be used for
the following purposes only:
1.Tourism marketing;
2.Marketing and operations of special events and festivals designed to attract tourists;
3.Operations and capital expenditures of tourism-related facilities owned or operated by a
municipality or a public facilities district; or
4.Operations of tourism-related facilities owned or operated by nonprofit organizations
Note: As of July 1, 2013, capital expenditures for tourism-related facilities owned by nonprofit
organizations are no longer permitted expenditures of lodging tax funds.
