Balsam St., Moses Lake, Washington. ROLL CALL Present: Mayor Liebrecht; Deputy Mayor Curnel; Council Members Jackson, Myers, Leonard, Riggs, and Hankins. PLEDGE OF ALLEGIANCE Roger Silva led the Council in the Pledge of Allegiance. SUMMARY REPORTS MAYOR’S REPORT Bridges Appointment Mayor Liebrecht was asked to represent the City on this regional association for sister cities. She would like to accept the invitation since her term as Mayor is scheduled to end soon. Action taken: Council Member Jackson moved to accept the appointment of Mayor Liebrecht to the Bridges Association, second by Council Member Riggs. The motion carried 7 – 0. CITY MANAGER’S REPORT Grant County Conservation District (GCCD) and Watershed Council Update Interim City Manager Kevin Fuhr advised that the GCCD is not interested in funding from the City through an Interlocal Agreement and that they would like the Council to vote to rejoin the District vs. sending the vote to a public election. City Attorney Katherine Kenison advised that the Attorney General (ATG) indicated no case law to interpret the current RCW to rejoin and the only conservative approach for the Council would be a public vote. Council concurred for the Mayor to attend the next GCCD meeting to make another attempt to discuss the opinion provided by the ATG. Council Oaths of Office Council approved staff to arrange for a local Judge to administer the Oaths of Office for new and reappointed Council positions at the last meeting in December. CITIZEN’S COMMUNICATION Thank You Elisia Dalluge, 310 Loring, Moses Lake, thanked everyone for helping with a fundraiser, the fire department for attending the community Thanksgiving meal, and shared that she is working with Grant County and City staff for a joint Kindness Proclamation in 2020. PUBLIC HEARING #2 2020 Budget Ordinance 2938 The first public hearing of the draft ordinance occurred on November 12. Mayor Liebrecht continued the public hearing at 7:21 p.m. Downtown Moses Lake Association Executive Director Brandon Nicholas requested Council approve participation in the Main Street Tax Credit program and contributing to their association. Council asked the City Attorney to provide information about the program at the next meeting. There being no further comment, the hearing was closed at 7:29 p.m. Action taken: Deputy Mayor Curnel moved to adopt Ordinance 2938, second by Council Member Myers. The motion carried 7 – 0. OLD BUSINESS #3 Right of Way Vacate Request from Fox Properties Ordinance 2939 Council conducted a public hearing for this request on November 12 to vacate a portion of 3rd Avenue west of Broadway Avenue. The ordinance includes compensation to the City, City access for utility maintenance, and requirement of the owner to do a lot consolidation. Action taken: Council Member Riggs moved to adopt Ordinance 2939, second by Council Member Myers. The motion carried 7 – 0. #4 Fire Impact Fee Ordinance 2940 Staff are requesting Council consider development fees to cover costs to increase fire services in order to maintain the same insurance rating for existing property owners during new growth. Mark Fancher, Gary Mann, Teresa Sullivan, and Dustin Schwartz provided testimony to Council. Action taken: Council Member Hankins moved to postpone the vote until a Council subcommittee can be formed to meet with stakeholders and the new City Manager to discuss this solution, second by Council Member Riggs. The ordinance gives authority for the Police Chief to hire a Hearing Examiner for seizure and forfeiture proceedings. Action taken: Council Member Jackson moved to adopt Ordinance 2941, second by Deputy Mayor Curnel. The motion carried 7 – 0. #6 Planning Commission Membership MLMC 2.36 Ordinance 2942 First presentation occurred on November 12. The ordinance reduces the number of Commissioners from nine to five. Action taken: Council Member Hankins moved to adopt Ordinance 2942 as presented, second by Deputy Mayor Curnel. The motion carried 7 – 0. #7 Cascade Valley in City Limits Recommendation First presentation occurred on November 12. Staff is seeking direction from Council regarding suggested specialized requirements to ‘existing’ platted lots in order to issue building permits within this designated area. Action taken: Council Member Myers moved to allow the platted area be deemed insufficient and allow for a covenant to be attached to the lots, second by Council Member Leonard. The motion carried 7 – 0. #8 Lakeside Disposal Contract Following several Council committee and public meetings, Council authorized staff to negotiate services for solid waste with Lakeside Disposal. The new contract contains a rate reduction, eliminates a fuel surcharge, eliminates charge for bailing recycled material, purchases the residential carts from the City, and increase their annual donation to local youth programs. Requested insurance requirements are under review and if they cannot be met by Lakeside, a revised contract will be brought back for Council approval. Action taken: Deputy Mayor Curnel moved to authorize the City Manager to execute the contract as presented, second by Council Member Myers. The motion carried 7 – 0. NEW BUSINESS #9 2019 Budget Amendment Ordinance – First Presentation The draft ordinance reflects changes in six funds totaling $784k in additional expenses and $184k in additional revenue. First presentation of the ordinance. No action taken. #10 Solid Waste Fee Schedule Resolution 3785 Solid waste rates were adjusted in 2018 following a rate study to fully recover costs. Due to the new hauler contract approved tonight under item #8, the reduction in rates can be passed on to the customers. Action taken: Council Member Hankins moved to adopt Resolution 3785, second by Council Member Riggs. The motion carried 7 – 0. #11 School Flashing Beacon Surplus Termination The School District has requested to turn back ownership of the flashing beacons that the City determined surplus to the District on Resolution 3657 dated December 27, 2016. Moses Lake Council Packet 12-10-19, Page 5 of 83 Beacons that are operating will remain in service until they need repair, those not operating will be removed, both instances are located in neighborhoods with a speed limit of 25 mph. Beacons located near schools on Pioneer Way and Paxson Drive will be repaired and maintained by the City due to the higher speed limits. Action taken: Council Member Leonard moved to authorize the termination of the flashing beacon surplus agreement, second by Deputy Mayor Curnel. The motion carried 6 – 1, Council Member Hankins opposed. #12 Port of Moses Lake Water Resolution 3779 (Actual discussion took place immediately following the Consent Agenda). The resolution adopts the policy to provide consistent criteria and parameters for a new Group-A Non-transient Non-community water system within the City’s retail service area Action taken: Council Member Hankins moved to adopt Resolution 3779 as presented, second by Deputy Mayor Curnel. The motion carried 7 – 0. ADMINISTRATIVE REPORTS Finance Director Cindy Jensen announced that the sales tax income has met the full 2019 budget as of November. COUNCIL COMMUNICATIONS AND REPORTS Council Member Jackson advised that the revised municipal airport lease will be presented for Council review at the first meeting in December with hopes of approving a final document before the year end. Council Member Myers reported that the Grant Transit Authority has completed a study on the effects of I-976 that reduces car tab fees and feel there will be no negative impacts as a result of its passage. Council Member Riggs met with the Mayor, City Manager, and representative from Governor Inslee’s office to discuss local and statewide issue impacting cities. Mayor Liebrecht thanked everyone who participated in the City Manager panel interview process. EXECUTIVE SESSION Mayor Liebrecht called an Executive Session at 8:30 p.m. to be held for ten minutes pursuant to RCW 42.30.110(1)(c) to discuss the sale of surplus property and there will be no further business. RCW 42.24.180 requires the review and approval of all payments at a regularly scheduled public meeting on at least a monthly basis. The State Budgeting, Accounting and Reporting Systems (BARS) Manual outlines the above format for approval by the City Council. RCW 42.24.080 requires that all claims presented against the City by persons furnishing materials, rendering services, or performing labor must be certified by the appropriate official to ensure that the materials have been furnished, the services rendered, or the labor performed as described, and that the claims are just, due and unpaid obligations against the City. RCW 42.24.180 allows expedited processing of the payment of claims when certain conditions have been met. The statute allows the issuance of warrants or checks in payment of claims before the legislative body has acted to approve the claims when: (1) the appropriate officers have furnished official bonds; (2) the legislative body has adopted policies that implement effective internal control; (3) the legislative body has provided for review of the documentation supporting the claims within a month of issuance; and (4) that if claims are disapproved, they shall be recognized as receivables and diligently pursued. The City meets all these conditions. To comply with the requirements, Finance staff schedule payment of claims and payroll for semi-monthly Council approval on the Consent Agenda. The payments listed in the schedule cover all claims and payroll payments during the period prior to the date of the Council meeting. All payments made during this period were found to be valid claims against the City. Details are attached and any questions should be directed to the City Manager or Finance Director. The City’s internal controls include certification of the validity of all payments by the appropriate department prior to submission for payment. The Finance Director has delegated authority for the examination of vouchers and authorization of payments to the Finance, Accounts Payable, and Payroll staff. All payments are reviewed and validated. The Finance Division regularly reviews its processes to ensure appropriate internal controls are in place. Background Closure of the Larson Recreation Center eliminated onsite concessions at the ice rink. Mobile concession units are an option to address the public’s food and beverage needs without operating a fixed internal location. Mr. Galfano has a self-contained mobile unit that would allow him to vend at the ice rink with City Council authorization. Fiscal and Policy Implications Onsite concessions allow patrons to purchase food and beverage at the facility. This typically leads to higher facility usage, especially during regular meal times. Options Option Results •Approve Mr. Galfano’s request There would be on-site food & beverage during operation of the ice rink. •Take no action The ice rink would operate without food & beverage sales on-site. Background The City has a contract with Cenex Harvest States for fuel procurement. That contract was executed on November 16, 2004, and Addendum 1 provides for additional 3-year extensions. The contract has been extended four (4) times: in 2007, 2010, 2013, and 2016. The current extension expired on November 16, 2019. In some cases there is additional revenue to support the additional expenditures, either in program revenues or grants. In those cases that are not supported by additional revenue, the fund balance is adequate to absorb the increase. The attached ordinance increases the 2019 budget for six funds resulting in citywide total expenditures of $784,000 and adds $184,000 to estimated revenue, resulting in a net use of fund balance of $600,000 in three separate funds (three funds have equal expenditures and revenues). Background RCW 35A.33.090 sets forth the requirements to amend the budget absent a true “emergency”. Most fund amendments are primarily the result of things already approved by Council but just not completely incorporated in the current budget. A summary of the changes follows: •The emergency repairs for the Division and 5th water main break and Northshore Drive Wastewater pipe break ($150,000 and $350,000 respectively). •Fire reported that they have several staff on extended light duty, so we are budgeting to cover the backfill of their shifts, both with provisional employees and overtime, in the amount of $115,000. This is the only addition in General Fund, and part of the increase in Sales Tax is being added to the revenue estimate to keep this entry neutral. Moses Lake Council Packet 12-10-19, Page 57 of 83 • A power cot used to lift patients in and out of ambulances broke down. Because of its age and condition we determined it was more cost effective to replace the piece of equipment rather than repair it. This is adding $24,000 to the Ambulance Fund, which is being covered by prior years’ Ground Emergency Medical Transportation (GEMT) Medicaid reimbursement. • Unemployment claims are higher than anticipated this year, adding $45,000 which will be charged back to applicable operating budgets, keeping that entry neutral as well. • Risk management deductible estimates exceeding original estimates -- $88,000 is being added. • We just found out that the copy machine in the Administration area needs a part that is obsolete (it was purchased in 2011). We are proposing to purchase a replacement out of Central Services budget, estimated to cost $12,000. Fiscal and Policy Implications It is a compliance issue to have actual results be within the authorized appropriation. If we overspend an appropriation, the State Auditor’s Office would likely note it as an area of non- compliance with laws. The City Council declares that an emergency exists and this ordinance is deemed a public emergency ordinance necessary for the protection of public health, public safety, public property, or public peace and shall take effect immediately as provided by law upon one reading if a majority plus one of the whole membership of the City Council vote in favor of passage. Section 4. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written or as applied to any particular person or circumstances, no other section of the ordinance shall be deemed to be invalid, but rather, should be deemed to have been enacted independently and without regard to the section affected. Background Many of the fees are unchanged from 2019. Parks and Recreation reviewed their fee structure and are proposing modest fee increases for some of their activities, primarily to recover the minimum wage increase. In accordance with Council direction given in November of 2016, basic utility fees are being adjusted to keep up with inflationary increases, by applying the year-over- year increase in September’s All Urban Consumers (CPI-U) West—B/C (i.e. small cities) index of 2.3%. Community Development is proposing 2 new fees. A building permit for Grading, Parking Lots, and/or Stormwater of $100.00 is being added. Also, a technical fee of 1% on all building permits is being proposed, which is intended to help cover the cost of the technology related to land use (such as GIS/ESRI software, mobile devices, etc.) Fiscal and Policy Implications Since we have recently established by ordinance that the appropriate way to modify the City’s fee schedule is by resolution, that is how we are setting the fees to be effective January 1, 2020. These fees were used to develop the revenue estimates that are the basis of resources available to accomplish the 2020 budget that was adopted by Council at the November 26, 2019, meeting. In connection with the municipal functions and operations of the City of Moses Lake, the City requires certain fees; and 2. It is appropriate to review such fees and make adjustments to appropriately address costs; and 3. In keeping with the philosophy of setting City fees in amounts reflective of actual costs, it is appropriate at this time to revise certain fees to compensate the City for costs associated with various City functions and facilities. Resolved: Section 1. See attached map. The matter of initiating annexation proceedings with the subject property comes from a request for municipal water. In accordance with the City Council’s Policy regarding utility extensions, properties that are within one-half mile of the corporate limits and wish to connect to water/sewer services must annex unless otherwise granted an exception by the City Council. Background In 2001, the City Council adopted a Comprehensive Plan that included an Urban Growth Area (UGA) that was negotiated between the Grant County Board of County Commissioners and the Moses Lake City Council in accordance with RCW 36.70A.110. The final adopted UGA was nearly ten (10) years in the making and was subject to much debate, discussion and Public Hearings. The Moses Lake UGA is a twenty (20) year vision that is intended to encourage growth that is urban in nature and whereby urban governmental services would be provided by the City. The Moses Lake Comprehensive Plan, Goal 3, Section 3-8 Land Use Chapter, addresses when it is appropriate to annex areas within our Urban Growth Area. “Goal 3: THE CITY SHALL ANNEX ONLY THOSE PROPERTIES WHERE URBAN SERVICES ARE APPROPRIATE AND CAN BE REASONABLY PROVIDED” Moses Lake Council Packet 12-10-19, Page 72 of 83 Fiscal and Policy Implications Municipal Services, Police, Fire, Planning and Building would all be impacted in terms of providing services. The development of annexation area would yield property taxes and more, which would be utilized to offset staff and infrastructure costs associated with City services that would be provided to the area. Options Option Results • Consider and accept the Notice of Intention to Commence Annexation Proceedings Annexation proceedings are initiated and the City Council can initiate the annexation and proceed with annexation. • Take no action The City Council will contradict the Goals and Policies of the Comprehensive Plan, Urban Growth Area.
