Council agreed to have the Planning Commission review current residential standards for fire access, fire safety, and quality of life; as well as planter strips in the commercial standards. CALL TO ORDER: The regular meeting of the Moses Lake City Council was called to order at 7:00 p.m. by Mayor Liebrecht in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington. ROLL CALL: Present: Mayor Liebrecht, Deputy Mayor Curnel, Council Members Hankins, Jackson, Leonard, Myers, and Riggs. PLEDGE OF ALLEGIANCE: Council Member Leonard led the Council in the Pledge of Allegiance. SUMMARY REPORT: MAYOR’S REPORT Mayor Liebrecht recommended appointment of Darrin Jackson to serve the unexpired term on the Airport Board. Action taken: Deputy Mayor Curnel moved to confirm the appointment, second by Council Member Leonard. The motion carried 7 – 0. CITY MANAGER’S REPORT AWC Conference A notice of quorum was posted due to four Council Members attending the AWC Annual Conference in Yakima from June 27th through June 29th. ADA Sidewalk Placement Staff distributed a map at the meeting relating to a request of a business to add ADA access. Council concurred to have staff move forward with design and formal approval. New City Employees Police Chief Kevin Fuhr provided a brief history about Edmond Guerrero and then administered his Oath of Office as Moses Lake Police Officer. CONSENT AGENDA #1 a. City Council meeting minutes June 12, 2018. b. Claims in the amount of $269,860.92; prepaid claim checks in the amount of $12,252.62 and $120,793.29; claim checks in the amount of $1,213,572.45 and payroll checks in the amount of $424,405.50. OLD BUSINESS #2 Repeal Board of Library Trustees, Consolidate Boards & Commissions to MLMC 2.36 Ordinance 2902 First presentation of the draft ordinance occurred on June 12th. The amendment will eliminate the Board of Library Trustees and consolidate all Board and Commission regulations to one section of the code. Staff distributed an update to subsection 2.36.040 at the meeting. Action taken: Council Member Hankins moved to adopt Ordinance 2902 as amended at the meeting, second by Council Member Myers. The motion carried 7 – 0. #3 Elected Officials Amendment of MLMC 2.92 Ordinance 2903 First presentation of the draft ordinance occurred on June 12th. The amendment will update Boards and Commissions that the Council are prohibited from being an appointed member of. Action taken: Council Member Leonard moved to adopt Ordinance 2903 as written, second by Council Member Jackson. The motion carried 7 – 0. #4 Water Conservation Amendment of MLMC 13.07 Ordinance 2904 First presentation of the draft ordinance occurred on June 12th. The ordinance designates July and August as mandatory months of water conservation and amends the definition of restrictions and rationing. Education materials will be distributed regarding watering for proper deep root growth, sustaining the aquifer, sustaining well equipment, and maintaining an ample water supply for fire protection services. Action taken: Deputy Mayor Curnel moved to adopt Ordinance 2904 as written, second by Council Member Riggs. The motion carried 6 – 0, Council Member Myers opposed. NEW BUSINESS 1 of 2 #5 a. Nuisance Abatement 1244 S Division Resolution 3732 b. Nuisance Abatement 1105 E Hill Resolution 3733 c. Nuisance Abatement 945 S Balsam Resolution 3734 Agenda item (d) Nuisance Abatement 233 N Manzanita St has complied. Pictures of the remaining three abatements were distributed at the meeting to illustrate the violations still exist. Code Enforcement Officer Rick Rodriguez was sworn in and provided testimony regarding the three nuisance violations. There was no other testimony and the hearing was closed. No action taken. #7 Surplus Property Resolution 3726 The city no longer requires the property deeded to the city under Resolution 1129 and staff recommends the property be declared surplus and authorize a sale in a commercially reasonable manner. Action taken: Council Member Jackson moved to adopt Resolution 3726 as written, second by Deputy Mayor Curnel. The motion carried 7 – 0. EXECUTIVE SESSION Mayor Liebrecht called an Executive Session at 7:57 p.m. to be held for 30 minutes pursuant to RCW 42.30.110(1)(b), (c), and (i) to consider property acquisition, to consider the minimum price at which real estate will be offered for sale, and regarding potential litigation; with action to follow. NEW BUSINESS 2 of 2 Purchase and Sale Agreement Sale of surplus property approved by Resolution 3726. Action taken: Mayor Liebrecht moved to authorize the City Manager to sign and execute all documents to complete the purchase and sale agreement(s) as discussed in Executive Session, second by Council Member Hankins. ADMINISTRATIVE REPORTS City Manager John Williams advised there are two Park and Recreation Board vacancies that will be advertised this week due to one resignation and from tonight’s elimination of a designated youth position. Finance Director Cindy Jensen will be meeting with the Consultant from Bell and Associates, Lakeside Disposal, and Consolidated Supply on Thursday to work on final information for the Solid Waste Cost of Service Study. A municipal access easement is required to be recorded concurrently with all binding site plans, to allow the City to access the water meters and flush the water system. This requirement applies to all new and revised binding site plans submitted since the adoption of the ordinance in 2007. Background Central Terminal Major Plat, Industrial Binding Site Plan, 2nd Amendment, has been reviewed and approved conditional upon the subject easement. This amendment adjusts a few internal property lines to better match the existing development. Fiscal and Policy Implications Accepting the easement is consistent with existing policy and Municipal Code requirements. Page 2 of 2 Options Option Results • Accept the easement Staff will move forward with recording the binding site plan, so the property will be configured as the property owner wishes, and the City has the easement for access to the water meters and/or sewer lines. • Take no action The binding site plan will not be recorded. The property lines will not be moved by a few feet but the owner can continue to develop under the previous approval. The City will not have an easement to access the water meters. Staff Recommendation Staff recommends City Council adopt Resolution 3731 to accept the easement as presented. Attachments A. B. Test results from a similar pipe tested in Vancouver, Washington are provided for review. Those test results are not a concern with the volume stated, and we can hold the water in our holding pond until it evaporates. Background MLMC 13.05.130 requires the City Council approval for all discharges without physical connections to the Publicly Owned Treatment Works (POTW). Fiscal and Policy Implications Staff time will be spent to monitor the discharge and prepare/review the reports. The proponent will pay a fee for the discharge proportionate to staff time required to the request and prepare staff reports. Page 2 of 2 Options Option Results • Move to authorize the “discharge” as presented, at the location approved by the Wastewater Division Supervisor Staff will prepare a letter in accordance with MLMC 13.05.130 to allow the discharge. • Take no action The City will not accept the discharge and the proponent will need to discharge at an alternate location. Background The project consisted of hauling and land applying 580.39 dry-tons of Biosolids from 2 basins and locations. One basin at the Sand Dunes Treatment Facility and one basin at the Larson Sewer Treatment Facility. The contract was awarded for $196,900.00 to haul 500 dry-tons. The final contract amount is $227,432.12. The increase was due to hauling and applying additional material to further empty the basin at the Larson Treatment Plant. Background The project consisted of replacing the existing headworks consisting of a settling basin, mechanical screen and flow splitter box with a new dual channel and screen facility with a more precision splitter box which allows greater control of how the flow is divided into the treatment basins. The project also demolished the old shelter that had been severely deteriorated due to the exposure to sewer gasses with a new shelter built of materials that will better resist the corrosive environment. The contract was awarded for $1,142,412.19. The final contract amount is $1,155,908.75. The increase was for miscellaneous changes to increase safety and operability of the final produce discovered during construction. A public hearing has been scheduled and the Council should open the public hearing and take testimony on the moratorium that was imposed on uses relating to cryptocurrency mining operations. Background Ordinance No. 2900 provides staff the time needed to study the impacts of cryptocurrency mining operations on the electrical distribution network and capacities of the network within the city limits. Land use considerations will also be studied in terms of compatibility and future development patterns. Section 6 of Ordinance No. 2900 requires the development of a Work Program. The public hearing will help determine some of the facets of the Work Program along with staff considerations. The update to the chapter includes three new sections that address fire alarm monitoring, maintenance and testing of hood fire protection systems, and maintenance and testing of fire alarm systems. Moses Lake Municipal Code Chapter 16.52 addresses the installation and maintenance of automatic fire extinguishing systems. Changes in how contractors report maintenance and repairs to required fire protection systems are addressed in the change to the chapter. Background Changes to National Fire Protection Association Standard 72, Fire Alarm Systems, has raised the issue of monitoring of fire alarm systems by voice over internet protocol and / or cellular dialers. The use of these devices as the sole means of transmitting fire alarm notifications has resulted in an increase in false alarm responses and / or increases in out of service time for fire alarms due to cellular and wifi “drop-out”. The ordinance would require the use of at least one hard wired phone line to monitor fire alarm systems that are required by the state fire code. Page 2 of 2 The sections added for maintenance and testing of hood systems and fire alarm systems addresses the requirement for all contractors providing this work to report to a centralized reporting system, within fourteen (14) days of the work being completed. In MLMC 16.52, the section addressing reporting of maintenance and testing of automatic fire extinguishing systems has been changed to reflect the move to centralized reporting of all system maintenance. Subsections 16.36 of the MLMC titled “Fire Code” are established as follows: 16.36.120 Alarm Monitoring: Fire protection systems that are required to be monitored as identified in the currently adopted state fire code, or where required by Moses Lake Municipal Code, shall be monitored by an alarm monitoring system that complies with National Fire Protection Association Standard 72. Required monitoring systems shall be hard wired with a minimum of one dedicated phone line and one shared line. When utilizing shared phone lines the dialer must have the capability of “seizing” the phone line for immediate use in reporting an alarm. Voice over internet protocol (VOIP) or cellular dialers may be utilized as a back-up system in lieu of a second phone line, but are not allowed to be utilized as the primary means of communication between the alarm dialer and the alarm monitoring station. 16.36.130 Maintenance and Testing of Hood Systems: Hood systems that are required by this code, or other code adopted under state law, shall be required to undergo maintenance and testing in accordance with the currently adopted state fire code. Records of maintenance and testing shall be reported to the reporting service currently in use by the fire department within 14 days of service. 16.36.140 Maintenance and testing of Fire Alarm Systems: Fire alarm systems required by this code, or other code adopted under state law, shall be required to be maintained and tested in accordance with the most recent edition of National Fire Protection Association (NFPA) Standard 72, and the currently adopted state fire code. Records of maintenance and testing shall be reported to the reporting service currently in use by the fire department within 14 days of service. Section 2. Subsection 16.52.030 of the MLMC titled “Installation and Maintenance of Automatic Fire Extinguishing Systems” is amended as follows: 16.52.030 General Information: A. The regulations contained herein require the installation and maintenance of fire extinguishing systems. B. Complete information regarding the systems shall be submitted to and approved by the Moses Lake Fire Marshal. As-built plans shall be submitted to the building owner and the Fire Marshal. C. All systems shall be installed by a contractor licensed by the State of Washington to install fire sprinkler systems and components. D. Maintenance and testing of systems required under this chapter shall be in accordance with the most recent editions of National Fire Protection Association Standards 13 and 25, and with the provisions of the currently adopted State Fire Code. Section 3. Severability.
