Chris Bell owner of Bell & Associates reviewed the draft report with staff and Council. Representatives were in attendance from local haulers Lakeside Disposal and Consolidated Disposal. CALL TO ORDER: The regular meeting of the Moses Lake City Council was called to order at 7:00 p.m. by Mayor Liebrecht in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington. ROLL CALL: Present: Mayor Liebrecht, Deputy Mayor Curnel; Council Members Jackson, Myers, Leonard, Riggs, and Hankins. PLEDGE OF ALLEGIANCE: Mr. Balcom from the Moses Lake School District led the Council in the Pledge of Allegiance. SUMMARY REPORT: MAYOR’S REPORT Mayor Liebrecht announced that today is Finance Director Cindy Jensen’s Birthday! CITY MANAGER’S REPORT c/o Finance Director 2nd Quarter Financial Report The printed report was distributed to Council in email after the meeting. Ovenell Farms Contract Legal Counsel for both the city and contractor completed the final draft contract for yard waste services earlier today. Action taken: Deputy Mayor Curnel moved to authorize the City Manager to execute the contract to process organic materials, second by Council Member Leonard. The motion carried 7 – 0. CITIZEN’S COMMUNICATIONS Septic System Waiver Greg Littlefield, 3343 Valley Rd, Moses Lake, requested Council make a motion for his exemption of city utility services. CONSENT AGENDA #1 a. City Council meeting minutes July 24, 2018. b. OLD BUSINESS #2 Paving District Map Update MLMC 12.12 Ordinance 2906 The amendment will reduce the regulated area for paving where the costs used to be split with the owner and the city at a 25/75 ratio. Action taken: Council Member Hankins moved to adopt Ordinance 2906 as presented, second by Deputy Mayor Curnel. The motion carried 6 – 1, Council Member Jackson opposed. NEW BUSINESS #3 2103 Westshore Drive Sewer Connection Request Thomas R. and M’Lee Jackson request approval to connect to the City’s sewer system to serve their property parcel #141767000. Staff recommends the approval of both water and sewer connections. Action taken: Council Member Leonard moved to approve the request with an extraterritorial agreement in place, second by Deputy Mayor Curnel The motion carried 7 – 0. #4 Solid Waste Rate Adjustment Ordinance The amendment will increase rates to the consumer based on the automatic COLA increase in the hauler’s contract, which will be a cap of 3% effective September 1, 2018. 1st presentation of the ordinance. No action taken. ADMINISTRATIVE REPORTS Finance Director Cindy Jensen reported that the city has received payment from Colville Fuels. Police Chief Kevin Fuhr announced the 2019 JAG award, this is one of the requirements for recipients of the funding. Parks and Recreation Director Spencer Grigg reviewed pool closure dates due to poor air quality. Municipal Services Director Fred Snoderly provided updates on scoping for a recreation facility, field lighting installation, and success of the water conservation program. Background The project consisted of filling 605,215 feet cracks in city streets and parking lots. The project also repaired wide cracks on the Municipal Airport taxiways. The contract was awarded for $251,522.00. The final contract amount is $227,551.86. The decrease was for using less material than was calculated in the bid documents. Page 2 of 2 Fiscal and Policy Implications Upon acceptance, the City will enter into the 60 day lien period as required by Washington State Law. Options Option Results • Approve a motion to accept the project as presented. The 60 day lien period will begin. • Take no action. The project won’t be accepted at this time. None Legal Review N-A Page 1 of 2 CITY OF MOSES LAKE STAFF REPORT To: John Williams, City Manager From: Fred Snoderly, Municipal Services Director Date: August 21, 2018 Proceeding Type: Consent Agenda Subject: Request To Award Juniper Booster Pump Rehab Project - 2018 Legislative History: • First Presentation: • Second Presentation: • Requested Action: August 28, 2018 Motion Staff Report Summary Staff opened bids on August 14th for the Juniper Booster Pump Rehab Project – 2018. The City received three (3) bids for the work. The low bid was $158,042.20. and the Engineer’s Estimate was $129,720.00. Background The 2018 budget includes money for completing improvements to the Juniper Booster Pump Station. This project will allow water to be pumped from the Central Water Zone to the Lakeview Water Zone, helping to raise flows and pressures during high use months. The City has not previously worked with Shannon Industrial, Inc. out of Coeur d’Alene. Fiscal and Policy Implications The project will require budgeted funds to be spent. Page 2 of 2 Options Option Results • Award the 2018 Juniper Booster Pump Rehab Project to the lowest bidder Staff will move forward with executing a contract with the low bidder to complete the work. • Take no action Staff will stop working on this project and wait for further direction from City council. The City received three (3) bids for the work. The low bid was $86,459.19 and the Engineer’s Estimate was $83,966.68. Background The 2018 budget includes money for completing these improvements to the water system. This project was started by another contractor earlier this year. Due to failure by the contractor, the contract was terminated and the remaining work is being rebid. The contractor’s bonding company is covering any additional expense to complete the work. The City has had good success working with Cutting Edge Earthworks, Inc. out of Moses Lake in the past. Page 2 of 2 Fiscal and Policy Implications The project will require budgeted funds to be spent. Bid Summary Legal Review N-A Page 1 of 2 CITY OF MOSES LAKE STAFF REPORT To: John Williams, City Manager From: Fred Snoderly, Municipal Services Director Date: August 21, 2018 Proceeding Type: Consent Agenda Subject: Resolution Accepting Improvements for the Parkview PUD Major Plat Legislative History: • First Presentation: August 28, 2018 • Second Presentation: • Requested Action: Motion Staff Report Summary The street and utility improvements consisting of new sidewalk improvements on Division Street and a sewer manhole within an easement onsite to serve the Parkview PUD Major Plat are complete and are ready to be accepted by City Council. Background The plat regulations require all the street and utility improvements installed in right of way and municipal easements to be accepted by City Council or bonded for prior to recording the plat and issuing building permits. The construction plans are required to be reviewed and approved by the City prior to construction. All of the construction work is inspected to assure compliance with the construction plans and city standards. The street and utility improvements in place will serve a thirty-two lot planned unit development. Page 2 of 2 Fiscal and Policy Implications Upon acceptance, the City will be responsible for the maintenance and repairs of the improvements. A SUBDIVISION MAINTENANCE BOND or other approved security in the amount of $13,554.00 (50% of total costs of $27,108.00) to the City is required to be provided by the owners for the two year maintenance period which commences on the date of acceptance of the improvements by the City Council. Resolution, Vicinity Map Legal Review N-A RESOLUTION NO. 3743 A RESOLUTION ACCEPTING STREET AND UTILITY IMPROVEMENTS FOR MUNICIPAL USE AS PART OF PARKVIEW PUD MAJOR PLAT Recitals: 1. Street and utility improvements, lying in dedicated right-of-way or easements, are in place and connected to the City of Moses Lake’s street and utility systems as part of Parkview PUD Major Plat. 2. Said street and utility improvements have been installed in accordance with the City of Moses Lake’s Community Standards, such facilities being completed in August 2018. 3. RCW 35.90.030 indicates that public street and utility facilities, which are developer installed should be accepted by the City of Moses Lake upon completion if the facilities are built to city standards. Resolved: 1. The City Council of the City of Moses Lake accepts the street and utility improvements as facilities of the City of Moses Lake and as such will charge for use of facilities as authorized by ordinance. 2. After August 28, 2020, all further maintenance and operation cost of said street and utility improvements, shall be borne by the City of Moses Lake, as provided by city ordinance. Adopted by the City Council of Moses Lake, Washington on August 28, 2018. ______________________________ Karen Liebrecht, Mayor ATTEST: _______________________________ Debbie Burke, City Clerk Page 1 of 3 CITY OF MOSES LAKE STAFF REPORT To: John Williams, City Manager From: Cindy Jensen, Finance Director Date: August 21, 2018 Proceeding Type: New Business Subject: 2018 Garbage (Solid Waste) collection rates, Ordinance 2907 Legislative History: • First Presentation: August 14, 2018 • Second presentation: August 28, 2018 • Action: Motion Staff Report Summary The attached ordinance would implement increases to the Sanitation rates for both commercial and residential accounts, to be effective September 1, 2018. This adjustment will keep pace with the increase in contractor charges and keep the fund solvent as required by RCW 35.92.020. Background Annually the fee charged by our contractors increases every September 1. For the contractor that rate for this year will be 3.0%, which is based on the contracted July CPI (it should be noted that the July CPI was published after the August 14 packet was submitted—this is based on the June index which is 3.3%. Per the contract, the maximum increase in any year is 3.0%). In 2013 the fund could not keep up with the landfill costs and operating expenses to the point that a $100,000 interfund loan was needed to cover the shortfall. In 2014 another $100,000 loan was required, and in 2015 the loan amount grew to $300,000. In 2016 another loan was approved for $300,000. The State Auditors observed that we have not covered the cost of the utility since 2013 and noted at Page 2 of 3 the end of the 2016 audit that the City needs to “closely monitor and evaluate the financial health of its … Sanitation Fund and take action as necessary to achieve solid financial health…”. We were able to avoid taking an additional loan at the end of 2017, although the fund balance was depleted. We have been repaying the loans according to the terms, and the last payment is due in 2019. Prior year increases are generating enough revenue to break even. The rate increase would raise the majority of residential bills (68%) by less than $1 per month. In order to keep this fund on the path to solvency, Council approved contracting for a rate study to be performed. The draft report has been completed which is the topic of an August 14 study session, however, Council can take some time to thoroughly vet the recommendations in the report, and can direct that any additional changes to the rate structure come back for their consideration later in the year, to be effective in January 2019. Fiscal and Policy Implications Passing the ordinance will increase rates of the Sanitation fund to keep pace with the contractor’s fee increase, and maintain the current level of service. The Municipal Code does allow for some exceptions to our requirement to connect to city services, but those exceptions must come from the City Council. Staff does not have the authorization to grant an exception to the requirements of MLMC 13.05, Wastewater Regulations, which state that all new Residential building meant for human occupancy must connect to city sewer. City sewer is not available in Cascade Valley. Background In 2006 and 2007 the City of Moses Lake annexed portions of Cascade Valley. Those annexations included the Willowcrest Subdivision, which was approved under County jurisdiction prior to annexation and also 163 acres of vacant undeveloped property referred to as the Schneider Homes property. The intent was to extend water and sewer to these areas via a lake crossing burial of utilities. Staff initiated the design and proper environmental permits but stopped all work due to budget constraints and the major drop in the housing development market nationwide. Page 2 of 2 There have been no plans or CIP budget items proposed to service the subject annexed areas since their annexation. This continues to be an issue for those property owners in the area and also the City of Moses Lake. Fiscal and Policy Implications The Fiscal implications are significant with the extension of municipal water and sewer service to the subject annexed areas. The Policy implications are yet to be determined in terms of how the City Council would like to handle those areas where city services are not available and building permits are denied due to the lack of municipal utilities. Options Option Results • Consider a deviation/variance to allow the installation of a private septic system for a single-family residence. Property owner is allowed to build on a vacant lot. • Deny the request Property owner is not allowed to build on a vacant lot resulting in possible risk exposure to the City of Moses Lake. Background Leland Drive was named in the Crestview Heights Major Plat. The street extended only one lot deep, none of the homes in the subdivision front the road, and none of the house addresses will need to be changed as a result of the renaming. Subsequent development results in this roadway being connected to the existing Polo Ridge Drive. This change will allow for the roadway to have a consistent name along its entire length.
