The meeting was called to order at 7 p.m. by MayorLane.
PLEDGE OF ALLEGIANCE:Calvin from Boy Scout Troop 96 led the Council in the pledge of
allegiance.
PRESENTATIONS AND AWARDS
PROCLAMATION
The proclamation honoring Lupe Hernandez for his service to the community was read in its
entirety.
CONSENT AGENDA
Minutes:The minutes of the March 8,2011 meeting were presented for approval.
Approval of Claims.Prepaid Claims.Checks,and Payroll:Vouchers audited and certified bythe
Finance Director as required by RCW 42.24.080, and those expense reimbursement claims,
certified as required by RCW 42.24.090, have been recorded on a listing whichhas been made
I j available to the Council for approval and is retained for public inspection at city hall.As of March
^•^22,2011 the Council does approve for payment claims in the amount of $256,734.72;prepaid
claims in the amount of $48,279.79;claim checks in the amount of $1,654,843.58;and payroll in
the amount of $24,446.96.
Action Taken:Mr.Pearce moved that the Consent Agenda be approved,seconded by Mr.Ecret,
and passed unanimously.
COMMISSION APPOINTMENTS
TOURISM COMMISSION
Mayor Lane requested Council confirmation of the re-appointment of Bev Shuford to the Tourism
Commission.
Action Taken:Mr.Deane moved that the re-appointment of Bev Shuford to the Tourism
Commission be confirmed,seconded by Dr.Curnel, and passed unanimously.

ORDINANCES AND RESOLUTIONS
[)ORDINANCE -AMEND 8.52 -RESIDENTIAL VEHICLE STORAGE -2nd READING
An ordinance was presented which amends the vehicle storage regulations to address the issue
ofthe use ofgravel asa parking surface in the front yard in the residential areas ofthe City.The
ordinancewas changed as requested bythe Council.

The ordinance amending Chapter 8.52 of the Moses Lake Municipal Code entitled "Residential
Vehicle Storage"was read by title only.
Joseph K.Gavinski,City Manager,mentioned that the Council amended the language in the
ordinance presented at the last meeting.With that change,some additional changes were needed
in other areas of the ordinance to make it comply with the requested changes.Three proposed
ordinances were provided for the Council's consideration.He showed several pictures of the
various ways home owners are storing their vehicles.
There was considerable discussion by the Council.
Ralph Dillon,339 Earl Road,stated that he is unable to have access to his back yard since the side
yard setback is only 5'. He mentioned that he had a paved area installed adjacent to the side lot
line to accommodate his vehicle as required by the city at the time and nowthe city is changing the
requirements and making it illegal to park his vehicle in that area.
Joe Cassiano, 508 Clark,stated that the city does not allowhimto parkhis 5th wheel orboat onthe
street so he installed asphalt on his lot in order to park them on the lot and now he is being told he
cannot do that either.
Mr.Gavinski gave some history on the regulations for residential vehicle storage.
There was additional discussion by the Council.
Action Taken:Mrs.Liebrecht moved that the ordinance be changed to eliminate the last sentence
in 8.52.040 B 1,seconded by Mr.Deane,and passed unanimously.
/y6-ORDINANCE -CREATE 9.22 -OFFENSES AGAINST PUBLIC PEACE -2nd READING
An ordinance was presented which addresses panhandling and donation solicitationfrom vehicle
occupants.
The ordinance creating Chapter 9.22ofthe MosesLake Municipal Code entitled "OffensesAgainst
Public Peace"was read by title only.
Action Taken:Mr.Deane moved that the ordinance be amended by using a C-13 penalty and the
second reading ofthe ordinance be adopted,seconded by Dr.Curnel,andpassed unanimously.
/O/S'ORDINANCE -AMEND 13.12-WATER.SEWER.AND STORMWATER RATES -2ND READING
An ordinance was presentedwhich increasesthe water,sewerand stormwater rates.
Theordinance amending Chapter 13.12 ofthe Moses Lake Municipal Code entitled "Water,Sewer,
and Stormwater Rates"was read by title only.
Action Taken:Mr.Pearce moved that the second reading ofthe ordinance be adopted,seconded
by Mr.Deane and passed with Dr.Curnel opposed.
/0/3 RESOLUTION -ABANDON EASEMENT -REC SOLAR GRADE SILICON
A resolution was presented which abandons the easements granted to the City by REC Solar
Grade Silicon during the reconstruction of Road N.

The resolution authorizing abandonment of an easement was read by title only.
Action Taken:Mr.Ecret moved that the resolution be adopted,seconded by Mrs.Liebrecht, and
passed unanimously.
REQUEST TO CALL FOR BIDS
TRACTORS AND SKID STEER LOADER
Staffrequested authorization to call for bids for a compact utility tractor for the Park and Recreation
Department,a 120-horsepower tractor for theWastewater Division,and askid steerloader for the
Stormwater Division.
Action Taken:Mrs.Liebrecht moved that staff be authorized to call for bids,seconded by Dr.
Curnel,and passed unanimously.
REFERRALS FROM COMMISSIONS
AMERICAN LEGION RIDERS -NATIONAL POW/MIA REMEMBRANCE DAY
The American Legion Riders requested the use of McCosh Parkon Friday,September 16,2011
fora National POW/MIA Remembrance Dayevent. The event will honorthe men andwomen from
the State of Washington who are or have served in the armed forces and those who are a
[J POW/MIA.Theevent will include food vendors and a beer garden.The Parks and Recreation
Commission recommended that the request be granted with the understanding that the American
Legion Riders will abide by all rules and regulations regarding food,beverages,and alcoholsales
and consumption.
George Doles,227 5th Avenue,Soap Lake,director for the American LegionRiders,explainedtheir
purpose and gave an outline of the events planned for the day.
There was some discussion by the Council.
Action Taken:Mr.Deane moved thatthe request be granted,seconded by Dr.Curnel,and passed
unanimously.
THE SPORTS FORUM
The Sports Forum, which will be holding three baseball tournaments in Moses Lake in 2011,has
requested permission to sell T-shirts and raffle tickets at their tournaments this year.These are
non-foodorbeverage items whichdo notcompetewiththe established Cityconcession operations.
ActionTaken:Dr.Curnel moved thatthe request be grantedwiththe stipulation thatthe appropriate
percentage of the profits be given back to the city,seconded by Mrs.Liebrecht,and passed
unanimously.
OTHER ITEMS FOR COUNCIL CONSIDERATION
SIGN -CENTRAL BASIN TRAFFIC SAFETY TASK FORCE
The Central Basin Traffic Safety Task Force requested permission to placea variable message
board at the Moses Lake Fire Department to promote the correct use of childcar seats.

Rhonda Chase,Hair,requested permission to place a sandwich board sign in city right-of-way at
the north side entrance to the Lep-re-con parking lot at 2707 W.Broadway.
Action Taken:Mr.Ecret moved that the request be granted for a 4"x 2'sign,seconded by Dr.
Curnel,and passed unanimously.

PROJECT UPDATE
GilbertAlvarado, Community Development Director, provided an update of the current projects in
the city.
