The meeting was called to order at 7 p.m. by Mayor Deane.
PLEDGE OF ALLEGIANCE: Mayor Deane led the Council in the flag salute.

CONSENT AGENDA
Minutes:The minutes of the January 27 meeting were presented forapproval.
Approval of Claims.Prepaid Claims.Checks,and Payroll:Vouchers audited and certified by the Finance
Director as required by RCW 42.24.080, and those expense reimbursement claims,certified as required by
RCW 42.24.090, have been recorded on a listing which has been made availableto the Councilforapproval
and is retained for publicinspection at the CivicCenter. As of February 10,2015 the Council does approve
for paymentclaimsinthe amountof $985,998.79;prepaid claimsinthe amountof $28,494.87;claim checks
in the amount of $1,338,214.13;and payrollin the amounts of $310,467.60 and $3,933.95.
Resolution -Accept Easement -PUD:Aresolution was presented which accepts an easement from the PUD /D/3
for sidewalk at the intersection of Stratford and Kinder Roads.
Resolution - Accept Easement -Ventura:A resolution was presented which accepts an easement from /OA3
Michael Ventura for sidewalk at the intersection of Stratford and Kinder Roads.
Accept Work -Heron BluffTrail Project:KelayeConcrete has completed the 2014 Heron BluffTrail Project.j£/D

Action Taken:Mr.Voth moved that the Consent Agenda be approved,seconded by Mr.Avila, and passed
unanimously.

ORDINANCE -EXTEND MORATORIUM ON MEDICAL MARIJUANA GARDENS -2nd READING/PUBLIC /QvY
HEARING
An ordinance was presented which extends the moratorium on the establishment of"collective gardens"for
the medical use of marijuana.
The ordinance of the Cityof Moses Lake extending a moratorium on the establishment of medical marijuana
collective gardens,defining "medical marijuana collective gardens",providing fora public hearing establishing
an effective date,and providing that the moratorium,unless extended,willsunsetwithin six (6)months of the
date of adoption was read by title only.
The public hearing was opened.There were no comments.
Action Taken:Dr.Curnel moved that the public hearing be closed,seconded by Mrs.Liebrecht,and passed
unanimously.
{^_J Joseph K.Gavinski,City Manager,stated that the moratorium is proposed in order to give the legislature time
to resolve the differences between the recreational and medical marijuana regulations.

ORDINANCES AND RESOLUTIONS
/03(f ORDINANCE -AMEND 16.40 -2nd READING
Anordinance was presentedwhich amends Chapter16.40,Fire Department Permit Fees,in ordertocomply
withthe requirements foroperational permits as outlined inthe currently adopted International Fire Code.
ActionTaken:Mr.Voth moved that the ordinance be removed fromthe table,seconded by Dr.Curnel, and
passed unanimously.
The ordinanceamending Chapter 16.40 ofthe Moses Lake Municipal Code entitled"Fire DepartmentPermit
Fees"was read by title only.
Brett Bastian,Assistant Fire Chief,stated that this update brings the regulations into compliance with the
International Fire Code and explained how they would be enforced and who they would pertainto.
ActionTaken:Mr.Ecretmoved thatthe second readingof the ordinance be adopted,seconded by Mr.Avila,
and passed unanimously.
/D&V ORDINANCE -AMEND 18.81 -AMENDMENTS AND ZONE CHANGES -1st READING
An ordinance was presented which brings Chapter 18.81,Amendments and Zone Changes,into compliance
with state law and the current operations of the Community Development Department.
The ordinance amending Chapter 18.81 of the Moses Lake Municipal Code entitled "Amendments and Zone (~*\
Changes"was read by title only.
Gilbert Alvarado,Community Development Director,stated that the proposed changes will bring the
regulations into compliance with state law.
Action Taken:Dr.Curnel moved that the first reading of the ordinance be adopted,seconded by Mr. Avila,
and passed unanimously.
Il6(f RESOLUTION -LEASE/PURCHASE
A resolution was presented which provides for the reimbursement of capital expenditures from the proceeds
ofthe lease/purchase agreement.
The resolution of the City Council of the City of Moses Lake declaring its intention to reimburse itself from the
proceeds of one or more tax-exempt financings for certain expenditures made and/or to be made in
connection with the acquisition,construction and equipping of certain capital improvements was read by title
only.
Action Taken:Mr. Avila moved that the resolution be adopted,seconded by Mr.Voth,and passed
unanimously.
lOyif RESOLUTION -ACCEPT DONATION -LIONESS
A resolution was presented which accepts a $1,500 donation from the Lioness Club of Moses Lake.The
funds will be used to purchase a playhouse for Yonezawa Park.
The resolution accepting a cash donation of $1,500 from the Lioness Club of Moses Lake was read by title ()
only.
