The meeting was called to order at 7 p.m. by Mayor Lane.
PLEDGE OF ALLEGIANCE:Mr.Deane led the Council in the pledge of allegiance.
PRESENTATIONS AND AWARDS -None
CONSENT AGENDA
Minutes:The minutes of the February 9,2010 meeting were presented for approval.
Approval of Claims.Prepaid Claims.Checks,and Payroll:Vouchers audited and certified by the
Finance Director as required by RCW 42.24.080,and those expense reimbursement claims,
certified as required by RCW 42.24.090,have been recorded on a listing which has been made
availableto the Council forapproval and is retained forpublic inspection at cityhall.Asof February
23, 2010 the Council does approve for payment claims in the amount of $225,736.18;prepaid
claims inthe amounts of $13,147.17 and $104,713.38;claim checks inthe amountof $684,936.77;
and payroll inthe amount of $34,579.60.
Resolution -Accept Easement -Desertview Utility:A resolution was presented which accepts //fa &
water and sewer mains constructed as part ofthe Desertview Utilities.
Resolutions -AcceptEasements:Resolutions were presented which accept easements from REC
Solar Grade Silicon, LLC and the Clara M.Davisson Trust for municipal purposes and uses on
Road N.
Action Taken:Mr.Pearce moved that the Consent Agenda be approved,seconded by Mr.Ecret,
and passed unanimously.

CONSIDERATION OF BIDS AND QUOTES
ROAD N RECONSTRUCTION PROJECT
The City received 10 bids for the 2010 Road N Reconstruction Project.This project includes
reconstructing approximately 3,850'of Road N from Wheeler Road to the north side of the
Guardian Fiberglass plant entrance.The City has obtained a $796,000 Transportation
Improvement Board grantto pay80% of the total project.
Action Taken:Mr.Reese moved that the bid be awarded to Central Washington Asphalt in the
amount of $651,742,seconded by Dr.Curnel, and passed unanimously.

//29 DANO PARK HYDROSEEDING
The City received one quote for the Dano Park Hydroseeding project.This project includes
hydroseeding approximately 21,000 square feet.
ActionTaken:Mrs.Liebrecht moved that the projectbe awarded to Tatum LawnCare,seconded
by Mr.Pearce,and passed unanimously.
PETITIONS.COMMUNICATIONS.OR PUBLIC HEARINGS
flOi?GRANT COUNTY MOSQUITO CONTROL
Daniel Couture,Manager ofthe Grant County Mosquito Control District #1,explained thattheyare
applying for a National Pollutant Discharge Elimination System Permit which allows themtospray
for mosquitoes. This permit will deal mainly with the spraying of mosquito larvae.
Annie Moser,Grant County Mosquito Council District #1,explained the life cycleof the mosquito
and pointed outthat it is during the larval stagethattheyaremost vulnerable tothe spray.There
are nuisance and vector mosquito. The nuisance mosquito is usually non-disease carrying
because they prefer humansas prey.Thevectormosquitoesaretheones thatcarry the diseases,
which they mainly get from infected birds.
Mr.Couture stated that the Departmentof Ecologyis proposing new regulations to limit spraying
in orderto reduce contamination of ground water.The new regulations,ifthey are enacted,will
notaffectthe spraying of the larval stage but will prohibit spraying for adult mosquitoes unless a
disease isdetected. The new regulations from the Departmentof Ecology will applyto any water
source,including such things as residential bird baths, that has the potential to seep into the
ground waters ofthestate.He pointed outthatthe inability tosprayfor adult mosquitoeswill affect
the City of Moses Lake since there is no way to completely eliminate mosquitoes at the larval
stage.He requestedthatthe Council provide commentstothe Department of Ecology abouttheir
concerns if the proposed new regulations are adopted.
There was some discussion by the Council.
Action Taken:Mr.Deane moved that the City Manager be authorized to contact the state
legislators concerning the issue,seconded by Mr.Reese,and passed unanimously.
USE OF CITY PROPERTY -FARMER'S MARKET
The Moses Lake Farmer's Market requested permission to use McCosh Park on Saturdays
beginning the first weekend inMaythrough the last weekend of October for the Farmer's Market.
They also requested the closure of the 300 block of Ash Street on Wednesdays from 1 p.m. to 7
p.m.for the Farmer's Market.
Mark Rowley, representing the Moses Lake Farmer's Market,stated that they had a very
successful year at McCosh Park last year and they would like to use it again in 2010. He
mentioned that they are requesting the closure of Ash Street an hour laterthan last year so that
lunch traffic could still use Ash Street.Only half of the 300 block of Ash Street would be closed
from Third Avenue to the entrance to Sinkiuse Square.

k )There was some discussion by the Council on the effect of the closure of the street on the adjacent
businesses andthe possibility of placing the vendors within the Sinkiuse Square parking area.
ActionTaken:Mr.Pearce moved that the request to use McCosh Parkand the use of Sinkiuse
Square onWednesdaywithout closing Ash Street be granted,seconded by Mrs.Liebrecht.
There was additional discussion by the Council.
ActionTaken:Mr.Deane moved thatthe issue be tabled,seconded by Dr.Curnel,and failed with
Mr.Deane,Dr.Curnel,and Mr.Lane in favor and Mr.Reese,Mr.Pearce,Mr.Ecret,and Mrs.
Liebrecht opposed.
The motion passed with Mr.Deane opposed.
PHOTO ENHANCED TICKETS
David Ames,1233 Mather Drive,statedthathewas issued a traffic citation for running a red light.
He felt thatthe length of time the yellow light isonistoo short and the fine for running the red light
is too high.He requested the Council consider extending the length oftime the yellow light ison
and reducingthe fine from $112 to $40.

Dean Mitchell,Police Chief,explainedthe processtaken bythe City prior to installation ofthe red
light cameras.That process included a public awareness campaign,emphasis patrols,signs
installed at intersectionswhere red light cameras were placed, and a 30 to 60 day grace period
after the cameras were activated before citations were issued.He pointed out that a citation is
issued onlyifthe carenters the intersection afterthe light has turnedred. He pointed outthatthe
number of people running the red lights has decreased significantly since the cameras were
installed.
Gary Harer,Municipal Services Director,provided information on the lengthof time of the yellow
lightand explained how the duration of the yellow lightis determined.
There was some discussion by Council but no action was taken.
COULEE CORRIDOR
Corinne Isaak,Byway Coordinator for the Coulee Corridor Consortium,submitted information on
the attractions along the 150 mile Coulee Corridor Byway that runs from Othello to Omak along
Highway 17 and Highway 155.She outlined their projects,past and future,and pointed out that
scenic byways are a tourist attraction.She requested funds from the city for their advertising
campaign.
There was some discussion by the Council and itwas suggested that the request be presented to
the Tourism Commission for a recommendation to the Council.

ORDINANCES AND RESOLUTIONS
//7(>ORDINANCE -AMEND 3.62 -UTILITY SYSTEM DEVELOPMENT CHARGES -2nd READING
An ordinance was presented which increases the system development charges.
The ordinance amending Chapter 3.62 of the Moses Lake Municipal Code entitled "Utility System
Development Charges"was read by title only.
Action Taken:Mr.Reese moved that the second reading of the ordinance be adopted,seconded
by Dr.Curnel,and passed unanimously.
REQUEST TO CALL FOR BIDS
)/(0(0 2010 SEWER LINING PROJECT
Staff requested authorization to callforbids forthe 2010 sewer lining project. This project consists
of lining approximately 24,150 linearfeet of 10",12",15",18",and 21"concrete sewer pipe inthe
Wheeler Road,downtown,and Larson areas.
Action Taken:Mr.Reese moved that staff be authorized to call for bids,seconded by Mr.Pearce,
and passed unanimously.

Staff requested authorization to call for bids for a new camera that will be used bythe Wastewater
Division to TV the sewer mains.The new camera will provide digital quality pictures and provide
better views into the side services.
Action Taken:Mr.Pearce moved that staff be authorized to call for bids,seconded by Mr.Deane,
and passed unanimously.
REFERRALS FROM COMMISSIONS
/£30 NEPPEL PARK -WAKE BOARD EVENT
INT AmateurTourand Sunshine Marketing,Inc.requested permission to use Neppel Park for a
wade board competition on July 16, 17, and 18.The Parks and Recreation Commission
recommended that the request be granted with certain stipulations including that INT secure all
necessary permits,insurance,and hold harmless agreements and approval from the various
agencies involved in such an activity.The Commission also expressed concern about whether or
not the lake wasdeep enough in this area for a wakeboard competition and the needto obtain
permission from the Moses Lake Irrigation District and Rehabilitation District for useoftheir dock.
Spencer Grigg,Parks and Recreation Director,explained the concerns over the depth ofthe lake
near Neppel Park.

\_J Action Taken:Mr.Deane moved that the request be granted,seconded by Mr.Reese,and passed
with Mr.Ecret opposed as he was concerned about possible inadequate parking inthe area for
such an event and the liability of people near the railroad tracks and on the bridge.
PARKS AND RECREATION COMPREHENSIVE PLAN
The 2010 Moses Lake Paks and Recreation Comprehensive Plan was presented.The Parks and
Recreation Commission recommended that the Comprehensive Plan be adopted.
Spencer Grigg,Parks and Recreation Director,statedthatthereisa greatdeal of information in
this Plan and has taken about 18 months to prepare.
There was some discussion by the Council.
Action Taken:Mr.Deane moved that the Parks and Recreation Comprehensive Plan be adopted,
seconded by Dr.Curnel, and passed unanimously.
OTHER ITEMS FOR COUNCIL CONSIDERATION
MOSES LAKE ELEMENTARY SCHOOL #2 -STREET DEVIATIONS
Brent Harding,NAC Architecture, representing the Moses Lake School District,requested
deviations to the required street improvement standards for the Moses Lake Elementary School
#2 project located on Paxson Drive.The request is to waive the requirement to construct the
^_^sidewalk on the west side of Paxson Drive,to construct the sidewalk on the east side of Paxson
Drive next to the curb, and to defer the construction of the permanent cul-de-sac for the south end
of Paxson Drive.
Action Taken:Mr.Pearce moved that the requested deviations be granted with the stipulation that
a covenant be required for the construction of the cul-de-sac within five years,seconded by Dr.
Curnel,and passed unanimously.
REQUEST FOR CITY UTILITIES -CHINOOK PROJECT
Representatives from"ProjectChinook"have requested permission to connect to the City'swater
and sewer facilities to serve their development located near the City's firing range on Randolph
Road.The project's water requirement is 20,000 gallons of water per day at startup and 150,000
gallonsperdayinthe future.The wastewater requirementis 16,000 gallons perdayatstartupand
130,000 gallons per day inthe future. Most of the wastewater will be discharged to the Port's
wastewater facility.The City's water and sewer facilities have adequate capacity to serve this
development.
Action Taken:Mr.Ecret moved that the request be granted with the stipulation that an Extra
Territorial Utility Agreement be required,seconded by Mr.Reese,and passed unanimously.
Joseph K.Gavinski,City Manager,stated thatthe "Project Chinook"wishes toconnect itsdomestic
wastewater to the force main in Randolph Road.The force main is owned by Takata.In order for
"ProjectChinook"to hook to the forcemain,they wouldhave to get permission from Takata orthe

for about 5,500'of the force main that runs from the middle of the "Project Chinook"property to the
entrance to the gravity sewer main.There is also the possibilitythat the Cityand the Port of Moses
Lake could make a joint application for funds from the County's Strategic Infrastructure Program
(SIP)to cover the cost.
There was some discussion concerning the implications of purchasing only a portion of the force
main.
Action Taken:Mr.Deane moved that the City offer to purchase the 5,500'of force main from
Takata for no more than $75,000,seconded by Mr.Reese,and passed unanimously.
Action Taken:Mr.Reese moved that staff be authorized to apply for an SIP grant to purchase the
force main,seconded by Mr.Pearce,and passed unanimously.

MOBERG -REMOVAL OF TREES
Gilbert Alvarado, Community Development Director, reported that Basin Tree Service was hired
to clean up the area south of Riveria Street. Heshowed pictures of the area before and after the
clean up.
The regular meeting was recessed at 9:40 p.m.and the Council met in an executive session to
discuss the sale of property where public knowledge of the sale may affect the price. The
executive session was adjourned at 10:15 p.m. and the regular meeting was reconvened. The
