3010 Maple Landing Annex CORRECTEDORDINANCE 3010 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ANNEXING PARCELS 170478005, 170478003, AND 170415000 TO THE CITY OF MOSES LAKE, WASHINGTON, ASSIGNING RESIDENTIAL R-2 ZONING CLASSIFICIATION, PROVIDING FOR THE ASSUMPTION OF EXISTING CITY INDEBTEDNESS AND FIXING A TIME WHEN THE SAME SHALL BE EFFECTIVE. Recitals: 1. On May 19, 2022, the City of Moses Lake, Washington received a notice of intention to commence annexation proceedings pursuant to the “direct petition” method of RCW 35A.14.120 for parcel 10876; as more fully described in Section 1 of this Ordinance and depicted in Exhibit A, attached hereto. 2. On May 24, 2022, the City Council of the City of Moses Lake, Washington held a public meeting with the annexation initiator pursuant to RCW 35A.14.120 and determined to increase the boundaries of the annexation area and that the City staff could proceed to acquire a 60% petition for annexation pursuant to RCW 35A.14.120. 3. At the same May 24, 2022, meeting, City Council set the annexation area and further determined that the property subject to annexation would be zoned Residential 2, and assume the annexation area’s share of City indebtedness. 4. The owners of not less than 60% in value, according to the assessed valuation for general taxation of the property hereinafter described, signed the petition pursuant to RCW 35A.14.120 for the annexation of said area to the City of Moses Lake, Washington. 5. The City provided public notice of the petition for annexation and has provided an opportunity for comment thereon by all interested citizens at a duly called and noticed public hearing. 6. On July 14, 2022, pursuant to proper notice given in accordance with RCW 35A.14.130, the Planning Commission conducted a public hearing on the proposed annexation, and following such hearing recommended City Council approve the annexation request with a modified boundary that included three parcels as depicted in Exhibit A. 7. On July 26, 2022, pursuant to proper notice given in accordance with RCW 35A.l4.130, the City Council received and reviewed all of the documentation associated with this annexation proposal, conducted a public hearing on the proposed annexation in accordance with RCW 35A. 14.140 and RCW 35A.l4.330-.340, and following such hearing determined to effect the annexation of the territory described in Section 1 of this ordinance, finding that the petition for annexation met the applicable requirements, and that the best interests of the City of Moses Lake, Washington, will be served by the annexation and that it is appropriate to good government of the City of Moses Lake, Washington, and therefore accepted the petition for annexation pursuant to RCW 35A.l4.120 and Chapter 20.03.060 of the Moses Lake Municipal Code. 8. The territory described in Section 1 of this ordinance is contiguous to the City of Moses Lake, Washington and entirely within the City of Moses Lake Urban Growth Area established pursuant to RCW 36.70A.110. THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS:       Section 1. Annexation. The following area is hereby annexed to and made a part of the City of Moses Lake, Washington, to wit: That portion of the NW 1/4 of Section 10, Township 19 North, Range 28 East, W.M., Grant County Washington, more particularly described as follows: Commencing at the Northwest corner of said Section 10; Thence S00°37’06”W along the West line of the Northwest quarter of said Section 10, a distance of 1242.71 feet to the northwest corner of a parcel of land described as Parcel 1 in a Statutory Warranty Deed, Auditor’s File Number (AFN) 1329660, records of said Grant County, being the Point of Beginning; thence along the north, east and south boundaries of said Parcel 1 the following three (3) courses: •S89°24’56”E, 1294.30 feet to the west right-of-way line of Grape Drive; •Thence S00°34’23”W along the west line of said right-of-way, 95.00 feet; •Thence N89°26’00”W, 485.00 feet to the northeast corner of a parcel of land described in Statutory Warranty Deed, AFN 1470299, records of said Grant County; Thence along the east, south and west boundaries of said parcel, the following three (3) courses; •S00°33’13”W, 445.00 feet; •Thence N89°27’17”W, 502.10 feet; •Thence N07°47’00”E, 348.07 feet to the southeast corner of a parcel of land described in Quit Claim Deed, AFN 1341970, records of said Grant County; Thence N89°27’17”W along the south boundary of said parcel, 351.16 feet to the west boundary of said section 10; Thence N00°37’06”E along the west line of said Section 10, a distance of 195.00 feet to the Point of Beginning. Section 2. Assessment and Taxation. All property within the territory so annexed shall be assessed and taxed at the same rate and on the same basis as other property of the City of Moses Lake, Washington is assessed and taxed to pay for any outstanding indebtedness of the City of Moses Lake, Washington as presently adopted or as is hereafter amended. Section 3. Comprehensive Plan Designation. All property within the territory so annexed shall be subject to and a part of the Comprehensive Plan of the City of Moses Lake, Washington as presently adopted or as is hereinafter amended. Section 4. Land Use Designation and Zoning. All property within the territory so annexed shall be hereby zoned as follows: Grant County Assessor Parcel Numbers 170478005, 170478003, 170415000 shall be zoned Residential 2 (R-2). Section 5. Transmittal and Filing. The Moses Lake City Clerk is directed to file a certified copy of this ordinance with the Grant County Board of County Commissioners. Section 6. Severability. If any portion of this ordinance is declared invalid of unconstitutional by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portion(s) of this ordinance Adopted by the City Council of the City of Moses Lake, WA and originally signed by its Mayor on July 26, 2022.
