AN ORDINANCE AMENDING CHAPTER 13.04 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "SEWER REGULATIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 13.04 of the Moses Lake Municipal Code entitled "Sewer Regulations" is amended as
follows:
13.04.145 Discharge to Sewer System Without Physical Connection to Sewer System: Regular or
intermittent discharge of wastewater to the POTW by anyone not physically connected to the
POTW may be permitted. Authority to so discharge may only be granted by the Moses Lake City
Council when the City Council determines that the discharge shall not have any deleterious or
damaging effects on the health and welfare of the City's residents and that the discharge will be
in the City's best interests.
A. Permission to discharge wastewater to the City's sewer system shall be upon such terms and
conditions deemed appropriate by the City Council as follows: The permit shall contain, at
a minimum, provisions that:
1.Require the payment of the rate as set by the City Council.
2.Set limitations on the quantity and quality of the wastewater.
3.State that the permit is terminable by the City Council at will within thirty (30) days of
written notice by the City to the discharger.
4.Provide where and how the wastewater is to be discharged to the POTW.
5.Require periodic testing of the wastewater according to the standards established by the
City.
B. The permission to discharge wastewater to the POTW shall include the requirement to
execute an extraterritorial utility extension agreement upon forms prepared by the City if the
wastewater is generated from a site outside the corporate limits of the City unless the City
Council enters into the record a finding that the wastewater discharger is incapable of
executing such an agreement as distinguished from the wastewater discharger's reluctance
to execute the agreement. The City Council may issue a waiver, if such a waiver is in the
best interests of the citizens of the City of Moses Lake.
13.04.170 Application for Permit - Fee :
A. Permit: The owner or the owner's agent shall make application for sewer service. The
permit application shall be supplemented by any plans, specifications, or other information
required by the Municipal Services Director.
B Fees: The following fees may be required for the connection and use of the City's sanitary
sewer:
1. At the time an application for sewer service is filed with the City, the applicant shall pay
a permit fee as set forth in the applicable State Plumbing Code for building sewers.
411 2. An applicant for a Wastewater Discharge Permit shall pay at the time of application for
the permit the cost of investigating and processing the permit per Chapter 3.54.
Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication
of its summary as provided by law.

4.Wastewater Discharge Permit annual fees per Chapter 3.54.
5.Permit fees to work in the right-of-way, or on proposed or existing municipal
improvements, in accordance with Chapter 12.16.
6.Sewer System Development Fees per Chapter 3.62.020.
13.04.200 New Buildings: Old building sewers may be used in connection with new buildings only when
they meet all requirements of this chapter and the State Building Code, as verified by the Building
Official.
