i\J AN ORDINANCE AMENDING CHAPTER 10.12 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "PARKING REGULATIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS:
Section 1.Chapter 10.12 of the Moses Lake Municipal Code entitled"Parking Regulations"is amended as
follows:
10.12.020 ParkingProhibitedDuring Special Events: Noperson shallparkavehicle between hours specified
and on the days specified on such signs erected for special events upon any street where signs
areerected. Anyvehicle parkedinviolation ofthe posted parking prohibition shallbe towed atthe
owner's expense.
10.12.025 ParkingProhibited-Garbage CollectionCarts orContainers: Parkingis prohibitedwithinfive feet
(5')ofagarbage collection cartorcontainer,as defined inMoses Lake Municipal Code 8.08.030i
on the day of collection.
10.12.030 Parking Signs Required:Whenever bythis chapter oranyother ordinanceor resolution,ororder
of the City Engineer any parking time limit is imposed or parking is prohibited on designated
streets,appropriate signs shallbe erected giving noticethereof, and no such regulations shallbe
effective unless said signs areerected and inplaceatthe time of anyallegedoffense;exceptthe
restrictions and prohibitions of Moses Lake Municipal Code 10.12.050,10.12.060,and any state
law shall not require any posting unless the Moses Lake Municipal Code or state law require
posting.

10.12.032 Angle Parking:Angle parking shallnot be permitted on any City street or portion thereof except
as authorized by the Moses Lake City Council.

10.12.040 Parking Time Limited and Regulated:No vehicles as defined in Moses Lake Municipal Code
8.52.0201 shallbe habitually parked orstored continuously inany one block upon any publicstreet
or highway inthe Cityof Moses Lake at any time fora periodlongerthan two hundred forty (240)
hours,regardless of any other regulations then ineffect.When any vehicle is parked orstored for
a period exceeding two hundred forty(240) hours, the vehicle is deemed to constitute a hazard
or obstruction to traffic or is deemed an abandoned vehicle and may be impounded as provided
for in Moses Lake Municipal Code 8.54.
10.12.050 Parking Non-Passenger Vehicles in Residential Zones:No street right-of-way in any residential
zone ofthe Cityof Moses Lake,orwhichisthe boundaryofany residential zone, shallbe used for
the parkingor storage of any farmvehicle,for-hire vehicle, limousine, motor home, motor truck,
<;privatecarrierbus, roadtractor,semi trailer,park trailer,travel trailer,tractor,truck tractor,boat,
>—•orany other commercial vehicle except forthe purpose of making deliveries. This section does
not prohibit on-street parking of a passenger vehicle, motorcycle,or motor-driven cycle.
10.12.060 Parking on Undeveloped Right-of-Wav:No undeveloped right-of-way shall be used at any time
for the parking orstorageof anyvehicles as defined in Moses Lake Municipal Code 8.52.020(1)
oranylawn mower,tractor,orgarden orlawn care equipmentoranyconstruction orcontractor's
equipment.
10.12.070 Accessible and Fire Lane Parking -Violations and Penalties:
A.It isunlawful for any person to park a motor vehicle in a parking space for use by persons who
qualify for special parking privileges as indicated by signage in compliance with RCW
46.61.581,orby signage displaying the international symbol ofaccess described under RCW
70.92.120 uponthe parking surfaceoruponasignbetween thirty-six inches(36")andeighty-
four inches (84")offthe ground unlesssuch person shall display,as provided bythe laws of
theStateofWashington,aspecial card,decal,orlicense plate issued under RCW46.16.381.
B.It is unlawful for any person to park a motor vehicle in any area marked as a fire lane bythe
Fire Chief,so designated bya red curb orsignagebetweenthirty-six inches(36")and eighty-
four inches (84")above ground,exceptfor Fire Department,Police Department,orMunicipal
Services vehicles inthe performance of officialduties.
C.Any person violating subsection A above shall be deemed to have committed a parking
infraction that ispunishable byanon-suspendable,non-deferrable penalty oftwo hundred fifty
dollars ($250).

D. Any person violating subsection B above shall be deemed to have committed a parking
infraction that is punishable by a non-suspendable,non-deferrable penalty of one hundred
seventy-five dollars ($175).
10.12.080 Penalties for Parking Violations -Generally:All infractions issued for parking violations shall
be subject to a penalty of two hundred fiftydollars ($250)unless another penalty is specifically
provided herein.
10.12.090 Specific Penalties for Parking Violations:All violations of sections .020 through .035 of this
Chapter shall be subject to a penalty of thirty-five dollars ($35);violations of sections .040
through .050 shall be subject to a penalty of one hundred fifty dollars ($150);furthermore,if
the defendant fails to respond to the notice of infraction issued for the violation, an additional
penalty ofthirtydollars ($30) shall be imposed bythe MunicipalCourt forthe failure to respond.
Such penalty shall not be suspended or excused by the Court.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of
its summary as provided by law.
