2690ORDINANCE NO.2690 AN ORDINANCE AMENDING CHAPTER 10.12 OF THE MOSES LAKE MUNICIPAL CODE ENTITLED "PARKING REGULATIONS"' THE CITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS: Section 1.Chapter 10.12ofthe Moses Lake Municipal Code entitled "Parking Regulations"isamended as follows: 10.12.070 Accessible and Fire Lane Parking Violations and Penalties: A.It is unlawful for any personto park amotorvehicleina parking space for use bypersonswho qualify for special parking privileges as indicated by signage in compliance with RCW 46.61.581,orbysignagedisplaying the international symbolofaccess described underRCW 70.92.120 uponthe parking surfaceorupona signbetween thirty-six inches (36")andeighty- four inches (84")offthe ground unless such personshall display,as provided by the!lawsof the State ofWashington, aspecialcard,decal,orlicense plate issued underRCW 46.-16.381. B.It is unlawful for any person to parka motorvehicleinany areamarkedas a fire lane bythe Fire Chief, so designated by a redcurborsignage between thirty-six inches (36")and;eighty- fourinches (84")above ground,except forFire Department, PoliceDepartment,or Municipal Services vehicles in the performance of official duties. C. No person shall stop, park, or leave standing any vehicle within fifteen feet (15') of a fire hydrant, to include private parking lots except as follows: i 1.Ifthe vehicle is attended by a licensed driverwho is seated inthe frontseat and who can immediately move such vehicle in case of necessity. i 2. Ifthe vehicle is owned or operated by a fire department and is clearlymarked as a fire department vehicle. D.Any person violating subsection A above shall be deemed to have committed a parking infraction that is punishable bya non-suspendable,non-deferrable penaltyoftwo hundred fifty dollars ($250). E. Any person violating subsection B above shall be deemed to have committed a parking infraction that is punishable by a non-suspendable,non-deferrable penalty of one hundred seventy-five dollars ($175). Section 2. This ordinance shall take effect and be in force five (5)days after its passage and publicationof its summary as provided by law.
