AN ORDINANCE REPEALING THE EXISTING SHORELINE MANAGEMENT
MASTER PLAN AND ADOPTING A NEW SHORELINE MASTER PROGRAM
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS:
Recitals:
1.Chapter 90.58.080(2)(a)(v)RCW establishes that on or before December 1,2013,the
Cityof Moses Lake must develop oramend its shoreline master programin accordance
with the provisions of the Shoreline Management Act.
2. Chapter 90.58.080(8)RCW allows for one additional year from the requirement of
90.58.080(2)(a)(v)for local government completion of the SMP update.
3.The current Shoreline Master Programwas originally approved bythe Washington State
Department of Ecology in 1975 and has not been substantively revised since that date.
4.The current Shoreline Master Program does not reflect existing conditions and does not
effectively implement the requirements of Chapter 90.58 RCW norTitle 173-26 WAC.
5. The Cityof Moses Lake held an open house on October 3,2013 and January29, 2014
to discuss the draft Shoreline Master Program.
6. The City ofMosesLake Planning Commission conductedanopen record public hearing
on February 27,2014 to accept public testimony and considerthe proposed Shoreline
Master Program.
7. On March 27,2014, the City of Moses Lake Planning Commission recommended that
the CityCouncil adopt the proposed Shoreline Master Program.
8. The City of Moses Lake issued a Determination of Non-Significance on April 28, 2014.
9. The City Council of the City of Moses Lake opened a 60-day public comment period
through June30,2014and held a public hearing on May 13,2014which was continued
to May 27,June 10, and June 24,2014.
10.The City Council ofthe City of Moses Lakeacceptedthe recommendations ofthe City
of Moses Lake Planning Commission at its August 12 meeting.
11.The City Council ofthe City of Moses Lake acceptedthe recommendations ofthe City
of Moses Lake Planning Commission, approved a Response to Comments, and
approvedthe draft Shoreline Master Program at itsAugust 26, 2014 meeting.
Section 1.The CityCouncil ofthe Cityof Moses Lake repealsthe existing Shoreline Management
MasterPlan adopted in1975 andadoptsthe updated ShorelineMasterProgram.The repealdoes
not take effect until the updated Shoreline Master Program takes effect.

Section 2.This City of Moses Lake's Shoreline Master Program shall take effect and be in force
on the date of the adoption of the Program by the Washington State Department of Ecology.
Section 3.This ordinance shall take effect and be in force five (5)days after its passage and
publication of its summary as provided by law.
Adopted by the City Council and signed by its Mayor on October 14,2014.
