AN ORDINANCE CREATING CHAPTER 2.39 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "LODGING TAX ADVISORYCOMMITTEE"ANDREPLACING AND
REPEALING RESOLUTION 2065
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS:
Section 1.Chapter 2.39ofthe Moses Lake Municipal Code entitled "Lodging Tax Advisory Committee"is
created as follows:
2.39.010 Board Created-Eliqibilitv:There iscreated a Lodging Tax AdvisoryCommittee, consistingof five
(5)members,who shall be appointed bythe City Council.One (1)membershall be an elected
official of the City who shall serve as chair,two (2)members shall be representatives of
businesses required tocollect the lodging tax,andtwo (2)members shall be persons involved in
activities authorized to be funded by revenue received from the lodgingtax.
2.39.020 Membership-Appointment:Membersshallbe appointed for aone (1)yearterm. The City Council
will review the membershiponan annual basisandmake changes as appropriate.Upon vacancy
bydeath,resignation,orother cause,theMayor,with confirmation bytheCity Council,shall fill the
vacancy by appointing a member tothe unexpired portion ofthe term.
2.39.030 Removal:A membermaybe removed during hisorherterm upon a recommendation from the
Mayor and the affirmative majority vote of the City Council sitting in quorum.If a member is
unexcused from two (2)meetings per year,excuses being permitted for personal orfamily illness
andvacations,causeexists for removal.The memberwishing tobeexcused from ameetingmust
notify the secretary tothe Lodging Tax Advisory Committee prior to the meeting.The absence
shallbe announced and the reasons thereforatthe time roll callistaken atthe meeting and shall
be recorded as excused or unexcused inthe minutes of the meeting, if minutes are taken.
2.39.040 Quorum:A majority oftheCommittee shall constitute aquorum for thetransaction of business.
Any action taken by the majority of those present at any regular or special meeting of the
Committee is deemed and taken as the action of the Committee.
2.39.050 Meetings:The Lodging TaxAdvisory Committee shall devote such time as may be necessary to
properly discharge all duties devolving upon them.The Commission members shall serve without
compensation.The Committee shall meet asoften asis necessary to conduct business but shall
hold a meeting at least once a year.
2.39.060 Duties of Council toCommittee:The Committee is entrusted with the responsibilities of advising
and making recommendations concerning the collection and useoflodging taxes.The City shall
submit any proposal that will impose a tax under Chapter 67.28,RCW.The City Council shall
submit tothe Lodging Tax Advisory Committee,for its review and comment,proposals on:
A. The imposition of a tax under SSB 5867.
B. Any increase inthe rate of such a tax.
C. Repeal of an exemption from such a tax.
D.A change inthe use ofthe revenue received from such a tax.
2.39.070 Duties of Committee:The Committee shall provide a report and analysis tothe City Council on
the extent to which any proposal will accommodate activities for tourists or increase tourism,and
the extent towhich any proposal will affect the long-range stability ofthe special fund created for
the lodging tax revenues.

Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of
its summary as provided by law.
Adopted by the City Council and signed by its Mayor on May 10, 2016.
