AN ORDINANCE AMENDING MOSES LAKE MUNICIPAL
CODE SECTION 5.04.040 TITLED "APPLICATION FOR
NEW BUSINESS”
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS
FOLLOWS:
Section 1. Section 5.04.040 of the MLMC titled "Application for New Business" is amended as follows:
5.04.040 Application for New Business:
Application for a business license as required by this chapter is made through the Business Licensing
Service (BLS). The application must include all information required for all licenses requested and total
fees due for all licenses, as well as the handling fee required by RCW 19.02.075. BLS will provide the
application information to the Finance Director. If the licensee is a new business, prior to the issuance of
the business license, the Finance Director shall submit the application therefor to the Fire Chief and the
Building Inspector of the City for approval of the location where the licensee is to carry on the business,
trade or profession, and the business license shall be approved for issuance only if the location is in
compliance with building and fire codes of the City as those codes relate to existing and/or new structures.
Applications for a business license as required by this chapter will remain in a “pending status” for a period
of 60 days from the date of receipt by the City. Within the 60-day period, the applicant has the
responsibility to provide all required information and documentation requested or required by the City for
the purpose of activating said license. Upon expiration of the 60 days, the application shall be deemed
abandoned and shall be withdrawn from processing; provided, however, that the Business License
Technician shall have the discretion whether to permit an extension of the 60 days, not to exceed 30 days,
in order to permit a late processing. Any application not processed within the original 60 days or extension
thereof shall be required to be processed as a new application.
Section 2. Severability. If any section of this ordinance is found to be unconstitutional or invalid as written
or as applied to any particular person or circumstances, no other section of the ordinance shall be deemed
to be invalid, but rather, should be deemed to have been enacted independently and without regard to the
section affected.
Section 3 . This ordinance shall take effect and be in force five (5) days after its passage and publication of
its summary a as provided by law.
