AN ORDINANCE GRANTING NORTHLAND CABLE
TELEVISION, INC. A CABLE TELEVISION FRANCHISE
RENEWAL
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. Renewal.
1.1 Background. On December 11, 2011, effective April 1, 2012, the City, by
Ordinance No. 2636, granted to Northland Cable Television, Inc., DBA Northland
Cable Television (“Northland”), a franchise to construct, operate, maintain, repair,
replace, upgrade and rebuild a cable system for the provision of cable television,
video programming and other programming and related services in the City (the
“Franchise”). By letter, dated July 16, 2021, the City was timely notified of
Northland's intent to exercise the five (5) year automatic renewal through March
31, 2027. Northland completed the required upgrades pursuant to Section 10 of
the Franchise and the City waives the requirement that the upgrade be completed
on or before the seventh (7) year of the current ten (10) year term. Northland is
currently doing business under two registered trade names, Vyve and Vyve
Broadband.
1.2 Automatic Extension of the Franchise Term. The term of the Franchise is
hereby automatically extended for a period of five (5) years, commencing April 1,
2022, and expiring March 31, 2027.
1.3 Amendments. Section 18.2, “Notices”, of the Franchise is updated and
amended to reflect changes to Grantee’s designated legal address as follows:

1.4 Estoppel. No event of default under the Franchise, and no event which
could become an event of default with the passage of time or the giving of notice,
or both, has occurred and is continuing as of the date hereof.
1.5 Effect of this Ordinance. Except as specifically set forth in this ordinance
and each of the documents referenced in Section 1.1 of this ordinance, the
Franchise shall remain in full force and effect in accordance with its terms.

Section 2. Effective date. This ordinance shall be in full force and effect five days after its
passage and publication of its summary as provided by law.
Adopted by the City Council of the City of Moses Lake, WA and signed by its Mayor on October 12,
2021.
