AN ORDINANCE PROVIDING FOR THE CONDEMNATION
OF AN AIR SPACE EASEMENT FOR AIRPORT PURPOSES
FOR THE CITY OF MOSES LAKE,WASHINGTON,AND
PROVIDING FOR THE CONDEMNATION,APPROPRIATION,
TAKING AND DAMAGING OF AIR SPACE OVER LAND
NECESSARY THEREFOR,PROVIDING FOR THE PAYMENT
THEREOF,AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOSES LAKE
AS FOLLOWS:
Section 1.That public necessity and convenience require,and
it is necessary in order to provide unobstructed air space for the landing
and taking off of aircraft utilizing the City of Moses Lake airport to
acquire an air space easement through,over,and across the land hereinafter
described,to insure safe approaches to the landing areas of said airport
and the safe and efficient operation thereof.
Section 2.That in order to provide unobstructed air space for the

and across the real estate described as follows,to-wit:
Beginning at the East Quarter (E¼)corner of Section 13,
Township 19 North,Range 28 EWM;thence North 89°13'14"
West a distance of 420.89 feet to the true point of beginning;
thence South 5°19'59"East a distance of 863.26 feet;thence
North 89°37'20"West a distance of 450.00 feet;thence North
6°05'14"East a distance of 865.26 feet;thence South 89°13'14"
East a distance of 278.01 feet to the true point of beginning,
located within the County of Grant and State of Washington.
Section 3.That the real estate above described is owned by the
United States of America and Hugh I.English,a single man,according to the
tax rolls of the Treasurer and Assessor of Grant County,Washington;said
property cannot be acquired for a reasonable price;that condemnation
proceedings are necessary to acquire same;and the City Council desires
to condemn an air space easement through,over,and across the lands
above described for airport purposes.
Section 4.That compensation would be paid the owners for the above
described real estate out of the general fund of the City of Moses L ake;no
special assessments shall be made upon property specially benefited by the
establishmert of said air space easement.

Section 5.That the City Attorney for the City of Moses Lake is
hereby authorized to proceed with condemnation proceedings in the Superior
Court of the State of Washington for Grant County and to do all things
necessary to acquire and condemn said air space easement in the manner
provided by the laws of the state of Washington.
Section 6 ,An emergency is hereby declared to exist and this
ordinance shall be in full force and effect five days after its passage and
publication as provided by law.
