AN ORDINANCE RELATING TO THE MUNICIPAL WATER
AND SEWER SYSTEM OF THE CITY OF MOSES LAKE,
WASHINGTON,PROVIDING FOR CONNECTION CHARGES
THERETO AND REPEALING ALL OF ORDINANCES 193,213
AND ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH
THE CITY COUNCIL OF THE CITY OF MOSES LAKEDOES ORDAIN AS FOLLOWS:
Section 1.Water Service Connection Charges
(1)All water service connections shall be metered and all
separate buildings shall be separately connected to the city
water system;EXCEPT,that separate buildings which are an
integral part of a single business or industry may be served
by a master meter serving the property.The following charges
shall be made by the City of Moses Lake for making metered
water service connections and said charges shall be paid in
full before the connection is made:
3/4 inch meter with 1 inch service line $125.001inchmeterwith1inchserviceline175.00
1¼inch meter with lŠ inch service line 300.00
2 inch meter with 2 inch service line 350.00
Meters larger than 2 inch will be installed at actual cost.
(2)When a water connection is made to a main which was con-i structed at the expense of the city,an additional $75.00 flat charge
shall be made in advance before the connection is authorized todefrayaportionofthecity's cost for installing said main.
The foregoing charges shall apply only to connections made along
any street where a main exists.In consideration of said charges
the City Water Department shall lay the service pipe from the main
to the meter and shall install a meter and meter box no further
than ten (10)feet from the property line .Responsibility for
installation and maintenance of the service piping beyond the
meter shall be the sole responsibility of the property owner.
Section 2 .Conformance with Building and Zoning Regulations .
The property owner shall not be entitled to water and/or sewerserviceeventhoughtheconnectionchargeshavebeenpaidtotheCityifthepremisesarenotinconformancewithbitildingorzoningregulations.
Section 3.Use of Water.
I No person supplied with water from the City water system shall usewaterfromthesystemforanyotherpurposethanthosestatedintheapplicationandshallnotsupplyinanywayanyotherpersonorfamilieswithwater.
In no case shall any cross connection be allowed between two ormorecityserviceconnectionsorbetweenanycitywatermainorserviceconnectionandpipesupplyingwaterfromanyothersource.

Section 4 .Insufficient Water Supply
The City of Moses Lake reserves the right at any time,without
notice,to shut off the water supply for repairs,extension,non-
payment of rates or for any other reason,and the City shall not
be responsible for any damage such as bursting of boilers
supplied by direct pressure,the breaking of new pipes or fixtures,I any damage to property caused by fire on account of insufficient
water supply or pressure or for any other damage resulting from theshuttingoffofwaterorfromtheinsufficiencyofthesupplyof
water ore pressure.
Section 5 .Maintenance of Private System.
The service pipes,connections and other apparatus within any
private premises must be kept in good repair and protected from
freezing,at the expense of the owner or lessee,who will be
responsible for all damage resulting from leaks and breaks .In
case of neglect to promptly repair any service or fixture,or make
any changes or alterations required in this ordinance,the superintendent
shall have authority,when deemed necessary,to go on the premises
and make or cause to be made,such changes,alterations or repairs,
and charge the same against the premises and the owner thereof.
The repairs of any meter damaged by hot water shall be charged totheowneroftheprogertyforwhichsuchmeterwasinstalled.The
deformation or warping of a metered disc or a register figure disc
of any meter shall be held to be a prima facie evidence of such

wasted by imperfect or learking stops,valves,pipes,closets,
faucets or other fi xtures,or to use water closets without self-
closing valves,or to use the water for purposes other than thosenamedontheapplicationuponwhichratesforwaterarebased,or for
any other purpose than that for which his contract provides.
Section 6 .Sewer Connection Charges .
Where a sewer connection is made to a sewer which was constructed
at the expense of the city,an additional $100.00 flat charge shallbemadeinadvancebeforetheconnectionisauthorized,to defray
a portion of the City's cost for installing said main.This charge
shall be in addition to the inspection charge as set forth in Section 402,
Article lV of Irdinance No.127 .
It is clearly understood that the foregoing charges inno way alters
or repeals any rules and/or regulations heretobefore enacted byOrdinancesregardingthesewersystemoftheCityofMosesLake .
I Section 7 .Street Restoration.
Where it is necessary to remove existing street pavement,curb and
gutter and/or sidewalk to install water and/or sewer service lines,t he property owner shall post a cash bond in the estimated amount ofthecostofrestoringsaidimprovementstotheiroriginalcondition.The water and sewer department will have the necessary repairs made
upon completion of the installation of the service connection,and
deduct the actual cost of said repairs from the cash bond.If thecostofrepairsexceedstheestimatedamountofthecashbond,thepropertyownershallbebilledforthebalance,which shall become alienagainstthepropertycollectableinthesamemannerasunpaidwater
and sewer charges .If the cost of repairs is less than the estimatedcashbondtheexcessshallbereturnedtotheprolertyowner.
Section 8.Conflicting Ordinances.
All ordinances or parts of ordinances in conflict herewith areherebyrepealed.
Section 9.Partial Invalidity,
i The invalidity of any part of this ordinance shall not affect
the validity of any other part of this ordinance which can be
given effect without such invalid part or parts .
Section 10 .Violations .
Any person,firm or corporation who violates any of the provisions
of this ordinance shall,upon conviction thereof,be subject to a
fine of not more than $300.00 or imprisonment not to exceed 90 days
in the City Jail,or both.
Section 11.Effective date.
This Ordinance shall take effect on October 1,1964.
PASSED BY THE CITY COUNCIL of the City of Moses Lake and APPROVED by
its Mayor this 8th day of September,1964.
