527_00001ORDINANCE No.527 AN ORDINANCE REQUIRING THE LICENSING OF DOGS; PROHIBITING DOGS TO RUN AT LARGE OR ALLOWING VICEOUS DOGS TO ENDANGER ANY PERSON;PLACING i ENFORCEMENT IN.THE POLICE DEPARTMENT;PROVIDING FOR IMPOUNDING AND CONFINING OF DOGS:MAKING VIOLATIONS HEREOF.A MISDEMEANOR;AND REPEALING ORDINANCE Nos.120 and 265 SECTION 1.It shall be unlawful for any person or persons to own or harbor any dog over the age of six (6)months within the corporate limits of the City of Moses Lake,unless such person or persons shall first procure a license therefor as hereinafter provided. SECTION 2.The license fee shall be in the sum of Two ($2.00)Dollars per year for male dogs and spayed female dogs,and Three ($3.00)Dollars per year for unspayed female dogs .Upon the payment of such license fee to the City Clerk,it shall be the duty of said City Clerk to issue a license to the party making application therefor.The license shall expire on the first day of January next succeeding the date of the issuance thereof and the time fixed for the issuing of a license shall commence on the first day of January of each year and no license shall be issued to expire at any other time than the above date. The above license fee shall be paid in full for any year or part thereof.The City Clerk shall,together with said license,furnish a suitable tag which shall be worn by the dog for which such license is issued and shall be fastened to such dog in such manner that it can easily be inspected at all times by city authorities. Lost tags will be replaced by the City Clerk upon payment of an additional fee of $.50. SECTION 3.It shall be the duty of City of Moses Lake Police Officers to enforce this ordinance.The Moses Lake Police Department shall keep records of all animals handled by them and shall make reports as required by the City Manager. Ordinance No.527 (Continued) SECTION 4.It shall be the duty of Moses Lake Police Officers to respond to all complaints received by them concerning any dog in the City of Moses Lake running at large,or that any dog has bitten or attacked any person or damaged property.Any dog which has bitten a ny person shall be confined for observation purposes for not less than fourteen (14)days at such place and in such manner as directed by the Chief of Police or any Police Officer of the City of Moses Lake. If such dog is impounded by the Chief of Police or a Police officer of the City of Moses Lake,the owner thereof shall be civilly liable for the impounding and board fees during the fourteen (14)day observation period. SECTION 5.It shall be unlawful for any person,firm or corporation being the owner or custodian of any dog to permit any such dog to run loose or be at large upon any public street,highway,or public place,or upon private property owned by a person or persons other than the owner or custodian of the dog,vi thin the corporate limits of the City of Moses Lake. SECTION 6.All dogs found upon any of the public streets,highways or public places or upon private property owned by a person or persons other than the custodian of the dog,within the corporate limits of the City of Moses Lake, shall be deemed to be running loose or to be at large within the meaning of this ordinance,except such dogs as may be under control by means of a chain or leash or which may be secured within any vehicle. SECTION 7.It shall be unlawful for any person owning or having the care or custody of any vicious dog to maintain or harbor said dog in such a manner as to endanger,or be likely to endanger,the safety or welfare of any person and,in i addition to penalties provided for herein,any Police Officer is authorized to impound said animal. SECTION 8.Any dog found running at large,contrary to the provisions of this ordinance within the corporate limits of the City of Moses Lake,shall be subject to seizure by any police officer or any other City authority designated by the Chief of Police for the purpose of seizing such dogs .Any private persons shall have the right to seize any such dog and to immediately notify the City Police authorities . Ordinance No.527 (Continued) After any such seizure,a written record thereof shall be kept in a record book for that purpose at the City of Moses Lake Police Department,which record shall give a general description of such dog,and such dog so seized shall be held for a period of forty-eight hours from the time of impounding,exclusive of holidays and Sundays,during which time the owner of such dog,upon establishing owner- ship of such dog,may recover the same by procuring a license for such dog if none has been issued and paying the sum of Three ($3.00)Dollars impounding and/ or redemption fee,together with a board fee in the sum of Two ($2.00)Dollars per day or any part thereof,which shall be paid to the keeper of such dog.The owner, by paying such impounding fee and board fee,shall not thereafter be immune from prosecution under this ordinance. If such dog is not claimed within forty-eight hours,exclusive of holidays and Sundays,from the time of impounding,said dog may be put to death,sold at aduction under the irecti 1 e.he Chief ods re iv'edr otherweiseid sposed of as in addition to the cost of boarding said dogs,shall be placed in the Current Expense Fund of the City. SECTION 9.It shall be the duty of the City Clerk to keep a record of the names of all persons to whom such licenses are issued with the number of each license and whether for male of female dog. SECTION 10.Any person violating the provisions of this ordinance,upon conviction thereof,shall be subject to a fine not to exceed Three Hundred ($300.00)Dollars, or by imprisonment not to exceed ninety (90)days or by both such fine and imprison- I ment. SECTION 11.Ordinance Nos.120 and 265 and all other ordinances or parts of ordinances in conflict herewith,are hereby repealed. SECTION L3.This Ordinance will be in effect five (5)days after passage by the City Council of the City of Moses Lake and publication in the local newspaper.
