531_00001ORDINANCE No.531 MEftBED BY CM""^?kß AN ORDINANCE ADOPTING TEE 1964 EDITION OF THE UNIFORM BUILDING CODE AND ITS APPENDIX RELATING TO AND REGULATING THE ERECTION,CONSTRUCTION, ENLARGEMENT,ALTERATION,REPAIR,REMOVAL,DEMOLITION, CONVERSION,OCCUPANCY,EQUIPMENT USE,HEIGHT,AREAiANDMAINTENANCEOFALLSTRUCTURESWITHINTHECITYOF MOSES LAKE,PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR,PROVIDING PENALTIES FOR THE VIOLATION THEREOF,DECLARING AND ESTABLISHING FIRE ZONES,AND REPEALING ORDINANCE No.439 AND ALL ORDINAN-CES OR PARTS OR ORDINANCES IN CONFLICT THEREWITH THE CITY OF MOSES LAKEDO ORDAIN AS FOLLOWS: SECTION 1. That the Uniform Building Code,1964 Edition,together with amendments thereto,adopted this date and copyrighted by the International Conference of Building Officials ,except as herein modified and changed,be and the same is hereby adopted,and each and all rules and regulations printed therein,except as herein modified,shall be in full force and effect in the City of Moses Lake upon this ordinance becoming effective as such,together with all amendments thereto as hereafter amended. SECTION 2. That three copies of the Uniform Building Code,1964 Edition,as amended and herein modified,identical with the copy of such code as amended and modified,shall be filed for use and examination by the public in the office of the City Clerk of the City of Moses Lake prior to the adoption hereof,and said copy of said code as amended shall remain in said office for use and examination by the public at all times subsequent to the adoption of this code,together with all amendments thereto as hereafter amended. Ordinance No.531 (Continued) SECTION 3. That Sections 203 (a),(b),(c),(d)and (e)of the Uniform Building Code be deleted.(ËeeChapter 3.3 Ordinance No.494 of City Code.) SECTION 4. That Section 301 (c)be amended as follows:Plans and Specifications - With each application for a building permit,and when required by the Building Official for enforcement of any provisions of this Code.,two sets of plans and specifications shall be submitted.The Building Official may require plans and specifications to be prepared and de- signed by an architect,civil or structural engineer licensed by the State to practice as such,or the building official may require structural plans and calculations to be designed by a structural engineer,licensed by the State to practice as such. SECTION 5. That Section 303 (a)Table 3-A of the Uniform Building Code be amended to read as follows: TABLE No.3-A BUILDING PERMIT FEES Total Valuation Less than $20.00 No fee $20.00 to and including $100.00 $1.00 More than $100.00 to and including $400.00 $2.00 More than $400.00 to and including $700.00 $4.00 More than $700.00 to and including $1,000.00 $6.00 Each additional $1,000.00 or fraction,to and including $15,000.00 $3.00 Each additional $1,000.00 or fraction,to and including $50,000.00 $1.50 Each additional $1,000.00 or fraction,exceeding $50,000.00 $1.00 Ordinance No.531 (Continued) SECTION 6. That Section 402 of the Uniform Building Code be amended to thæodrouhfalrle ess hLa t enany publi2c0 ) no dpthb r orbeen dedicated or deeded to the public for public use. SECTION 7. That Section 420 of the Uniform Building Code be amended to read as follows:STREET is any thoroughfare or public park not less than twenty feet (202)in width which has been dedicated or deeded to the public for public use. SECTION 8 . That Section 1602 (a)of the Uniform Building Code be amended by addition of an eaadditiponal pa agraph tbuih Exceptio tohraen naesfc>11ows: story in height,nor more than three hundred square feet (300 sq.ft.)in area and located not closer than twenty (20)feet from adjoining property lines shall be permitted for uses connected with car,trailer,and boat sales and for a temporary period not to exceed 120 days,for sale of fruits and vegetables in season.All such structures shall be built to comply with all other requirements of the Code and shall be maintained in a neat manner. SECTION 9. That Section 2305 (e)be amended as follows: Special Purpose Roofs.Roofs to be used for special purposes shall be designed for appropriate loads as approved by the Building Official. Greenhouses,lath houses,patio structure and agricultural buildings shall be designed for a vertical live load of not less than 20 pounds per square foot. Ordinance No.531 (Continued) SECTION 10. That Section 2307 be amended by creating paragraphs (a)and (b)to read as follows: (a)The deflection of any structural member shall not exceed the values set forth in Table 23-c,based upon the factors set forth in Table No.23-E.The deflection criteria representing the most restrictive condition shall apply.Deflection criteria for materials not specified shall be developed in a manner con- sistent with the provisions of this section.See Section 2305 (f) for camber requirements. (b)Curtain walls or non-bearing walls of other than masonzy construction to be designed in accordance with the requirements of Table No,23C.Deflection to be not less than 1/240 of the span either horizontally or vertically. SECTION 11. That Section 3312 (b)be amended by adding,an additional exception: All required exits regardless of occupant load and the way of access thereto shall be identified by readily visible signs in all cases where the exit or way to reach it is not immediately obvious to the occupants . SECTION 12 . That Section 4506 of the Uniform Building Code shall have a fourth paragraph added to read as follows: FIXED METAL AND PLASTIC AWNINGS shall not be permitted i in Fire Zones 1 and 2 unless they be made to comply with the following provisions: Ordinance No.531 (Continued) 1.That no portion of the awning be locateel closer than five feet from the adjoining property line adjacent to an alley . 2 .That plastic materials be of a type listed as Type A self extinguishing defined in Section 5201 (c)and when tested in accordance with Section 5201 (b)and 5202 of the Uniform Building Code . 3 .That structural frame shall be of structural steel to be of such quality as to conform with U.S.C.Standard 27-1-64. Secondary members in contact with,or directly supporting the awning surface,may be formed of light guage steel provided such members are designed in accordance with the specifications of the design of light guage steel and in addition shall be galvanized. 4.That fixed awnings shall be installed on one story buildings only and on other buildings not exceeding thirty (30)feet in height. 5 .That vertical and horizontal clearances shall be the same as for movable awnings . SECTION 13.That Chapter No.70,Section 7001 through 7020 entitled "Excavation and Grading"be deleted from.the Code. SECTION 14. Any person,firm or corporation violating any of the provisions of this ordinance,or of the Uniform Building Code,1964 Edition as amended, adopted by this ordinance,and by reference made a part herein,shall be deemed guilty of a misdemeanor,and upon conviction thereof,shall be punighsed by a fine in any sum not exceeding Three Hundred ($300.00) Dollars,or by imprisonment in the City Jail for a period not exceeding ninety (90)days or by both such fine and imprisonment. Ordinance No.531 (Continued) SECTION 15 . That Ordinance No.439,and all ordinances or parts thereof,in conflict with the provisions of this Ordinance be,and the same are hereby repealed. SECTION 16. That this Ordinance shall take effect and be in force five (5) days after its passage and publication as provided by law.
