AN ORDINANCE PROVIDING LICENSING,FOR THE
PURPOSES OF REGULATION AND REVENUE,ALL
AND EVERYKIND OF BUSINESS AUTHORIZED BY
LAW AND TRANSACTED AND CARRIED ON IN THE
CITY OF MOSES LAKE,WASHINGTON;PIXING THE
RATE OF LICENSE TAXUPON THE SAME;PROVIDING
FOR THE COLLECTION THEREOF BYSUIT OR OTHER-
WISE;PROVIDING PENALTIES FOR VIOLATION THEREOF;
AND REPEALING ORDINANCES Nos.91,103,131,141,
442 and 451
THE CIT'l COUNCIL OP THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN
AS FOLLOWS:
SECTION 1.The provisions of this Ordinance shall be deemed an
exercise of the authority and power of the City of Moses Lake,Washington,to
license,for the purposes of regulation and revenue,all and every kind of
business authorized by law and transacted and carried on within the corporate
limits of the City of Mœes Lake,as provided by R.C.W.35.24.290,Subsection 7.
SECTION 2.It shall be unlawful for any person,company,association,

after provided,within the City of Moses Lake,Washington,without first ob-
taining a license as provided for by this ordinance.
SECTION 3.All licenses provided for in this chapter shall be issued
by the City Clerk upon paying to.the City Clerk the proper license fee as herein-
after provided.All licenses shall bear the name of the licensee,and shall
designate the nature of the business,trade or profession operated by the
licensee;and shall also designate the location where said business,trade or
profession is carried on,the date of expiration of said license,the date of
the issuence of the license,and the amount paid for said license.Each
i licensee shall conspicuously post such license in his place of business
or office,and shall produce such license for inspection if required to do so
by any authorized City official.
SECTION 4.If the licensee is a new business,prior to the issuance of
said business license,the City Clerk shall submit the application therefor to
the Fire Chief and the Building Inspector of the City of Moses Lake for approval
of the location where the licensee is to carry on said business,trade or
profession,and said business license shall be issued only if the location is

in compliance with building and fire codes of the City of Moses Lake as

of said business,trade or profession from the location designated on the
business license,application must be made to the City Clerk prior to said
change in location and the City Clerk shall,prior to the issuance of a new
business license,submit the application therefor to the Fire Chief and the
Building Inspector of the City of Moses Lake for approval of the new location
where the licensee is to carry on said business,trade or profession,and
said business license shall be issued only if the location is in compliance
with building and fire codes of the City of Moses Lake as those codes relate
to existing and/or new structures.There shall be no additional business

SECTION 6.All licenses shall be for a period of one year,unless
otherwise provided herein;such license to begin January 1st of each year and
terminate the following December 31st,and must be renewed annually in
advance.Any license which is hereinafter required for any business that may
begin operation on or after July lst of any year shall be one-half of the legal
Iicense fee and shall entitle said licensees to operate within the City of Moses
Lake until December 31st of said year after which date said licensee shall
pay the license fee for one year in advance.Any and all licenses issued for
any new business wh ich shall begin operation after January 1st of any year,
i up to and including June 30th of any year,shall be required to pay the full
license fee.
SECTION 7.Licenses issued for the following businesses by the City
Clerk shall be temporary and a permanent license shall not be issued by the
City Clerk until said business has been approved by the Grant County Health
Department,which approval must be obtained within thifty days after the
issuance of said temporary licenses:
Bakeries,cafes and restaurants,confectioneries,grocery stores,meat

markets,produce stores (wholesaleand retail),soda fountains,taverns,
auto courts,cabin courts,hotels,trailer courts.If at any time any of the
i said businesses licensed above do not meet with the approval of the Grant
County Health Department,such license shall be revoked and shall not be
reissued until such business again meets with the approval of the Grant
County Health Department.
SECTION 8.Thebusiness license fee schedule is hereby fixed in
the amount of $35.00 per year,payable in advance,for each business,trade
or profession,conducted or carried on within the corporate limits of the
City of Moses Lake,Washington.No business,profession or trade conducted
or carried on in a single location under one management or ownership shall
pay more than one license fee regardless of the multiple nature of the business
carried on.Any business,profession or trade operating or conducting a business,
profession or trade in more than one location within the City of Moses Lake shall
pay a license fee for each location where said business,profession or trade
is conducted.
SECTION 9.Recognizing that there are locally owned and operated small
or part-time businesses which would be unduly penalized by requiring licensing
under this ordinance and the payment of the business license fee as herein
provided,there is exempted from this business licensing ordinance those locally
owned and operated businesses,pref essions or trades wherein the annual gross
income is less than $1,000.00 per year.
SECTION 10.All persons,co·-partnerships,companies,associations,or
corporations who shall be engaged in business or in practice of their trades or
professions in the City at the time this section shall be in full force and effect
shall procure their license to operate for the year of 1966 on or before January 31,
1966,and on or before the 31st day of each and every January thereafter.In the
event said license is not procured on or before January 31st of each year,the
following penalties shall apply.If said license fee is not paid before February 1st,
the sum of ten per cent (10%)of the required license fee shall be assessed as a
penalty;the sum of twenty per cent (20%)of the required license fee shall be

assessed as a penalty if said license fee is not paid before March lst;the
sum of thirty per cent (30%)of the required license fee shall be assessed as

if said license fee is not paid before May 1st;and the sum of fifty per cent
(50%)of the required license fee shall be assessed as a penalty if said license
fee is not paid before June 1st.
Provided further,that all persons,co-partnerships,companies,
associations,or corporations who commence business or practice of their
trades or professions in the City of Moses Lake after the 31st day of January
of each and every year,shall,within one month from said commencement
date,procure their license to operate for the current year and if said license
to operate is not procured within said month,then the penalties provided for

month that said license is delinquent,until a maximum penalty,equal to fifty
per cent (50%)of the required license fee,has accrued.
SECTION 11.All funds received by the City under the terms of this
ordinance shall be paid into the general fund of the City and budgeted annually
for any municipal purpose,as required by law.
SECTION 12 .All licenses provided for in this ordinance shall be
transferable to a successor in interest at the same location with the written
approval of the City Clerk and upon payment of a transfer fee of Ten Dollars
($10.00).
SECTION 13 .Any person violating any of the provisions of this ordinance
or operating any of the above-named businesses,professions or trades
without having first procured a license as herein provided,shall be guilty of
a misdemeanor;and upon conviction thereof,shall be punished by a fine of
not more than $300.00 or by imprisonment for not more than ninety (90)days
or both such fine and imprisonment.

SECTION 14.The City of Moses Lake shall have the power

SECTION 16.This ordinance shall take effect five (5)days from
and after its passage,approval and publication as provided by law.
