550_00001ORDINANCE NO.550 AN ORDINANCE REGULATING TEEN-AGE DANCES HELD WITHINTHECITYOFMOSESLAKE,STATE OF WASHINGTON:CREATINGATEEN-AGE DANCE BOARD:PROVIDING PENALTIES OF VIOLATIONBEREOFANDREPEALINGALLORDINANCESORPARTSTHEREOFINCONFLICTHEREWITH I THE CITY OF MOSES LAKE DO ORDAIN: Section l.Definitions. For the purpose of this ordinance the following words and phrases are hereby defined and shall be construed as hereinafter set out unless it shall be apparent from the context that they have a different meaning,to-wit: (a)Teen-age dances shall mean special dances held for teen-age minors,when held outside of school and church and the Municipal Park and Recreation Department authority under a per- mitmpa thocri ei hb hthproevei iagne dhe eeinboc rn a nn dconducted in (b)Sponsor or sponsoring groups shall mean any one or more of the following: 1.Governmental agencies,entities,or politicalsubdivisions. 2.Bona Fide Clubs,fraternal orders,societies,organizations or groups of persons organizedandexistingforordevotedprimarilyto thepurposesofpromotingandcarryingonyouthactivitiesandrecreationalanddancingfacili-ties,provided that such club,order,society,group or organization has been regularly anddulyorganized. 3.Any person,firm,corporation or associationexistinganddevotedtothepurposesof promotingandcarryìngonrecreationalordancingfacilities,provided such person,firm,corporation or associa- (d)Teen geh been rer sh enadnduly organi ee einafter provided for. Section 2.Creating a Teen-Age Dance Board. There is hereby created and established a board to be known as "The Teen-Age Dance Board"which board shall consist of seven members,as follows: Ordinance No.550(Continued),2 1.one member of said Board shall be the PoliceChieforhisdelegatedrepresentative. 2.One member of said board shall be the Park and Recreation Director or his delegated representative. I 3.One member shall be the School superintendent of Moses Lake School District No.161 or his delegatedrepresentative. 4.Two members of the board shall be appointed by theCityManagertoserveforaperiodoftwoyearsexceptthatintheoriginalappointmentonemembershallbeappointedforoneyearandtheotherfor a period of two years. 5.Youth membership on the board shall come from thefollowingsourcesandshallserveforoneyearterms. (1)One member of the student body of the MosesLakeHighSchoolwhoisdelegatedbytheHighSchoolPrincipal. (2)One member of the Big Bend Community collegeundertheageoftwentyuponthedelegation of the College President. Four (4)members of said board shall constitute a quorum. Section 3.Permit for Teen-Age Dance Required. It shall be unlawful to conduct or sponsor any teen-age dance in the City of Moses Lake,Washington without having first obtained a written permit as herein provided. Section 4.Permit Applications Required. The application for a permit to hold a teen-age dance shall be accompanied by adequate proof that the place or premises where the dance is to be held has a valid public dance hall license,or is not required to have such a license but conforms with all safety regulations established by law subject to inspection by the Fire and Police Department wherein the dance is to be held.The appli- cation or permit shall set forth therein the following minimum information: 1.The name and address of the applicant or applicants. 2.The date upon which the dance is to be held. 3.The address of the place where the dance is to be held. 4.The approximate attendance expected. Ordinance No.550 (continued):3 5.The minimum number of adult supervisors who will be inattendanceatalltimesduringtheholdingofsaiddance,and the name and addresses of such adults. Upon the filing of each application for a teen-age dance,the board shall cause to be made such investigation as it deems proper,and shall either deny or approve the same.If the appli- cation is approved,the permit for such dance may then be issued be alhef hw lerbe fiMoses Lakethe Bocorpd If he arp cati feod such permit is denied by the said Teen-Age Dance Board,the appli- cant shall have,and is hereby given the right of appeal from said denial .to the City Council of Moses Lake. Section 5.Revocation of Suspension,Grounds or Procedure. Any permit issued hereunder may be revoked or suspended by the Teen-age Dance Board if any of the following conditions exist or occur: 1.The applicant for the permit or the holder of anypermit,as the case may be,has knowingly made anymaterialmisstatementintheapplicationfortheperait. 2.The holder of the permit is violating any of theprovisionsofthissection. 3.The holding of such teen-age dances pursuant to thepermitissuedwillnotbeinaccordancewiththepublicpeaceorwelfare. In the event such permit is revoked or suspended as above provided,the holder of such permit shall be and is hereby given the right of appeal from such revocation or suspension to the City Council of Moses Lake,Washington. Section 6.General Provisions. It is hereby provided that: 1.Teen-Age dances shall in no way be construed aspublicdancesandshallbeunderthecontroloftheTeen-Age Dance Board. Ordinance No.550 (continued):4 2.No alcoholic beverages shall be sold,consumed or beavailableonthedancefloororonthegroundswhilethedanceisinprogress. 3.Admission to the Teen-Age dance shall be denied to e epearson shoh gevidence oc bdreink9ing alcoh ecrson. 4.Sufficient qualified adult supervision shall be pro-vided by the sponsor at all teen-age dances to insurethatacceptedstandardsofsocialconductarefollowed as determined by rules and regulations of the Teen-AgeDanceBoard. 5.No dancing at any Teen-Age dance shall be permittedafterthehourofoneo'clock A.M. 6.No person under age as determined by rules and regula-tions of the Teen-Age Dance Board nor over the age oftwenty(20)shall attend any teen-age dance as a partici-pant.This does not prohibit the attendance of adultsupervisors,chaperones,parents or other sponsors,nordoesitprohibitpersonsemployedasentertainersormusiäiansatsuchdances. 7.It shall be unlawful and shall constitute a violationofthissectionforanypersonwhoisnoteligible forabdmittaneceptremsteena-agehidan euch d nite a nng held. 8.It is further provided that the Teen-Age Dance Boardisherebyauthorizedandempoweredtoadoptanyrulesandregulationsatitsowndiscretion,not inconsistantherewithasitdeemsnecessarytocarryoutthepurposeofthissection. 9.Violation of any of the rules or regulations as adoptedbysaidBoardshallmakethepermitforfeitableimmediately. Section 7.Fees for Issuance of Permit. The Board shall require payment to the City Clerk of Thirty Five Dollars ($35.00)per year,or Five Dollars (5.00) per dance from any sponsoring agency before the City Clerk shall issue any permit. I section 8.Violation of Provisions of this ordinance. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon the conviction thereof shall be Punished by a fine of not to exceed Three Hundred ($300.00)Dollars or by imprisonment in the City Jail for a period of not to exceed ninety (90)days or by both such fine and imprison- ment. ordinance No.550 (Continued):5 Section 9.Repeal. That all ordinances or parts of ordinances of the city of Moses Lake in conflict with the provisions of this ordinance be, and the same are,hereby repealed.
