AN ORDINANCE PROHIBITING THE LOITERING OFMINORSINPUBLICPLACESDURINGCERTAINHOURS:DETERMINING THE RESPONSIBILITY OFPARENTS,GUARDIANS,AND OTHERS HAVING THECAREANDCUSTODYOFMINORS:FIXING PENAL-TIES FOR THE VIOLATION OF THIS ORDINANCE;REPEALING ORDINANCE NO.39 and ALL OTHERIORDINANCESORPARTSTHEREOFINCONFLICTEEREWITH.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE ,WASHINGTON
DO ORDAIN AS FOLLOWS:
SECTION l.LOITERING OF MINORS PROHIBITED.
It shall be unlawful for any minor under the age of
eighteen (18)years to loiter or remain on public streets,side-
walks,highways,alleys,parks,playgrounds,public places,places
of amusement,vacant lots or other unsupervised places within the
City of Moses Lake between the hours of 1:00 A.M.and 5:00 A.M.
and it shall be unlawful for the parent,guardian or other adult

or
remain on the public streets,sidewalks,highwayì alleys,parks,
playgrounds,public places,places of amusement,vacant lots or
other unsupervised places within the City of Moses Lake between
the hours of 1:00 A.M.and 5:00 A.M.•provided,however,that
the provisions of this section do not apply to a minor accompanied
by his or her parent,guardian or other adult person having the
authorized care of or custody of the minor or when the minor is
upon an errand directed by 'his or her parent,guardian or other
adult person having the authorized care or custody of such child
i or when such minor is returning directly home from any school
function,licensed public dance,eating place,work,recreational
activity or any other properly supervised activity to which any
minor may attend.

SECTION 2.PENALTIES.
Any minor under the age of eighteen (18)years
violating the provisions of Section 1 of this ordinance shall
be arrested and detained by the officer making the arrest and
referred to the Juvenile Court to answer for and to be punished
for the violation of this ordinance,and if remanded to the
Municipal Court for prosecution,upon conviction,shall be
punished by a fine of not more than Three Hundred Dollars
($300.00)or confined in the city jail for not more than ninety
(90)days,or punished by both such fine and imprisonment for
such offense.
Any parent,guardian or other adult person having
the authorized care or custody of a minor under the age of
eighteen (18)years,who violates section 1 of this ordinance
shall be guilty of a misdemenaor,and upon conviction thereof
shall be punished by a fine of ¤ot more than Three Hundred
Dollars ($300.00)or confined in the city jail for not more
than ninety (90)days,or punished by both such fine and
imprisonment for such offense.
Each violation of the provisions of this section
shall constitute a separate offense.
SECTION 3.TINE SYSTEM INDICATED.
The hours indicated in this ordinance are with
reference to the prevailing time in theCity of Moses Lake
I whether it be what is commonly known as Pacific Standard Time
or Pacific Daylight Time.

SECTION 4.REPEAL OF CONFLICTING ORDINANCES.
Ordinance No.39 and all other existing ordinances
or parts thereof,of the City of Moses Lake in conflict with
I the provisions of this ordinance are hereby repealed.
SECTION 5.SEVERABILITY OF PROVISIONS.
It is the intention of this ordinance that each
separate provision hereof shall be deemed independent of all
other provisions herein;if any provision of this ordinance be
declared invalid for any reason whatsoever,all other provisions
shall remain valid and enforceable.
