AN ORDINANCE PROVIDING FOR THE LICENSING OFPUBLICDANCESANDCABARETS,REGULATING PUBLICDANCESANDCABARETS,PROVIDING FOR REVOCATION
OF LICENSE,PROVIDING A PENALTY FOR VIOLATIONTHEREOFANDREPEALINGORDINANCESNo.11,45,265 AND ALL OTHER ORDINANCES AND PARTS OFORDINANCESINCONFLICTTHEREWITHITHECITYCOUNCILOFTBECITYOFMOSESLAKE,WASHINGTON DO ORDAINASFOLLOWS:
Section 1.Definition of Terms.
a.Public dance shall mean any dance or hall to whichthepublicgenerallymaygainadmissionwithorwithoutthepaymentofanadmissionfee.
b.Public dance hall is hereby defined to mean any roomorpartthereof,any hall or any part thereof,pavilion,buildingorotherstructureoccupiedforthepurpose,in whah or in part,of conducting therein public dances or dancing.
c.Cabaret is hereby defined to be a tavern,a diningroom,restaurant or eating place.
d.Open air dancing is defined as any dance conductedoutsideofabuildingandwhichisusuallyheldonapavedsurfaceinthecity.
Section 2.Exemption.
All public dances when held under school authority,churchauthority,or Park and Recreation Department authority shalikeexemptfromthisordinance.
Section 3.License Required.
a.It shall be unlawful for any person,firm,society,association or corporation to sponsor,permit or conduct any publicdanceorcabaretdancewithinthecorporatelimitsoftheCityofMosesLake,Washington,without first obtaining a license so to do,as is hereinafter provided.Licenses may be issued on a calendaryearornightlybasis.
Section 4.Fees.
Charitable,patriotic or benefit dances for the publicshallbeexemptfrompaymentuponrequesttoandpermissiongrantedbythecityClerkoftheCityofMosesLake,Washington.The licensefeeforpublicdancesordancesmaintainedoroperatedandconductedinacabaretshallÞeFiveDollars($5.00)per night or Thirty-fiveiDollars($35.00)per year,payable in advance.Each full year shallbeginonthefirstdayofJanuary.Those in operation only for one-half year may pay on June 1st on the basis of a half-year license.
Section 5.Application.
Application for a license to conduct a public dance orcabaretdanceshallbemadeinwritingtotheCityClerkatleast48hourspriortothetimesaidpublicdanceistobeheldand shallbeaccompaniedbyadepositoftheamountofmoneyitrequires.Said application shall obtain the following information:
1.The name and mailing address of the applicantorapplicants.

2.The date upon which the event is to be held.
3.The address of the place where the dance is tobeheld.

onducting the dance.No license shall be granted to any corporation,but if any dance beconductedbyacorporation,the permit shall be issued to the managerorotherdirectingofficerthereof.
Section 6.Granting of License.
No license to conduct a public dance or cabaret danceshallbegrantedunlesstheapplicantthereforbeofgoodmoralcharacter.For the purpose of considering an application for alicense,the Police Chief and Fire chief or their designated assis-tants may make,or cause to be made,an inspection of the premiseswheresuchdanceordancingistobemaintainedorconducted,andmayinquireintothecharacterandreputationoftheapplicantorapplicantsandmayinquireintoandmakeinvestigationastothelocationwheresuchdanceordancingwillbemaintained,conductedoroperated.The City Clerk may,in his discretion,grant or refuseanylicenseappliedfor.The applicant may then appeal directly totheCityCouncil.All licenses granted hereunder shall be keptpostedinaconspicuousplaceonthelicensedpremisesorina room

No license shall be assigned or transferred.
Section 8.Floor Manager Duties.
Every person conducting a public dance or cabaret danceshallhaveafloormanagerincontrolofthepremisescontinually fromone-half hour before dancing begins until the dance hall is closed.It shall be the duty of the floor manager to see that standards ofdecencyandgoodtastearemaintainedandthatdisorderly,familiar,or objectionable conduct is not tolerated,and to take effectivestepspromptlytoremoveobjectionablepersonsandstopobjectinable ~
practices.The floor manager shall carry out the provisions of thisordinancerelatingtopublicdancehallsandpublicdancingandinpreservingorderandgoodconductonthepartofthepatronsandemployeesofsaiddance.
Section 9.Dance Halls -Lighting.
I a.The place where any such dance or dancing is permittedshallbelightedorilluminatedinsuchamannerandtosuchan ex-tent as is usual or customary for lighting halls or rooms of like di-mensions and like character in the night time for public assemblage,before any patrons are admitted thereto or before any dance or danc-ing is commenced therein.Such lighting or illumination shall bemaintainedthereafterthroughouttheentiretimesuchdancehall andpremisesshallbeopenandentertainingpatronsandduringanyrecessorintermissionwithoutdimunitionandwithoutinterruption,untiltheplacewheresuchdanceordancingispermittedshallbeclearedandclosed,
b.No person maintaining,permitting,operating or conduct-ing any dance or dancing,or any manager or agent in charge thereof,shall:

1.Permit in the place where such dancing is held,upon the premises under his control any personhavinginhispossession,or offering for sale,selling,giving away or drinking any intoxica-ting liquor other than liquor sold on the premisesiunderastatelicenseorpermit.
2.Permit any person under the influence of liquor
or drugs to enter the place wherein such dancingispermitted,nor to participate therein or remainatsuchplace,nor upon the premises under hiscontrol.
3.Permit any narcotic peddler,narcotic addict,lewd or dissolute persons,idlers or other hangers-
on to be at or about the place where such dance ordancingispermittedorconducted.
c.Nogublic dancing or cabaret dancing shall be conducted orcarriedonbetweenthehoursof1o'clock AM and 6 o'clock AM Pacific IstandardTimeorPacificDaylightTime,whichever is then prevailing•provided,however,that cabarets licensed by the Washington StateLiquorControlBoardforthesaleofintoxicatingbeverages,may con-duct dancing during the hours authorized by the Washington StateLiquorcontrolBoardforthesaleofintoxicatingbeverages.Thehoursduringwhichopenairdancingmaybeconductedmayberestrict-ed at the discretion of the City Clerk.I d.The Police and Fire Chief of the City of Moses Lake orhisdesignatedofficialinuniformshallhavefreeaccessatalltimestoanyandallpublicdances,dance halls,or cabarets for thepurposeofinspectionandtoenforcecompliancewiththeprovisionsofthisordinance,and shall have the power and it shall be theirdutytocauseanydancehalltobevacatedwheneveranyprovision ofthisordinanceisviolated,or wherein any ordinance,regulation orlawofanycharacterisbeingviolated.
Section 10.Revocation of Licenses.
Any license or licenses of whatsoever kind granted hereundertoconductapublicdanceorcabaretdancemayberevokedbytheactionoftheCityCounciloftheCityofMosesLake,Washington,foranyviolationofanyoftheprovisionsofthisordinance,or any stateorfederallaworforpermittingthisordinanceoranyofthepro-visions thereof to be violated,after a hearing held upon no less thantendayswrittennoticetothelicensee,his agent or employee,andtheactionofsaidCouncilinrevokinganysuchlicenseshallbefinalandconclusive.Every licensee accepting a license hereundershallbedeemedtohaveconsentedtotheprovisionsofthissectionIwithrespecttothecancellationoflicense,and no public dancesshallbeconductedatanyotherplacethanspecifiedinthelicensethereof.
Section 11.Partial Invalidity.
If any section or sections of this ordinance shall be declaredinvalid,it shall not affect the validity of the other sections ofthisordinance.

Section 12.Conflicting Ordinances Repealed.
Ordinances No.11,45 and 265 of the City of Moses Lake,Washington,and all other ordinances or parts of ordinances inconflictherewithareherebyrepealed.
Section 13.Penalties.
Any person,firm or corporation violating any of the pro-visions of this ordinance shall be deemed guilty of a misdemeanor,and4uponconvictionthereofshallbepunishedbyafineofnotmorethan~Three Hundred Dollars ($300.00)or imprisonment not to exceed ninety(90)days or both such fine and imprisonment.Each day of viiationshallbeconsideredaseparateoffense.Upon conviction under thisordinancethelicenseofsuchperson,firm,or corporation may berevokedorsuspendedbytheCourtinadditiontoctherpenalties.
