559_00001ORDINANCE No.559 AN ORDINANCE APPROVING AND CONFIRMING THEASSESSMENTSANDASSESSMENTROLLOFLOCAL IMPROVEMENT DISTRICT No.22,WHICH HAS BEENCREATEDANDESTABLISHEDFORTHEPURPOSEOF IMPROVING WHEELER ROAD FROM THE INTERSECTION OF PIONEER WAY TO STATE HIGHWAY 11G BY GRADING,i GRAVELING,CONSTRUCTING AND INSTALLING STORM DRAINAGE,CURBS AND GUTTERS,SIDEWALKS,RETAIN-ING WALL AND ASPHALTIC CONCRETE PAVEMENT AND TRAFFIC SIGNALS AS PROVIDED BYORDINANCE No.548,AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS,TRACTS,PARCELS OF LAND AND OTHER PROPERTY SHOWN ON THE ROLL WHEREAS,the assessment roll levying the special assessments against properties located in Local Improvement District No.22 in the City of Moses Lake,Washington,created under Ordinance No.548,has been filed with the Clerk of the City of Moses Lake,as provided by law;and WHEREAS,notice of the time and place of hearing thereon and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law,fixing the time and place of hearing thereon for the 28th day of February,1967,-at,the hour of 8 o'clock PM (PST),in the Council Chambers in the Cityllall,Moses Lake,Washington,and further notice thereof was duly mailed by the City.Clerk to each property owner shown on the roll;and WHEREAS,at the time and place fixed and designated in the notice the hearing was duly held and all protests in writing were read and submitted to the City Council and were by it overruled,NOW,THEREPORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLSOe t n 1.The assessments and assessment roll of Local Improvement .District No.22,which has been created and established for the purpose of paying the cost of improving Wheeler Road from the intersection of Pioneer Way to State Highway 11G by grading,graveling,constructing and installing storm,drainage, curbs and gutters,sidewalks,retaining wall and asphaltic concrete pavement and traffic signals as provided by Ordinance No.548,as the same now stand,be and the same are hereby in all things and respects approved and confirmed. Section 2.Each of the lots,tracts,parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefited by the improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several aass ssmeants appearing upon the r nd ther t erhpereby levied aLn asspesn e roll the amount finally charged against the same thereon. Section 3.The assessment roll as approved and confirmed shall be filed with the Treasurer of the City of Moses Lake for collection and said City Treas- urer is hereby authorized and directed to publish notice as required by law stating that said roll is in her hands for collection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty days from the date of the first publication of the notice without penalty,interest or cost,and that thereafter the sum remaining unpaid may be paid in ten equal annual install- ments with interest thereon hereby fixed at the rate of 5 .5%per annum.The first installment of assessments on the assessment roll shall become due and payable during the thirty day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter each succ-eading installment shall become due and payable in like manner.If the whole or any portion of the assessments remains unpaid after the first thirty day period,interest upon the whole unpaid sum shall be charged at the rate of 5 .5%per annum and each year thereafter one of the installments,together with interest due on the whole of the unpaid balance, shall be collected.Any installment not paid prior to the expiration of the said thirty day period during which such installment is due and payable shall thereupon ecome del q5% per All delingduent insatellmentaS1 chall be subjepcenalta ch for upon both principal and interest due upon such installment or installments .The collection of such delinquent installments will be enforced in the manner provided by law. Ordinance No.559 (Continued) This Ordinance was considered by the City Council at Public Hearing;therefore, the provisions of Section 23,Ordinance No.379,are hereby waived and this Ordinance shall be adopted on the date of its first introduction and after its first reading.
