565_00001AMENDEDBYORDÐANCENo..if ORDINANCE No. AN ORDINANCE RELATING TO THE WATER AND SEWER SYSTEM ACQUIRED BY THE CITY AT PORMER LARSON AIR FORCE BASE,REGULATING THE USE OF WATERTHEREFROM,PROVIDING FOR SALE OF THE SAME,FIX-ING THE PRICE THEREOF,PROVIDING A METHOD OFiCOLLECTINGCHARGESTHEREFOR,AND FIXING THE METHOD OF COLLECTING POR THE USE OF FACILITIES AND FURNISHING OP SERVICES BYTHE SEWER SYSTEM AND SEWERAGE DISPOSAL PLANT,AND PROVIDING PENALTIES FOR THE VIOLATION TIE REOF THE CITY COUNCIL OF THE CITY OF MOSES LAKEDOES ORDAIN AS FOLLOWS: Section 1.Residential Water Rates (1)The following shall be the monthly rate charged for water from themunicipallyownedwatersystemforsinglefamilydwellingsand duplexes: Amount Used Water Rate 0 -600 Cubic Feet 0 .50 per 100 Cubic Feet or portion thereof601-1500 Cubic Feet 0.15 """"""1501 -3000 Cubic Feet 0.12 """"""3001 -5000 Cubic Feet 0 .10 """"""i 5001 -10,000 Cubic Feet 0.08 """"""Over 10,000 Cubic Feet 0.06 """""" (2)The following shall be the minimum monthly amounts chargedaccordingtoeachmeterinservice: Meter Size Minimum Charge Per Water Delivered Calendar Month For Minimum 5/8 Inch 3.00 600 Cubic Feet l Inch 3.60 1000 Cubic FeetlàInch5.55 2500 Cubic Feet 2 Inch 12.15 10,000 Cubic Feet (3)Duplexes served by a single meter,whether the second unit is occupied or not,shall be charged $2.00 per month in addition totheabovecharges. (4)Master metering of the entire housing area will be permissible asatemporaryexpediencywithwatersoldthroughaprogramofmastermeteringbaseduponthecommercialratestructure.In addition i to the commercial rate through master meters,a flat rate of $3.75permonthwillbechargedforeachoccupiedlivingunitforwaterservices. Section 2 .Commercial Water Rates (1)The following shall be the monthly rate charged for water from the municipally owned water system for commercial and industrial users: Amount Used Water Rate0-600 Cubia Feet 0.80 per 100 Cubic Feet or portion thereofi601-3000 ""0.15 """"""3001 -15,000 ""0.12 """"""15,001 -35,000 ""0.10 """"""35,001 -70,000 ""0.08 """"""Over 70,000 Cubic Feet 0 .06 """""" (2)The following shall be the minimum monthly amount charged according to each meter in service: Meter Size Minimum Charges Water Delivered Per Calendar Month For Minimum 5/8 Inch 4.80 600 Cubic Feet 1 "7.65 2,500 ""li "10.80 5,000 ""2 "16.80 10,000 ""3 "27.80 20,000 ""4 "42.80 35,000 ""6 "54.80 50,000 ""8 "82.80 90,000 ""10 "118.80 150,000 "" Section 3.Sewer Rates (1)Single Family Residence 3 .75 per month (2)Duplexes (a)With 2 meters 3 .75 per month perMeter (b)With single meter 5.35 per month (whether second unit is occupied or not)(c)Unmetered or on master meter 3.75 per month for each occupied unit (3)Commercial and Industrial 80%of total monthly water charges (4)Air Conditioning and Refrigeration All air conditioning and refrigeration units that are installed,replaced, or that have capacity increased after the effective date of this ordinanceishallberequiredtoinstallrecirculatingunitsortodischargetheir waste water into a storm sewer system.Disposal may not be accomplish ed by discharging into the sanitary sewerage system. (5)Sewer Charges Waived: Upon application to the City of Moses Lake,a business orindustryirrigatingmorethan5000squarefeetofarea,under the commercial water rate may receive credit for sewer charges on water used for irrigation or landscaping during the months of April to September,inclusive, i Credit may also be received for water used for air conditioning units exceeding three (3)tons in capacity,whose discharge is not into the sanitary sewerage system. The City will estimate the amount of credit based upon available data or the property owner may install a separate meter for the sole purpose of serving en irrigation or sprinkler system. (6)Industrial Sewer Rates: Sewer rates for commercial,industrial or processing plants may be separately determined by the City Council,based upon both volume and chemical characteristics of the sewage.The City Council reserves the privilege to require pre-treatment of anymaterialdischargedintotheseweragesystem,or to prohibit discharge into the system of industrial wastes that,because of either volume or concentration,will overload existing seweragefacilities. Section 4.Payment of Accounts i Water and sewer bills shall be the responsibility of and billed directly tothepropertyowner,and the same shall be due and payable on or before the 10th day of each month and shall become delinquent on said date.The City reserves the right to cut off the water supply from the premises and the water supply may be cut off if either the water charge or the sewer charge is delinquent,or both,and should said water supply be turned off for failure to pay the sewer charge and/or water charge,when due,said water supplyshallnotbeturnedonuntilalldelinquentchargeshavebeenpaidinfull. The sum of $4.00 as a turn-on charge shall be added to the amount due and payable. PROVIDED FURTHER,that the City shall have a lien against the premises for unpaid water and sewer charges as provided by the laws of the State ofWashington. Section 5 .Application for Water and Sewer Service Application for turn-on of water and sewer service shall be made upon formsprescribedbytheFinanceDirector.The water charge shall begin to run fromthedatewateristurnedonandthesewerchargeshallstartafterthesewerlinehasbeeninspected.Application for a Water meter installation or seWer connection permit shall be made upon forms prescribed by the City Engineer. Section 6.Temporarily Vacant or Unoccupied Premises The minimum water and/or sewer service shall continue until an order inwritingtodiscontinueservicehasbeengiven.The water shall not be turned on until a request in writing is given for the turning on of said service.The sum of $4.00 as a service charge shall be added for each turn-on or for eachchangeofservicetoanotheroccupant. When water and sewer service is resumed,billing shall commence from thedatewaterserviceisturnedon.Where water is turned on prior to the 15thofthemonth,water and sewer shall be charged for a full month.Where water is turned on after the 15th of the month,water and sewer shall bechargedforone-half month. Section 7 .Fire Protection Charges (1)Those agencies or firms that control property within the areaservedbythewatersystemwillbechargedthesumof$30.00 per hydrant per year in payment to the City Water Department in order to reimburse the City for the excess water facilities required to provide fire protection service and to pay for testingandmaintenanceoffirehydrants, I (2)Metering shall not be required for fire protection lines to buildings when used solely for furnishing water to sprinkler,deluge or otherfireprotectivedevices.A flat rate monthly charge shall be made by the City of Moses Lake in accordance with the schedule established for meter sizes in Section 2 of this Ordinance.Water used throughsuchsystemineventoffirewillbeestimatedandbilledinaccordancewiththecommercialratestructureifconsumptionisinexcessofthatallowedinaccordancewithlinesize. (3)Water used through fire hydrants in event of fire will be estimatedandbilledtotheagencyforwhichwaterwasusedinaccordance withthecommercialratestructure. Section 8.Damage to System Should damages occur to fire hydrants through their use for fire protection or other authorized uses,all costs for repair shall become the obligation of the user.Damage resulting from an accident or from unauthorized or improper use of water and/or sewerage facilities shall become an obligation againsttheagencyorpersoncausingsuchdamage. Section 9 .Partial Invalidity The invalidity or any part of this ordinance shall not affect the validity of anyotherpartofthisordinancewhichcanbegiveneffectwithoutsuchinvalid part or parts . Section 10 .Violations Any person,firm or corporation who violates any of the provisions of thisordinanceshall,upon conviction thereof,be subject to a fine of not morethan$300.00 or imprisonment not to exceed 90 days in the city jail,or both,and shall also become liable to the City for any expense,loss or damage occasioned the City by reason of such violation. Section 11.Emergency Clause and Effective Date It is hereby declared than an emergency exists,the provisions of Section 23,Ordinance 379 are hereby waived,this ordinance shall be read only once beforeiitspassage,and it shall take effect immediately upon passage.
