AN ORDINANCE RELATING TO THE WATER AND SEWER SYSTEMACQUIREDBYTHECITYATFORMERLARSONAIRFORCEBASE,PROVIDING FOR CONNECTION CHARGES THERETO,REGULATIONSFORTHEUSETHEREOF,AND PROVIDING PENALTIES FOR VIOLATION
THE CITY COUNCIL OF THE CITY OF MOSES LAKEDOES ORDAIN AS FOLLOWS:
Section 1.Unauthorized Use
It shall be a violation of this Ordinance for any unauthorized person toturnonoroffhisownwaterserviceortootherwisetamperwithanyportionoforappurtenancestothewaterand/or sewer system or to makeconnectionstheretowithoutfirsthavingmadeapplicationonformspro-vided at the Engineering Office of the City of Moses Lake,and havingbeengrante.d such permission in writing.
Section 2 .Water Service Connection Charges
(1)All water service connections shall be metered and all separatebuildingsshallbeseparatelyconnectedtothecitywatersystemEXCEPTthatseparatebuildingswhichareanintegralpartofasinglebusinessorindustrymaybeservedbyamastermeterservingtheproperty.The following charges shall be made bytheCityofMosesLakeformakingmeteredwaterserviceconnectionsandsaidchargesshallbepaidinfullbeforetheconnectionismade:

(2)The foregoing charges shall apply only to existing connectionsmadealonganystreetwhereamainexists.In considerationofsaidchargestheCityWaterDepartmentshalllaytheservicepipefromthemaintothemeterandshallinstallameterandmeterboxnofurtherthanten(10)feet from the property lineEXCEPTthatwherethemeterinstallationismorethan100feet fromthewatermain,that line in excess of 100 feet will be billed on anactualcostbasisfortimeandmaterial.Responsibility for install-ation and maintenance of the service piping beyond the meter shallbethesoleresponsibilityofthepropertyowner.
(3)Existing meters may be utilized without payment of the foregoingcharges,except that actual costs for repairing those meters andplacingtheminoperableconditionwillbechargedtotheuser,I (4)When a new water connection is made to an existing main or to amainwhichislaterconstructedattheexpenseoftheCity,anadditionalchargeof$2.00 per front foot of property shall be madeinadvancebeforetheconnectionisauthorizedtodefrayaportionoftheCity's cost for purchase or installation of that main.
(5)Water main extensions shall be made at the expense of theprospectiveuser,in accordance with the provisions ofResolutionNo.181 of the City of Moses Lake and shall beinstalledforthefullfrontageofpropertybeingserved.

Section 3 .Conformance with Regulations or Agreements
The property owner shall not be entitled to water and/or sewer serviceeventhoughtheconnectionchargeshavebeenpaidtotheCityifthepremisesarenotinconformancewithbuildingorzoningregulations.
The City shall have authority to discontinue water or sewer servicebecauseofnonconformancewithCityOrdinances,prescribed standards,or special agreements between the user and City.
Section 4.Use of Water
No person supplied with water from the City water system shall use water fromthesystemforanyotherpurposethanthosestatedintheapplicationandshallinotsupplyinanywayanyotherpersonorfamilieswithwater.
In no case shall any cross connection be allowed between two or more cityserviceconnectionsorbetweenanycitywatermainorserviceconnectionandpipesupplyingwaterfromanyothersource.
Section 5 .Insufficient Water Supply
The City of Moses Lake reserves the right at any time,without notice,toshutoffthewatersupplyforrepairs,extension,non-payment of rates orforanyotherreason,and the City shall not be responsible for any damagesuchasburstingofboilerssuppliedbydirectpressure,the breaking ofpipesorfixtures,any damage to property caused by fire on account ofinsufficientwatersupplyorpressureorforanyotherdamageresulting fromtheshuttingoffofwaterorfromtheinsufficiencyofthesupplyofwaterorpressure.
Section 6.Maintenance of Private System
The service pipes,connections and other apparatus within any privateipremisesmustbekeptingoodrepairandprotectedfromfreezing,at theexpenseoftheownerorlessee,who will be responsible for all damageresultingfromleaksandbreaks.In case of neglect to promptly repairanyserviceorfixture,or make any changes or alterations required in thisordinance,the City shall have the authority,when deemed necessary,togoontothepremisesandmakeorcausetobemade,such changes,alterations or repairs,and charge the same against the premises and theownerthereof.
The repairs of any meter damaged by hot water shall be charged to the ownerofthepropertyforwhichsuchmeterwasinstalled.The deformation orwarpingofametereddiscoraregisterfigurediscoranymetershallbe heldtobeaprimafacieevidenceofsuchdamagehavingbeencausedbytheactionofheat.
It shall be unlawful for any person to wilfully allow water to be wastedbyimperfectorleakingstops,valves,pipes,closets,faucets or other
fixtures,or to use water closets without self closing valves,or to usethewaterforpurposesotherthanthosenamedontheapplicationuponwhichratesforwaterarebased,or for any other purpose than that forwhichhiscontractprovides.
Section 7.Sewer Connection Permit
No unauthorized person shall uncover,make any connections with oropeninginto,use,alter,or disturb any portion of the sewer system orappurtenancethereofwithoutfirstmakingapplicationandreceivingwrittenpermissionfromtheEngineeringOffice,City of Moses Lake.Thepermitapplicationshallbesupplementedbyanyplans,specifications orotherinformationconsideredpertinentinthejudgmentofthecity.A permit
and inspection fee of $15.00 shall be remitted with the permit application.
The applicant for the building sewer permit shall notify the EngineeringDepartmentoftheCityofMosesLakewhenthebuildingsewerisreadyforinspectionandconnectiontothepublicsewer.The connection shallbemadeunderthesupervisionoftheCityEngineerorhisrepresentative.
Section 8 .Sewer Connection Charges
(1)When a new sewer connection is made to an existing main or to amainwhichislaterconstructedattheexpenseoftheCity,anadditionalchargeof$2.00 per front foot of property shall be made
i in advance before the connection is authorized to defray a portionoftheCity's cost for purchase or installation of that main.
(2)Sewer main extensions shall be made at the expense of the prospective
user,in accordance with the provisions of Resolution No.181 oftheCityofMosesLakeshallbeinstalledforthefullfrontageof
property being served.
Section 9.Sewer Construction Standards
The owner shall be responsible for installation and for maintenance of allbuildingsewers.A separate and independent building sewer shall be provided
for every building:EXCEPT,that separate buildings which are an integral
part of a single business or industry may be served by a single sewer.
Building sewers which are connected to the City system shall be designedandconstructedinaccordancewiththeWashingtonStateAmericanPublicWorksstandardspecificationsasadoptedbytheCityofMosesLake,CityPlumbingCode,Washington State Department of Health and Pollution ControlCommissionstandards.
Where no properly located "Y"branch is available,a connection may beimadebycuttingthesewerandforminga"Y"branch in the upper one-halfofthesewer,with entry in the downstream direction of forty-five (45°)degrees .
Section 10 .Street Restoration
Where it is necessary to remove existing street pavement,curb andgutter,sidewalk or gravelled streets,to install water and/or sewerservicelines,the property owner shall post a cash bond in the estimatedamountofthecostofrestoringsaidimprovementstotheiroriginalcondi-tion.The water and sewer department will have the necessary repairs made
upon completion of the installation of the service connection,and deductitheactualcostofsaidrepairsfromthecashbond.If the cost of repairsexceedstheestimatedamountofthecashbond,the property owner shall
be billed for the balance,which shall become a lien against the propertycollectableinthesamemannerasunpaidwaterandsewercharges.Ifthecostofrepairsislessthantheestimatedcashbondtheexcessshallbereturnedtothepropertyowner.Temporary patches shall be placed attheexpenseoftheownerifdeemednecessarybythePublicWorksDirector.
Section 11.Use of Public Sewers
(1)No person shall discharge or cause to be discharged any storm
water,surface water,ground water,roof runoff,subsurface
drainage,cooling water or unpolluted industrial process waterstoanysanitarysewer.
(2)Except as hereinafter provided,no person shall discharge or
cause to be discharged any of the following described waters
or wastes to any public sewer:
(a)Any liquid or vapor having a temperature higher
than 150°F.
i (b)Any water or waste which may contain more than
100 parts per million,by weight,of fat,oil,orgrease.
(c)Any gasoline,benzene,naptha,fuel oil,or other
flammable or explosive liquid,solid or gas.
(d)Any garbage that has not been properly shredded.
(e)Any ashes,cinders,sand,mud,straw,shavings,metal,glass,rags,feathers,tar,plastics,wood,
paunch manure,or any other solid or viscous substance
capable of causing obstruction to the flow in sewers orotherinterferencewiththeproperoperationofthesewageworks.
(f)Any waters or wastes having a pH lower than 6.0 orhigherthan9.0,or having any other corrosive propertycapableofcausingdamageorhazardtostructures,equipment,and personnel of the sewage works .
i (g)Any waters or wastes containing a toxic or poisonous
substance in sufficient quantity to injure or interfere
with any sewage treatment process,constitute a hazard
to humans or animals ,or create any hazard in the re-ceiving waters of the sewage treatment plant.
(h)Any waters or wastes containing suspended solids of
such ctlaracter and quantity that unusual attention or
expense is required to handle such materials at the
sewage treatment plant.
(i)Any noxious or malodorous gas or substance capable
of creating a public nuisance.
(3)Grease,oil and sand interceptors shall be provided when,
in the opinion of the City Engineer,they are necessaryfortheproperhandlingofliquidwastescontaininggreaseinexcessiveamounts,or any flammable wastes,sand,andotherharmfulingredients;except that such interceptorsshallnotberequiredforprivatelivingquartersordwellingunits.All interceptors shall be of a type and capacity approvedbytheCityEngineerandshallbelocatedastobereadilyIandeasilyaccessibleforcleaningandinspection.
Section 12 .Power and Authority of Inspectors
The Public Works Director and other duly authorized employees of the CityofMosesLakeshallbepermittedtoenteruponallpropertiesforthepurposeofinspection,observation,measurement,sampling and testing,in accordancewiththeprovisionsofthisordinance.
Section 13.Partial Invalidity
The invalidity of any part of this ordinance shall not affect the validity of
any other part of this ordinance which can be given effect without suchinvalidpartorparts.
Section 14 .Violations
Any person,firm or corporation who violates any of the provisions of thisordinanceshall,upon conviction thereof,be subject to a fine of not morethan$300.00 or imprisonment not to exceed 90 days in the city jail,or both,I and shall also become liable to the City for any expense,loss or damageoccasionedtheCitybyreasonofsuchviolation.
Section 15.Emergency Clause and Effective Date
It is hereby declared that an emergency exists,the provisions of Section 23,Ordinance 379 are hereby waived,this ordinance shall be read only oncebeforeitspassage,and it shall take effect immediately upon passage.
