AN ORDINANCE OF THE CITY OF MOSES LAKE RELATING
TO INTOXICATING LIQUORS IN CITY PARKSAND RECREATION
AREASAND PROVIDING A PENALTY FOR THE VIOLATION
THEREOF AND DECLARING AN EMERGENCY
I Section 1.It shall be unlawful for any person or persons to consume or
have in their possession any intoxicating liquor while upon the premises of
a City Park,or a public parking lot in or adjacent to a City Park or a park
and recreation area or building maintained and operated by the City of Moses
Lake:PROVIDED that the foregoing shall not apply when a license has been
issued to possess and consume intoxicating liquor by the Washington State
Liquor Control Board .
Section 2 .For the purposes of this ordinance,the term "intoxicatingliquor"
shall be one and the same definition as liquor is defined in the Washington
State Liquor Law Code No.66.04.200.
Section 3 .For the purposes of this ordinance,a person shall be deemed in
possession of intoxicating liquor by knowingly being an occupant,passenger,
operator or in control of a vehicle containing intoxicating liquor.
Section 4.Any person or persons violating any of the provisions of this ordinance
shall be guilty of a misdemeanor and upon conviction thereof for the first offense,
shall be punished by a fine of not less than Ten ($10.00)Dollars which shall not
be suspended,nor more than Three Hundred ($300.00)Dollars.Upon the con-
viction of the second or subsequent offense shall be punished by a fine of not
less than Ten ($10.00)Dollars nor more than Three Hundred ($300.00)Dollars and
by imprisonment in the city jail for not less than thirty (30)days,which may not
be suspended,nor more than ninety (90)days .
