597_00001ORDINANCE NO.597 AN ORDINANCE AMENDING ORDINANCE NO.433 ENTITLED "THE COMPREHENSIVE ZONING ORDINANCEOPTHECITYOFMOSESLAKE,WASHINGTON"BY AMEND- ING THE USES AND CONDITIONS IN THE "CNS"ZONE THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS: I That Chapter 3.24.140.20 CNS Zone -Permitted Uses -Be amended as follows: (1)Hereafter in the "CNS"Zone,no building,structure,or land shall be used and no building or structure shall be erected,altered,enlarged or relocated which is designed or intended to be used for any use other than the following: 1.Art supply shop 2 .Auto accessory store 3.Autonobile service station (one only) 4.Bakery,retail products sold on premises 5.Barber shop and beauty shop 6.Book or stationary store 7.Clinics,medical and dental 8.Clothes pressing and spot cleaning 9 .Clothing store or tailor shop 10 .Confectionary or candy store 11.Delicatessen i 12.Drug store 13.Dry goods store,draperies,millinery,dressàhop 14.,Florist shop (excluding greenhouse) 15 .Furniture store and floor covering 16.Gift shop 17.Grocery,fruit or vegetable store,meat market,supermarket &lockers 18.Hardware or applance store 19.Hobby shop,fixit shop 2 0.Jewelry store 21.Laundry agency or self service (excluding laundryl 22.Music store,record shop 23.Offices (business or professional) 24.Photo Shop 1 25.Post office branch 26.Radio and TV shop127.Restaurant 28.Shoe store and shoe repair 29.Sporting goods store 30.Studios,music,art,dance 31.Variety store,5 &10 cent store 32.Accessory uses customarily incidental to the permitted uses,provided all such accessory uses are carried on entirely within a building Ordinance No.597:2 33.Other uses ruled by the Council under Section 3.24.310,2.0 of this chapter,to be similar to the above specified uses,and exceptions as permitted in Article II of this chapter. Conditions:In the "CNS"neighborhood shopping zone,a retail drug store and I retail food market shall be the first two buildings installed in this area.All merchandise shall be sold at retail only.All activity and storage except loading,unloading and automobile parking and refueling shall be conducted wholly within a building or enclosed by a sight obscuring screen not less than six feet high.All open areas,other than parking areas and walks,which are visible from an adjoining "R"zone shall be maintained in properly cared for lawn or shrubbery.Screening may consist of evergreen natural growth,or fences and walls may be used,except at locations in required yards where fences of such heights are prohibited by the fence regulations in Section 3.24.230.50 of this chapter.No materials or equipment shall be stored to a height greater than that of the enclosing screen.Establishments in the CNS zone may dispense beer on the premises under the limitations set forth in RCW 66.24.320 entitled 'Beer retailer's license -Class A'and provided,further,that the establishment dispensing beer pursuant to a Class A beer retailer's license issued by the Washington State Liquor Control Board shall not maintain on the premises where beer is dispensed pursuant to said permit,any cabaret,separate bar or separate barroom.1 (2)A comprehensive plot plan of the entire shopping area,showing all buildings, parking facilities ,loading areas ,inner curbs ,drains ,paving ,sign and light pylons ,walls , fences walks,roof lines approaches and plantings shall be approved by the City Planning Commission prior to issuing any building permit.Any change in development of the approved plan may be subject to additional approval of the City Planning Commission. (3)Residences shall be permitted only at the following locations:(a)on any lot having a side property line which adjoins an<"R"zone without an intervening street; (b)On any lot which has less than one hundred feet of frontage and has residences existing on all lots adjoining its side property lines; (c)On any lot forming a part of the frontage on one side of a street where over one-half of said lineal frontage between two intervening streets is developed in residences .Said residences shall be of the type permitted in the lease restrictive adjoining "R"zone and shall comply with the regulations of said 1 zone.Where no "R"zone adjoins,said residences may be of a type permitted in the "R3"zone and shall comply with the regulations of said zone.Residences in a "CNS" zone must be approved by the Planning Commission.
