625_00001CITY OF MOSES LAKE,WASHINGTON ORDINANCE NO.625 AN ORDINANCE approving and confirming the assessments and assessment roll of Local Improvement District No.24 which has been created and established for the purpose of theimprovementofthealleyparallelandnorthwestofBroadwayAvenuefromAlderStreettoAsh i Street by grading,graveling,constructing and installing storm drainage,curbs,sidewalks and asphaltic concrete pavement. WHEREAS,the assessment roll levying the sepcial assessments against properties located in Local Improvement District No.24 in the City of Moses Lake,Washington,created under Ordinance No.603,has been filed with the Clerk of the City of Moses Lake,as provided by law;and WHEREAS,notice of the time and place of hearing thereon and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law,fixing the time and place of hearing thereon for the 11th day of May,1971,at the hour of 8:00 o'clock p.m.(PDST), in the Council Chambers in the City Hall,Moses Lake,Washington,and further notice thereof was duly mailed by the City Clerk to each property owner shown on the roll;and WHEREAS,at the time and place fixed and designated in the notice the hearing was duly held and all protests in writing were read and submitted to the City Council and were by it overruled.,NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN as follows: Section 1.The assessments and assessment roll of Local Improve- ment District No.24,which has been created and established for the purpose of paying the cost of the improvement of the alley parallel and northwest of Broadway i Avenue from Alder Street to Ash Street by grading,graveling,constructingandinstalling storm drainage,curbs,sidewalks and asphaltic concrete pavement as provided by Ordinance No.603,as the same now stand,be and the same are hereby in all things and respects approved and confirmed. Section 2.Each of the lots,trpets,parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefited by the improvements in at least the amount charged against the same Ordinance No.625 Fage 2 and the assessment appearing against the same is in proportion to the several assessments appearing upon the roll.There is hereby levied and assessed against each lot,tract,parcel of land and other property appearing upon the roll the i amount finally charged against the same thereon. Section 3.The assessment roll as approved and confirmed shall be filed with the Treasurer of the City of Moses Lake for collection and said City Treasurer is hereby authorized and directed to publish notice as req- uired by law stating that said roll is in his hands for collection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty days from the date of the first publication of the notice without penalty,interest or cost,and that thereafter the sum remaining unpaid.may be paid in ten equal annual installments with interest thereon hereby fixed at the i rate of 6.5%per annum.The first installment of assessments on the assessment roll shallabf ect heeddaetea dp ydpleb1di at nÅ’beythhe Ci y Trperi d ucceeding the daete assessment rollis in her hands for collection and annually thereafter each succeed- ing installment shall become due and payable in like manner.If the whole or any portion of the assessments remains unpaid after the first thirty-day period,in- terest upon the whole unpaid sum shall be charged at the rate of 6.5%per annum and each year thereafter one of the installments,together with interest due on the whole of the unpaid balance,shall be collected.Any installment not paid prior to the expiration of the said thirty-day period during which such installment is due and payable shall thereupon become delinquent.All delinquent installments shall be subject to a charge for interest at 6.5%per annum and for an additional I charge of 5%penalty levied upon both principal and interest due upon such install- ment or installments .The collection of such delinquent installments will be enforced in the manner provided by law. This Ordinance was considered by the City Council at Public Ordinance No.625 Page 3 Hearing,therefore the provisions of Section 17,Ordinance No.474,are hereby waived and this Ordinance shall be adopted on the date of its first introduction and after its first reading. PASSED by the City Council of the City of Moses Lake,Washington, ,at a regular meeting thereof,and APPROVED by the Mayor this 11th day of May, 1971.
