AN ORDINANCE RELATING TO FIREWORKS:REGULATING THE SALEAND
i USE THEREOF WITHIN TÚE CORPORATE LIMITS OF THE CITY OF MOSES IAKEANDPROVIDINGPENALTIESFORTHEVIOLATIONOFTHISORDINANCEANDREPEALINGORDINANCENUMBER132,AND ALL OTHER ORDINANCES
.AND PARTSOF ORDINANCES IN CONFLICT THEREWITH.
BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF MOSES LAKEAS FOLLOWS:
SECTION 1.PERMIT REQUIRED FOR SALES-APPLICATION.It shall be unlawful for any persontoofferforsaleatretailorwholesale,or to sell at retail or wholesale,any fireworks within the City
.of Moses Lake without having first obtained a permit to do so.Application for such permit shall be madeinwritingtotheChiefofthePireDepartmentoftheCityofMosesLakenolaterthanJune15oftheyear
.for which the permit is sought on forms provided for that purpose.The Chief of the Fife Department shallmakeaninvestigationandsubmitareportofhisfindingsandhisrecommendationfororagainsttheissuanceofthepermit,together with his reasons therefor,to the Moses Lake City Council.The CityCouncilshall,.deny or grant any such application subject to such reasonable conditions,if any as it may prescribe.A permit shall not be issued unless the applicant is the holder of a validItcenseissuedbytheStateFireMarshaltodotheparticularactoractsprescribedinthepermitasrequiredbyR.C.W.Ghapter 70.77,and unless applicant files with the Chief of the Fire DepartmentacertificateofinsuranceintheminimumamountofFiveHundredThousandDollars($500,000)combinedsinglelimitcovering.bodily injury liability,property damage liability,including products liability,premises liability and contractual liability,with the applicant named as insured thereon;and which alsoshallname,as additional insured parties,the City of Moses Lake,its officers and employees acting intheircapacityasagentsoftheCityofMosesLake.
SECTION 2..PUBLIC DISPIAY-EMPLOYlÅ¡E COlvÌPENSATION INSUlmNCE-LIABILÌTY INSUPANCE.The applicant for a permit for a public display of fireworks shall,at ute time of application,submit his lic-ense for inspection and furnish proof that he carries compensation insurance for his employees as providedibythelawsoftheStateofWashington,and he shall file with the Chief of the Fire Department a certificateofinsuranceintheminimumamountofFiveHundredThousandDollars($500,000)combined single limitcoveringbodilyinjuryliability,property damage liabliity,including products liability,premises liabilityandcontractualliability,with the applicant named as insured therein and which shall also name,asadditionalinsuredparties,the City of Moses Lake,its officers and employees acting in their capacityasagentsoftheCityofMosesLake.
SECTION 3.Any person,firm or corporation who shall violate or fail to comply with any of theprovisionsofthisOrdinance,or who shall.counsel,aid or abet any such violation or failure to comply
.,shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in anysumnotexceedingFiveHundred(3500)Dollars,or by imprisonment in the City-Jail for a term not exceedingninety(90)days,or by both fine and imprisonment.
SECTION 4.That Ordinance Number 132 he and the same is hereby repealed.
SECTION 5.This Ordinance shall be in force and take effect after its passage and publicationasprovidedbylaw.
