AN ORDINANCE AMENDING ORDINANCE NO,433 WHOSEITITLEIS"THE COMPREHENSIVE 2ONING ORDINANCE OFTHECITYOPMOSESLAKE,WASHINGTON"BYADDING ARESIDENTIALUNITDEVELOPMENTSECTION.
NOW THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTONDOORDAINASFOLLOWS:
.That Section 3,24.110.130 of Ordinance No.433,as amended,be,amended to read as fonows:
3.24.110.130 LOT.A parcel of land on which a principal use or build-ing and its accessory buildings are placed,together with the requiredopenspaces.For the purpose of determiníng the location of requiredyards,a lot shan be considered to be as shown on the official recordedplatoftheproperty,when a tract of land officially recorded on theplatrecordsistobedevelopedformorethanoneprimarybuildingoruse,it shall be subdivided into individual lots for each primary useandrecordedassuchontheplatrecordsunlesslocatedwithinanapprovedResidentialUnitDevelopment.(0.433 Section 110.130-1961)
Section 2.That Section 3.24.120.20 of Ordinance No.433,as amended,beamendedbyaddinganewsubsection14toreadasfollows:
14.Residential Unit Developments (RUD)may be developed inaccordancewithSection3.24.210.90 of thîs ordinance.
Section 3.That Ordinance No.433 as amended,be amended by adding a newIsectiontoreadasfoHows:
3.24.210.90 Residential Unit Developments (RUD)may be developed intheR-1,R-18 and R-2 districts after approval of the Planning Commissioninaccordancewiththerequirementsofthedistrictinwhichitislocatedandthefollowingadditionalminimumrequirements:1.General Standards:In granting approval for a RUD,the PlanningCommissionwîllbeguidedbythepoliciesoftheCityaswellasstandardsandrequirementsinthissection,a.The RUD shall conform with the Comprehensîve Plan of the Cityb.The RUD shall be compatible with adjacent land uses and willnotadverselyaffectthecharacteroftheareainwhichitislocatedc.The RUD win be designed to adequately handle the traffic itgeneratesthroughstreetimprovementsandparkingareas.2 .Development Standards:
a.The parcel shall contain a minimum of two acres having aminimumdimensionof150feet,b.The RUD shall have permanent access to a public street that isdesignedtoadequatelycarrythetrafficitgenerates.3.Density Standards:
a.Residential units of any type (i.e.single family,duplex,townhouses,etc.)or combination of types which meet theCityBuildingCodesmaybeconstructedwithinaRUD.b.The gross density of a RUD cannot exceed six units peracreinenR-1 or R-18 District,or ten units per acre in anR-2 District.4.Roadways and Parking:a.All roadways within a RUD shalibe paved to a minimum width of 18'.b.Off street parking spaces shall be provided at the ratio of twospacesperunit,unless on-street parking is available,inwhichcasethePlanningCommissionmayallowittosubstituteforuptohalftheminimumoff-street parking requirement.c.Roadways within the RUD shall be designed to carry emergencyvehicles,d.Dedicated street right of way may be required for through streets.
5.Utilities:
a.All utilities and roadways shall be installed as stated in the
plan before building permits are issued,
b.All utilities,including electricity and telephone shall be
installed and underground.
c.Sewer lines shall be installed to City standards.
d.Water lines shall be installed to City standards ard capable
of providing enough water for fire protection.
e.Storm sewers shall be installed when required by the City Engineer.
6.Ground Surfaces shall be landscaped and maintained in a manner that
wül not create dusty or muddy conditions.
7.Preliminary Plans Required:The applicant shall submit a map drawn
to scale showing the following:
a.Boundaries of proposed RUD.
b.Location of roadways and streets within and adjacent to the
proposed RUD.
c.Location and dimensions of all buildings.
d,Off-street parking spaces,
e.Landscaping.
f.Written statement outlining the general time schedule for
proposed development.
8.Planning Commission Review and Approval:Upon receiving an
application för a RUD,the following steps shall be taken:
a.The Planning Commission.shall call a public hearing as stated
in Section 3.24.350.20 of this ordinance,
b.The Planning Commission,following the public hearing,reviews
the proposal in terms of the guidelines and regulations in the section,
c.The Planning Commission after reviewing the application may:
1)give preliminary approval,2)give preliminary approval-
subject to specific changes,.or 3)deny the application as not
meeting the requirements or standards of this ordinance,
d.If no major changes have been made in the prelíminary plans,
the Zoning Administrator may grant final approvel.If any major
changes are made from the preliminary plans,revised plans shall
be presented the the Planning Commission for final approval.
Approved RUD's shall be indicated on the official City Soning map,
e.Certificates of occupancy shall not be issued within a RUD .
until final approval has been granted,or a bond has been
posted to cover the uncompleted work.
9.No major changes or construction may be made within a RUD after
it has received fînal approval without approval of the Planning
Commission.
10.Prelimiriary approval of a RUD shall expire twelve months from the date.
It was granted if a building permit has not been issued for construction.
Section 4.That Section 3.24,220.20 or Ordinance No.433 as amended,be amended
to read as fonows:
3.24.220.20 AREAREGUTATIONS-RESIDENCES ON LARGETRACTS.A platted
tract served by a public street containing sufficient area to meet the area re-
quirements may be occupied by no more than one residence which fronts on
said street,unless constructed within an approved ResidentiëÏUnit Develop-
ment.Said residence shall be of a type permitted in the.zone wherein it may
be situated,and shall comply with the area.,yard,and building coverage
regulations of said zone.No building may be constructed on unplatted property
or by a metes and bounds description on a portion of a filed plat in any zone,
until all requirements of Chapter 3.20 of this code,and íts amendments are
complied with.(0.433 Section 220.20--1961)
Section 5.That Section 3.24.224.10 subsection 1 or Ordinance No.433,as amended,
be amended to read as follows:
3.24.220.10 AREAREGUIATIONS-MINIMUM LOT SIZE FOR RESIDENCES.
1.No residence shall be erected,except within an approved RUD on any
lot which has a width of less than fifty feet,or an average depth of less -
than eighty feet,or an area of less than six thousand square feet,except
in the "Rl"and "R18 zones wherein the minimum area shall be seventy-two
hundred square feet except as follows:
i Exceptions:The following exceptions shall be allowed only on lots
located where residences are a permitted use.One one-family residence
may occupy any lot which was of record prior to December 14,1954,or
any lot having an area not less than six thousand square feet,and which
was of record at the time of the passage of this chapter (See Section 3.24.370,30).
Through lots having an area of.twelve thousand square feet or more which
were of record at the passage of this chapter,may be occupied by two
residences provided each shall front on opposite streets,shall have a
lot area not less than six thousand square feet and shall provide front,
side,and rear yards as if the lot were platted into two lots fronting the
opposite streets.All yard,height,and off-street parking regulations of
the zone wherein such lots are located shall be complied with.
