AN ORDINANCE VACATINGAN ALLEYIN BROADRIPPLE ADDITION
TO THE CITY OF MOSES IAKE
IWHEREAS,a Resolution was passed by the City Council of the City of Moses Lake on the 26th day of
September,1972 fixing the 24th day of October,1972 at 8:00 p.m.as a time for Public Hearing on the
advisability of vacating an alley in the Broadripple Addition to the City of Moses Lake,
WHEREAS,no objections to the alley vacation were voiced at the Public Hearing,
NOW THEREFORE,BE IT ORDAINED by the City Council of the City of Moses Lake as follows:
Section 1.That the alley in the Broadripple Addition of Moses Lake,described as follows:
Beginning at the S.W.oorner of Section 23 of T19N,R28 FNM,thence
North 0 03'50"E a distance of 69.89';thence North 18°49'30"E for adistanceof251.90':thence South 89 56'10"E for a.distance of 137.29'
to the True Point of Beginning.Thence continuing South 89 56'10"E adistanceof21.12';thence North 18 49'30"E.for a distance of 105.61';
thence North 89°56'10"W a distance of 21.12';thence South 18°49'30"W
g distance of 105.61'to the True Point of Beginning.
is hereby vacated.
Section 2.The City of Moses Lake hereby reserves an easement over,under,and across said real
estate above described,and the whole thereof,for utility purposes with the right of ingress and egressthereto.
Section 3.The City of Moses Lake hereby requires the receipt of a payment totalling one half of the
appraised value of said real estate above described,from the two owners adjacent to said real estate
prior to the final passage of this ordinance.
Section 4.A Public Hearing has been held regarding the vacation of this alley.Therefore,the provisions
of Section 17 of Ordinance 474 are hereby waived.This ordinance shall only be read once before its
passage and shall take effect immediately after passage and publication.
PASSED by the City Council and APPROVEDby its Mayor this 14th day of NOVEMBER ,
1972.
