AN ORDINANCE AMENDING CHAPTER 3.24 OF THE MOSES LAKECITYCODEENTITLED"ZONING CODE"BYADDING SECTIONSREGULATINGSTORAGEANDDISPLAY,DEFINING AN AUTO WRECKINGYARD,AND REPEALINGORDINANCE NO.654
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN ASFOLLOWS:
M.That Chapter 3.24.110 of the Moses Lake City Code entitled "Zoning Code -Definitions"be amended by adding the following section:
3.24.110.026 Auto Wrecking Yard Any lot or area used for the dismantling or dis-assembling of motor vehicles or trailers,or the storage,sale or dumping of four ormoredismantled,partially dismantled,obsolete or wrecked vehicles or their parts.
.That Chapter 3.24.140 of the Moses Lake City Code entitled "Zoning Code -CNS 2one",be amended by adding the following section:
3,24.140.65 "CNS"Zone Storage and Display Merchandise,equipment,suppliesandothersimilarmaterialsbeingstoredshallbekeptwhollywithinabuildingorsightobscuringscreeningorfencing.Screening or fencing shall be constructed andmaintainedtoaheightofatleastsixfeetandshallbeinconformancewithSection3.24.230.50.Materials required to be stored within a sight obscuringfenceshallnotbestackedorpîledhigherthantheenclosingscreen.Storage ofnurserystock,operative automobiles,farm machinery,trailers,mobile homes,boats,and other similar items for rent or resale may be allowed in an open sales lot or nexttotheplaceofbusiness.
Open outdoor displays of merchandise are permitted on priva+e property when theyIarelocatedsuchthattheydon't interfere with parking,traffic,or pedestrian move-ment and are changed at least every sixty (60)days.Displays may consist ofChristmastrees,bedding plants,peat mosa,or presto logs arranged in an orderlymanner;larger items such as swing sets,stock racks,or utility buildings whennotmorethanone(1)of a model is displayed.
Section 3,That Chapter 3.24.145 af the Moses Lake City Code entitled "Zoning Code -CI Zone",beamendedbyaddingthefollowingsection:
3.24.145.80 "CI"Zone Storage and Display Merchandise,equipment,suppliesandothersimilarmaterialsbeingstoredshallbekeptwhollywithinabuildingorsightobscuringscreeningorfencing.Screening or fencing shall be constructed andmaintainedtoaheightofatleastsixfeetandshallbeinconformancewithSection3.24.230.50.Materials required to be stored within a sight obscuring fence shallnotbestackedorpiledhigherthantheenclosingscreen.Storage of nursery stock,operative automobiles,farm machinery,trailers,mobile homes,boats,and othersimilaritemsforrentorresalemaybeallowedinanopensaleslotornexttotheplaceofbusiness.
Open outdoor displays of merchandise are permitted on private property when they arelocatedsuchthattheydon't interfere with parking,traffic,or pedestrian movement andarechangedatleasteverysixty(60)days.Displays may consist of Christmas trees,bedding plants,peat moss,or presto logs arranged in an orderly manner:larger itemssuchasswingsets,.stock racks or utility buildings when not more than one (1)of amodelisdisplayed.
Soction 4.That Chapter 3.24.150 of the Moses Lake City Code entitled "Zoning Code -CM Zono",heamendedtoreadasfollows:
i 3.24.150.20 "CM"Zone Permitted Uses.Hereinafter in the "CM"sone no building,structure,or land shall be used and no building or structure shall be erected,altered,enlarged,orrelocated.which is designed or intended to be used for any use other than the following:

(1)Any business use permitted in the "Cl"zone.
(2)Amusement parks for children,including merry-go-round,pony riding rings,
and similar uses.
(3)Baat sales establishments.
(4)Contractors'offices.
(5)Drive-in restaurants.
(6)Nurseries and commercial greenhouses.
(7)Open sales lots as permitted in the "Cl"zone.
(8)Pet shops,excluding kennels.
(9)Plumbing and heating shops.
(10)Public garages,including body-fender work and painting.Tire recapping
is prohibited except on lands adjoining West Broadway west of the inter-
section of West Third Avenue and West Broadway and any additional lands
lying adjacent to West Broadway which may be zoned "CM"light commercial
in the future.There shall be no combustible storage exceeding one thousánd
cubic feet by volume outside of an enclosed building or covered structure.
Combustible materíals shall be kept at least five feet from adjacent property
lines,and a sight obscuring fence as approved by the Building Department
shall be provided to congeal outside storage.Where a solid masonry or
concrete fence or wall approved by the Building Inspector is provided at
a property line to a height three feet higher than the combustible storage,
the storage shall be permitted not to exceed twenty-five hundred cubia feet
by volume adjacent to the fence or wall.No fence or wall exceeding four
feet in height or any storage or operation will be permitted in a front yard.
An approved fence shall mean any type of fence the Building Inspector shall
consider proper for the protection of property and adequate for presenting en
attractive and pleasing appearance to the public view,
(11)Public and private schools.
(12)Residences,provided the yard regulations of the "R3"zone,and all other
regulations are complied with,ex.cept the "R3"regulations shall not apply
to multi-family residences unless the lot adjoins an "R"zone.
(13)Secondhand stores.
(14)Service stations,provided that any station adjoining a lot in an "R"zone
shall be improved in compliance with the regulations in Section 3.24.260.50.
The storage of fuel oil at duly authorized service stations for delivery to
the consumer by means of trucks at the place where the fuel oil is to be
consumed may be allowed by special permit from the Commission upon due
proof that such storage facility and operation thereof will not be unduly
detrimental to surrounding properties and provided that said storage stiall
be underground and no truck shall be parked or stored on the premises
except duríng actual refueling operations.A six feet by six feet inner
curb between access driveways may be required by the Commission for
the protection of pedestrian traffic.Accesa drives shall comply with the
community standards ordinance.Liquefied petroleum in approved above-
ground containers,not exceeding two thousand gallon capacity,may be
permitted for resale purposes if all other ordinances and regulations have
been complied with and after being approved by the City Fire Department.
(15)Taverns,by special permission of the Commission upon due proof that
such activity will not be unduly detrimental to surrounding propertíes and
create a special policing problem.
(16)Warehousing for movers and commercial haulers may be permitted by
special permission from the Planning Commission after a finding that
adequate parking and access can be obtained.
(17)Accessory uses,buildings and structures ordinarily appurtenant to any of
the above uses,
(18)Other uses ruled by the Council under Section 3.24.310.20 to be similar
to the above specified uses,and exceptions as permitted in Article 2 of
this chapter (Sections 3.24.210--3.24.270).
