NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASil!NGTON DO ORDAIN AS
FOLLOWS:

(1)The folowing shall be the monthly rato charged for water from the city water

9.6.08 COMMBCIAL WATTE RATES
(1)The-following shall be the monthly rate charged for water from the city water system
for commercial users and dwellings with two or more living units served by one meter:

Section 3•That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer Rates",-Section9.6.12,"Residential Sewer Rates"be amended to read as follows:
9.6.12 RESIDENTIAL SEWER RATES The followîng shall be the monthly ratechargedforsewerservicefromtheCitysewersystemforsinglefamilydwellingsandeachunitofaduplexwithseparatemeters:

Section 4.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer Rates"be amended by adding a new section to read as follows:
9.6.13 COMMERCIAL SEWER RATES
(1)The following shall be the monthly rate charged for all chargeable water dis-charged into the City sewer system by commercial users and dwellings with
two or more Ilying units served by one meter:
Up to -1000 C.F.33.00/month (minimum)1001 -15000 C.F.0.20/100 C.F.
(2)For purposes of calculating sewer charges,chargeable water shall be defined
as follows:
Chargeable water shall be measured by the water consumed on the premises,whatever the source of such water,and the same will be metered either by
a public utility meter or one installed and maintained by the owner of thepremisesathisownexpenseandapprovedbytheCity.Where the use of
water is such that a portion of all the water used does not flow into.theisewersystem,but is lost.by evaporation,irrigation,sprinkling,or is usedinmanufacturingorinamanufacturedproduct,and the person in controlprovidesproofofthisfactandinstallsameterorothermeasuringdeviceapprovedbytheCitytomeasuretheamountofwatersousedandsolost,this water may be deducted from the actual water consumption used incalculatingthesewercharge.
The sewer charges for duplexes and apartments,mobile home parks,motels,schools,and hospitals during the irrigation season shall be computed ontheaverageconsumptionduringthepreviousnon-irrigation season,unless.the user elects to install,at his expense,an approved measuring devicetomeasurewaternotenteringthesewersystem.When a user has a swimm-ing pool or an air conditioner discharging to the sanitary seger,he mustinstallanapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shall be definedastheperiodofMaythroughOctober.
(3)Special Commercial Sewer Rates:Sewer rates for Commercial uses dischargedinexcessof10,000 cubic feet per month may be separately determined bytheCityCouncil,based upon both volume and chemical characteristics ofthesewage.The City Council reserves the privilege to require pretreatmentofanymaterialdischargedintotheseweragesystem,or to prohibit dischargeintothesystemofindustrialwastesthat,because of either volume or concentra-ti,an will overload existing sewerage facilities.
(4)Air conditioning and refrigeration:All air conditioning and refrigeration unitsthatareinstalled,replaced,or that have capacity increased after the effectivedateoftheordinancecodifiedinthischaptershallberequiredtoInstallre-circulating units,Disposal may not be accomplished by discharging into thesanitaryseweragesystem.
(5)The foregaing chartjes in no way alter or repeal any rules and/or regulationsipreviouslyenactedbyordinancesregardingthesewersystemofthecity ofMosesIake.

amended by adding a new section to read as follows:
9.6.30 TIRE PROTECTION CHARGES
(1)Metering shall not be required for fire protection lines running directly tobuildingswhenusedsolelyforfurnishingwatertosprinkler,deluge or other

fire protective systems,Water flow alarms shall be provided in all fire pro-
tection sprinklerTnstallations.Such alarms shall be either water motor or
electric goncjs,except where alternate devices are specifically approved by
the city.
(2)Water supplied to underground tanks or other private systems from which water
is pumped for fire protection service shall be metered and payment shall be
made in accordance with the established rate for commercial accounts.
Section 6.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer Rates"
be amended by adding a new section to read as follows:
9.6.31 EFFECTIVE DATE
The effective date of Sections 9.6.04,9.6.08,9.6.12,9.6.13,9.30,9.32,shall be
March 22,1973.
Section 7.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer Rates",-Sec.
9.6.32,"Penalties"be amended to read as follows:
9.6.32 PENALTIES.
Any person,firm or corporation who violates any of the provisions of this
chapter shall,upon conviction thereof,be subject-to a fine of not more
than five hundred dollars ($500)or imprisonment not to exceed ninety (90)
days in the City jail,or both.
Section 8..SEVERABILITY.
The invalidíty of any part of this ordinance shall not affect the validity of
any other part d this ordinance which can be given effect without such
invalid part or parts.
