AN ORDINANCE AMENDING CHAPTER 9.10 OF THE MOSES LAKE CITY CODEENTITLED"WATERAND SEWER RATESAND REGULATfONS FOR LARSON AIR FORCEBASEPROPERTY"BY INCREASING THE WATER AND SEWER RATES:ADDING A SECTIONiESTABLISHINGCOMMERCIALSEWERRATESBASEDUPONWATERDISCHARGEDINTOTHECITYSEWERSYSTEM:AMENDING A SECTION PERTAINING TO FIRE PROTECTIONSYSTEMCHARGES;AND AMENDING THE PENALTY PROVISIONS.
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES IAKE,WASHINGTON DO ORDAIN ASFOLLOWS:
Section 1.That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and Sewer RatesandRegulationsforLarsonAirForceBaseProperty",Section 9.10.04 "Residential Water'Rates be amendedasfollows:
9.10.04 RESIDENTIAL WATER RATES
(1)The following shall be the monthly rate charged for water from the municipallyownedwatersystemforsinglefamilydwellingsandeachunitofaduplexwithseparatemeters:

(3)The Master metering of the entire housing area will be permissible with watersoldthroughaprogramofmastermeteringbaseduponthecommercialratestruc-ture.In addition to the commercial rate through master meters,a flat rate ofthreedollarsandseventy-five ($3.75)per month will be charged for each occupiedlivingunitforwaterservices.The City may,at its option,require individual metering.
Section 2,That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and Sewer Rates andRegulationsforLarsonAirForceBaseProperty",Section 9.10.08 "Commercial Water Rates,be amended asfollows:
9.10.08 COMMERCIAL WATER RATES
(1}The following shall be the monthly rate charged for water from the municipallyownódwatersystemforcommercialusersanddwellingswithtwoormorelivingunitsservedbyonemeter:

That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and Sewer Rates and .
Regulations for Larson Air Force Base Property",-Section 9,10.12 "ResidentialsewerRates",be amended
as follows:
9.10.12 RES1DENTIALSEWER RATES
(1)The following shall be the monthly rate charged for sewer service from the
municipally owned sewer system for single family residences and each
unit of a duplex that is either unmetered or has separate meters:
Flat Rate -$6.00/month
Section 4.That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and Sewer Rates and
Regulations for Larson Air Force Base Property",be amended by adding a new section to read as follows:
9.10.14 COMMERCIAL SEWER BATES
(1)The following shall be the monthly rate charged for all chargeable water
discharged into the municipally owned sewer system by commercial users
and dwellíngs with two or more 11ving units served by one meter:
Up to -1000 C.F.$5,00/month (minimum)
1001 -15000 C.P.0.40/100 C.F.
15001 -35000 C.F.0.35/100 C.F.
all over 35000 C.F.0.30/100 C.F.
(2)For purposes of calculating sewer charges,chargeable water shall be defined as follows:
Chargeable water shall be measured by the water consumed on the premises,
whatever the source of such water,and the same will be metered either by
a public utility meter or one installed and maintained by the owner of the
premises at his own expense and approved by the City.Where the use of
water is such that a portion of all the water used does not flow into the
sewer system,but is lost by evaporation,irrigation,sprinkling,or Is used
in manufacturing or in a manufactured product,and the person in control
provides proof of this fact and installs a meter or other measuring device
approved by the City to measure the amount of water so used and so lost,
this water may be deducted from the actual water consumption used in
calculating the sewer charge.
The sewer charges for duplexes and apartments,mobile home parks,schools,
hospitals,and motels during-the irrigation season shall be computed on the
average consumption during the previous non-Irrigation season,unless the
user elects to install,at his expense,an approved measuring device to
measure water not entering the sewer system.When a user has a swimming
pool or an air conditioner discharging to the sanitary sewer,he must install
an approved meter to determine the amount of water exempt from sewer charges
during the irrigation season.The irrigation season shall be defined as the
period of May through October.
(3)Special Commercial Sewer Rates:Sewer Rates for Commercial uses discharged
in excess of 10,000 cubía feet per month may be separately determined by the
City Council,based upon both volume and chemical characteristics of the sewage.
The City Council reserves the privilege to require pretreatment of any material
discharged into the sewerege system,or to prohibit discharge into the cyctem of
industrial wastes thet,because of either voluma er concentration will overload
existing sewerage facilities.
.(4)Air conditioning and refrigeration:All air conditioning and refrigeration units
that are ínstalled,replaced,or that have capacity increased after the effective
date of the ordinance codified in this chapter sha11 be required to install recircu-
lating ùnits.Disposal may not be accomplished by discharging into the sanitary
sewerage system.

as follows:
9.10.28 FIRE PROTECTION CHARGES
(1)Those agencies or fir ms that control property within the area served by the
water system will be charged the sum of twenty dollars ($20.00)per hydrant
per yea,in payment to the City Water Department as reimbursement to the Cityfortheexcesswaterfacilitiesrequiredtoprovidefireprotectionservicesandtopayfortestingandmaintenanceoffirehydrants.Water use through firehydrantsineventoffirewillbeestimatedandbilledtotheagenciesforwhich
water was used in accordance with the commercial rate structure.The City
reserves the right to deactivate those hydrants located in open areas where
no building can be served from the hydrant,in which event the fire protection
charge will also be waived.
(2)Metering shall not be required for fire protection lines running directly
to buildings when used solely for furnishing water to sprinkler,deluge orotherfireprotectivesystems.Unmetered water used through such system in
event of fire will be estimated and billed in accordance with the commercial
rate structure,Water flow alarms shall be provided in all fire protection
sprinkler installations.Such alarms shall be either water motor or electrîc
gongs,except where alternate devices are specifically approved by the city.
(3)Water supplied to underground tanks or other private systems from which
water is pumped for fire protection service shall be metered and paymentshallbemadeinaccordancewiththeestablishedrateforcommercialaccounts,

9.10.31 EFFECTIVE DATE
The effective date of Sections 9.10.04;9.10.08;9.10.12;9.10.14;9,10,28:and 9.10.84,shall be March 22,1973.
Section 7,That Chapter 9.10 of the Moses Lake Municioal Code entitled "Water and Sewer Rates andRegulationsforLarsonAirForceBaseProperty,".-Sec.9.10.84 "Violafions",.be amended as follows:
9.10.84 VIOIATIONS
Any person,firm or corporation who violates any of the provisions of thischaptershall,upon conviction thereof,be subject to a fine of not morethanfivehundreddollars($500),or imprisonment not to exceed ninety (90)days in the City jail,or both,and shall also become Deble to the city for
any expense,loss or damage occasloned the city by reason of such violation.
Section 8.SEVERABILITY
The invalidity of any part of this ordinance shall not affect the validity of
any other part of this ordinance which can be given effect without suchinvalidpartorparts.
PASSED by the City Council of the City of Moses Lake and APPROVED by its Mayor this 13
day of March 1973.
