683_00001ORDINANCE NO.683 AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSEMENT ROLL OF LOCAL IMPROVEMENT DISTRICT.NO.28,WHICH BAS BEEN CREATED .AND ESTABLISHED FOR THE PURPOSE OF THE IMPROVEMENT OF THE ALLEY BETWEEN DIVISION AND ALDER STREETS RUNNING FROM FOURTH TO FIFTH AVENUES,BY GRADING,GRAVELING,CONSTRUCTING,AND INSTALLING -ASPHALT CONCRETE PAVEMENT,AS PROVIDED BY ORDINANCE NO.672 AND LEVYING AND ASSESSING THE AMOUNT TEEREOF AGAINST THE SEVERAL LOTS, TRACTs,PARCELS OF IAND AND OTHER PROPERTY SHOWN ON THE ROLL . WHEREAS,the assessment roll levying the special assessments against properties located .in Local Improvement District No.28 in the City of Moses Lake,Washington,created under Ordinance No.672,has been filed with the City Clerk of the City of Noseh Iake,as provided by law,•and, WHEREAS,notice of the time and place of hearing thereon and making objections and proiests to said roll was duly published at and for the time and in the manner provided by law,fixingthetimeandplaceofhearingthereonfor.the 8th of Tanuary ,1974,at the hour of 8:00 P.M.(PDS ,.in the Council Chambers in the city Hall,Moses Lake,.Washington,and further notice thereof was duly mailed by the City Clerk of the City.of Moses Lake to each prpperty ownershownontheroll;and, WHEREAS,at the time and place fixed and designated in the notice,the hearing was auly heldandallprotestsinwritingwerereadandsubmittedtotheCityCouncilandwerebyitover-ruled, i NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,MSHINGTON DO ORDAIN AS.FOLLOWS: Section 1.The assessments and assessment roll of Local Improvement District No.28,which has been crea ed and established for the purpose of paying the cost of improvement of thealleybetweenDivisionandAlderStreets,running from Fourth to Fifth Avenues by grading,graveling,and constructing and installing asphalt concrete pavement as provided by Ordinance No.672,as the same now stand,be and the same are hereby in all things and respects approved and confirmed. Section 2.Each of the lots,tracts,parcels of land and other property shown.upon the roll is hereby determined and declared to be especially benefited by the improvements in at ledst the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon the roll.There is hereby levied and . assessed against each lot,tract,parcel of land and other property appearing.upon the roll the amount finally charged against the same thereon. Section 3.The assessment roll as approved and confirmed,shall be filed with the Treasurer of the City of Moses Lake for collection and said city Treasurer is hereby authoriz,ed and directed to publish notice as required by law,stating that said roll is in his hands for col-lection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty (30)days from the date of,the first publication of the notice without penalty,interest or cost,and that thereafter the sum remaining unpaid may be paid in tenequalannualinstallmentswithinterestthereonherebyfixedattherateof-6.5%per annum.The first installment of assessments on the assessment roll is in his hands for collectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlike manner.If the whole,or any portion of the assessments,remains unpaid after the first thirty (30)day period,interest upon the whole unpaid sum shall be charged at the rate of 6.5%per annum and each year thereafter one of the installments,.together witt interest dueionthewholeoftheunpaidbalance,shall be collected.Any installment not paid prior to the expiration of the said thirty (30)day period during which such installment is due and payable,shall thereupon become delinquent.All delinquent installments shall become sd>- ject to a charge for interest at 6.5%per annum and for an additional charge of 5%penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments will be enforced in the .manner provided by law. Ordinance No.:2 This ordinance was considered by the City Council at Public Rearing,therefore,the provisions of Section 17,Ordinance No.474 are hereby waived and this ordinance shall he adopted on the date of its first introduction and after its first reading.
