AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO.27,WHICH HAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF THE IMPROVEMENTOF THE AREA ON KNOLLS VISTA DRIVE FROM RIDGE ROAD TO PINE STRE"I BY GRADING,GRAVELING,CONSTRUCTING, AND IlbTALLING STÓRM DRAINAGE,CURBS.,SIDEWALKS AND ASPflALT CONCRETE PAVEMENT,AS PROVIDED BY ORDINANCE NO.647 AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS,TRACTS,PARCELS OF LAND AND OTHER PROPERTY SHOWNON THE ROLL WHEREAS,the assessment roll levying the special assessments against the properties located in Local Improvement District No.27.in the City of Moses Lake;Washington,created under Ordinance No.647,has been filed with the city clerk of the city of kbses Lake,as provided by law;and, WHEREAS,notice of the time and place of hearing thereon and making dbjections and protests to said roll was duly published at and for the time and in the manner provided by law, fix;Lng the time and place of hearing thereon for the 12th of February .,1974,at the hour of 8:00 p.m.(PDST),in the council Chambers in the City Hall,E ses Lake,Washington,and further notice thereof was duly mailed by the City Clerk of the City of Moses Lake to each .property owner shown on the rolly and, WHERRAS',at the time and place fixed and designated in the notice,the hearing was duly held and all protests in writing were read and submitted to the City Conncil and were by it over-ruled: NOW,.THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAIƒ,WASHINGTONDO ORDAIN AS FOLLOWS: Section 1.The assessments and assessment roll of Local Improvement District No.27,which has been created and established for the purpose of paying the cost of improveraent of the area on Knolls Vista Drive from Ridge Road to Pine Street by grading,graveling,constructing, and installing storm drainage,curbs,sidewalks,and asphalt concrete pavement,as provided by Ordinance No.647,as the same now stand,be and the same are hereby in all thipgs and respects approved and confirmed. Section 2.Each of the lots,tracts,parcels of land and other property shown upon the roll is hereby determined and declared to be especially benefited by the improvemente in'at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon the roll.There is hereby levied and assessed agaias:each lot,tract,parcel of land and other property appearing upon the roll the amount finally charged against the same thereon. Section 3.The asacasment roll as approved and confirmed,shall be filed with the Treasurer of the City of Moses Lake for collection and said City Treasurer is hereby authorized and directed to publish notice as required by law,stating that said roll is in his hands for collection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty (30)days from the date of the first publication of the notice without penalty,interest,or cost,and that thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon,hereby fixed at the rate of 6.5¾per annom.The first installment of assessments on the assessment roll is in his hands for collection und annually thereafter each succeeding installmmat shall become due and pay-able in like manner.If the whole,or any portion of the assesumnts,remains unpaid after the first thirty (30)day period,interest upon the whole unpaid sum shall he charged at the rate of 6.5%per annum and each year thereafter one of the installments,together with interest due on the whole of the unpaid balance,.shall be collected.Tag·installment not paid prior to the expiration of the said thirty (30)day period,during which such installment is due and payable,shall thereupon become delinquent.All delinquent installments shall become subject to a charge for interest at 6.5¾per annum and for an additional charge of 5%penalty levied upon both principal and interest due upon such installment or irstallments.The collection of such delinquent installments will be enforced in the manner peevided by law. This ordinance was considered by the City Council at Public Heæing,therefore,the pro-visions of Section 17,Ordinance No.474 are hereby waived and this .ordinance shall headoptedonthedateofthefirstintroductionandafter'its fit reading.
