710_00001.ORDINANCE NO.710 .AN ORDINANCE ESTABLISHING WEED CONTROL 2ONES:,ESTABLISHING · i REGUIATIONS FOR CONTROL WITHIN THE ZONES;AND DECLARING IT A PUBLIC NUISANCE TO ALLOW THE GROWTH OF WEEDS OR OTHER NATURALVEGETATION UPON PUBLIC OR PRIVATEPROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF MOSES LAKE,WASHINGTON, THE COUNCIL OP THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: SECTION.1.Por the purpose of establishing a method of weed control,the City of Moses Lake hereby creates control zones within the corporate limits: A.2one 1 -Central Business District: From the intersection of Alder Street and the Milwaukee Railroad Tracks northeasterly along the railroad tracks to their intersection with Balsam Street extended;thencesoutheasterlyonBalsamStreetextendedtoitsintersectionwithBroadway;thence northeast on Broadway to its intersection with Elder Street;thence southeast onElderStreettoitsintersectionwithFifthAvenue,thence southwest on Fifth Avenue to its intersection with Pioneer Way;thence southernly on Pioneer Way to its inter- section with Walnut Street;thence southwest on Walnut Street to its intersection with Chestnut Street;thence northwest on Chestnut Street to its intersection with Fifth Avenue;thence southwest on Fifth Avenue to its intersection with Balsam Street; thence northwest on Balsam Street to its intersection with Fourth Avenue;thence southwest on Pourth Avenue to its intersection with Dogwood Street;thence north- west on Dogwood Street to its intersection with Third Avenue;thence southwest onThirdAvenuetoitsintersectionwithHollyStreet;thence northwest on Holly Street to the point where Holly Street extended intersects with the Milwaukee Railroad Tracks;thence northeast along the railroad tracks to their intersection with Alder Street;thence southernly on Alder Street to the point of beginning. E.Zone IV 1 Industrial -Agriculture -Large Vacant Space All remaining areas within the corporate limits not hereinto defined. SECTION 2 .For the purpose of effectively contro111ng weeds and other natural vegetation with- in the defined zones,the following minimum requirements will be met: A.Real property owners within 2one 1 shall be required to eliminate unsightly weeds and other unsightly natural vegetation from their real property or real property under their control;adjacent right-of-ways between the.traveled portion of the right-of-way and property owned or controlled by them,and to eliminate weeds and other natural .vegetation which are a hazard to traffic vision,pedestrian traffic,which consti- tute a real or potential fire hazard,or which in any way are detrimental to the health, safety,or general welfare of the citizens of Moses Lake. B.Real property owners along 2one IA shall be aquired to eliminate unsightly weeds or other unsightly natural vegetation between the traveled portion of the stmet right-of-way and fifteen (15)feet back from the edge of the right-of-way. C.Real property owners within zone II shall be required to eliminate unsightly weeds and other unsightly natural vegetation from-their real property or real property under theircontrol;adjacent right-of-ways between the traveled portion of the right-of-way and Property owned oi•controlled by them,and to maintain their real property free of real orpotentialfirehazard,with clear traffie visibility,unîmpeded pedestrian traffic and any other hazards to the health,safety and general welfare of the citizens of Moses Lake. D.Owners of developed real property within 2one III shall be required to eliminate unsightly weeds or other unsightly natural vegetation from their reel property orpropertyundertheircontrol.Owners of undeveloped real property within 2one III .Shall be required to eliminate weeds and other natural vegetation on property that constitute a real or potential fire hazard within fifty (50)feet of developed property, impediments to pedestrian traffic and to eliminate hazards to traffic visibility. E.Owners of developed real property within 2one.IV shall be required to eliminateweedsandothernaturalvegetationthatconstitutesrealorpotentialfirehazards, or hazards to traffic visibility.Owners of undeveloped real property within Zone IV shall be required to eliminate weeds and other naturalvegetation;that consti- tutes a real or potential fire hazard within one hundred (100)feet of developed property,impediments to pedestrian traffic,and to eitminate hazards to traffic visi- bility. SECTION 3.Any person owning real property,whether occupied or controlled by him,who violates any provision of this Ordinance shall be guilty of committing a publio nuisance. SECTION 4 .Within ten (10)days after receiving a notice in writing by certified or registered mail,signed by the City Manager or his designated representative,the person(s)responsible for the accumulation of weeds or other natural vegetation in violation of the conditions set forth herein shall take the necessary steps for the abatement of said nuisance.If the notified person(s)shall fall,neglect,or refuse to remove a designated nuisance,such nuisance may be removed or abated by order of the City Manager or his designated representative .In addition to incurring the penalty provided for in this Ordinance,the person(s)on whom a notice is served shall become indebted to the City of Moses Lake for the damages,costs,and charges incurred by the City in the removal of such nuisances.Such costs shall he recovered.by civil action brought by the City against the person(s)so served. SECTION 5.In addition to the penalties herein prescribed,a violation of this Ordinance shall be a misdemeanor and,upon the first conviction,punishable by a fine of not more than one hundred ($100.00)dollars.For a second conviction,the violation may be punishable by a fine of not more than five hundred ($500.00)dollars or ninety (90)days imprisonment,or both such fine and imprisonment. Ordinance No.710 :5 SECTION 6.This ordinance shall take effect and shall be in force five (5)days after its passage, I approval and publication.
